Conditional Use Permit 2502-001 - River Posse Storage. Interim City Manager Crecelius stated J&J Tire Services applied for a Conditional Use Permit to construct the River Posse Storage facility at 9162 E. Hobsonway. The site has a General Commercial zoning designation. Automobile storage facilities are permitted in the General Commercial Zone with a Conditional Use Permit. The site is presently vacant and was once a fuel station. Notice of application for the subject Conditional Use Permit and adoption of a Notice of Exemption for the project was published in the Palo Verde Times and sent to surrounding property owners on June 25, 2025. No comments were received regarding the proposed project/CUP. As the Lead Agency under the California Environmental Quality Act, the City has undertaken preliminary review and determined that the proposed development qualifies for a Class 32 Infill Development Categorical Exemption pursuant to CEQA Guidelines Section 15332. The Categorical Exemption report describes the proposed project and assesses each of the criteria required to qualify for a Class 32 categorical exemption. The proposed project is not subject to any of the exceptions for exemption under Section 15300.2 of the CEQA Guidelines. The location of the project is predominantly urban and not considered a sensitive environment; therefore, the project will not result in any significant impacts. The cumulative impact of this project, and the approval of other projects like it in the vicinity, is not expected to have any significant environmental impact. The project is not located along any state designated scenic highway or within any designated hazardous waste site. Staff does not expect any significant impacts or unusual circumstances related to the approval and construction of this project. Therefore, the proposed project is categorically exempt from CEQA under CEQA Guidelines Section 15332, Infill Exemption. The Notice of Exemption will be filed with the County Clerk following City Council approval. Before final approval of the Conditional Use Permit, the City Council shall make the following findings: that the proposed location of the Conditional use is in accord with the objectives of this title and the purpose of the zone in which the site is located; that the proposed location in which the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity; and A Conditional Use Permit issued under the terms of Blythe Municipal Code Title 17.68 shall lapse if no improvements have been made, and the holder of the permit shall not have utilized it within one year from the date upon which such a permit shall have been granted. Therefore, subsequent to the public hearing, it is recommended that Council Adopt Resolution No. 2025-020 approving a Notice of Exemption for Conditional Use Permit 2502-001 for the development of River Posse Storage and Resolution No. 2025-021 -56-

Palo Verde Hospital Ad Hoc Committee Update. Vice Mayor Rodriguez provided an update.

Public Comment. Katchya Currier said our hospital staff are amazing and show up for our community without open communication, honesty or transparency. She asked about hospital payments for Medical and Medicare. She asked if safety measures were put into place after hospital security was removed. As an ER without a surgical team are we still supporting three layers of executive staff including a CEO, COO, CNO and Medical Director? I challenge you to ask about the SCORE survey.

The item was received and filed.

Acceptance of the Cannabis Tax Fund Grant and Adoption of a Resolution Amending the Schedule of Positions to Add a Police Sergeant - Retired Annuitant Position.

Police Chief Dale stated the California Highway Patrol Cannabis Tax Fund Grant Program is intended to assist allied agencies in education, prevention and enforcement of laws relating to driving under the influence of alcohol and other drugs including cannabis and cannabis products.

The goal of the grant is to reduce and mitigate the impacts of impaired driving. The Blythe Police Department submitted a grant for the period of July 1, 2025 through June 30, 2026 to fund DUI saturation patrol and DUI checkpoints. The California Highway Patrol has conditionally approved a grant award of $211,582 to be used toward equipment, salaries and training related to DUI enforcement. Due to deployment needs, a part time employee should be utilized for this program. It is proposed that the City hire a retired Blythe Police Department as an extra help retired annuitant. The retired annuitant has years of experience in traffic and DUI enforcement.

Staff recommends Council adopt Resolution No. 2025-018 authorizing the Interim City Manager to accept and expend grant funds provided by the California Highway Patrol Cannabis Tax Fund -57-
and Resolution No. 2025-022 approving a revised Schedule of Authorized Positions to include a Police Sergeant- Retired Annuitant Position.

Request by E Clampus Vitus for the Exclusive Use of Quechan Park, Including Overnight Camping, October 9-12, 2025 at No Cost, and to Place a Plaque in Quechan Park to Commemorate the Bradshaw Ferry and Bradshaw Trail. Interim City Manager Crecelius stated staff received a request from Kati Cusick who is working with E Clampus Vitus (ECV) who would like to hold an event in Blythe in October. They would like to place a monument at a historical site. They are a benevolent organization who likes to recognize historically significant sites while having a good time. They proposed several locations for a historical monument. They were told property owner permission would be necessary. They would like to use Quechan Park exclusively from October 9-12t '. This would include camping. My only concern with exclusive use is that the City sells annual passes to Quechan Park for use of the Boat Launch. This year we had a Summer Special, and the pass is valid through October 31, 2025. I would like to keep park access open to those with annual passes. At this time of the season, I don't anticipate a lot of traffic, but don't want any issues from pass holders if they are unable to launch their boat after purchasing a pass. ECV is self-sufficient, providing their own security, power and restroom facilities. They have since provided the City with an MOU for the use, which is under review by the City Attorney. If you wish to allow them free use of the park, with overnight camping, we will bring a Resolution to you in September as overnight camping is not currently allowed. The Resolution would state Council resolves to give them permission for that use. Time is of the essence, as they need to plan this event, so I put this item on today along with the Study Session. They have decided to put the monument at Quechan to memorialize the Bradshaw Trail and Bradshaw Ferry.

They thought Quechan would be a good place as the Ferry passed by Quechan Park. I asked for a rendering and location. Today a photo of a standard monument was received.

I would ask for final approval of plaque wording. I ask for direction to allow ECV to -59-
work with Public Works on the monument's placement in Quechan Park. They may also need to work with Development Services if permits are required. Staff also seeks direction to execute the agreement once reviewed and approved by the City Attorney.

Discussion was had related to exclusive use vs. allowing those with annual passes to use the park during this event. Council wished to allow access to season pass holders.

Interim City Manager Crecelius stated in one email the group stated they would donate up to $1,500 to a charity of our choice. Direction was provided to split any donation between the Rec-N-Crew and PAL.

Interim City Manager Crecelius stated they will also be required to submit a Park Use Permit and provide insurance.

No public comment. Council Member Burton moved approval to authorize the Interim City Manager to execute an MOU for use of the park and work with Public Works on placement of a monument. The motion was seconded by Council Member Spraggins with a unanimous aye vote.

ADJOURN: The City Council meeting was adjourned at 2:48pm.

TORIA'S TAST BUT

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: August 26, 2025
SUBJECT: Agreement between City and Tripepi, Smith & Associates for Communication Support Services
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council authorize the Interim City Manager to execute Agreement No. 2025-049 A with Tripepi Smith & Associates, Inc. for continued communication support services in an amount not to exceed $150,000 in such final form as approved by the City Attorney.

FISCAL IMPACT: Up to $150,000 over the term of the three-year agreement.

BACKGROUND: In response to the California Department of Corrections announcing the closure of Chuckawalla Valley State Prison in December 2022, the City hired a lobbying firm and Tripepi, Smith & Associates, Inc. ("Tripepi Smith") for communications and marketing services. Tripepi Smith created the Save Chuck campaign and website, hosted media events, prepared and distributed Press Releases and Op Eds related to the prison closure along with videos about the impacts of the closure, shared testimonials from residents and assisted with building a coalition of supporters for the Save Chuck campaign. When it became evident that the City was unsuccessful in its fight to Save Chuck, the services were redirected to inform the community about other important City issues, projects and events. Tripepi Smith has been providing communications and marketing services for the City since January of 2023.

Tripepi Smith electronically distributes a bi-monthly newsletter to over 4,000 residents. The newsletter includes information about City projects, updates on new developments and the promotion of various programs and services offered by the City and partner agencies. This has been an effective way for the City to communicate with the community and a fast and easy way. for residents to stay informed.

Prior to the engagement with Tripepi Smith, the City was not effectively distributing information to the public. These services have been a great tool to share positive information about the City, available to residents as well as those thinking about moving to; or developing a new business in, Blythe.

STAFF REPORT: With the current agreement for services expiring at the end of September, staff requested a multi-year proposal from Tripepi Smith for general communication support services. The proposal reflects a continuation of the previous scope: three weekly social media posts on several platforms, bi-monthly newsletter along with project management and meetings with staff. Optional work includes Press Releases and Op Ed Articles on an as needed basis.

The proposal includes a cost of $3,545 per month or $42,540 per year with an annual adjustment of CPI or 5%, whichever is higher. Staff is requesting for a maximum compensation not to -75-
exceed $150,000 over the term of the three-year agreement. This would provide staff with a small budget to commission optional work was needed. Tripepi Smith will charge the City for optional work on a time and materials basis. Such work will only be performed with prior written authorization from the City.

Under the current agreement, the City has issued Press Releases related to the Chuckwalla monument designation, the Beautify Blythe Project, the removal of the City's Financial High- Risk Designation and the fiscal challenges facing Palo Verde Hospital.

The City has been operating under annual agreements with Tripepi Smith. This year, staff requested a multi-year proposal for services. A three-year agreement will save time and allow the City to lock in current rates, subject to an annual adjustment as outlined above, for an extended period. Although the agreement is for a term of three years, the City can terminate the agreement at any time, with 30 days' written notice.

Therefore, it is recommended the Council authorize the Interm City Manager to execute Agreement No. 2025-049 A with Tripepi Smith & Associates, Inc. for continued communication support services in an amount not to exceed $150,000, in such final form as approved by the City Attorney.

COVER LETTER
Thank you for the opportunity to continue supporting the City of Blythe with its outreach and communication efforts. It has been a pleasure working with you and your Council, and we're excited about the prospect of continuing our partnership.

This proposal reflects a renewal of our previous scope, maintaining access to the full range of Tripepi Smith's capabilities as needed.

Whether it's graphic design, video production, writing, social media or strategy, we are able to tell a complete story across platforms-all from within one team. That means the City of Blythe continues to benefit from a streamlined partnership with a single, integrated communications provider.

We're honored to be considered for another term and look forward to helping the City of Blythe serve its residents, businesses, visitors, and community partners.

Authorization
I affirm that I have the legal authorization to bind Tripepi Smith into agreements with the City of Blythe and to make the statements below on behalf of the firm. This proposal is valid for 60 days from the date of submission.

Axioms We Live By
Introduction
In our work with over 200 local government agencies on external communications since our incorporation in 2002, we have identified many patterns, observations and insights. As a result we have developed some axioms (AKA sayings or mottos) when it comes to thinking about external-facing communications. These are just a few that we find universally true.

Content X Distribution = Impact
The audience must see your content to be impacted by it.

CONTENT
Tripepi Smith was born in the digital era. We take digital seriously and recognize how critical it is to not only develop great visuals and messaging, but to ensure the audiences we want to reach actually see that content.
"Content x Distribution = IMPACT" is how we illustrate the point: What good is content if you aren't properly promoting, distributing or sharing it? On the other hand, what good is distribution if the content fails to engage your audience positively? We use this principle to guide a comprehensive distribution strategy that ensures we reach our target audiences.

Single Source Communications
In this age of smartphones and voice-activated virtual assistants, we are used to being able to access news and information at our fingertips. When your community cannot easily find information - such as a controversial policy decision, a new housing development or a political scandal - they may resort to finding "the facts" on their own. This is especially true for crisis communications: the longer you wait to address the crisis, the more time you are giving to others to fill that void with their own research and/or opinions.

So, we strive to get your information out there first, even if it is a "holding message" such as "we are aware of the situation and will use our official channels to share more info soon." By publishing information on your agency's website or some other centralized location, you, your agency leadership and your supporters will be able to easily debunk misinformation with verifiable facts and talking points. 3%

The 3% includes local government professionals like you and consultants like us-the select few who wake up daily thinking about the complexities facing public policy and municipal management. We have our own language in local government: terms, phrases and especially acronyms. Most of the population may have little exposure to or interest in local government. They just want their utilities to work, no potholes, low crime and other securities provided by their local governments that enable a high quality of life.

So, when we speak with the 97% through public outreach, we ensure our language is accessible and understandable. This mitigates any risk of alienating them; moreover, it enables an ability to build relationships and engender trust.

Other Cost Information
Tripepi Smith has related service fees that may come up during our engagement that we want to tell you about.

Annual Increase
Tripepi Smith will increase the hourly rates and retainer fees for all resources by 5% or the national CPI index-whichever is higher-each year on the anniversary of the contract, starting on the first anniversary of any contract when the contract duration is longer than one year. Otherwise, new rates will be negotiated with each new contract.

Retainer Discount
When a client's retainer exceeds $7,500 per month, they gain access to our reduced retainer rates.

Travel Costs
Travel costs must be pre-authorized and then will be reimbursed by the client for any requested travel to complete a requested scope of work. Travel costs may include airfare, lodging, car rentals and gas.

Additionally, when client work requires that we be onsite, we will invoice for a resource's travel time at 50% of the resource's hourly rate.

Equipment Costs
Tripepi Smith offers some services that require equipment, such as drone operations and video production. As such, in those cases, the following rates apply:

Half Day (Under 4 Hours) Full Day (4+ Hours)
Video $450 $650
Drone $550 - Flat Fee
Please note that A/ equipment fees are based on the amount and type of equipment required, with pricing tailored to the specifics of each event.

Music and Video Licensing
Sometimes, the client will want Tripepi Smith to apply music or use stock imagery/video while producing video. In these cases, we will need to apply licensing fees of approximately $100 per song and $200 if we use stock video imagery. This will provide a license for the use of the music and video footage to Tripepi Smith and its clients.

The defense obligation provided for hereunder shall apply without any advance showing of negligence or wrongdoing by Consultant, its employees, and/or authorized subcontractors, but shall be required whenever any claim, action, complaint, or suit asserts as its basis the negligence, errors, omissions or misconduct of Consultant, its employees, and/or authorized subcontractors, and/or whenever any claim, action, complaint or suit asserts liability against the City, its elected officials, officers, agents and employees based upon the work performed by Consultant, its employees, and/or authorized subcontractors under this Agreement, whether or not Consultant, its employees, and/or authorized subcontractors are specifically named or otherwise asserted to be liable. Notwithstanding the foregoing, Consultant shall not be liable for the defense or indemnification of the City for claims, actions, complaints or suits arising out of the sole active negligence or willful misconduct of the City. CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT

BLISHED
MEETING DATE: August 26, 2025
SUBJECT: Ratification of Agreement for Abatement Services with R&L Watkins, Inc. for the Emergency Abatement at 316 W. Hobsonway
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council ratify the Agreement for Abatement Services with R&L Watkins, Inc. for the emergency abatement at 316 W. Hobsonway.

FISCAL IMPACT: $90,000 in General Funds allocated to Building Abatement.

BACKGROUND: Chapter 8.28 of the Blythe Municipal Code (BMC) sets forth the guidelines and procedures relating to the abatement of public nuisances. Generally, the procedure consists of providing notice to the property owner of the nuisance conditions and an opportunity to correct the conditions, conducting a hearing if the owner fails to correct the nuisance conditions, providing the owner an opportunity to abate the nuisance conditions following the hearing, and then obtaining a warrant from the Court and performing the abatement work through a contractor if the owner fails to abate the nuisance conditions following the hearing.

Pursuant to Section 8.28.190 of the BMC, whenever the City Manager determines that a public nuisance constitutes an immediate hazard, threat of harm or danger to persons or property, the City Manager may immediately cause the summary abatement of such public nuisance in such manner as the City Manager determines is reasonably required. Pursuant to subsection (c) of Section 8.28.190 of the BMC, any abatement pursuant to Section 8.28.190 shall be limited to the actions necessary to neutralize the immediate hazard, threat or danger only.

Pursuant to Section 2.65.100 of the BMC, the City Manager is authorized to make emergency purchases and execute contracts necessary in connection with emergency purchases. In the event an emergency purchase exceeds the City Manager's contract authority, staff is required to submit the purchase order and/or contract to the City Council for ratification at its next properly noticed meeting.

The building located at 316 W. Hobsonway has been abandoned for several years, creating a public nuisance. On July 14, 2025, a fire occurred at 316 W. Hobsonway, partially destroying the building and leaving unstable walls. Following the fire, on July 14, 2025, the north wall of the building fell onto the sidewalk and partially into the street. It was determined the remaining walls were unstable and were at risk of collapsing. This constituted an immediate threat of harm to persons or property.

Public Works crews worked diligently to remove the debris from the public right-of-way. On July 15, the Interim City Manager authorized the summary abatement of the harmful conditions. It was determined the following work was necessary to abate the harmful -108-
conditions:
• Haul away hazardous burned debris
• Removal of unstable east and center walls while holding traction to prevent collapse. • Removal and preservation of metal sign
• Breaking of concrete wall and footings, removal of metal piping and small amounts of rebar
• Hauling and disposing of concrete and brick debris
Removal of debris on site
• Water down pad
• Disposal of brick and concrete waste from Public Works yard from initial wall failure.

STAFF REPORT: Staff obtained a quote from R&L Watkins for the emergency abatement work. R&L Watkins commenced the emergency abatement work on July 16, 2025. Pursuant to the authority granted in Section 2.65.100 of the BMC, the Interim City Manager executed the Abatement Services Agreement, which provided for payment of a flat fee of $90,000 for the emergency abatement work.

As outlined above, because the Abatement Services Agreement exceeded the Interim City Manager's contract authority, staff is required to submit the Agreement to the City Council for ratification.

Therefore, it is recommended Council ratify the Agreement for Abatement Services with R&L Watkins, Inc. for the emergency abatement at 316 W. Hobsonway.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: August 26, 2025
SUBJECT: Palo Verde Hospital Ad Hoc Committee Update
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council receive and file a summary report from the Hospital Ad Hoc Committee.

FISCAL IMPACT: None
BACKGROUND: Earlier this year, the City began receiving information from concerned citizens related to the financial state of the Palo Verde Healthcare District which operates Palo Verde Hospital. In February, the City contacted Riverside County Supervisor V. Manual Perez's Office offering the City's assistance. At the same time, the City requested assistance in identifying the oversight body for the Palo Verde Healthcare District's Board of Directors.

After learning the hospital had shuttered operations except for the Emergency Room, Laboratory and Radiology, City officials contacted our State and Federal partners requesting assistance. In May, the Mayor appointed Vice Mayor Rodriguez and Council Member Burton-to serve on a Hospital Ad Hoc Committee.

In June, the City sent a letter to the Riverside Local Agency Formation Commission (LAFCO) requesting that LAFCO conduct a Municipal Service Review (MSR) of the Palo Verde Healthcare District. The item was placed on June 26, 2025, Agenda and the Commissioners unanimously voted to direct staff to proceed with the MSR. It is the City's understanding that the MSR report will be presented to the LAFCO Board of Directors at their September meeting.

The MSR will include several options and recommendations for the Palo Verde Healthcare District to undertake to improve their current financial position.

In July, the City released a Press Release providing the Community with information related to the current situation at Palo Verde Hospital. Another Press Release is planned after the MSR is published
The County of Riverside has been instrumental in providing support to the Hospital and community. Several working groups were formed to address care and support displaced staff after hospitals workers were furloughed and laid off. City officials and staff regularly participate in work group meetings.

STAFF REPORT: Although the City has no jurisdiction over Palo Verde Healthcare District, its Board of Directors or its management, it is a critical aspect of our community. The City is committed to working with the Board, either current or re-organized, its management and our elected representatives to ensure the hospital remains open and operational. The future success of the City is dependent upon having a functional hospital and healthcare system for our residents. -128-
The Ad Hoc Committee will provide an update.
