PUBLIC HEARING:
Ordinance No. 923-23 Amending Chapter 17.26 (Signs) of Title 17 (Zoning) of the Blythe Municipal Code. Interim City Manager Crecelius stated at the last meeting, staff asked Council to continue the Public Hearing for this item as the City Attorney's office was reviewing and making modifications to the Ordinance to address First Amendment issues. After speaking with that attorney, a simple change to the Ordinance to make it more business friendly has turned into a total re-write. As the current ordinance is over twenty years old, there have been significant changes in the law. He is finishing up those changes, so I am once again asking you to continue this Public Hearing to the October meeting.
No public comment. Councilman Reynolds moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.
CONTINUED BUSINESS:
Save Chuck. Interim City Manager Crecelius gave an update on Save Chuck. -33-
No public comment. The item was received and filed.
NEW BUSINESS:
Issuance of Commercial Cannabis Business Cultivation and Distribution Permits to Edelweiss Enterprises, LLC. Interim City Manager Crecelius stated Edelweiss Enterprises, LLC submitted applications for Commercial Cannabis permits for a Cultivation and Distribution operation to be located in the former Kmart Building at 1455 W. Hobsonway. The applicants have successfully completed Phases 1-3 of the Commercial Cannabis Licensing process including an interview with City staff. Edelweiss Principles Patrick Kelly, James Shatter,
and nothing was found to preclude them from being issued commercial cannabis permits. Staff recommends Council issue Commercial Cannabis Cultivation and Distribution permits to Edelweiss Enterprises, LLC for a commercial Cannabis Facility to be located at 1455 W.
Hobsonway. If approved, the Cannabis permits will be issued once a Certificate of Occupancy is issued by the Building Department and Business License fees are paid.
The Council asked applicant Patrick Kelly questions about site development and timing.
Councilman Reynolds moved approval of staff's recommendation. The motion was seconded by Vice Mayor Rodriguez with a unanimous aye vote.
Animal Shelter Committee Appointment. Interim City Manager Crecelius stated in January Mayor Deconinck appointed members of the Council to serve on the City's various boards, standing and Ad Hoc Committees. Staff inadvertently left the Animal Shelter Committee off the list of committees to be assigned. It is recommended the Mayor appoint two members of Council to serve on this committee.
Mayor DeConinck appointed Councilmembers Reynolds and Burton to the Animal Shelter Committee.
Engevik Park Playground Shade Structure Project. Interim City Manager Crecelius stated last fiscal year Council allocated $120,000 in Park Bond Funding to improve the complete the playground improvement project. On July 19th the City released an Invitation for Proposal for the Engevik Park Playground Shade Structure Project. The bid was directly sent to several playground installers, posted on the City's website, in the Palo Verde Times, sent to seven plan rooms and several minority news outlets in accordance with both the City's Purchasing Policy and CDBG noticing requirements. The City conducted the bid opening on August 15"h with one bid received from Ortco, Inc. Ortco's construction license is current and in good standing with the State of California. Ortco Inc. has previously performed work for the City of Blythe, as the successful bidder for the Miller Park Improvement Project in 2019 and most recently completed the Engevik Park Playground Improvement project. There is a 6-8-week lead time on the shade structure. Staff anticipates this project will be completed by the end of the calendar year. Therefore it is recommended Council Authorize the Interim City Manager to -34-
execute Agreement No. 2023-049 A with Ortco, Inc. contingent upon all bonds and proper contract documents being fully executed to the satisfaction of the City Attorney and Interim City Manager, issue a purchase order to Ortco, Inc. in an amount not to exceed $42,625.00, including $3,875 in contingencies, authorize the Interim City Manager to approve change orders during construction not exceeding the contingency allowance and establish a project budget not to exceed $42,625.00.
No public comment. Councilman Reynolds moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.
ORAL REPORTS:
Chief Dale reported on the Quality-of-Life Operation conducted last Thursday and the Summer Boating Patrol program which were both very successtul.
PUBLIC COMMENT:
Students Esai Sanchez, Dominic Rogers, Alyiah Lianez, George Sanchez, and Rudy Guilin from the Escuela De La Raza Unida's Outreach Program provided information on community handouts. The handouts contain information about the heat and water conservation.
Luther Holley of 955 Lido Ln. asked for tennis and pickle ball courts. I don't believe in bad cops, we all make mistakes, but I believe in bad supervision. Too often things are swept under the carpet. The complaint I filed was determined to be un-sustained. Is the body cam not evidence? Chris Peters of 371 Tesoro Ln. made complaints about the Flag Football season. We have 4 weeks for practice and end a month before All-stars. We don't need that much time for All-Stars.
Shortening the program is defeating the purpose of teaching these kids. We have always played on Saturdays and now the games are during the week.
Carmela Garnica of 409 Earle Street wanted to inform the Chief that there was a case involving raising kids in Blythe. They were using stats about the crime in Blythe, and I was very curious about it so I called the Police Department. The Officer stated the way they tackle things in Blythe is that the Police Department, Sheriff, Boarder Patrol, CHP all come together when there is a crisis. As a community member here with a large family I was very pleased to hear that response. It made me feel safe.
ADJOURN: The City Council meeting was adjourned at 6:47pm.
Joseph DeConinck, Mayor

Blythe CITY COUNCIL MEETING
STABLISHE STAFF REPORT
MEETING DATE: October 10, 2023
SUBJECT: Acceptance of the California Division of Boating and Waterways Boating and Enforcement Grant
PRESENTED BY: Garth V. Dale, Chief of Police
PREPARED BY: Garth V. Dale, Chief of Police
RECOMMENDATION: Staff recommends the City Council accept a grant from the California Division of Boating and Waterways Boating and Enforcement and authorize the Interim City Manager to expend funds in the amount of $40,058.00.
FISCAL IMPACT: $40,058.00 in grant funds to purchase equipment for the Blythe Police Department's Marine Enforcement Division.
BACKGROUND: The Blythe Police Department Marine Division provides law enforcement and safety services for several miles along the Colorado River. Due to limited funding, the City's patrol boat does not have the proper emergency lighting equipment, safety gear or a sonar system. Additionally, the current Unmanned Aircraft Systems (UAS) aircraft are limited in time and distance and not suited for long search and rescue operations along the river. Blythe Police Department Administration has been searching for funding to improve the current boat and add long range UAS aircraft to the current fleet.
STAFF REPORT: Staff applied for and received a grant from the California Division of Boating and Waterways Boating and Enforcement in the amount of $40,058.00. The grant will fund the following upgrades to the patrol boat and purchase a search and rescue unmanned aircraft as follows:
Code 3 Emergency Signaling Equipment Package: $14,529
Drone $20,529
Sonar System $5,000
Due to an increase in proactive activity by our Marine Enforcement Division, Blythe Police Department Administration believes the City could qualify for additional funding from this state program in the future. Staff requests the Council accept the grant award and authorize the Interim City Manager to expend the funds in an amount not to exceed $40,058.00.

RECOMMENDATION: Adopt Resolution 2023-022 authorizing the destruction of certain financial records and documents for fiscal year 2017-2018.
RESOLUTION NO. 2023-022. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BLYTHE,
CALIFORNIA, AUTHORIZING THE DESTRUCTION OF CERTAIN RECORDS AND DOCUMENTS AS
AUTHORIZED BY THE CALIFORNIA GOVERNMENT CODE
FISCAL IMPACT: None
STAFF REPORT: Official documentation of the City's appropriations, revenues and expenditures for each fiscal year is in the City's annual audited financial statements. Copies of the annual audited financial statements are retained in the City's central files at City Hall.
The detailed reports generated by computerized accounting and utility billing systems are voluminous and require an extraordinary amount of storage space. Rarely is it necessary to access revenue, expenditure and billing data beyond the year immediately prior to the year last audited. However, once the fiscal year audit is completed, records of this nature must, by law be retained for at least five years. The information generated in these reports is strictly departmental in nature and in the interest of efficiency in records management; these records that have been retained for the period required by law are now scheduled to be destroyed Financial records and documents for Fiscal Year 2017-2018 have been retained for the minimum required period of five (5) years pursuant to Government Code Section 34090. The City Attorney's consent has also been obtained as required by the referenced Code Section.

MEETING DATE: October 10, 2023
SUBJECT: Tentative Parcel Map 38780
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended the City Council, subsequent to the public hearing thereon, adopt Resolution No. 2023-025 approving the Notice of Exemption with De Minimis Impact Findings for Tentative Parcel Map 38780 and Resolution No. 2023-026 approving Tentative Parcel Map 38780 with conditions.
RESOLUTION NO. 2023-025. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BLYTHE CONTAINING
FINDINGS IN SUPPORT OF APPROVAL OF A NOTICE OF EXEMPTION WITH DE MINIMIS IMPACT FINDING FOR TENTATIVE PARCEL MAP 38780.
RESOLUTION NO. 2023-026. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BLYTHE CONTAINING FINDINGS AND CONDITIONS IN SUPPORT OF APPROVING TENTATIVE PARCEL MAP 38780 TO ALLOW THE DIVISION OF ONE (1) 22.94+ (GROSS) ACRE PARCEL INTO FOUR (4) SEPARATE PARCELS, A REMAINDER
PARCEL AND LOT A ON PROPERTY LOCATED AT THE N/E CORNER OF WEST WELLS ROAD AND QUAIL RUN ROAD (ASSESSOR'S PARCEL NUMBERS 821-170-054, 821-170-055 AND 871-170-171.
FISCAL IMPACT: None.
BACKGROUND: The current parcel consists of three APNs but is considered one legal parcel
22.94 acres in size comprised of vacant land. The proposed subdivision of the subject property would allow the applicant to divide the legal parcel into four (4) separate parcels, a remainder parcel and Lot A.
STAFF REPORT: John Carmack and his agent, The Holt Group are requesting approval to allow the division of one (1) 22.94t acre parcel into two (4) separate parcels, Lot A and a Remainder Parcel. The project site is located at the N/E corner of West Wells Road and Quail Run Road and is legally described as Assessor's Parcel Numbers 821-170-054, 821-170-055 and 821-170-171. Proposed Parcel No. 1 is 16.84‡ acres in size, Proposed Parcel No. 2 is 1.01‡ acres in size, Proposed Parcel No. 3 is 1.01t acres in size, Proposed Parcel No. 4 is 1.00+ acres in size, Lot A is .059 acres in size and the Remainer Parcel is 2.49t acres in size. Each parcel has access from an improved dedicated right-of-way. No variances or exceptions are required for this Parcel Map.
This site is included in the Mesa Bluffs Specific Plan. The General Plan Land Use and Zoning Designation is R-E (Residential Estates). The existing zoning designation allows for a minimum lot area of 9,600 S.F. with minimum lot width and depths of 75x100. As the smallest proposed parcel is 1.00t acre, the Parcel Map is consistent with existing zoning regulations. Surrounding land uses include the Blythe Municipal Golf Course, vacant land, and residential uses. -67-
Environmental Review: The project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Guidelines Section 15315- Minor Land Divisions, and a Notice of Exemption with De Minimis Impact Finding will be filed.
Findings:
That the proposed Tentative Parcel Map is consistent with the City of Blythe General Plan:
The Tentative Parcel Map allows for parcel sizes that meet the requirements of the Residential Estate Zone and therefore the City's General Plan. There are no proposed development plans for this site, but this Parcel Map may help further the goals of the General Plan by making this site more attractive for residential development.
B. That the proposed Tentative Parcel Map is consistent with the requirements of the Zoning Ordinance:
The Tentative Parcel Map as proposed meets the requirements of the City's Zoning Code as the proposed lot sizes meet the parameters of Chapter 17.10.010 of the Blythe Municipal Code.
C. That the site is physically suitable for the land division as proposed:
The site is presently vacant land zoned for residential development. The site is suitable for this land division. The land divisions could subsequently encourage the future development of residential lots on this site.
D. That the designs of the project will have no impact on environmental resources including fish and wildlife:
As no development of this land is proposed at this time, this division of land will have no impact on the environment. Future development plans will be reviewed, and environmental review performed to determine and/or mitigate any potential environmental impacts.
That the project is exempt under State CEQA Guideline Section 15315 - Minor Land Division.
The environmental analysis/determination reflects the independent judgment of the City of Blythe.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: October 12, 2023
SUBJECT: Ordinance No. 923-23 Repealing and Replacing Chapter 17.26 (Signs) of Title 17 (Zoning) of the Blythe Municipal Code
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended that the City Council, acting as the City's Planning Agency, conduct a public hearing regarding Ordinance No. 923-23 and provide direction regarding any desired changes to the ordinance.
FISCAL IMPACT: None.
BACKGROUND: Earlier this year, the City Council met in a Study Session to discuss proposed amendments to the City's Sign Ordinance. Staff sought direction from Council on potential amendments to the City's Sign Ordinance to provide clear guidance on the type and size of signs allowed within commercial and non-commercial zones. It was also intended to make the Sign Ordinance easier to use and have a favorable outcome for businesses. Staff took direction at the Study Session and went to work on proposed amendments to the City's Sign Ordinance. The last comprehensive update of the City's Sign Ordinance occurred in 2004.
On July 26, 2023, the City published a notice of public hearing regarding the review of proposed Ordinance No. 923-23, which would amend Chapter 17.26 (Signs) of Title 17 (Zoning) of the Blythe Municipal Code. On August 8, 2023, the City Council, acting as the City's Planning Agency, continued the public hearing to September 12, 2023. On September 12, 2023, the City Council again continued the public hearing to October 10, 2023.
STAFF REPORT: Significant changes were made to the City's Sign Ordinance for compliance with State and Federal law. Also included in the proposed Ordinance are the items discussed at the Study Session. Signs that were previously prohibited including A-frame signs and billboards are permitted in the proposed Ordinance with regulations. The number of allowable signs, sign height and sign area were increased in the proposed Ordinance. The current Ordinance has a maximum size aggregate of 50 sq. ft. In the proposed Ordinance, the total maximum sign aggregate is 250 sq. ft. based on the property's parcel size. If adopted, larger parcels would have the opportunity to install larger signs to match the scale of their development.
The proposed Sign Ordinance allows for up to a total of four signs in commercial zones and industrial zones, with a maximum of two signs per building side. The current Ordinance does not allow for more than two signs with no more than one sign per building. This was problematic for businesses wanting to place both their business name and logo on their building. This will allow -80-
businesses more flexibility in their signage plan and will help meet the needs of corporate businesses with standardized signage requirements. The proposed Ordinance also addresses not particly ay sissed icement and Cranent window signs, like window graphics, which are The proposed Ordinance provides a definition and procedures for murals. The Ordinance outlines the mural approval process which is a recommendation from the Art in Public Places Committee to the City Council.
Staff's intent with this update was to provide better signage options for our businesses while promoting the public health, safety and welfare and preserving community aesthetics through the implementation of a uniform set of rules and regulations. Staff believes this Ordinance, as proposed, is representative of the goals of the City. It is therefore recommended that the City Council, acting as the City's Planning Agency, conduct a public hearing regarding Ordinance No. 923-23 and provide direction regarding any desired changes.
This is the first of two public hearings regarding the proposed Ordinance in accordance with the requirements of State law and the Blythe Municipal Code. The first hearing is being conducted by the City Council, acting as the City's Planning Agency.

(See Clear Channel Outdoor, Inc. v. City of Los Angeles, 340 F.3d 810 (9th Cir. 2003); Outdoor Systems: Inc. v. City of Mesa, 997 F.2d 604 (9th Cir. 1993); and WHEREAS, the unregulated proliferation of temporary signs in the public right-of- way can be detrimental to the aesthetic quality of the streets and sidewalks, can interfere with traffic safety, pedestrian access to public sidewalks and streets, and can obstruct the entrance to businesses and residences; and

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF BLYTHE DOES ORDAIN AS FOLLOWS:
SECTION 1. Recitals. The City Council finds that the recitals set forth above are true and correct.
SECTION 2. Amendment to Chapter 17.26 of Title 17. Chapter 17.26 (Signs) of Title 17 (Zoning) of the Blythe Municipal Code is hereby deleted in its entirety and replaced with the following:
Chapter 17.26 - SIGNS
17.26.010 - Findings.
The city council finds all of the following:
A. Police power. The city, pursuant to its police power, has the authority to take appropriate action to address concerns regarding traffic safety and aesthetics, as Ordinance No. 923-23
-84-
they relate to signs (Metromedia Inc. v. City of San Diego, 453 U.S. 490 (1981)); and
B. First Amendment. Signs constitute speech protected by the First Amendment of the United States Constitution and by Art. 1, Sec. 2, of the Constitution of the State of California and that its regulation of signs must be consistent with these protections; and
C. Harms of non-regulation. An uncontrolled proliferation of signs within the city is harmful to the public's health, safety and welfare, in that such signs are:
1. aesthetically displeasing, distracting, discordant with their surroundings and detract from the natural beauty of the city, and
2. they create a safety hazard as drivers, pedestrians, and others venturing into the public area will be distracted by attempting to read an excessive number of signs that are placed in a haphazard, dangerous, or dangerously attention- seeking manner; and
D. Substantial interest. The city has a substantial interest in regulating signs and the regulations within this chapter further the city's substantial interests in traffic safety and aesthetics, consistent with National Advertising Co. v. City of Orange, 861 F. 2d 246, 248 (9th Cir. 1988) and Foti v. City of Menlo Park, 146 F.3d 629 (9th Gir. 1998); and
E. Commercial interests. Businesses have an interest in having signage that effectively advertises their goods or services, and is visible to potential customers; and
F. Aesthetic interests. City residents and visitors have a substantial interest in visiting, • living, and working in an aesthetically pleasing city; and G. Traffic safety interest. City residents and visitors have a substantial interest in traffic safety within the city; and
H. Limited regulation is necessary. The city has properly balanced its interests in aesthetics and traffic safety with the interests of businesses and consumers by limiting off-site commercial signs, and by limiting the time, place, and manner of placement of commercial signs on commercial lots; and
legitimately call for regulation; and
J. Commercial speech vs. non-commercial speech. Commercial speech can be regulated more stringently than non-commercial speech; however, the city council Ordinance No. 923-23
-85-
recognizes the need of businesses in the city to communicate to the public about the goods and services they provide; and
K. Content neutrality. The city council intends this chapter to ensure its regulations are content-neutral and are the least restrictive means to achieve the goals set forth herein (See e.g., Reed v. Town of Gilbert, 76 U.S. 155 (2015); and L. On-site signage. These regulations allow on-site commercial signage while limiting off-site advertising signs, the city council having found that onsite commercial speech is more valuable than offsite commercial speech, as permitted in Outdoor Systems, Inc. v. City of Mesa, 997 F.2d 604, 611 (9th Cir. 1993) and Metromedia Inc. v. City of San Diego, 453 U.S. 490 (1981); and
M. Procedures are beneficial. Because signs are speech protected by the United States and the California Constitutions, detailed procedures are necessary to ensure that permits are expeditiously issued or denied based on objective criteria and consistent with due process of law; and
N. Message substitution. A message substitution provision has been added to the city's sign regulations, allowing any sign regulated by the new provisions of this ordinance to display a non-commercial message, so that the city's regulations satisfy the constitutional mandate that it not restrict non-commercial signage to a greater degree than commercial signage. (See Clear Channel Outdoor, Inc. v. City of Los Angeles, 340 F.3d 810 (9th Cir. 2003); Outdoor Systems. Inc. v. City of Mesa, 997 F.2d 604 (9th Cir. 1993); and
O. Temporary. signs. The unregulated proliferation of temporary signs in the public right-of-way can be détrimental to the aesthetic quality of the streets and sidewalks, can interfere with traffic safety, pedestrian access to public sidewalks and streets, and can obstruct the entrance to businesses and residences; and P. Limits on interfering with traffic. Prohibiting commercial conduct that is intended to, or that does in fact, attract the attention of drivers, furthers the city's substantial interest in traffic safety (See, e.g., Sanctity of Life Network v. California Highway Patrol, 105 Cal. App. 4th 858, 862 (2003) (holding that protected First Amendment speech can be restricted if it interferes with traffic)).
17.26.020 - Purpose.
The purpose of this chapter is to promote the public health, safety and welfare and preserve community aesthetics through implementation of a uniform set of rules and regulations. This chapter is intended to:
A. Preserve and improve the appearance of the city as a place to live, work, and visit; Ordinance No. 923-23
-86-
B. Reduce : visual clutter while providing reasonable opportunities for adequate identification of businesses and the goods and services they offer; C. 17.26.040 - Applicability/general rules.
A. Applicability. This chapter applies to all existing and proposed signs to be located within the city.
B. Types of signs. There are three main types of signs: permanent, semipermanent, and temporary.
C. General rule. No person shall erect, place, modify, or maintain any sign except as authorized by this chapter. To ensure compliance with this chapter, a sign permit shall be required for any sign, except as provided herein.
D. Other permits required. Even if a given sign is exempted from the sign permit requirements of this chapter, the sign is still subject to all other applicable requirements of this code,: including, but not limited to, grading, plumbing, electrical, building, fire, encroachment, and similar safety requirements.
17.26.050 - General policies.
The following policies, principles, rules, and regulations apply to all signs within the regulatory scope of this chapter, and to all provisions of this chapter, notwithstanding any more specific provisions to the contrary:
A. Message neutrality. It is the city's policy to regulate signs in a viewpoint-neutral and/or content-neutral manner. The message of the sign shall not be reviewed except to the minimum extent necessary to identify the type of sign.
B. Administrative interpretations. All administrative and quasi-adjudicative interpretations of this chapter are to be exercised in light of the city's message neutrality policy. Where a particular type of sign is proposed in a permit application, and the type is neither expressly allowed nor prohibited by this chapter, or whenever a sign does not qualify as a "structure" as defined in the building code, then the director and/or the city council, as applicable, shall approve, conditionally approve, or disapprove the application based on the most similar sign type that is expressly regulated by this chapter.
C. Message substitution. Subject to the owner's consent, a non-commercial message of any type or content may be substituted for any allowed commercial message or any allowed non-commercial message, provided that the sign structure or mounting device is legal without consideration of message content. Such Ordinance No. 923-23
-93-
substitution of message may be made without any additional approval or permitting. This provision prevails over any more specific provision to the contrary within this chapter. The purpose of this provision is to prevent any inadvertent favoring of commercial speech over non-commercial speech, or favoring of any particular non-commercial message over any other non-commercial message.
This provision does not create a right to increase the total amount of signage on a parcel or lot; it does not create a right of substitution of one commercial message in place of another; it does not create a right to display an off-site commercial message sign, and it does not affect the requirement that a sign structure or mounting device be properly permitted.
D. Specific controls over general. Where a matter of interpretation arises regarding the provisions of this chapter, the more specific definition or more rigorous standard shall prevail. Whenever the planning director determines that the application of any provision of this chapter is uncertain, the issue shall be referred to the City Council for determination. *

d. Preserving existing murals that are a valued part of the history of the city of Blythe.
2. The city wishes to encourage the installation of murals and, at the same time, prevent the proliferation of off-site commercial signs. Therefore, the city's mural regulations exclude commercial advertising on murals to prevent the installation of the equivalent of an off-site commercial sign on a mural. This restriction on commercial advertising is intended to work in tandem with the limitations of off-site commercial signs to designated areas in the city. Both the limitation on zones and the exclusion of commercial advertising on murals are supported by the United States Supreme Court's ruling in Metromedia, Inc. v.
City of San Diego, 453 U.S. 490 (1981). In Metromedia, the Supreme Court ruled that cities may ban off-site commercial signs. The Supreme Court also ruled that cities can carve out exemptions to such a ban for non-commercial signs and on-site commercial signs.

a. That the design, construction, installation, repair, and maintenance of such displays will not interfere with traffic safety or otherwise endanger public safety.

c. That the public will enjoy the aesthetic benefits of being able to view such displays in numbers and sizes that are reasonably and appropriately regulated without having to endure visual blight and traffic safety impacts that would be caused by such displays that are not reasonably and appropriately regulated.
d. That consideration will be given to equalizing the opportunity for messages to be displayed.
e. That adequacy of message opportunity will be available to sign users without dominating the visual appearance of the area.
f. That the regulations will conform to judicial decisions, thereby limiting further costly litigation and facilitating enforcement of these regulations.
B. Permit required. It shall be unlawful for any person, firm, or corporation to authorize, erect, construct, maintain, move, alter, change, place, suspend, or attach any art mural within the city without first obtaining an art mural permit.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING
STAFF REPORT
RELISHED
MEETING DATE: October 10, 2023
SUBJECT: Save Chuck
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council receive and file a report on Save Chuck and authorize the Interim City Manager to sign a letter of support for a research partnership with John M. Eason, Associate Professor of Sociology at the Watson School of International and Public Affairs at Brown University and the Urban Institute.
FISCAL IMPACT: Impacts to the City of Blythe from the closure of Chuckawalla Valley State Prison include a revenue decline of $2.9 million.
BACKGROUND: In December, the Secretary of the California Department of Corrections and Rehabilitation (CDCR) announced plans to close Chuckawalla Valley State Prison in Blythe by March 2025. The City quickly sprang into action to rally against this closure. The City began contacting State and Federal legislators and held meetings with elected officials, the CDCR Secretary, CVSP Close Down Manager and other CDCR staff members. The City submitted over 40 Public Records requests to the State seeking information related to how CVSP was selected for closure over other older and more costlier prisons in the State's system. Several of the City's requests for information were denied.
The City also went to work on solutions and proposed a swap of CVSP in Blythe for the California Rehabilitation Center (CRC) in Norco. Both City of Blythe and City of Norco officials are championing this proposal. This is a win-win for the Cities and State as a more cost- effective prison will be shuttered in a City that has far more resources to absorb job losses than Blythe. The City of Norco has petitioned for the closure of CRC for years. CRC has been on the State's chopping block since 2012. The State's own Legislative Analyst's report as well as other independent reports find that CRC should be the next CDCR institution to close due to a number of issues including cost to operate and safety.
In January, the City hired Tripeppi Smith for PR Services and the Gonsalves & Son Firm for lobbying efforts in the State Capitol. The City has garnered support from Assemblyman Garcia, Congressman Ruiz, State Senators Steve Padilla and Kelly Seyarto, The Riverside County Board of Supervisors, CVAG, fellow Cities in Riverside County, Riverside and Orange County Sheriff's, PVID, Cal Cities Riverside County Division Crime Victims United and others.
The Save Chuck (www.savechuck.org) website was launched. Many presentations have been made around the Community to detail the Coalition's efforts to Save Chuck.
STAFF REPORT: In September staff was put in contact with John M. Eason, Associate Professor at Brown University through the California Governor's Office of Business and -119-
Economic Development (GO-Biz). The City's GO-Biz representative was familiar with the work Professor Eason and his students were doing in Susanville related to their prison closure. She thought our city may benefit from their research work and put us in contact.
Staff met with Professor Eason who has done extensive research and written books on rural communities across America with a focus on rural communities with prisons; and what happens to rural communities when they lose a prison. He believes that if prisons are going to be closed, rural communities need to be at the center of the conversation and be centered around the needs of the communities where the prisons are located.
Last semester his students performed interviews with residents and business owners in Susanville to understand what types of jobs, industries and repurposing can take place as their prison closes. He was also tasked with preparing a two-page brief on Susanville for the Governor's Office. The brief outlines the investments needed in internet and public health infrastructure and increasing alternative energy to enhance Susanville's ability to cope with the closing of CCC. This research is performed free of charge by Professor Eason's students. There is no cost to the City for this service.
This research could further help the City in its point that closing Chuckawalla Valley State Prison will be devastating to our community, and should the State refuse to rethink this position, the State will need to provide adequate funding to our community to offset the impacts of this closure. We will also gain a better understanding of the Blythe Business community's interests as we look for new business development and expansion opportunities as these students will interview a number of community leaders and business owners as part of their research. This information will be presented to the Governor's Office which could give us an opportunity to discuss Save Chuck with the Governor and his staff. Blythe CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: October 10, 2023
SUBJECT: Request to Waive Community Center Rental Fees for the Rec-N-Crew's Annual Homecoming Fundraiser
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council waive the Community Center Rental fees except for the $100 labor fee for the Rec-N-Crew's Homecoming Fundraiser.
FISCAL IMPACT: Loss of $500 in rental fees.
BACKGROUND: For a number of years, the Rec-N-Crew has hosted a fundraiser during Homecoming in front of the Community Center in Todd Park. The Community Center has been used by the Rec-N-Crew to store equipment overnight and for use of the public restrooms during the event. In previous years the Rec-N-Crew has coordinated its use of the Community Center with other applicants renting the center for Homecoming class parties. So far this year, nobody has requested to rent the center during Homecoming. As such, the Rec-N-Crew is required to submit the appropriate paperwork and fees for its use.
STAFF REPORT: The Rec-N-Crew was formed to support the Blythe Joe Wine Recreation Center. As the Homecoming event is one of their annual fundraisers, it is requested Council waive the rental fees for their use. As the labor fee to open and close the facility is a direct cost to the City, staff recommends Council waive all Community Center Rental fees except for the $100 labor fee.

Blythe CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: October 10, 2023
SUBJECT: Request to waive Building Permit Fees for the Chamber of Commerce's Sign Project
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: Provide direction to staff.
FISCAL IMPACT: Loss of revenue estimated at $1,007.05.
BACKGROUND: In early 2020, the Chamber discussed with staff a project to place signage at key points in the City. The signs would consist of Welcome to Blythe and Crop Signs. To streamline the permitting process for the installation of these signs, in September 2021 the City Council authorized the Welcome to Blythe and Field Crop signs to be directional/informational signs per Chapter 17.26 of the Blythe Municipal Code.
Designating the signs as directional or informational signs allows the Chamber more flexibility in the size and placement of the signs. This also waives the requirement of applying and paying for a sign permit.
In September 2023, the Chamber approached City staff about the permits necessary for the installation of the four signs. Due to the size of the signs, and the installation procedures necessary, it requires a building permit. Building permit fees are set by the City's User Fee Study which aimed at full cost recovery to the City. Building Permit fees are based on a project's valuation.
STAFF REPORT: The Blythe Chamber of Commerce submitted a written request asking the Council to waive building permit fee(s) for the installation of four signs. The total permits fees are estimated to be $1,007.05 based on a project valuation of $25,636.00. As there are four signs, each location will require an inspection by the City's Building Official.
Beginning in FY 2022/23, the City Council allocated $30,000 in American Rescue Plan Act (ARPA) funding to support the Chamber in enhancing tourism to the City. This funding allocation will be made in the 2023/24 and 2024/25 fiscal years as well. The scope of the activities to be performed includes promoting tourism with activities and expenditures designed to increase tourism to the City. Tourism promotion activities may include, but are not limited to, advertising, publicizing, or otherwise distributing information for the purpose of attracting and welcoming visitors to the City.
Along with the Tourism funding, the City provides support to the Chamber and its events by -123-
providing traffic control, street closures, preparation of and free use of City facilities and waiving TUP fees for Chamber events.
As the City is contributing $30,000 annually to the Chamber to support its tourism goals, it is not recommended that Council waive the permit fees. The fees are in place to recover the City's costs, including staff time necessary to issue the permits and inspect the work, once complete.

Blythe CITY COUNCIL MEETING
STAFF REPORT
48 1S PEDI
MEETING DATE: September 14, 2021
SUBJECT: Sign installation by Blythe Chamber of Commerce PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council, as the government authority, authorize the Welcome to Blythe and Field Crop signs to be directional/information signs per Chapter
17.26 of the Blythe Municipal Code, and treat them as exempt signs per Section 17.26.040 of the BMC.
FISCAL IMPACT: None.
BACKGROUND: The Blythe Chamber of Commerce's Sign Committee is working on new signage for Blythe and the Palo Verde Valley. This has included working with Caltrans to update freeway signage in and around Blythe as well as designing new Welcome to Blythe and field Corp signs that showcase the various crops produced in our valley. This is part of the Chamber's mission to clean up and promote Blythe and the Palo Verde Valley.
Staff worked with the Chamber on the various City sign requirements. After review of the project and Chapter 17.26 of the Blythe Municipal Code, staff determined the signs can be approved by Council as directional, warning, or informational signs authorized by a government authority.
Designating the signs as directional or informational allows the Chamber more flexibility in the size and placement of the signs. This also waives the requirement of applying for a sign permit.
It does not however relive them of any required sign maintenance. Directional/information signs contain no advertising copy.
STAFF REPORT: The Chamber plans to install four Welcome to Blythe Signs to be located near the westbound and eastbound lanes of 110, on Highway 78 and Highway 95. The signs will be 14 feet wide and 12 feet tall. The signs will be similar to the existing Welcome to Blythe sign located near the E. Hobsonway exit on I10, with Welcome to Blythe at the top, and the service club logos below. Each service club logo will be 30in x 30in. All signs will be placed on private property. These regulations will only apply to signs placed inside City limits. Signs placed outside of City limits may have other restrictions and/or regulations as directed by the County and/or Caltrans.
The Welcome to Blythe sign will also include the Chamber's new logo. As they wish to publicly unveil the logo at a later date, it was not included in the attached mockup. -126-
Two large field crop signs will be placed on private property facing the east and westbound lanes of I10. The signs may be the same size as the Welcome to Blythe sign, or slightly smaller. The signs will show a listing of year-round crops produced in the valley. Small, individual crop signs will be placed on private property in agricultural production along HWY 78 and HWY95. These signs may be changed seasonally based on crop production and will be either 4ft × 5ft or 6ft by 4ft in size. The placement of these signs will allow travelers to see the various crops growing in a particular field.
Staff has supported this project, and the work of the Chamber's sign committee. Staff recommends Council approve this request and treat the proposed signs as directional/informational signs per Chapter 17.26 of the BMC.

SUBJECT: Citywide Slurry Seal Project
PRESENTED BY: Kenneth McLaughlin, Public Works Director PREPARED BY: Kenneth McLaughlin, Public Works Director
RECOMMENDATION: It is recommended that Council:
1. Authorize the Interim City Manager to execute Agreement No. 2023-056 A with American Asphalt South, Inc. contingent upon all bonds and proper contract documents being fully executed to the satisfaction of the City Attorney and Interim City Manager; and issue a purchase order to American Asphalt South, Inc. in an amount not to exceed $565,470.56.
2. Authorize an additional $56,547.06 (10%) for contingencies and project inspection and authorize the Interim City Manager to approve change orders during construction within the approved project budget.
3. Establish a project budget not to exceed $622,017.62.
FISCAL IMPACT: $622,017.62 in Measure A funds allocated to the Citywide Slurry Seal Project.
BACKGROUND: Council adopted the FY 23/24 budget with $750,000 in Measure A funds for the Citywide Slurry Seal Project. This project consists of the pavement treatment (slurry seal) of various streets within the city limits, to help preserve and protect the underling pavement structure and provide a new driving surface along with replacement of existing striping and pavement markings. The streets included in the Slurry Seal project include Main Street, Broadway from Juniper Trail to 10" Ave, Broadway from Hobsonway to 14# Ave, Solano, Acacia, Date Rd., 14" Avenue and Barnard.
STAFF REPORT: The bid specifications and plans for the Citywide Slurry Seal project were released on August 18, 2023. The bid announcement was published in the Palo Verde Valley times, sent to two plan rooms, emailed to a list of contractors who typically perform work or submit bids on this type of work in the city and posted on the City's website in conformance with the City's Purchasing Policy. On August 31, 2023, one company attended the mandatory pre-bid meeting for the project. On September 26, 2023, the city conducted the bid opening, and one bid was received from American Asphalt South, Inc. in the amount of $565,470.56.
City staff reviewed American Asphalt South, Inc. project work history, references, and construction license. American Asphalt South Inc. construction license is current and in good standing with the State of California. American Asphalt South, Inc. recently completed the Slurry Seal Project for Riverside County. Therefore, staff determined American Asphalt South Inc. is the responsive and responsible bidder.

Blythe CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: October 10, 2023
SUBJECT: Consideration of Ordinance Prohibiting the Unlawful Possession of Catalytic Converters
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council provide direction to staff.
FISCAL IMPACT: None.
BACKGROUND: Under existing laws, law enforcement cannot seize a catalytic converter found to be removed from a vehicle and in someone's possession unless a victim can be identified. Due to a rise in catalytic converter thefts throughout Riverside County, the County Executive Office prepared an ordinance to combat the theft catalytic converters, specifically known as Ordinance No. 987. The Ordinance establishes that it is unlawful for any person to possess any catalytic converter that is not attached to a vehicle, unless the person has valid proof of ownership. A violation of the Ordinance will result in criminal and/or civil penalties, regardless of whether the lawful owner is identified.
On September 12, 2023, the Riverside County Board of Supervisors adopted Ordinance No. 987.
The Ordinance will go into effect on October 12, 2023. The Ordinance was shared with all City Managers and Mayors in Riverside County, in the event a city wishes to adopt County Ordinance No. 987 by reference pursuant to California Government Code §§ 50022.2 and 50022.3.
STAFF REPORT: About a year ago, the Blythe Police Department made an arrest for the theft of catalytic converters. Since then, these types of thefts have not been prevalent. However, adopting an ordinance like the County's and prohibiting the unlawful possession of catalytic converters could help deter future thefts and be a tool for law enforcement should prosecution of these thefts be necessary later.
Ordinance No. 987 provides that any person who violates the ordinance is guilty of a misdemeanor, and upon conviction, shall be punished by a fine not exceeding one thousand dollars ($1,000.00), or by imprisonment in the county jail for a term not exceeding one year, or both.
In addition to criminal penalties, the Ordinance provides for administrative civil penalties in the amount of one thousand dollars ($1,000) for the first offense, two thousand dollars ($2,000.00) for the second offense within a thirty-sixth (36) month period and five thousand dollars ($5,000.00) for any subsequent offenses within a thirty-sixth (36) month period. The Ordinance outlines that a person shall be deemed guilty of a separate offense for each and every catalytic converter in the person's possession that is not attached to a vehicle, unless the person has a valid proof of ownership.
-132-
It is recommended that Council provide direction to staff on whether or not Council would like to adopt an ordinance similar to Ordinance No. 987. If Council would like a similar ordinance, staff will prepare an ordinance for Council's review and approval at a later date.

Blythe CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: October 10, 2023
SUBJECT: Urgency Ordinance Establishing a Temporary Moratorium on the Approval of Commercial Solar Energy Facilities
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Brittany E. Roberto, City Attorney
RECOMMENDATION: It is recommended that the City Council adopt, by a four-fifths vote, Urgency Ordinance No. 925-23-U:
URGENCY ORDINANCE NO. 925-23-U. AN INTERIM URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF BLYTHE, CALIFORNIA, ESTABLISHING A TEMPORARY MORATORIUM ON THE ESTABLISHMENT OF
COMMERCIAL SOLAR ENERGY FACILITIES TO ALLOW TIME FOR CONSIDERATION OF POTENTIAL
AMENDMENTS TO THE BLYTHE ZONING CODE FOR THE PURPOSE OF ENSURING COMPATIBILITY WITH
SURROUNDING LAND USES AND FINDING THE ORDINANCE IS EXEMPT FROM ENVIRONMENTAL REVIEW
UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT PURSUANT TO CEQA GUIDELINES SECTION 15061(B)(3)
FISCAL IMPACT: None.
BACKGROUND: State law governs the City's ability to adopt temporary moratorium ordinances. A moratorium is a stringent temporary land use control based on documented health, safety, and general welfare concerns made pursuant to the police power. Cities may adopt temporary ordinances prohibiting any uses that may be in conflict with a contemplated general plan, specific plan, or zoning proposal that the city plans to study within a reasonable time. (California Government Code section 65858) To adopt a moratorium, the City must follow the prescribed statutory process and must make written statutory findings.
A moratorium ordinance is adopted on a temporary basis and may be adopted as an urgency measure or not. An interim urgency ordinance is adopted without notice and becomes effective immediately. An interim non-urgency ordinance is adopted following notice and a public hearing, but also becomes effective immediately. Whether the moratorium is adopted as an urgency or non- urgency basis, a moratorium requires a four-fifths vote of the City Council to approve and has an initial duration of 45 days.
If the initial ordinance is adopted as an urgency measure without following the notice and adoption procedures required for other ordinances, after notice and a public hearing, the interim ordinance may be extended for up to 10 months and 15 days and subsequently extended for up to one additional year. Any extension requires a four-fifths vote of the City Council for adoption. No more than two extensions may be adopted for a total duration of up to two years.
Alternatively, if the moratorium is adopted following notice and a public hearing, after the expiration of the initial 45 days, an ordinance may be adopted by a four-fifths vote of the City -134-
Council, following notice and a public hearing, that extends the ordinance for up to 22 months and 15 days, for a total duration of up to two years.
Regardless of whether notice is provided when adopting the moratorium, such an ordinance goes into effect immediately without the need to conduct a second reading.
Ten days before the expiration of the interim ordinance or any extension, the City Council must issue a written report describing the measures taken to alleviate the condition which led to the adoption of the ordinance. (California Government Code section 65858(d).) It is important to note that the City may only prohibit the issuance of development permits. It may neither prohibit developers from submitting new permit applications nor prohibit the processing of permits during the moratorium.
When adopting a moratorium, the City must make two statutory findings: (1) there is a current and immediate threat to the public health, safety or welfare, and (2) the approval of additional permits or entitlements under the zoning ordinance would result in that threat to public health, safety or welfare. (California Government Code section 65858(c).) STAFF REPORT: Earlier this year, the City received applications for the construction and operation of a photo-voltaic (PV) solar array with attached battery storage on property located within the Colorado River Corridor Plan area. The proposed project includes a five-megawatt solar facility with 20 megawatts of battery energy storage on a property that is approximately 58 acres in size. The land is currently in agricultural production. Staff anticipates that the City will continue to receive applications for the construction of similar facilities in the Colorado River Corridor Plan area and throughout the City.
The Colorado River Corridor Plan ("Plan") was adopted in March 2007 following a comprehensive and iterative planning process that started with the formation of the Colorado River Corridor Plan Ad-Hoc Advisory Committee ("Committee") in August 2005. The process included coordination between the Committee and City departments, and consultation with the Palo Verde Unified School District and the Palo Verde Irrigation District. Professional planning, environmental, and engineering consultants also provided support to the City during the planning process. The planning process also included input from the community at community workshops and input from the Planning Commission and City Council.
The Plan is a comprehensively planned, waterfront-oriented land use plan intended to complement other areas of the City. The City's vision for the Plan area includes providing a variety of housing opportunities to establish viable and livable neighborhoods; preserving valuable open space; developing additional recreational and resort land uses; protecting existing agricultural land uses; creating a multi-purpose recreational trail system; providing additional river access points; and preserving open space while balancing circulation needs.
The Plan establishes connections between all of the lands within its boundaries to provide integration and balance between the Riverfront and the rest of the City. Goals of the Plan include maintaining a small-town atmosphere, encouraging development of resorts, hotels, and other -135-
visitor-serving commercial uses, and managing growth and development timing.
The Blythe Zoning Code does not define or regulate commercial solar energy facilities. The closest use defined in the Zoning Code is "utility operations facilities," which are defined by Section
17.08.710 as "facilities involved in the operation of the various public and quasi-public utilities such as telephone switchboard centers, electrical generating plants and terminals, sewage treatment plants and water pumping stations or reservoirs". Such definition was last amended in 1982 and does not clearly, and was not likely intended to, include commercial solar energy facilities.
For purposes of this staff report and the proposed urgency ordinance, "commercial solar energy facility" refers to a solar energy facility that is designed to collect, store, and distribute solar energy that will be used to meet off-site energy demand. "Commercial solar energy facility" does not include a solar energy system that meets the definition of California Civil Code section 801.5. "Commercial solar energy facility" also does not include accessory solar energy equipment installed for on-site consumption. "Commercial solar energy facility" does include what are commonly known as solar farms.
Because commercial solar energy facilities are not currently identified or regulated in the Zoning Code, Development Services Department staff is concerned that commercial solar energy facilities may have adverse effects on City residents. Staff is also concerned that if commercial solar energy facilities are established, they may be incompatible with residential and other land uses in the City and would interfere with achieving the goals and objectives of the Colorado River Corridor Plan.
If the City Council does not adopt a moratorium ordinance, staff is concerned that commercial solar energy projects that are not compatible with surrounding uses may be established that could adversely impact the quality of life for residents of the City and interfere with the carefully thought out and developed Colorado River Corridor Specific Plan. Staff believes it is necessary to study and assess approaches to regulating the scale, design, and location of such facilities in order to ensure they are compatible with residential and other land uses in the City.
Therefore, staff is recommending that the City Council adopt, by a four-fifths vote, an urgency ordinance to prohibit the establishment of a new commercial solar energy facilities. As outlined above, the interim ordinance would have an initial duration of 45 days.

The City Council of the City of Blythe hereby finds and declares as follows:
WHEREAS, Section 17.08.710 of the Blythe Municipal Code defines "utility operations facilities" as "facilities involved in the operation of the various public and quasi- public utilities such as telephone switchboard centers, electrical generating plants and terminals, sewage treatment plants and water pumping stations or reservoirs"; and WHEREAS, Section 17.08.710 was last amended in 1982; and WHEREAS, Section 17.08.710 does not clearly, and was not likely intended to, include commercial renewable energy facilities such as commercial solar energy facilities; and
WHEREAS, the Blythe Municipal Code does not define or contain specific regulations for commercial solar energy facilities; and WHEREAS, for purposes of this ordinance, "commercial solar energy facility" refers to a solar energy facility that is designed to collect, store, and distribute solar energy that will be used to meet off-site energy demand. "Commercial solar energy facility" does not include a solar energy system that meets the definition of California Civil Code section 801.5. "Commercial solar energy facility" also does not include accessory solar energy equipment installed for on-site consumption. "Commercial solar energy facility" does include what are commonly known as solar farms; and
WHEREAS, the City has a pending application for the construction of a five- megawatt commercial solar energy facility on land located within the Colorado River Corridor Plan area. The land is currently in agricultural production; and WHEREAS, the City anticipates that it will continue to receive applications to construct commercial solar energy facilities; and

WHEREAS, the City is concerned that commercial solar energy facilities may have adverse effects on City residents. Absent this interim urgency ordinance, incompatible commercial solar energy facilities may be established that could adversely impact the quality of life for residents of the City and interfere with the carefully thought out and developed Colorado River Corridor Plan; and
WHEREAS, California Government Code section 65858 provides that to protect public health, safety, and welfare, the City Council may adopt as an urgency measure an interim ordinance prohibiting certain uses while the City studies the prohibited uses; and WHEREAS, this interim urgency ordinance is necessary to provide the Development Services Department time to study and assess various approaches to regulating the scale, design, and location of commercial solar energy facilities to ensure Urgency Ordinance No. 925-23-U

they are compatible with residential and surrounding land uses, and to present its recommendations to the City Council; and
WHEREAS, there is a current and immediate threat to the public health, safety, and welfare if new commercial solar energy facilities are established, and the approval of any permits or entitlements for such facilities would result in that threat to the public health, safety, and welfare.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF BLYTHE DOES ORDAIN AS FOLLOWS:
SECTION 1. Recitals. The City Council finds that the recitals set forth above are true and correct.
SECTION 2. Moratorium. In order to protect the public health, safety, and welfare of the community and pursuant to the provisions of California Government Code section 65858, no new commercial solar energy facility shall be established. The City shall not issue any permits or entitlements inconsistent with this ordinance while this moratorium and any extension thereof is in effect. Nevertheless, as required by State law, the City may continue to accept and process applications for development prohibited by this moratorium. Any application shall be processed at the applicant's sole cost and risk with the understanding that no new commercial solar energy facilities shall be established while this moratorium and any extension thereof is in effect. This ordinance shall apply to all applications for commercial solar energy facilities, including any application that has been filed, even if complete, prior to the effective date of this ordinance.
SECTION 3. Urgency Measure. This ordinance is declared to be an urgency measure and interim ordinance adopted pursuant to the provisions of California Government Code section 65858. As set forth in the findings above, this ordinance is necessary for preserving the public health, safety, and welfare of the community.
Accordingly, upon adoption by a four-fifths vote of the City Council, this ordinance shall take effect immediately.
SECTION 4. Effective Date; Expiration. This ordinance shall take effect immediately and be of no further force or effect upon the expiration of forty-five (45) days from the date of adoption, unless extended in accordance with California Government section 65858.
SECTION 5. Environmental Compliance. The City Council finds that, regarding the California Environmental Quality Act (CEQA), this ordinance is exempt from CEQA because there is no possibility that the adoption of this ordinance may have a significant adverse effect on the environment (CEQA Guidelines section 15061(b)(3)).
SECTION 6. Severability. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the Urgency Ordinance No. 925-23-U

decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Blythe hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional.
