PUBLIC HEARING:
Ordinance No. 927-23 Repealing and Replacing Chapter 17.78 (Environmental Evaluation) of Title 17 (Zoning) of the Blythe Municipal Code. Interim City Manager Crecelius stated on December 12, 2023, the Council, acting as the City's Planning Agency conducted a Public Hearing regarding proposed Ordinance 927-23 which would repeal Chapter
17.78 of the BMC in its entirety. Currently, this chapter requires the Planning Director to make an environmental assessment of all matters requiring action by the City Council under the zoning code. As the California Environmental Quality Act does not apply to projects that an agency rejects or disapproves, Chapter 17.78 requires grater obligations on City staff and project applicants than what is required by State Law. Staff prepared Ordinance No. 927-23 to repeal this chapter in its entirety for compliance with State laws and regulations. It is therefore recommended that the City Council, subsequent to the Public Hearing, introduce Ordinance No. 927-23.
No public comment. Councilman Reynolds moved approval of Staff's recommendation. The motion was seconded by Vice Mayor Rodriguez with a unanimous aye vote.

Tentative Parcel Map No. 38860. Interim City Manager Crecelius stated Jonathan Smith and his agent, The Holt Group request approval to allow the division of one (1) 0.39t acre parcel into two (2) separate parcels. The project site is located at 184 N. Acacia and is legally described as Assessor's Parcel Number 851-071-014. Proposed Parcel No. 1 is 0.14t acres in size and Proposed Parcel No. 2 is 0.25+ acres in size. Each parcel has access from an improved, dedicated right-of-way. No variances or exceptions are required for this Parcel Map. This site has a Low- Density Residential zoning designation which allows for a minimum lot area of 6,000 SF. As the smallest proposed parcel is 6,000 SF, the Parcel Map is consistent with existing zoning regulations. Surrounding land uses include residential uses and vacant property. The project is ategorically exempt from the California Environmental Quality Act (CEO) pursuant t Guidelines Section 15315- Minor Land Divisions, and a Notice of Exemption with De Minimis Impact Finding will be filed. Therefore, subsequent to the Public Hearing, it is recommende Council adopt Resolution No. 2024-002 approving the Notice of Exemption with De Minimis Impact Findings for Tentative Parcel Map 38860 and Resolution No. 2024-003 approving Tentative Parcel Map 38860 with conditions.

Blythe CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: February 13, 2024
SUBJECT: Application for Funding with State Water Resources Control Board PRESENTED BY: Christa Elms, Director of Finance
PREPARED BY: Christa Elms, Director of Finance
RECOMMENDATION: Recommended that the City Council adopt Resolution No. 2024- 004 authorizing on behalf of the City of Blythe the filing of a financial assistance application with the State Water Resources Control Board (SWRCB") for a Hidden Beaches Water System Treatment, Filtration and Storage Project (the "Project") and, if awarded, authorizing and designating a representative to take actions required to receive and accept the financial assistance.
FISCAL IMPACT: If awarded, funding opportunity from the State in an undetermined amount.
BACKGROUND: The State Water Board (the "Board") is dedicated to protecting California's drinking water and helping ensure that all Californians have access to clean, safe, accessible, and affordable drinking water through serval regulatory and financial assistance programs. Through its Division of Drinking Water, the Board has primary authority to enforce federal and state drinking water statues and is responsible for the regulatory oversight of over 7,000 public water systems. The Board's Division of Financial Assistance provides funding opportunities for drinking water infrastructure, some of which are targeted at helping smaller disadvantaged public water systems.
STAFF REPORT: The SWRCB offers various types of funding through its Drinking Water State Revolving Fund ("DWSRF") program. The DWSRF program assists public water systems in financing the cost of drinking water infrastructure projects needed to achieve or maintain compliance with Safe Drinking Water Act requirements.
The City owns and operates three water systems that supply potable water to the residence of Blythe. The Hidden Beaches Water System is one of these systems, which is currently in need of water treatment, filtration, and storage improvements to comply with orders issued by the State. The infrastructure improvements needed to bring the Hidden Beaches Water System in compliance meet the intended use guidelines under the DWSRF program. It is Staff's recommendation to make application for funding for these improvements utilizing the DWSRF program. Staff intends to make applications for the planning, design, and construction of the entire project. Before Staff can do so, the SWRCB requires City Council to adopt by Resolution giving authorization to file the financial assistance application, and authorize and designate a representative to receive, accept, and carry out all tasks associated with making application including, if awarded, accepting award and executing agreement. -45-
It is requested that the City Council adopt Resolution 2024-004 authorizing the filing of a financial assistance application with the SWRCB for the Hidden Beaches Water System Treatment, Filtration and Storage Project and, if awarded, authorizing and designating the Interim City Manager, or designee, to take actions required to receive and accept financial assistance.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: February 13, 2024
SUBJECT: Ordinance No. 927-23 Repealing Chapter 17.78 (Environmental Evaluation) of Title 17 (Zoning) of the Blythe Municipal Code PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Brittany E. Roberto, City Attorney
RECOMMENDATION: It is recommended that the City Council adopt Ordinance No. 927-23:
ORDINANCE NO. 927-23 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BLYTHE, CALIFORNIA, REPEALING CHAPTER 17.78 (ENVIRONMENTAL EVALUATION) OF TITLE 17 (ZONING)
OF THE BLYTHE MUNICIPAL CODE AND FINDING THE ORDINANCE IS EXEMPT FROM
ENVIRONMENTAL REVIEW UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO CEQA GUIDELINES SECTION 15061(B)(3) (COMMON SENSE EXEMPTION) FISCAL IMPACT: None.
BACKGROUND: Chapter 17.78 of Title 17 of the Blythe Municipal Code has one section, Section 17.78.010. Section 17.78.010 provides in part: "The [P]lanning [D]irector shall make an environmental assessment of all matters requiring action by the [C]ity [C]ouncil under this title." Section 17.78.010 was last amended in 1987.
California Public Resources Code section 21080(b)(5) provides that the California Environmental Quality Act (CEQA) does not apply to projects which a public agency rejects or disapproves.
Section 15270 of the CEQA Guidelines provides that CEQA does not apply to projects which a public agency rejects or disapproves. Section 15270 provides that it is intended to allow an initial screening of projects on the merits for quick disapprovals prior to the initiation of the CEQA process where an agency can determine that the project cannot be approved. Specific to environmental impact reports (EIR), the Court of Appeal has indicated that to require a public agency to prepare and circulate a draft EIR, and prepare a final EIR including responses to comments, before rejecting a project would impose a substantial burden on the agency, other agencies, organizations, and individuals commenting on the proposal, and the project applicant, and would not produce any discernible environmental benefit (Las Lomas Land Co., LLC v. City of Los Angeles, 177 Cal. App. 4th 837, 849 (2d Dist. 2009).
STAFF REPORT: By requiring the Planning Director to make an environmental assessment of all matters requiring action by the City Council under the Zoning Code, Section 17.78.010, on its face, imposes a greater obligation on City staff than what is required by State law. The City has limited staff with limited time. Requiring City staff to comply with an obligation that exceeds State requirements utilizes resources that can be allocated to other City needs. -62-
Staff prepared the proposed Ordinance No. 927-23 to repeal Chapter 17.78 in its entirety. If Chapter 17.78 is repealed, staff will continue to comply with State requirements relating to environmental review and assessments.
The Blythe Municipal Code and State law require two public hearings regarding the proposed Ordinance. On December 12, 2023, the City Council, acting as the Planning Agency, conducted a public hearing regarding proposed Ordinance No. 927-23. On January 9, 2024, the City Council conducted a public hearing and then introduced Ordinance No. 927-23.
Staff recommends that the Council adopt Ordinance No. 927-23.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: February 13, 2024
SUBJECT: Save Chuck
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council receive and file a report on Save Chuck.
FISCAL IMPACT: Impacts to the City of Blythe from the closure of Chuckawalla Valley State Prison include a revenue decline of $2.9 million.
BACKGROUND: In December, the Secretary of the California Department of Corrections and Rehabilitation (CDCR) announced plans to close Chuckawalla Valley State Prison in Blythe by March 2025. The City quickly sprang into action to rally against this closure. The City began contacting State and Federal legislators and held meetings with elected officials, the CDCR Secretary, CVSP Close Down Manager and other CDCR staff members. The City submitted over 40 Public Records requests to the State seeking information related to how CVSP was selected for closure over other older and more costlier prisons in the State's system. Several of the City's requests for information were denied.
The City also went to work on solutions and proposed a swap of CVSP in Blythe for the California Rehabilitation Center (CRC) in Norco. This is a win-win for the Cities and State as a more cost-effective prison will be shuttered in a City that has far more resources to absorb job losses than Blythe. The City of Norco has petitioned for the closure of CRC for years. CRC has been on the State's chopping block since 2012. The State's own Legislative Analyst's report as well as other independent reports find that CRC should be the next CDCR institution to close due to a number of issues including cost to operate and safety.
In January, the City hired Tripeppi Smith for PR Services and the Gonsalves & Son Firm for lobbying efforts in the State Capitol. The City has garnered support from Assemblyman Garcia, State Senators Steve Padilla and Kelly Seyarto, The Riverside County Board of Supervisors, CVAG, fellow Cities in Riverside County, Riverside, San Bernardino and Orange County Sheriff's, the Riverside County District Attorney, PVID, Cal Cities, Crime Victims United, Crime Survivors, and others.
STAFF REPORT: Staff will provide an oral report on the efforts being made to "Save Chuck".

FISCAL IMPACT: $64,490 in abatement funds allocated in the FY 2023/24 Budget.
BACKGROUND: The property at 226 & 228 S. Main Street has been a nuisance for years, with multiple active Code cases on the property. Numerous fires occurred on the property causing further damage and adding to the nuisance condition. While the City worked to abate this nuisance, the property sold multiple times over several years. After each sale, Code Enforcement worked to contact the various property owners to bring the property into compliance, to no avail.
As the property further deteriorated, contributing to the nuisance condition, staff took the necessary steps to turn this case over to the City Attorney's office to seek an abatement warrant from the Court.
In December 2023, the Council awarded an agreement for the abatement of 226 & 228 S. Main Street to R&L Watkins. This was done in anticipation of the City receiving an abatement warrant from the court. On January 29, 2024 the City received the abatement warrant which was issued on January 26, 2024. R&L Watkins quickly went to work on the site.
STAFF REPORT: R&L Watkins completed all work to the satisfaction of the City on January 8, 2024. No extensions to the warrant were required as R&L Watkins was able to complete the project within the 14 days prescribed by the warrant.
Final costs incurred for abatement totaled $64,490. One Change Order in the amount of $2,690 was issued during the abatement. The Change Order increased the scope of the project to include removal of large concrete steps and ramps on the south portion of the foundation on 226 S. Main Street and removal of block and concrete perimeter foundation/stem wall on 228 S. Main Street.
As the adopted project budget was $69,080, the project was well within the budget, even with the issued Change Order.
City staff would once again like to commend Leslie Watkins and R&L Watkins for their blight abatement efforts. Their ability to complete these projects within the very tight parameters of the abatement warrant is no small feat. Having a contractor who can complete these project within the Court prescribed timelines allows the City to continue these abatement efforts.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: February13, 2024
SUBJECT: Purchase of Bus Shelters and Lighting Systems for the Beautify Blythe Project
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council authorize staff to issue a purchase order for Solar Lighting to Horizon Lighting, Inc. in an amount not to exceed $128,925.80 and issue a purchase order for Bus Shelters to LNI Custom Manufacturing, Inc. in an amount not to exceed $181,490.38.
FISCAL IMPACT: $310,416.18 from the Beautify Blythe Clean California Grant Program.
BACKGROUND: The City of Blythe, in partnership with the Palo Verde Valley Transit Agency received $2,922,991 in CleanCA Grant funding for the Beautify Blythe project. The project proposes to improve existing conditions at several key city & transit facilities, including placement of twenty-four (24) bus stops with trash receptacles across three underserved census tracts, a decorative wall and perimeter solar lighting at the City's Public Works Yard, a public access restroom at Transit's CNG Station, landscaping, parking lot improvements and solar lighting at Miller Park, and an outdoor pubic space for community engagement, iron fencing, decorative security fencing and solar lighting at the PVVTA Operations Facility and Main Street Park n' Ride facility.
In addition to the infrastructure improvements, the project includes community engagement, clean up events and ribbon cuttings. To date, clean up events have resulted in the removal of over 120 cubic years of litter and debris from our community.
Work on the grant is required to be completed by June 30, 2024.
STAFF REPORT: In December, the City released a Request for Proposals for the Solar Powered Outdoor Lighting Systems and Bus Shelters for the Beautify Blythe Project. Both products required substantial lead times for manufacturing and delivery. As the grant is required to be completed by June 30, 2024, staff determined the best path forward was to invite proposals for the purchase of these materials separately from the construction documents. Materials could be manufactured while the City solicited bids for construction of the project. Once a contractor for the project is awarded, the materials will be supplied, and the contractor can get to work on the various infrastructure improvements.
On January 3, 2024 proposals were received Technology International Inc., Smart Era Lighting Systems and Horizon Lighting, Inc. for the solar lighting systems. On the same date proposals were received from Andrew Studer's Extreme Iron and LNI Custom Manufacturing, Inc. for -74-
the bus shelters.
After reviewing the proposals received for the Solar Lighting systems, it was determined that the purchase order should be issued to Horizon Lighting, Inc. who demonstrated the ability to meet the project specifications and requirements outlined in the Request for Proposal. After review of the proposals received for the Bus Shelters, it was determined that LNI Custom Manufacturing should be awarded the purchase order as their proposal meets the project specifications and requirements as outlined in the Request for Proposal.

Blythe CITY COUNCIL MEETING
STAFF REPORT
MEETING DATE: February 13, 2024
SUBJECT: Central Garage Staffing
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council fund the position of Purchasing Warehouseman/Safety Officer at the first step of Range 40 of the Mid-Management MOU through June 30, 2024.
FISCAL IMPACT: This action is budget neutral. The Equipment Shop Manager position is vacant after a recent retirement. Salary savings from the vacancy will fund the Purchasing Warehouseman position.
BACKGROUND: In December, the City's Equipment Shop Manager retired. Over the last few years, the City has sent more and more vehicles out for repair vs. repairing in house.
Management has discussed restructuring the Central Garage to include outsourcing vehicle and equipment repair. This retirement provides the City with a good opportunity to do so. However, until a long-term solution is in place, the Garage is short staffed and in need of personnel to assist with inventory, purchasing, parts running and vehicle maintenance scheduling.
Prior to layoffs in 2008/09, the City's Central Garage was staffed with an Equipment Shop Manager, Purchasing Warehouseman, and several mechanics. After layoffs and through attrition, current staffing levels in Central Garage include one mechanic position that is vacant and an Equipment Shop Manager that has been vacant since December.
STAFF REPORT: While management works to restructure the functions of Central Garage, personnel is needed to assist with the daily operation of the Central Garage shop. The City recently recruited several open positions in the Public Works Department. During interviews for these positions, staff identified someone who could assist the City with these needs until a permanent solution is in place. As the Warehouse Position is not funded in the current fiscal year, staff recommends Council fund the Warehouseman/Safety Officer position at Step 1 of Range 40 of the Mid-Management MOU. The Equipment Shop Manager position will remain vacant.

MEETING DATE: February 13, 2024
SUBJECT: Chanslor Place Subdivision Sewer Repairs
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Brittany Roberto, City Attorney
RECOMMENDATION: It is recommended that the Council authorize and direct staff to issue a request for proposals for the design of the Chanslor Place Phase II Sewer Repairs Project. It is further recommended that the Council direct staff to investigate the City's options with respect to the repairs needed for the sanitary sewer system in Phase III of the Chanslor Place subdivision.
FISCAL IMPACT: None.
BACKGROUND: The Chanslor Place subdivision was proposed to be constructed in three phases. Phase I construction was completed in 2005. The plans for Phase II and Phase III were approved by the City in August 2006. Phase II construction began in 2006, but was never completed due to outstanding issues with the sanitary sewer system. There are currently eight undeveloped lots in Phase II. In Phase III, there are currently two undeveloped parcels and 23 undeveloped lots. The City has not issued any building permits for Phase IIl due to the issues with the sanitary sewer system.
STAFF REPORT: The City Engineer prepared an estimate of the costs for the Chanslor Place Phase II Sewer Repairs Project. The Engineer's Estimate is approximately $500,000, which includes roughly $250,000 to repair the sewer system and $250,000 to repave the street after the sewer repairs are made. Staff estimates the cost to design the project would be approximately $75,000. Funding for the proposed project would come from the Sewer Utility Fund. Staff believes repairing the sewer system in Phase II will enable the eight vacant lots to be developed, as well as correct defects that could impact current residents. If Council authorizes and directs staff to move forward with this project, staff will aim to issue the request for proposals for the design of the project within three months. Once staff has selected a proposed design consultant, stail will seek Council authorization for award of an agreement. Once the design work is complete, staff will issue a notice inviting bids for construction of the sewer repairs.
Staff is also seeking Council's direction to investigate the City's options with respect to the Phase III sewer repairs. If such direction is provided, staff will return to Council at a later date for additional direction regarding the Phase III sewer repairs.

MEETING DATE: February 13, 2024
SUBJECT: Transfer of an Armored Vehicle from the Law Enforcement Support Office (LESO)
PRESENTED BY: Garth V. Dale, Chief of Police
PREPARED BY: Garth V. Dale, Chief of Police
RECOMMENDATION: It is recommended Council approve the transfer of a 2013 Oshkosh Corporation Model M-ATV all terrain, a mine-resistant ambush protected (MRAP) vehicle, from the Federal Law Enforcement Support Office (LESO) and authorize the Interim City Manager to execute any documents required for its transfer.
FISCAL IMPACT: $5,000.00 for delivery, upfitting, supplies and a safety inspection from asset forfeiture. There are estimated on-going costs of $2,500 a year for routine maintenance.
BACKGROUND: Currently, the Blythe Police Department has a 2000 Dodge Peacekeeper armored vehicle obtained from the LESO program several years ago that it uses for tactical operations. However, this vehicle is beyond its useful life and should be replaced. Staff has been searching for a vehicle capable of accessing our riverbanks for search and rescues and other law enforcement operations. Staff has also outlined its intent to obtain a newer armored vehicle from LESO in its Military Equipment Use Policy pursuant to AB 481.
Over the last year, staff has been working with LESO to find a replacement vehicle. An MRAP vehicle is now available. Staff has a very limited time to claim this vehicle as it is highly sought after by other law enforcement agencies. This vehicle can travel over very soft sand, in up to four feet of water and has ballistic protection. As such, it can be used for river rescue, provide the Police Department with much needed access to riverbanks, be used in tactical operations and for downed officer rescue. If this vehicle is obtained, the 2000 Dodge Peacekeeper will be transferred back to LESO.
STAFF REPORT: In accordance with Section 12 of Executive Order 14074, a local law enforcement agency must notify its governing body and the local community of its intent to request certain controlled property from Federal sources. The Police Department provided this notice to the Blythe City Council and posted the notice on the City's website on January 16, 2024. The notice is included as Attachment 1 to this report.
Based on the critical need of this vehicle to improve public safety, and the cost savings associated with accepting a vehicle as a LESO transfer, staff recommends accepting the transfer and authorizing the Interim City Manager to execute any documents required for the transfer.
