Ordinance No. 923-23 Amending Chapter 17.26 (Signs) of Title 17 (Zoning) of the Blythe Municipal Code. Interim City Manager Crecelius stated all proposed changes have been made to the Sign Ordinance. As such, we recommend continuing the Public Hearing for the introduction of the Sign Ordinance to the next City Council meeting to allow time for this review.
No public comment. Councilman Reynolds moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.
CONTINUED BUSINESS:
Save Chuck. Interim City Manager Crecelius gave an update on Save Chuck.
No public comment. The item was received and filed.
NEW BUSINESS:
Acceptance of the Palo Verde Valley Community Improvement Fund Grant Award.
Chief Dale stated the Blythe Police Department Quality of Life Program addresses both the homeless and traffic related issues which directly affect our community. Staff has been searching for funding to continue this program at the same successful level as it was last year. An application was made to and approved by the Palo Verde Community Improvement Fund. -39-
Funding in the amount of $35,000 was awarded. This will continue the program at the same level as last year when we had overtime officers contacting the homeless and working traffic. This is a good opportunity and we are very thankful to the CIF Board for approving this and helping out our community.
Public Comment. George Colangeli of Peace From Chaos commended the Chief for obtaining funding for this program. We need to work as a community to see how we can continue this funding.
Councilman Halby thanked the Community Improvement fund for awarding this grant.
Councilman Reynolds moved to accept $35,000 in grant funding from the CIF for the Quality- of-Life Program. The motion was seconded by Councilman Burton with unanimous aye vote.
Letter of Public Convenience and Necessity- Grocery Outlet Inc. Vice Mayor Rodriguez recused himself for a potential conflict of interest. Interim City Manager Crecelius stated Grocery Outlet, Inc. proposes to develop a supermarket at 691 W. Hobsonway, in the All- Star Cinemas Shopping Center. To support the operation of the supermarket, they have applied for a Type 20-Supermarket Alcoholic Beverage License within Census Tract No. 461.02. There are currently five active off-sale licenses with one license currently allowed in this Census Tract.
The licenses are issued to a wholesale beverage distributor, a pharmacy, two convenience stores and a grocery store. Census Tract 461.02 encompasses a large geographical area that extends from Hobsonway to Chanslorway and from Defrain to N. Broadway. The population within this census tract is 2,027. The entire fixed population of Blythe and the transient population is not considered when factoring the allowed number of licenses. The issuance of this license will provide another supermarket for residents of Blythe. This store will fill a void in an area of the City in need of full-service grocery providers. This store will eliminate the need for people to travel to the west and east ends of the City for groceries. The availability of alcohol with the sale of groceries makes this store a one stop shop, where residents would otherwise be obligated to travel to other locations to purchase these items. Therefore, the establishment of off-site alcohol at this location serves a public convenience. The grocery store and sale of off-site alcohol is consistent with the City's zoning ordinances and General Plan by providing a product that serves to provide the full spectrum of commercial needs for a community retail center. Therefore, it is recommended that Council approve the draft letter supporting the issuance of an Off-Sale (Type 20 - Supermarket) Alcoholic Beverage License within Census Tract No. 461.02 to Grocery Jutlet Inc. for the proposed Grocery Outlet to be located at 691 W. Hobsonway in Blythe, with the full knowledge of the undue concentration provision as outlined by the Alcoholic Beverage Control Board.
No public comment. Councilman Reynolds moved approval of staff's recommendation. The motion was seconded by Councilman Halby with a unanimous aye vote. Vice Mayor Rodriguez rejoined the meeting.
Memorandum of Understanding between City and Palo Verde Unified School District for the 2023/24 School Year and 2024 Summer School Programs. Interim City Manager Crecelius stated the Palo Verde Unified School District is required by AB 130 to -40-
provide an expanded learning opportunities program for children in TK through sixth grades.
This summer, the City partnered with the School District to provide this expanded learning program at the Joe Wine Blythe Recreation Center. Any student enrolled in Summer school was eligible to enroll in the summer program. After summer school, the School District would bus participants to the Recreation Center where they would engage in activities until 5pm. Ninety students enrolled in the Summer Program and the Recreation Center had an average daily participation of 50 students. As the summer program was successful, the School District would like to continue this program into the 2023/24 school year. The District wishes to provide access for up to 300 students. The School district will reimburse the City $800 per day, $4,000 per week for this program. This will allow the Recreation Center to hire additional personnel necessary to meet the ratios required of the Extended Learning Program. The School will once again bus participants from the school sites to the Center after school. At 5pm each day, the District will provide transportation back to the school sites. It is recommended Council authorize the Interim City Manager to execute an agreement with PVUSD authorizing the City to collaborate with the District to provide expanded learning opportunities to student participants at the Joe Wine Blythe Recreation Center as part of PVUSD's 2023-2024 School Year and 2024 Summer Program. It is further recommended Council increase the number of budgeted part-time Recreation Center Aide positions in the FY 2023/24 Operating and Capital Budget from 7 to 15 to accommodate the staffing needs of this program. The School Board adopted the MOU for this program at their regular meeting on August 1, 2023.
No public comment. Councilman Burton moved approval of staff's recommendation. The motion was seconded by Councilman Reynolds with a unanimous aye vote.
Sage Lovekin Blythe, LLC Development. Interim City Manager Crecelius stated staff has been working with Sage Investco, LLC to develop a Chipotle Mexican Grill Restaurant on the SE corner of Lovekin and Hobsonway. In January, Council adopted a Categorical Exemption for the project, satisfying State CEQA requirements. On July 5, 2023 staff notified the applicant that the City had completed plan check review, and once a contractor was selected, building plans would be issued. This was an exciting step, as the developer can essentially break ground on the development. In early August, staff learned bids to construct Chipotle had returned much higher than the developer had anticipated or budgeted. They budgeted $1.2 million for construction and bids received came in at $1.9 million. As the project is over budget, the developer cannot obtain financing to begin construction. This project is very important to the City, and we would very much like it to be constructed. Staff has been in communication with the developer on how we can work to advance this project. As The City placed minimal conditions on this project, removing project conditions will not bridge the estimated $700,000 funding gap. Some items that could be considered to bring costs down include removal of the condition to repave the alley along the south property frontage (EE $25,000), remove the condition of placing a bus stop on W. Hobsonway ($18,000) and remove the requirement to pay the Art in Public Places fee of just under $25,000. It does not get the developer to where he needs to be, but shows a good faith effort by the city to advance this project. City Staff believes the construction bids received are inflated and have been speaking with local contractors to see if there are other options for Sage Investco to develop the site within their budget. We have also suggested that representatives of Sage Investco look for other funding sources, such as applying for funding from the Community Improvement Fund. Therefore, it is recommended Council -41-
provide direction to staff on steps staff make take to work with Sage Investco, LLC to facilitate the development of a Chipotle Restaurant on the SE corner of Lovekin and Hobsonway.
Councilman Reynolds asked to hear from the Transit Agency related to removing the bus stop.
Public Comment. George Colangeli of the Palo Verde Valley Transit Agency stated I think we could swing it. We currently have a stop there, but it's going to be a heavy trafficked stop. The demographic will be bus riders, especially from the College. The contractors on this project are looking to cut every corner. We need to work with local contractors to see what's available to them before we start cutting things.
Councilman Reynolds moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.
Funding Agreement between City and Chamber of Commerce for Tourism Activities. Interim City Manager Crecelius stated the City council allocated $30,000 per year for the 2023, 2024 and 2025 fiscal years from the City's American Rescue Plan Act funding to assist the Chamber with tourism related activities. To memorialize the terms relating to the use of City funding for the Chamber's tourism activities, it is recommended Council direct the Interim City Manager to negotiate and execute a funding agreement once it has been reviewed and approved by the City Attorney. Relevant terms of the agreement, based on prior discussions with the City and Chamber include funding to be used for tourism related actives only, submission of quarterly reports, future installments to be paid on a quarterly basis, once the City has received the quarterly report from the previous quarter. The agreement will end on June 30, 2025, when the APRA funding allocated for this project has been exhausted.
No public comment. Councilman Reynolds moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.

Minutes of the Blythe City Council Special Meeting
and Special Closed Session
August 28, 2023
The August 28, 2023 Special Meeting and Special Closed Session of the Blythe City Council ras called to order at 4:30pm in the Council Chambers by Mayor DeConinck. Also in attendanc vere Vice Mayor Rodriguez and Council Members Reynolds and Halby. Councilman Burto:

The Pledge of Allegiance was led by Mayor DeConinck.
SPECIAL MEETING ITEMS:
1. Posting of the Agenda.
The summary of agenda items were posted on the bulletin boards on the outside of the public entrance to the Council Chamber and near the inside entrance of the Council Chamber on Friday, August 25, 2023.
No public comment. Councilman Reynolds moved approval of the posting of the Agenda. The motion was seconded by Vice Mayor Rodriguez with a unanimous aye vote.
2. Extension of the Service Fee Collected on behalf of the Riverside County Abandoned Vehicle Abatement Service Authority. Police Chief Dale stated in 1990, the California State Legislature enacted legislation allowing for the creation of a County based Vehicle Service Authority to fund abandoned vehicle abatement. Every ten years the City is required to adopt a Resolution authorizing the State to take $1 out of every registration fee collected in the City of Blythe and distribute it to the County which in turn distributes it to the City to fund an AVA program. The reason for the Special Meeting is that the State changed our deadline. Previously we had to renew 5 months prior to the deadline, now the state wants 8 months for review. The County is putting this item on their Board Agenda on September 12th ", which is the same date as our next Regular Meeting. Due to this, we were unable to meet the County's deadline without calling a Special Meeting. We are asking you to Adopt Resolution No. 2023-021 authorizing the extension of the service fee collected on behalf of the Riverside Count bandoned Vehicle Abatement Service Authority until May 2034 No public comment. Councilman Reynolds moved to adopt Resolution No. 2023-021.
The motion was seconded by Vice Mayor Rodriguez with a unanimous aye vote.

Blythe CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: September 12, 2023
SUBJECT: Letters of Support for Community Grant Programs PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: Receive and File.
FISCAL IMPACT: None.
BACKGROUND: The Palo Verde Valley Transit Agency and Blythe Chamber of Commerce requested letters of support for two different grant opportunities that would benefit the Blythe community.
The Palo Verde Valley Transit Agency (PVVTA) submitted a proposal to the Clean California Transit Partnership Project from the California Department of Transportation. The proposal, if awarded, would allow PVVTA to beautify and modernize an area of the City which includes the Main Street Park N Ride with art inspired waste containers, enclosed bicycle storage rack shelter, ADA hydration stations, bicycle art installation, a mural and solar powered EV Charging station with two charging stands.
The Chamber of Commerce asked the City to support the Center for Employment Training (CET) in their request for funding from the Recompete Pilot Program for funding in Phase I and II. If awarded, CET would place a satellite location in Blythe to offer community training in sustainable programs such as HVAC, Culinary Arts, Pluming and other possible subjects. CET's project will support long term comprehensive economic development by providing access to job training, community development resources and established sustainable job creation.
STAFF REPORT: Attached to the staff report are the support letters issued on behalf of the City of Blythe for each program.

RE: Letter of Support for the Palo Verde Valley Transit Agency (PVVTA) Towards the California Department of Transportation (CALSTA) Clean California District Transit Partnership Program To Whom It May Concern:
I am writing in support of the Palo Verde Valley Transit Agency's (PVVTA) proposal to the Clean California transit partnership project from the California Department of Transportation (CALSTA). This proposal would allow the PVVTA to beautify and modernize an area of the City including the Main Street Park N Ride, the Todd Park Corridor and allow for culturally artistic expression. These key project outcomes would encourage the community to become more active through frequent visits to the newly improved areas and increase ridership due to new culturally competent improved passenger amenities that aim to make public transit more enjoyable.
The proposal to the Clean California Transit Partnership project would fund the purchase and installation activities at the Main Street Park N Ride including art inspired waste containers, an enclosed bicycle storage rack shelter adorned by local art, publicly ADA accessible hydration stations, a Bicycle art installation, placement of a culturally inspired large art panel mural and a Solar-powered off-grid EV charging station with two charging stands.
These grant funds will help to further address PVVTA's active transportation goals. If awarded, the project will address many of the needs and concerns of the greater community. We believe the multi-benefits of this project would enhance the quality of life for residents, better serve community needs, and address broader sustainability and cultural competency issues, including increased transportation amenities, litter abatement, improved public confidence, reduced greenhouse gas emissions, and encourage transit riders to use bicycling for wellness.
On behalf of the Blythe City Council, I respectfully request for your consideration of the Palo Verde Valley Transit Agency's proposal to the Clean California transit partnership project from CaSTA.
Should you have any questions, please feel free to contact me at (760) 922-6161.

Re: Letter of Support Political Subdivision of a State in Local Service Area To the Economic Development Administration:
The purpose of this letter is to formally express our support for the Center for Employment Training for the Recompete Pilot Program project phase I and II funding to identify, research, and implement innovative and strategic approaches to provide economic advancements through cultivating career pipelines to Prime Age Employment Gap (PAEG) populations within the City of Blythe, California.
The City of Blythe fully supports CET's proposal for funding to provide strategic and innovative approaches to provide upward economic mobility to PAEG populations within historically economically distressed areas within our communities. CETs proposed project will support long- term comprehensive economic development by providing access to job training, community development resources, and establishing sustainable job creation. By identifying pocket community needs, the CETs project will provide individualized community support and career pathway approaches, supporting regional economic gains.
CET has been a mutual long-term partner and supportive resource for our communities, strengthening our local economy and reducing poverty by providing quality, high-demand occupational training. We know CET will offer quality training and economic support through new innovative approaches and partnerships with tribal, military, and re-entry communities serving the PAEG-targeted populations. We fully support CETs' request for funding through EDAs Recompete Pilot Program Phase I and II to support our local area's economic development.
Sincerely,
Joseph Lace

«Blyther CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: September 12, 2023
SUBJECT: Amendment Number One to Peacemaker Lease Agreement between The City of Blythe and Syneco Systems, Inc.
PRESENTED BY: Kenneth McLaughlin, Public Works Director PREPARED BY: Kenneth McLaughlin, Public Works Director
RECOMMENDATION: Council authorize the Interim City Manager to execute Agreement No. 2023-047A between the City and Syneco Systems, Inc. for Peacemaker® Odor Scrubbers for Sewer Lift Stations: #3, #5, #11, #13 and #14 in an amount not to exceed $249,530.74.
FISCAL IMPACT: $249,530.74 from the Sewer Utility Fund. Funds for this project were included in the adopted FY 2023/24 budget.
BACKGROUND: Council first entered into a lease agreement with Syneco Systems, Inc. in May 2008. The last lease extension was approved in October 2020. Since 2008, Syneco has provided a filtration system that uses media and positive flow fans to capture gasses emitted from the sewer lift stations.
In 2014, staff released a Request for Proposals for Lift Station Odor Control in which Syneco Systems, Inc. was the sole bidder. In 2019, the City entered a pilot program with ATS Innova for wastewater bioaugmentation to further reduce smells emitted from the City's sewer lift stations.
The trial program concluded and was found to be ineffective in reducing solid build up in the sewer system.
In 2014, the City performed system upgrades which increased the mitigation of sewer gasses in comparison to previous years.
STAFF REPORT: The sewer lift stations included in the odor scrubber program include: #3 (Del Taco), #5 (Public Works Yard), #11 (Intake - South ofI 10), #13 (Sparkling Lagoon), and #14 (Defrain).
Terms of the attached lease include the equipment and media filters replaced as necessary to control sewer gas emissions over the term of the lease, which is three years.
Bidding is not required in connection with this lease pursuant to Blythe Municipal Code section
2.65.100(A)(2), which exempts from bidding contracts in which a commodity or service is offered by only one vendor, or when only one vendor is able to supply a commodity within the time frame or under terms and conditions which reasonably meet the needs of the City (known as sole source). Syneco Systems meets this exception as they are the only vendor that can provide the equipment.
-64-
As Syneco Systems' odor filtration system continues to be the most effective process in reducing odors escaping the City's sewer lift stations, it is recommended the City Council authorize a three-year lease agreement with Syneco Systems in substantially the form as attached and in such final form as approved by the City Attorney.

Blythe" CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: September 12, 2023
SUBJECT: Purchase of Sewer Lift Pumps for Sewer Lift #14 PRESENTED BY: Kenneth McLaughlin
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council authorize the Interim City Manager to issue a Purchase Order in an amount not to exceed $61,279.25 to Rockwell Solutions, LLC for two 10 HP Pumps and an electrical for Sewer Lift #14.
FISCAL IMPACT: $61,279.25 from the Sewer Enterprise Fund.
BACKGROUND: The week of April 10, 2023 there was a catastrophic pump failure at Sewer Lift #14 located at corner of 6 Avenue and Defrain Blvd. Public Works crews were able to install a rented temporary pump to maintain the flow of the sewer system until new pumps could be ordered, purchased and installed. It was determined it was more cost effective to purchase new pumps for the lift than to rebuild the existing 10 HP pumps.
STAFF REPORT: Rockwell Solution, Inc. has supplied Sewer Pumps to the City for years.
City Staff reached out to Rockwell Solutions Inc. to purchase two new pumps for Sewer Lift #14. Installing two pumps will create redundancy should there be a future failure at the Lift Station. It is therefore recommended Council authorize the Interim City Manager to issue a Purchase Order to Rockwell Solutions, Inc. for the purchase of the two 10 HP Pumps and an electrical panel for Sewer Lift #14.

"Blythe CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: September 12, 2023
SUBJECT: Save Chuck
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council receive and file a report on Save Chuck.
FISCAL IMPACT: Impacts to the City of Blythe from the closure of Chuckawalla Valley State Prison include a revenue decline of $2.9 million.
BACKGROUND: In December, the Secretary of the California Department of Corrections and Rehabilitation (CDCR) announced plans to close Chuckawalla Valley State Prison in Blythe by March 2025. The City quickly sprang into action to rally against this closure. The City began contacting State and Federal legislators and held meetings with elected officials, the CDCR Secretary, CVSP Close Down Manager and other CDCR staff members. The City submitted over 40 Public Records requests to the State seeking information related to how CVSP was selected for closure over other older and more costlier prisons in the State's system. Several of the City's requests for information were denied.
The City also went to work on solutions and proposed a swap of CVSP in Blythe for the California Rehabilitation Center (CRC) in Norco. Both City of Blythe and City of Norco officials are championing this proposal. This is a win-win for the Cities and State as a more cost- effective prison will be shuttered in a City that has far more resources to absorb job losses than Blythe. The City of Norco has petitioned for the closure of CRC for years. CRC has been on the State's chopping block since 2012. The State's own Legislative Analyst's report as well as other independent reports find that CRC should be the next CDCR institution to close due to a number of issues including cost to operate and safety.
In January, the City hired Tripeppi Smith for PR Services and the Gonsalves & Son Firm for lobbying efforts in the State Capitol. The City has garnered support from Assemblyman Garcia, Congressman Ruiz, State Senators Steve Padilla and Kelly Seyarto, The Riverside County Board of Supervisors, CVAG, fellow Cities in Riverside County, Riverside and Orange County Sheriff's, PVID, Cal Cities Riverside County Division Crime Victims United and others.
The Save Chuck (www.savechuck.org) website was launched. Many presentations have been made around the Community to detail the Coalition's efforts to Save Chuck.
STAFF REPORT: Staff would like an opportunity to update the community on efforts being made to "Save Chuck". For more information on how you can help Save Chuck, visit savechuck.org.
