Save Chuck. Interim City Manager Crecelius provided an update on the City's efforts to "Save Chuck", an upcoming visit to Sacramento to meet with legislators, the Kosmont Presentation and an article released by the Watson Institute related to the partnership between the City and Professor Eason at Brown University.

No public comment. The item was received and filed.

NEW BUSINESS:

Abatement of 226 and 228 S. Main Street- Final Report. Interim City Manager Crecelius reported this is a receive and file item related to the completion of the abatement fforts at 226 & 228 S. Main Street. As Council is fully aware, this property has been a nuisanc or many years, with multiple active codes cases on the property. Numerous fires have furthe deteriorated conditions on site. As staff worked to abate the nuisance, the property sold several times, requiring staff to start the process over after each sale. After a significant amount of time -28-
and effort, the City was prepared to apply for an abatement warrant to clean the property at the end of last year. In anticipation of receiving an abatement warrant from the court, Council awarded an abatement agreement to R&L Watkins at the December Council meeting. In late January, the City Attorney was issued the warrant and R&L Watkins went to work. The work was completed to the satisfaction of the City on February 8th ", well within the 14-days granted by the Court. City staff would like to again commend Leslie Watkins and team at R&L Watkins for their efforts. Their ability to complete these projects within very tight parameters allows the City to continue these abatement projects. This is the third abatement project completed by the City in a little over a year. Staff have identified the next round of projects to continue these abatement efforts.

Councilman Halby said this has been a point of contention for over to years. Good job everybody.

Public Comment. Leslie Jessop-Watkins thanked everyone. This effort was quite something to overcome. We had nine business days to complete with two of them being rain days. We have a lot of people to thank, at City Hall, the Police Department, CR&R and Brickley Environmental.

It was a huge collaborative effort. We look forward to the future potential to continue to clean our city.

The item was received and filed.

Purchase of Bus Shelters and Lighting for the Beautify Blythe Project. Interim City Manager Crecelius stated the City and Palo Verde Valley Transit Agency were awarded $2.9 million in Clean CA grant funds for the Beautify Blythe Project. The project proposes to improve existing conditions at several key city & transit facilities, including placement of twenty-four bus shelters and amenities across three underserved census tracts, a decorative wall and perimeter solar lighting at the Public Works Yard, a restroom at Transit's CNG Fueling Station, landscaping, parking lot improvements and solar lighting at Miller Park, and an outdoor public space, iron fencing, decorative security fencing and solar lighting at the PVVTA Operations Facility and their Main Street Park n' Ride. In addition to the infrastructure improvements, the project includes community engagement, clean up events and ribbon cuttings. To date, clean up events have resulted in the removal of over 120 cubic yards of debris from our community. In solar lighting systems. On the same day, proposals were received from Andrew Studer's Extreme Iron and LNI Custom Manufacturing, Inc. for the bus shelters. After reviewing the proposals received, it was determined that a purchase order should be issued to Horizon Lighting, Inc. and LNI Custom Manufacturing. It is recommended Council authorize staff to issue a purchase order for the Solar Lighting systems to Horizon Lighting, Inc. in an amount not to exceed $128,925.80 and issue a purchase order for Bus Shelters to LNI Custom Manufacturing, Inc. in an amount not to exceed $181,490.38.

No public comment. Councilman Reynolds moved approval of staff's recommendation. The motion was seconded by Vice Mayor Rodriguez with a unanimous aye vote. -29-
Central Garage Staffing. Interim City Manager Crecelius stated over the last few years, the City has sent more vehicles out for repair than repairing in house. Management has discussed restructuring Central Garage to include outsourcing of vehicle and equipment repair. In December, the City's long-time Equipment Shop Manager retired, providing an opportunity to look at restructuring. However, until a long-term solution is in place, the Garage is short staffed and in need of personnel to assist with inventory, purchasing, parts running and vehicle maintenance scheduling. The City recently recruited several open positions in the Public Works Department. During interviews, staff identified someone who could assist the City with these needs until a permanent solution is in place. Staff would like to fill the Purchasing Warehouse position. As this position is not funded in the current budget, staff recommends Council fund the Warehouseman/Safety Officer position at Step 1 of Range 40 of the Mid-Management MOU.

The Equipment Shop Manager position will remain vacant until a long-term plan for the Garage is implemented. Salary savings from the Equipment Shop Manager vacancy will offset the costs of filling the Warehouse position.

No public comment.

Councilman Halby asked who will train this employee.

Councilman Reynolds moved approval of staff's recommendation. The motion was seconded by Councilman Burton with a unanimous aye vote.

Chanslor Place Subdivision Sewer Repairs. Interim City Manager Crecelius stated the Chanslor Place subdivision was proposed to be constructed in three phases. Phase I construction was completed in 2005. The plans for Phase II and Phase III were approved by the City in August 2006. Phase II construction began in 2006 but was never completed due to outstanding issues with the sanitary sewer system. There are eight undeveloped lots in Phase II. In Phase III, there are two undeveloped parcels and 23 undeveloped lots. The City has not issued any building permits for Phase III due to the issues with the sanitary sewer system. The City Engineer prepared an estimate of the costs for the Chanslor Place Phase II Sewer Repairs Project. The Engineer's Estimate is approximately $500,000, which includes roughly $250,000 to repair the sewer system and $250,000 to repave the street after the sewer repairs are made. Staff estimates the cost to design the project would be approximately $75,000. Funding for the proposed project would come from the Sewer Utility Fund. Staff believes repairing the sewer system in Phase II will enable the eight vacant lots to be developed, as well as correct defects that could impact current residents. If Council authorizes and directs staff to move forward with this project, staff will aim to issue the request for proposals for the design of the project within three months. Once staff has selected a proposed design consultant, staff will seek Council authorization for award of an agreement. Once the design work is complete, staff will issue a notice inviting bids for construction of the sewer repairs. Staff is also seeking Council's direction to investigate the City's options with respect to the Phase III sewer repairs. If such direction is provided, staff will return to Council at a later date for additional direction regarding the Phase III sewer repairs.

Therefore, It is recommended that the Council authorize and direct staff to issue a request for proposals for the design of the Chanslor Place Phase II Sewer Repairs Project. It is further recommended that the Council direct staff to investigate the City's options with respect to the repairs needed for the sanitary sewer system in Phase III of the Chanslor Place subdivision. -30-
Councilman Halby asked if after this was done, will we certify the streets and they become City streets? Interim City Manager Crecelius stated we would accept all of the improvements, as would have been done had they been completed to the satisfaction of the City back in the early 2000's.

Councilman Reynolds asked how will not doing the Phase III repair right now affect us later? Interim City Manager Crecelius stated as there are no homes there and as nothing has been built yet; we need to determine if we should do the Phase III improvements ourselves or down the road work with a developer.

A notice of defect will be recorded against every vacant property outlining the building restrictions related to the sewer defaults.

No public comment. Councilman Reynolds moved approval of staff's recommendation and to further investigate the Phase III improvements. The motion was seconded by Vice Mayor Rodriguez with aye votes from DeConinck, Rodriguez, Reynolds and Burton and a no vote from Halby.

Transfer of an Armored Vehicle from the Law Enforcement Support Office. Police Chief Dale stated the Police Department has a 2000 Dodge Peacekeeper armored vehicle obtained from the Federal Law Enforcement Support Office. It's on loan, long term from the Federal Government. We are using it, but it's beyond its useful life and needs to be replaced. We had been searching for a new vehicle from LESO and came across an MRAP vehicle which could also be used for search and rescue operations. This vehicle can also access our riverbanks, which has been an issue for department vehicles. If this vehicle transfer is approved, we will return the Peacekeeper to LESO. The MRAP would also be a long-term transfer, where it is on loan to us. This vehicle is worth between $350,000 and $500,000. We are getting it for the cost of delivery and outfitting. We estimate annual costs at $2,500 for maintenance.

No public comment. Vice Mayor Rodriguez moved approval of the vehicle transfer. The motion was seconded by Councilman Halby with a unanimous aye vote.

ORAL REPORTS: None
PUBLIC COMMENT:

Tom Daly, 2591 Fairway Dr. introduced Commissioner Elizabeth Tucker. She is currently a commissioner at the Indio Court and is now running for Riverside County Judge. She is here today to present her platform and seek your support. I have known her for over 20 years working with her as both a District Attorney and Public Defender. Her reputation is well known, as hardworking and professional.

Elizabeth Tucker stated I have served the courts for the past 5 years as a Superior Court Commissioner. I have experience presiding over civil, criminal, juvenile justice, juvenile dependency, probate, and traffic. In addition to my experience on the bench as Commissioner I was a Riverside County Deputy District Attorney for 23 years. I have vast courtroom experience.

I have been a resident of the Coachella Valley since 1995 with a strong commitment to giving back to my community. One of my platforms is being fair to everybody. One of the motivating reasons for this is because what is going on in the eastern part of our county, Blythe and Needles courts is not ok. We have a Judge and Commissioner commuting from outside of the area. Our Governor is not appointing people from the eastern part of the County. I can't promise to fix all the issues at the Blythe Court, but I will promise to care about Blythe. -31-
Councilman Reynolds thanked her for coming. The court in Blythe is only open three days a week and I hope Tom has convinced you to get on the bandwagon and support it being open 5 days a week.

Mrs. Tucker stated we have talked about it, and as a Judge I will have a bigger voice. My plan would be to start with juvenile. Getting Blythe services in the juvenile area would be a really good start and give Blythe another day.

Jim Sergeant of 2204 Riviera Dr. stated I am the President of the Blythe Bass Club. We would like to build a partnership with the City. We would like to have a clean our river day with the Bass Club providing the boats, work with CR&R on bins and have the Bass Club provide lunch.

We have thought about a youth fishing day at Quechan Park. The purpose for me being here is to introduce myself. If there is anything you can suggest youth wise or river clean ups, we are open to suggestions.

Esai Sanchez of 233 S. 4' street is here as a staff member of Escuela De La Raza, an outreach funded program from the Governor's Otticer. We are here to propose a change in stop signs that have the potential to cause an accident. At the stop sign at the corner of S. 5th Street and Dekema, the fence and sign block the view for oncoming traffic. Our proposed solution is moving the fence. The second stop sign is on the corner of E. Donlon and S. Th Street. The stop sign is far back and the view from both sides is blocked. The solution is extending the sidewalk and stop sign, allowing vehicles line of sight.

Niko Lopez of 481 N. Eucalyptus Ave, Apt. 4E. stated 1 am here today to discuss issues we are having with stop signs. This one is on East Chanslorway and Highway 95. A brick wall is obstructing the view. The solution is to convert the stop sign into a signal light.

ADJOURN: The City Council meeting was adjourned at 6:40pm.

MEETING DATE: March 12, 2024
SUBJECT: Amendment Number One to the Mid-Management MOU PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended that the Council adopt the following Resolution:

RESOLUTION NO. 2024-008. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BLYTHE, CALIFORNIA,

APPROVING AMENDMENT NUMBER ONE TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF BLYTHE AND THE EMPLOYEES REPRESENTED BY THE MID-MANAGEMENT UNIT.

FISCAL IMPACT: None.

BACKGROUND: The MOU between the City and the Mid-Management Unit ("Unit") expired on June 30, 2023. Unit representatives and the City's negotiator, Interim City Manager Crecelius negotiated the terms of a successor MOU. That MOU was adopted by the Council on February 13, 2024.

After MOU adoption, staff realized there were some clean up items that were inadvertently left off of the Final Deal Points Memo presented to the Unit and Council for adoption. Staff would like to correct this error with the adoption of Amendment Number One to the Mid-Management Unit's MOU. These changes will be retroactive to July 1, 2023.

STAFF REPORT: the City and the Unit have met and conferred in accordance with the Meyers-Milias-Brown Act and California Government Code section 3500 to discuss amending the pay ranges for the Wastewater Treatment Plant Supervisor, Water Treatment Plant/Water Supervisor, Chief Wastewater Treatment Plant Operator, and Chief Water Treatment Plant Operator classifications, and removing the Lead Airport Operations/Maintenance classification as set forth in Article 3, Section 1 of the MOU and have agreed upon such changes. The City and the Unit have memorialized the agreement in Amendment Number One to the Memorandum of Understanding, which is attached hereto as Exhibit "A"

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: March 12, 2024
SUBJECT: Save Chuck
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council receive and file a report on Save Chuck.

FISCAL IMPACT: Impacts to the City of Blythe from the closure of Chuckawalla Valley State Prison include a revenue decline of $2.9 million.

BACKGROUND: In December, the Secretary of the California Department of Corrections and Rehabilitation (CDCR) announced plans to close Chuckawalla Valley State Prison in Blythe by March 2025. The City quickly sprang into action to rally against this closure. The City began contacting State and Federal legislators and held meetings with elected officials, the CDCR Secretary, CVSP Close Down Manager and other CDCR staff members. The City submitted over 40 Public Records requests to the State seeking information related to how CVSP was selected for closure over other older and more costlier prisons in the State's system. Several of the City's requests for information were denied.

The City also went to work on solutions and proposed a swap of CVSP in Blythe for the California Rehabilitation Center (CRC) in Norco. This is a win-win for the Cities and State as a more cost-effective prison will be shuttered in a City that has far more resources to absorb job losses than Blythe. The City of Norco has petitioned for the closure of CRC for years. CRC has been on the State's chopping block since 2012. The State's own Legislative Analyst's report as well as other independent reports find that CRC should be the next CDCR institution to close due to a number of issues including cost to operate and safety.

In January, the City hired Tripeppi Smith for PR Services and the Gonsalves & Son Firm for lobbying efforts in the State Capitol. The City has garnered support from Assemblyman Garcia, State Senators Steve Padilla and Kelly Seyarto, The Riverside County Board of Supervisors, CVAG, fellow Cities in Riverside County, Riverside, San Bernardino and Orange County Sheriff's, the Riverside County District Attorney, PVID, Cal Cities, Crime Victims United, Crime Survivors, and others.

STAFF REPORT: Staff will provide an oral report on the efforts being made to "Save Chuck".

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: March 12, 2024
SUBJECT: Fiscal Year 2023-2024 Budget Amendment and Mid-Year Financial Report PRESENTED BY: Christa Elms, Director of Finance
PREPARED BY: Christa Elms, Director of Finance
RECOMMENDATION:

1. Receive and file mid-year Financial Report of fiscal year 2023-2024

2. Adopt Resolution 2024-007 amending fiscal year 2023-2024 budget as referenced in Exhibit A of said resolution.

FISCAL IMPACT: The City's Operating and Capital Budget provides the funding and expenditure plan for all funds. The fiscal impacts of the proposed budget amendments are identified in Exhibit A.

BACKGROUND: It is considered best practice to review the annual budget on an ongoing basis. Since the fiscal year 2023-2024 budget was adopted on June 13, 2023, staff have continued to monitor the performance of revenues and expenditures throughout the year.

Through this regular review, staff has identified a need to amend some of the existing revenues and appropriations to allow for changes.

STAFF REPORT: Based on revenue and expenditure review through mid-year, December 31, 2024, the following budget amendments are being proposed.

General Fund.

Revenue: Revenue estimates are developed prior to the start of the fiscal year based on historical data, trends, and actual receipts. Tax revenues make up the largest part of the General fund's revenue, 75% of the City's revenue is derived from the City's sales tax, motor vehicle in-lieu tax ("VLF"), property tax, and transient occupancy tax ("TOT"). Sales tax alone makes up 40% of General fund revenues. Mid-year review of actuals shows these tax revenues are performing close to budget projection with no notable variances. General fund revenues tend to trend below 50% at mid-year primarily due to the timing of actual receipts of the City's General fund major revenues, the average at mid-year is approximately 30%. In addition, other revenue sources are trending as expected with no noteworthy variances, actual receipts at mid-year are 46% of budget. Based on mid-year review staff is recommending amendments to revenue estimates as identified in Exhibit A attached. Although the amendment is not intended to correct all anticipated variances, it will better align the year end budget to actuals while providing additional resources. The amendments will account for increases in the General fund for grants awarded post budget adoption. The amended General fund revenue budget is proposed at $14,678,300 (excluding transfers), net increase of $65,100 as indicated in Exhibit A. -64-
Expenditure: Although not all expenditures follow a straight-line spending pattern, operating expenditures should track close to 50% of budget at mid-year, general government typically trends above 50% at mid-year due to timing of lump-sum pension liability and debt payments.

General fund expenditures through December totaled $8.80 million, or 62% of the adopted budget. Most departments are operating at or below 50% of their approved budget. As indicated in Exhibit A, staff is proposing amendments to appropriations in the General fund. Amendments include appropriations for expenditures that tie to grant funds, City staff and service agreement ' amendments that were awarded or approved post budget adoption. The amended General fund expenditure budget is proposed at $13,214,000 (excluding transfers), net increase of $132,100.

Enterprise Funds.

No proposed amendments to Water or Sewer Enterprise funds at mid-year review.

Other Funds.

The following provides a summary of proposed budget amendments to other funds. A complete list of these amendments is identified in Exhibit A to the Resolution:

Measure A and Capital Street Project Funds: Decrease in operating transfers and appropriation of street project expenditures. 6th Ave improvements delayed to fiscal year 2024-2025.

Recreation Fund: Increase revenues and appropriation for salary and supply expenditures per school program agreement with PVUSD.

Police Vehicle Impound Fund: Increase appropriations for supply expenditures offset by recognized revenues.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: March 12, 2024
SUBJECT: New Water Reservoir at Palo Verde College Project PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council:

Award the agreement for the New Water Reservoir at Palo Verde College Project to AZCA Drilling & Pump, Inc. (AZCA) as the lowest responsible bidder with a bid in the amount of $978,400.

2. Approve Change Order No. 1 in the amount of $97,600.

3. Authorize the Interim City Manager to execute Agreement No. 2024-010 A in the amount of $1,076,000 with AZCA once all bonds and contract documents are approved as to form by the Interim City Manager and City Attorney.

4. Authorize an additional $108,000 for contingencies, engineering, and project inspection.

5. Establish a project budget not to exceed $1,184,000.

6. Authorize the Interim City Manager to approve and execute change orders and approve expenditures for engineering and project inspection services during construction within the approved project budget.

FISCAL IMPACT: $1,184,000 from State and Federal grant sources and the City's Water Utility fund.

BACKGROUND: The College Tank is located at Palo Verde College and is part of the City's Mesa Ranch Water System. This 500,000-gallon tank was installed over 20 years ago when the College relocated to the Mesa. The College created new demand on the water system for water and fire flow protection resulting in the construction of this reservoir. The tank has been repaired several times over the years and is leaking. To maintain water utility operations in this area, the tank is considered to have met its useful life and should be replaced as soon as possible.

In 2021, The Holt Group was tasked with preparing project design documents for the replacement of the bolted steel water reservoir at the College. Design work was completed and the project was put out to bid in January 2022.

At the same time and based on the Engineer's Estimate of probable cost, staff applied for the FY 2022 EDI Community Project Funding Grant in the amount of $500,000. With support from Congressman Dr. Raul Ruiz, the City was successful in an award of $500,000 for this project. In February 2022, bids were received for the project with the low bid being over $1 million dollars.

Without adequate funding for the project, Council rejected the bids and staff went back to the drawing board. Changes were made to the bidding documents to streamline construction to gain more favorable bid prices. Staff also submitted an Urgent Drinking Water Needs Grant to the -70-
State Water Resources Control Board for $500,000 to close the funding gap. The City was successful in obtaining this grant.

In late 2022, staff re-issued a Notice Inviting Bids for the New Water Reservoir at Palo Verde College Project. At the bid opening on January 10, 2023, the City received three bids:

AZCA Drilling and Pump, Inc. $978,400
Cora Constructors, Inc. $1,110,450
Canyon Springs $1,280,706
After the bid opening, AZCA Drilling and Pump, Inc. was determined to be the lowest responsive and responsible bidder. However, as staff continued to work to obtain project funding, finalize grant agreements from both grant funding sources, which were required before project costs could be incurred, obtain design approval from the State Water Resources Control Board, and finalize environmental documents, an agreement for the project was not awarded.

STAFF REPORT: As of March 1, 2024, all items are in place to allow the City to proceed with the project. The New Reservoir at Palo Verde College Project consists of site prep for the installation and connection of a new 500,000-gallon manufactured water reservoir to the City's Mesa Ranch Water System. The project documents and specifications prepared for the project included all work necessary for the construction and placement of the tank.

As both the State and Federal grants have strict timelines for construction, and the previous bids received comply with the project requirements and were never rejected, staff recommends awarding the bid to AZCA Drilling and Pump, Inc. This will save time on re-bidding the project for a third time.

In December 2023, AZCA submitted a proposed change order in the amount of $97,600, noting that the original bids were valid for 120 days and that since the time of receipt of bids, both prevailing wage rates and materials prices have increased. The change order increases AZCA's price to $1,076,000. With the price increase, AZCA still remains the low bidder. Due the considerable amount of time that has passed since the bid opening in January 2023 and the increases in prevailing wage rates and materials prices, staff believes the change order is reasonable. Staff also believes that allowing the change order due to such increases would not give AZCA an unfair advantage.

There is a 12-week lead time on manufacturing the 500,000-gallon water reservoir. Once the tank is delivered, construction is expected to take another 4-6 weeks. With the City required to have the project completed by November 30, 2024 to receive reimbursement from the State grant funding, there is no time to re-bid the project, as it would take another 2-3 months to solicit new bids. Therefore, it is recommended that Council award the agreement to AZCA as the lowest responsible bidder, approved Change Order No. 1, authorize the Interim City Manager to execute Agreement No. 2024-010 A in the amount of $1,076,000 with AZCA Drilling & Pump, Inc. once all bonds and contract documents have been approved as to form by the Interim City Manager and City Attorney, authorize an additional $108,000 for contingencies, project inspection and engineering services, establish a project budget not to exceed $1,184,000, and authorize the Interim City Manager to approve and execute changes orders and approve expenditures for engineering and project inspection services during construction within the approved project budget.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: March 12, 2024
SUBJECT: Demolition and Abatement of 125 W. Murphy Street- Part 1 EVCS Power Relocation
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council:

1. Authorize the Interim City Manager to execute Agreement No. 2024-012 A in the amount of $17,975.00 with Johnson Electric once all bonds and contract documents are approved as to form by the Interim City Manager and City Attorney.

Authorize an additional $2,000 for contingencies.

3. Establish a project budget not to exceed $19,975.

4. Authorize the Interim City Manager to approve and execute change orders during construction within the approved project budget.

FISCAL IMPACT: $80,000 was allocated in the FY 2023/24 budget in the Building Fund for the demolition and abatement of 125 W. Murphy Street. An additional $80,000 was budgeted to expand the parking lot once the building located at 125 W. Murphy Street is removed.

BACKGROUND: For years staff has wanted to demolish the vacant building located at 125 W.

Murphy Street to expand the parking lot at City Hall. In doing so, this would clean up a blighted structure and allow for more public parking for those with business in City Hall. With staff parking and City vehicles in the parking lot daily, there is limited public parking available.

There are two Electric Vehicle Charging stalls in the parking lot at City Hall. When they were installed, the power was supplied from 125 W. Murphy Street. Before the site can be demolished, the power supply will need to be relocated to City Hall. Once the power supply is relocated, subsequent bidding documents will be released for the demotion and abatement and parking lot expansion.

STAFF REPORT: In February, staff released a Notice Inviting Bids for the Demolition and Abatement at 125 W. Murphy Street Part 1 EVCS Power Relocation. Sealed bids were received until 2:00pm on March 5, 2024. One bid was received from Johnson Electric in the amount of $17,975.00.

City staff reviewed the bid submitted by Johnson and Electric and determined it was responsive and responsible. Johnson Electric has performed electrical work for the city for years. Their contractor's license is current and in good standing with the State of California. Therefore, it is recommended Council authorize the Interim City Manager to execute Agreement No. 2024-012 -72-
A in the amount of $17,975.00 with Johnson Electric once all bonds and contract documents are approved as to form by the Interim City Manager and City Attorney, authorize an additional $2,000 for contingencies, establish a project budget not to exceed $19,975 and authorize the Interim City Manager to approve and execute change orders during construction within the approved project budget.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: March 12, 2024
SUBJECT: Ordinance Establishing 72-Hour Parking Limit
PRESENTED BY: Keith Walnoha, Lieutenant
PREPARED BY: Keith Walnoha, Lieutenant, and Brittany Roberto, City Attorney RECOMMENDATION: It is recommended that the City Council introduce Ordinance No. 929- 24:

ORDINANCE NO. 929-24 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BLYTHE, CALIFORNIA, ADDING A NEW SECTION 10.08.070 (PARKING FOR MORE THAN 72 HOURS PROHIBITED; REMOVAL) TO CHAPTER 10.08 (PARKING REGULATIONS) OF TITLE 10 (VEHICLES AND TRAFFIC OF THE BLYTHE MUNICIPAL

CODE AND FINDING THE ORDINANCE IS EXEMPT FROM ENVIRONMENTAL REVIEW UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO CEQA GUIDELINES SECTION 15061(B)(3) (COMMON

SENSE EXEMPTION)
FISCAL IMPACT: None.

BACKGROUND: City streets are frequently used to park or store vehicles for extended periods of time. Vehicles parked or stored on City streets for extended periods of time raises public safety concerns, including obstruction of access to rights-of-way, reduced site distance, and reduced visibility, all of which have a detrimental effect on the public health, safety, welfare, and quality of life in the City. Vehicles left parked or stored on City streets for extended periods of time also create visual blight.

California Vehicle Code section 22651 outlines the circumstances in which a peace officer or a regularly employed and salaried employee who is engaged in directing traffic or enforcing parking laws and regulations of a city in which a vehicle is located may remove a vehicle located within the territorial limits in which the officer or employee may act. Pursuant to subsection (k) of California Vehicle Code section 22651, removal is authorized if a vehicle is parked or left standing for 72 or more consecutive hours in violation of a local ordinance authorizing removal.

STAFF REPORT: The Blythe Municipal Code currently does not have any restrictions regarding how long a vehicle can be parked on a City street. To address the health, safety, and quality of life impacts associated with extended vehicle parking and/or storage on City streets, staff prepared the attached proposed ordinance.

The proposed ordinance prohibits parking, leaving standing, or storing any vehicle upon any highway, street or alley for 72 or more consecutive hours. The proposed ordinance provides that a vehicle that has been parked or left standing in the same location or parking spot for 72 consecutive hours must be moved or relocated to a different location or parking spot that is at least one-half of -74-
a mile, or 2,640 feet, from its current location and may not return to the same location or parking spot for at least 48 hours after its departure. If a vehicle is not relocated to a different location or parking spot that is at least one-half of a mile from its current location or returns to the location or spot where it was previously parked or left standing within 48 hours, the vehicle will be subject to removal.

Once the proposed ordinance goes into effect, officers will place a warning notice on the vehicle upon initial contact advising that the vehicle will be towed if it is not moved to a location at least one-half mile from the current location within 72 hours or if it returns to the same location or parking spot within 48 hours.

To preserve the safety and attractiveness of the City's streets, staff recommends that the City Council introduce Ordinance No. 929-24.
