CONTINUED BUSINESS:

Save Chuck. Interim City Manager Crecelius gave an update on Save Chuck. The County of Riverside through the CEO's office and various department heads are meeting with City staff on a quarterly basis to coordinate Save Chuck efforts. To date, 54 community support -34-
letters have been sent to our legislators.

No public comment. The item was received and filed.

NEW BUSINESS:

Flash Vote Survey Results. Interim City Manager Crecelius reported on the results of the Flash Vote Survey #2- Priorities. The survey was sent to 234 participants who have enrolled to receive the Flash Vote Surveys. The survey was released on June 20th and closed June 22nd.

Ninety-six people participated. When the local filter was applied, 68 participants lived within the 92225-zip code. The survey's purpose was to identify the community's priorities, identify street projects to design in the current fiscal year and identify problems the City should prioritize solving. 51% of respondents believe sense of community was a strength, followed by 27.9% stating local recreation options and 25% stating community events and entertainment are a strength of Blythe. Comments including our location, proximity to metro areas, a logistic hub, river, tourism, and college were also highlighted as strengths. 81.5% of voters feel the conditions of our streets and sidewalks is most important, followed by 69.2% wanting the community to be clean and have visual appeal and 66.2% felt physical safety and security was most important.

Respondents were asked to identify from a list which streets were most important in need of rehabilitation. 46.2% selected 1st street from Chanslorway to Hobsonway and Murphy Street from 3rd Street to Main Street. 41.5% votied for West Hobsonway from Florence Blvd. to city limits. There was a third-place tie at 33.8% between W. Chanslorway from Highway 95 to Olive Lake Blvd and those selecting other. The streets most selected in the other category were 7*h Street and Defrain starting from various locations up to the Golf Course. The Survey asked residents what problems) the City should prioritize solving and top responses were abandoned and rundown buildings, homelessness and poorly maintained streets and sidewalks. Based on the survey results, it is recommended Council prioritize the First and Murphy Street project and 7th Street project in the current fiscal year. Due to the size and cost of the W. Hobsonway Project, fund the design in the following fiscal year. This year we are also partnering with the County to pave 10th avenue and 6th avenue.

Councilman Reynolds asked if CalTans was ever contacted and discussed that W. Hobsonway is the old Highway 60. If there is an issue on the I10, that's the detour route. I believe CalTrans should provide some type of funding to help with the project.

No public comment. Councilman Burton moved approval of staff's recommendation. The motion was seconded by Councilman Reynolds with a unanimous aye vote.

Agreement with County of Riverside for Use of the Public Safety Communication (PSEC) System. Lieutenant Walnoha stated over the last year staff investigated ways to upgrade the current public safety radio system to provide safe and reliable communication to our public safety personnel. This includes providing communications to other law enforcement agencies in Riverside County. The PSEC system provides critical countywide communication among County public safety agencies. The goal of PSEC is to have interoperability among all City and County public safety groups to enable a coordinated response in the event of a multi-jurisdictional emergency or disaster. The Riverside County Sheriff's Department has utilized the PSEC System since 2014. Several other law enforcement agencies in the County have joined or are in the -35-
process of joining the PSEC System. Many fire departments are being added as well as Federal Law Enforcement. On February 16, 2023 the City Council held a Study Session on the PSEC System. On May 18, 2023 the City Council held a Budget Study Session in which support for joining the PSEC system was expressed. Funding for the proposed PSEC system was included in the FY 2023/24 Operating and Capital Budget which was approved on June 13, 2023. The proposed radio system will include Police, Fire and Code Enforcement. This proposal also includes a new repeater to operate the Fire Department's pager system. It is anticipated the installation, training and testing will take approximately three months once approval is obtained and the agreement has been executed.

No public comment. Councilman Burton moved approval of staff's recommendation. The motion was seconded by Councilman Reynolds with a unanimous aye vote.

ORAL REPORTS:

Councilman Reynolds reported on the Blythe Fire Department's 4"h of July Fireworks show. The kids had a great time. Hats off to the Department. There were some technical issues, but they did a great job.

Councilman Burton reported on the Little League Girls Senior Softball All Star Tournament that has been hosted in Blythe over the last five days.

Councilman Halby stated it's a State tournament so there are teams from all over Arizona here in Blythe.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: August 8, 2023
SUBJECT: Amendment to Professional Services Agreement with Tripepi, Smith & Associates, Inc.

PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council authorize the Interim City Manager to execute an Amendment to the Professional Servies Agreement between the City and Tripepi, Smith and Associates, Inc. for Communication and Marketing Services.

FISCAL IMPACT: $100,000 from funds budgeted in FY 2023/24 for this project. This amendment increases the total compensation for services from $125,000 to $225,000.

BACKGROUND: On December 6, 2022 the California Department of Corrections and Rehabilitation (CDCR) announced the planned closure of Chuckawalla Valley State Prison (CVSP) located in Blythe by March 2025. The City immediately sprang into action and opposed the closure. In January, the City engaged Tripepi, Smith and Associates to launch a Public Relations Campaign to bring awareness of the closure and the impacts it will have on the community. At the time, it was anticipated the City had through June 2023 to change the course and fate of CVSP, and the original term of the agreement was six months with a total compensation not to exceed $125,000.

STAFF REPORT: As the City continues to fight to Save Chuck, the services provided by Tripepi, Smith and Associates should continue through June 30, 2024. The City now believes the close down procedures for CVSP will be adopted by the legislature sometime during the State's next budget planning process, starting with the May revise. The City Will continue to work to Save Chuck until then, and will need PR expertise and services to continue the momentum of the Save Chuck campaign.

To date, Tripepi, Smith and Associates has created the "Save Chuck" campaign, including supported website, produced numerous community and informational videos about the importance of CVSP to our community, drafted Press Releases, OpEd's and a monthly newsletter, designed numerous advertisements placed in various Sacramento based news outlets, organized a Press Event and built a coalition of supporters who are working to Save Chuck. They also work closely with the City's Lobbyist, coordination efforts in the Capitol.

This Amendment will extend the term of the agreement through June 30, 2024 and authorizes the use of the additional funding necessary for the services being provided by Tripepi, Smith and Associates. As staff anticipated the need to continue these services through the initial contract term, funds were allocated in the current Operating and Capital Budget for both Marketing and Communication services as well as lobbying efforts.

As the initial term of the agreement for lobbying services was one year, an amendment to that -53-
agreement will not be necessary until January 2024.

City sil Blythe Marketing
Executive Summary
Thank you for the opportunity to continue working with the City of Blythe on its expanding outreach and communication efforts. It's been such a pleasure working with you and your council these past few months, and we'd love to continue our partnership! This proposal offers a modified version of our existing scope, with the breadth of Tripepi Smith's services remaining available as needed.

As you know, Tripepi Smith is a team of over 50 communication experts-robust enough to offer experienced and effective professionals for the job, yet small enough to be nimble and responsive. We offer a spectrum of skills that allow us to match the appropriate resource to the task at hand, letting us execute faster and reduce engagement costs. These resources vary by both years of experience and core hard skills (graphic design versus videography versus writing versus social media, for example). The result: we have an ability to tell a complete story across mediums, all within our one team. The City will only need one communication partner.

We look forward to the opportunity to help the City of Blythe for the benefit of its residents, businesses, partners and visitors.

Respectfully,
Ree to Sath

TRIPEPI SMITH

PROPOSED SCOPE OF WORK
Tripepi Smith can continue our engagement with a kickoff meeting to review our updated scope, define Key Performance Indicators (metrics, goals and timelines); review project management processes and tools; and ensure each team member has a full understanding of their responsibilities.

Tripepi Smith primarily uses the following tools to manage projects:

Google Workspace for email, creating real-time collaborative documents and instant messaging; • Dialpad and Zoom for conference calls;
• Hootsuite and Sprout Social for social media management; Meltwater for social media and media monitoring;
• Kantanta for project/task management, internal project status updates and time entry.

These project management tools enable project manager(s) to quickly determine a project's budget status, review the schedule of tasks and send rapid notifications to the whole team if issues arise.

Outside of regular check-in calls, the City may contact Jennifer Vaughn, account manager, with any questions, requests or issues. Jennifer will then swiftly relay instructions to the rest of the team. Should a serious issue arise that could impact a deliverable, she will arrange a meeting with all team members to discuss potential solutions. For example: if more resources are needed to execute on a deliverable or speed up a process, Tripepi Smith can immediately tap into its internal talent pool.

Principal Ryder Todd Smith will also be available 24-7 to address the City's needs.

Retainer Engagement
Bi-Weekly Check-In Calls & Content Planning
To coordinate our efforts with City Staff and sustain momentum on projects, Tripepi Smith will schedule a recurring, hour-long bi-weekly phone call that will include a City-designated lead for our engagement. These weekly calls will help drive content planning for various communication channels, including website content, press releases and social media posts and stories. Call content will focus on story plans, new issues or concerns that need to be communicated, identification of major themes or ideas to address in the coming weeks, review of recent media mentions and social media comments and sharing of communication opportunities. This will be a working call during which Tripepi Smith will manage an agenda and provide notes for each call. After each call, the client will receive an action summary email about decisions made on the phone call and related action steps. We will produce work, such as press releases and article drafts, in a shared workspace where the City can see our progress in real time and provide instant feedback as needed.

These tools allow for enhanced collaboration and expedite the production process.

Press Release Writing
Tripepi Smith can draft news articles, press releases and/or official statements, which are typically up to five hundred (500) words in length. The City would direct the allocation of stories with Tripepi Smith's suggestions, making internal subject matter experts available to aid the development of the stories when needed. Additionally, this assumes the City would provide a media and external agencies notification list for use by Tripepi Smith where a press release scenario is desired. The City would also facilitate timely approval 4 TRIPEPI SMITH
marketing • technology • public affairs

TRIPEPI SMITH
City of Blythe
of quotes in the release when connected with City Staff or City Councilmembers. This scope includes 1 press release per month.

Social Media Management
Content Creation: Social media content creation involves: planning, fact-checking, sourcing graphics, grammar checking and scheduling the post. Tripepi Smith will create up to three (3) posts per week and distribute them on up to five (5) platforms (e.g. Facebook, Instagram, Twitter, Linkedin, Nextdoor).

Monitoring: Tripepi Smith will monitor inboxes for questions and comments. When appropriate, responses will be drafted, which will occasionally require fact-checking and seeking out guidance from the City.

Additional: Our work also includes optimizing social media accounts to boost performance and keeping up to date on the latest social media platform updates and options. Boosted posts and targeted ads are also helpful in disseminating information to community members, and Tripepi Smith is fully capable of running and tracking these paid campaigns (fees to be agreed upon and paid by the City).

Website Content Management
Tripepi Smith can ensure your dedicated Save Chuck.org website is kept up to date with pertinent content such as press releases, FAQs and contact information. We can allocate two (2) hours per month providing these updates.

Monthly Digital Newsletter Production
We will utilize the existing email template in the City's Constant Contact to generate a monthly newsletter.

Email is another avenue for broadcasting the news article content that is created every month. Email remains an inexpensive, prevalent and a solid way to reach and engage residents.

We can use existing email lists from the City's utilities and/or Parks & Recreation databases. Tripepi Smith's scope includes designing the electronic newsletter, providing editorial calendar planning services, writing up to seven (7) articles in cooperation with City subject matter experts and deploying that content through the email. We suggest a format that links newsletter highlights back to articles on the Blythe website.

Media Intelligence Services
As media and technology constantly evolve, organizations are trying to find the latest and greatest ways of staying ahead of the news cycle.

Enter Meltwater, an enterprise-class media monitoring tool that uses complex search functions to scan news outlets and social media for mentions of your organization, delivering findings straight to your inbox. Our team of Meltwater experts turned all the tool has to offer into a set of media intelligence services designed to take your communication to the next level. Retainer Billing
Tripepi Smith will email an invoice to the designated email address(es) of the person overseeing our contract and will accept payment by check. Preference is for payment with net 30-day terms. The retainer invoice will be mailed on the 15'h of each month for that month's services.

Time & Materials (Ad Hoc) Work Pricing
Tripepi Smith is providing our hourly rates for the full array of our resources to support City communication efforts. Examples of these ad hoc projects include but are not limited to video production, photography services, virtual meetings/events, website development and a wide array of graphic design services. We propose time and materials rates here so we can be responsive to other needs that arise that are not best accounted for in a monthly retainer.

Cost Estimates for Ad Hoc Work
Activity Price Notes
Press Conference Execution $2,500 / Event Includes facilitation and promotion/invitation to media
Op Ed Article Writing $950 / Article 1,500-3,000 words, excludes distribution
Economic Development Video ~$13,020 / Video Video showcasing Blythe as a business development
opportunity
Ad Hoc Billing
Any requested ad hoc work will be invoiced at the end of the month in which the work was done. Terms are net 30 days.

Time & Materials Billing
For ad hoc work, time at Tripepi Smith is billed in 15-minute increments - i.e. we invoice our time in the following examples: 1.25, 0.75, 4.0 or 6.5 hours.

Annual Increase
Tripepi Smith will increase the hourly rates and retainer fees for all resources by five percent (5%) or the national BLS Consumer Price Index - whichever is higher — each year on the anniversary of the contract, starting on the first anniversary of any contract when the contract duration is longer than one year. Otherwise, new rates will be negotiated with each new contract renewal period.

Retainer Discount
When client monthly retainers exceed six-thousand-five-hundred dollars ($6,750) a month, they have access to our reduced Hourly - Retainer rates noted below. Otherwise, any ad hoc work done outside the scope of the Retainer would be at the Hourly - Standard rates.

Equipment Costs
Tripepi Smith offers some services that require equipment, such as drone operations and video production.

As such, in those cases, the following rates apply:

Half Day Full Day
Video Equipment $400 $600
Drone Equipment N/A $500
• Six hundred ($600) for a full day of video equipment use (includes full set of video equipment). Full day is defined as a shoot lasting four (4) or more hours. • Four hundred ($400) for a half day of video equipment use. Half day is defined as anything under four (4) hours of video production. All such expenses will be authorized by the City prior to fee being assessed.
• Five hundred dollars ($500) per day drone fee applies and is not inclusive of the drone operator time (Drone Operator rate).

If the City requires additional equipment outside of what Tripepi Smith owns, Tripepi Smith can provide a rental cost estimate for added equipment.

Service Fees
Client Pays Directly Client Reimburses TS
Print costs, digital advertising, media
placement, voiceover/captions No Fees 10%
Typically, Tripepi Smith prefers to have service providers bill the client directly to avoid additional administrative costs and because we have no economic interest in the service provider selection. If Tripepi Smith is asked to pay the bill for the client, we will apply a ten percent (10%) agency fee to the reimbursement expense. Typical services include, but are not limited to:

Print Costs: Tripepi Smith is happy to use a printer of the client's choosing for print production work, or to recommend a printer with whom we have experience.

Digital Advertising: Tripepi Smith is a Google Partner and Constant Contact Solution Provider and has Facebook Certified staff. We consider digital platforms to be a cornerstone element of any outreach strategy; often this comes with digital advertising fees.

Media Placement: Tripepi Smith can help liaise on behalf of the City for advertising space within various mediums, such as newspapers, magazines or websites.

Voiceover, Translation and Closed Caption Fees: Tripepi Smith occasionally uses third-party resources to record voiceovers for videos, generate closed captions for videos, and for non-English language translations. 10 TRIPEPI SMITH

The effects of the LSDD reduce a suspect's reactionary capabilities and allow for momentary disorientation which creates a tactical advantage. LSDD is a hand delivered device and generally deployed on the exterior of structures Provides a humane fright to aggressive dogs that pose a threat to deputies Explosive breaching tools are used to breach fortified structures to establish a point of entry. Explosive charges are fashioned to produce little to no fragmentation at the time of detonation. Explosive breaching effectively reduces the time spent overcoming a fortified door or structure. The reduction in time mitigating a hardened structure increases officer safety and the element of surprise. Blast injuries are reduced by using low yield explosives that mechanically overcome door frames and locking mechanisms. Explosive breaching mandates extensive schooling and certification processes
• Tear gas
• Chemical agents are deployed through various means to include hand delivery and weapon launchable, such as pepper ball. Munitions are either 37mm or 40mm caliber, shotgun ferret rounds or cannister shotgun launched ordinance. Hand delivered chemical agents are placed in metal burn boxes to reduce fire hazards Military Equipment Use

• Water cannon
• The BOMB-CAT bullet resistant rescue vehicle is provisioned with a front mounted water cannon. BOMB-CAT use is for tactical operations, explosive ordinance mitigation and fire suppression
• Long Range Acoustic Device (LRAD)
• LRAD is an acoustic hailing device used for emitting amplified public announcements during search warrant services, barricaded suspects, or tactical operations. The loud audible technology ensures broadcasted announcements are loud and clear while offering advantages over less amplified patrol car PA systems.

The LRAD can also be used for public announcements or safety advisements during natural disasters or evacuations
• The larger LRAD 1000 system is portable and can be used for criminal unrest and rioting to provide clear dispersal orders for unlawful assembly • Command and control vehicles built or modified to facilitate the operational control and direction of public safety units
• Command vehicles are built in various platforms to include ½ ton pickup chassis, vans, trailers, and RV style configurations. Vehicles are built to better assist in command and control during law enforcement operations, natural disasters, and public safety issues. Vehicles are designed with additional communication abilities, computers, white boards, lighting, generators, and mission essential supplies • 40mm projectile launchers
• Less lethal 40mm launchers and rubber projectile munitions are configured for high and low energy impact. Munitions have the additional benefit as a barrier round for breaking vehicle and residential glass so that chemical munitions can be deployed. 40mm less lethal has been effective in disarming violent suspects, armed suspects, and subjects who are suicidal with minimal injury and risk to the person, law enforcement or the public
• Bean bag launchers
• Less lethal bean bags are utilized through a marked/orange colored easily identifiable less lethal shotgun. The bean bag round is a small led pellet filled munition made of high-density cloth. The bean bag is the predecessor to 40mm less lethal having similar benefits as other less lethal platforms • Rubber projectile launchers
• Sting ball grenade launches .38 caliber rubber projectiles and are hand delivered.

Generalized use in a tactical operation is infrequent in use and deployment. Search warrants, violent combative subjects, or hostage rescue scenarios are criteria for consideration and use against suspects. Sting balls have a greater application in a Jail Corrections Environment.

STAFF REPORT

STABL TERED
MEETING DATE: August 8, 2023
SUBJECT: Save Chuck
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council receive and file a report on Save Chuck.

FISCAL IMPACT: Impacts to the City of Blythe from the closure of Chuckawalla Valley State Prison include a revenue decline of $2.9 million.

BACKGROUND: In December, the Secretary of the California Department of Corrections and Rehabilitation (CDCR) announced plans to close Chuckawalla Valley State Prison in Blythe by March 2025. The City quickly sprang into action to rally against this closure. The City began contacting State and Federal legislators and held meetings with elected officials, the CDCR Secretary, CVSP Close Down Manager and other CDCR staff members. The City submitted over 40 Public Records requests to the State seeking information related to how CVSP was selected for closure over other older and more costlier prisons in the State's system. Several of the City's requests for information were denied.

The City also went to work on solutions and proposed a swap of CVSP in Blythe for the California Rehabilitation Center (CRC) in Norco. Both City of Blythe and City of Norco officials are championing this proposal. This is a win-win for the Cities and State as a more cost- effective prison will be shuttered in a City that has far more resources to absorb job losses than Blythe. The City of Norco has petitioned for the closure of CRC for years. CRC has been on the State's chopping block since 2012. The State's own Legislative Analyst's report as well as other independent reports find that CRC should be the next CDCR institution to close due to a number of issues including cost to operate and safety.

In January, the City hired Tripeppi Smith for PR Services and the Gonsalves & Son Firm for lobbying efforts in the State Capitol. The City has garnered support from Assemblyman Garcia, Congressman Ruiz, State Senators Steve Padilla and Kelly Seyarto, The Riverside County Board of Supervisors, CVAG, fellow Cities in Riverside County, Riverside and Orange County Sheriff's, PVID, Cal Cities Riverside County Division Crime Victims United and others.

The Save Chuck (www.savechuck.org) website was launched. Many presentations have been made around the Community to detail the Coalition's efforts to Save Chuck.

STAFF REPORT: Staff would like an opportunity to update the community on efforts being made to "Save Chuck". For more information on how you can help Save Chuck, visit savechuck.org.

A BLUSHED
MEETING DATE: August 8, 2023
SUBJECT: Letter of Public Convenience and Necessity- Grocery Outlet Inc.

PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council approve the attached letter supporting the issuance of an Off-Sale (Type 20 - Supermarket) Alcoholic Beverage License within Census Tract No. 461.02 to Grocery Outlet Inc. for the proposed Grocery Outlet to be located at 691 W.

Hobsonway in Blythe, with the full knowledge of the undue concentration provision as outlined by the Alcoholic Beverage Control Board (ABC).

FISCAL IMPACT: Potential sales tax revenue to the City.

BACKGROUND: During the 1994 Legislative Session, the Department of Alcoholic Beverage Control made amendments and additions to certain provisions of the Business and Professions Code relating to alcoholic beverage licensing, to wit:
"Effective January 1, 1995, Section 23958.4 was added to the Business and Professions Code to define "undue concentration" of licenses and to establish the procedure for determining if public convenience and necessity will warrant the issuance of a license notwithstanding a determination that there is an undue concentration of licenses. The undue concentration criteria as outlined by said Code Section is based on the census tract within which the application for licensing exists.

With respect to all off-sale licenses, the determination of whether or not public convenience and necessity is met will be determined by the local governing body of the appropriate city or county.

In other words, if there is an undue concentration of licenses in the area of a proposed licensed premises and the local governing body determines that issuance of the license would meet public convenience and necessity standards, the Department of Alcoholic Beverage Control will be bound by that determination and the license could be issued, assuming other factors, such as the personal qualification of the applicant, citizen protests and other non-public convenience and necessity factors do not preclude the issuance of the license. On the other hand, if the local governing body determines that public convenience and necessity would not be served, that determination by itself would preclude the issuance of the license by the Department." STAFF REPORT: Regarding the proposed general off-sale Type 20 licensing by Grocery Outlet to be located at 691 W. Hobsonway, the Business and Professions Code requires a letter from the City Council specifically addressing the over concentration issue, and the justification for issuance of the license.

The proposed license site is located within Census Tract No. 461.02 which currently has Five (five) active off-sale licenses with one (1) license currently allowed in the census tract. The -105-
awarded licenses are issued to a wholesale beverage distributor, a pharmacy, two convenience stores and a grocery store.

Census Tract No. 461.02 encompasses a large geographical area that extends from Hobsonway to Chanslorway and from Defrain Boulevard to N. Broadway. The population within this census tract is 2,027. The entire fixed Blythe population and the transient population is not considered when factoring the allowed number of licenses.

The issuance of this license will provide another supermarket for residents of Blythe. This store will fill a void in this area of the City in need of full-service grocery providers. This store will eliminate the need for people to travel to the west and east ends of the City for groceries.

The availability of alcohol with the sale of groceries makes this store a one stop shop, where residents would otherwise be obligated to travel to other locations to purchase these items.

Therefore, the establishment of off-site alcohol at this location serves a public convenience. The grocery store and sale of off-site alcohol is consistent with the City's zoning ordinances and General Plan by providing a product that serves to provide the tull spectrum of commercial needs for a community retail center.

Dear Ms. Mata,
The City Council of the City of Blythe at their regular meeting on August 8, 2023 voted to approve submittal of this letter regarding the public convenience and necessity to be provided through the issuance of an off-sale alcoholic beverage sales license for Grocery Outlet Inc.

After careful consideration, the Blythe City Council has determined that the need for public convenience and necessity outweighs the undue concentration of existing licenses.

The Blythe City Council supports the issuance of a Type-20 License (Off-sale beer and wine) for Grocery Outlet Inc. located at 691 W. Hobsonway in Blythe, California.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: August 8, 2023
SUBJECT: Sage Lovekin Blythe, LLC Development
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: Provide direction to staff on steps staff may take to work with Sage Lovekin Blythe, LLC to facilitate the development of a Chipotle Restaurant to be located on the SE corner of the Lovekin and Hobsonway intersection.

FISCAL IMPACT: None.

BACKGROUND: The City has been working with applicants from Sage Lovekin Blythe, LLC to develop a new Chipotle Mexican Grill Restaurant with drive-thru in the downtown area of the City of Blythe. The site is a 49 acre parcel that is presently vacant.

In January, the City Council approved a Categorical Exemption for the project which satistied CEQA requirements. On July 5, 2023, staff informed the developer that the City had completed plan check review and once a contractor was selected, building permits could be issued. This was an exciting step in this project, as construction can theoretically begin once a contractor has been selected by the Developer.

In early August staff learned from a representative of Sage Lovekin Blythe, LLC that the bid package for the construction of the Chipotle Restaurant has been submitted to 5 construction firms.

However, bids returned much higher than anticipated or budgeted. As the project is over budget, the developer cannot obtain financing to begin construction.

STAFF REPORT: As this development, and all developments, are of the utmost importance to the City, staff would like to work with the developer to find any feasible way(s) to help bridge the financing gap to hopefully move this project forward
During the meeting, staff will provide options for the Council's consideration which could reduce fees and development costs for this project. This could include a reduction or waiver of permit and Art in Public Places fees. Staff is also reviewing all project conditions to determine if there are any changes that could be made to reduce development costs. Staff is workign with the City Engineer on project recommendations that will aid the development without placing an undue burden on the City or surrounding properties.

Although staff believes the City may be able to provide some cost reductions, it should be noted that -134-
reducing development costs and fees alone will not get Sage Lovekin Inc. where it needs to be in aes of that budget and proposed construch as costs ing for funding trassuested that they also look at other funding options, such as applying
Improvement Fund.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: August 8, 2023
SUBJECT: Funding Agreement between City and Chamber of Commerce for Tourism Activities
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council authorize the Interim City Manager to negotiate and execute an agreement (Agreement No. 2023-045) between the City and Blythe Chamber of Commerce to memorialize the terms relating to the Chamber's use of City funding for tourism activities once the agreement has been reviewed and approved by the City Attorney.

FISCAL IMPACT: The Council allocated $30,000 per year in funding received through the American Rescue Plan Act (ARPA) to assist the Chamber with tourism-related activities for the 2022/23, 2023/24 and 2024/25 fiscal years. In June, the Council adopted the Operating and Capital Budget for the current fiscal year, which included the second funding installment of $30,000 for tourism activities.

BACKGROUND: The ARPA funding was allocated to support the Chamber in their efforts to enhance tourism in the City. The funds were to be used for tourism-related activities, excluding payroll expenses. The Chamber was asked to provide quarterly reports to the City on tourism activities performed during the prior quarter. The City received one report for the 2022/23 Fiscal Year which detailed activities occurring in Quarters 1-3. The report indicates the City's funding was used for a part-time tourism coordinator along with funding a website, tourism brochures, ads in the Palo Verde Valley Times, the River Float, Welcome Wagon and other miscellaneous expenses related to advertising. It was anticipated that in the fourth quarter the Chamber would fund the production of a YouTube commercial.

STAFF REPORT: To memorialize the terms relating to the use of City funding for the Chamber's tourism activities, it is recommended Council direct the Interim City Manager to negotiate and execute a funding agreement once it has been reviewed and approved by the City Attorney. Relevant terms of the agreement, based on prior discussions between the City and Chamber, will include:
• The funding is to be used for tourism-related activities only and will not be used for personnel and/or payroll expenses.
• Submission of quarterly reports.
• Future installments will be paid on a quarterly basis, once the City has received the quarterly report from the previous quarter.
• The agreement will end on June 30, 2025, when the ARPA funding allocated for this project has been exhausted.
