THE METROPOLITAN WATER DISTRICT OF SOUTHERN CALIFORNIA COMMUNITY ENHANCEMENT

COLLABORATIVE AND AUTHORIZING THE INTERIM CITY MANAGER OR HER DESIGNEE TO EXECUTE ALL GRANT APPLICATION DOCUMENTS.

City Clerk Crecelius stated that the first page of Resolution No. 2025-023 is missing from the Agenad. Copies of the full Resolution have been made available to the Council and public.

Council Member Halby asked to pull item No. 12 from the Consent Calendar.

Public Comment. Leslie Jessop-Watkins with R&L Watkins Inc. wanted to speak on Item No. 11 First and foremost, I would like to thank the Blythe Fire and Police Departments and all other responders of the initial fire. The Fire Department's hard work saved the four adjacent buildings.

They are to be commended for their quick response and efforts. I would like to recognize the entire team that made the project possible: Richard Hoover, Jonathan Hoover and Jacob Hoover with RE Hoover, Cody and Kelly Addington with Addington Land Management, Julie Padilla, Ruben Morales, Gustavo Alcala and Teddy Palmaris with CR&R, Roberto Flores, Earl Sonner, Terry Churchwell, Mark Barth Jr., Jacob Lopez and Morgann Brown with Public Works, Jason Brown, Adrian Ramirez, Lauren Ray and Michelle VanDyke with the Building Department and of course Mallory Crecelius. Your city staff were incredible to work with. Also, CB Plumbing, Officer Luis Landeros with Blythe PD, and Jim Morris and Dalton Churchwell with the Fire Department who were on standby while we took the unstable walls down. The staff at our business, Abigail Alday, Molly Rodriguez and Fernando Mejia Jr and Tim and Rob Holt with the Holt Group. Our names are on a piece of paper, but these are the people that made this happen. I was so proud of our community for pulling together the way they did. -18-
Council Member Halby moved approval of Consent Calendar Items 1-11. The motion was seconded by Council Member Burton with a unanimous aye vote.

Authorization to Apply for Multiple Grants, Seeking Funding Totaling $780,000 from the Palo Verde Irrigation District/Metropolitan Water District of Southern California Community Enhancement Collaborative. Councilman Halby stated MWD and PVID have come together to do another grant like the CIF. That is to enhance the community for non-profits and the private sector. I don't feel that the City should be applying, it's for the community. These items should be part of a budget study session. The spirit of the grants is for the private sector and community and none of the things here do that.

Public Comment. Ryan Copple recognized the Blythe Police Department and the role they take in keeping our community safe. My concern is not about the value of law enforcement, but how we as a city should prioritize and allocate funds. The City has requested $780,000 from the Community Enhancement Fund for the Blythe Police Department. The key word here is community enhancement. We are overlooking our youth and the critical condition of our parks.

We have teams that want to host tournaments here if the fields are better. This is an opportunity not only for our children but for local businesses and the City's economy. What policy was used to decide where these funds would go? Were there alternatives? I am asking the Council to table Item No. 12 and go back to the drawing board, to get the community involved and consider using these funds for our parks.

Leslie Jessop-Watkins stated she is the Chair of the Community Advisory Committee who makes recommendations to the CEC for funding. The committee is a nine-person committee that is very broad and have a wealth of knowledge and are interested in some of the things Mr. Copple said, including economic viability. Our Bylaws are not even approved yet, so approvals are not happening yet. We are going through the process of getting the grant policy completely done and by October will start reviewing the grant applications in the file. I want to assure the community that the committee charged with making recommendations to the CEC will do it diligently and carefully.

Interim City Manager Crecelius stated each department is responsible for their own grants. This is the first one brought by the Police Department, but there will be more. I am working with a community member to present an application to purchase new Christmas Decorations for the downtown. We've had conversations about Miller and Todd Parks. We've received requests to put playground equipment in Bommer Park. I would like to leverage CDBG funding with this fund to do that. So yes, this is the first initial application but there are a lot of other things in the works that have a community benefit and that will benefit the youth.

Councilman Halby reiterated that the City should not be applying for these funds. We as a City have plenty of grant opportunities to apply for things. It's rare when things come across for the non-profits and private sector.

Chief Dale said I have been waiting for this opportunity for two years. When the applications were distributed, we went right to work on applications and applied right when they opened. -19-
Anyone can apply and I don't know why the school wouldn't or other organizations wouldn't. I would be glad to help anyone with the forms form what I have learned.

Steve Goad started the Pink Trash Bags. I have sprayed the weeds around the City. I don't think anyone gives a damn about the children. I have been trying to get lights on at West Side Park for two years so the kids can play basketball there. All of the money should go towards the parks and the children.

Vice Mayor Rodriguez stated the Chief had been speaking to MWD long before this money was available to try to get them to donate other money. We would all benefit from public sáfety equipment, indirectly and our officers would benefit directly. The Chief was asked by MWD to present things to them before this funding became available. I also had conversations with our Congressman to take it away from them and to give it directly to our community and I thought it should be more money. If you look at the legislation we got the bottom dollar. That upset me and our Congressman. The City, or at least I did try to get that up to benefit the community. Not everyone will be happy or get what they want but I hope everyone gets something.

A community member reported her son fell in a gopher hole in the park and lost his front teeth.

Vice Mayor Rodriguez moved approval of staff's recommendation. The motion was seconded by Council Member Spraggins with aye votes from DeConinck, Rodriguez, Burton and Spraggins and a no vote from Halby.

CONTINUED BUSINESS:

Palo Verde Hospital Ad Hoc Committee Update. Interim City Manager Crecelius tated staff continue to work with the County and the working groups they formed to address th ssues at Palo Verde Healthcare District. We are waiting on the results of the LAFCO Municipa Service Review which should be presented to the Board at the September 25t* meeting.

Vice Mayor Rodriguez reported that the County CEO stated in our last meeting that they will work with us to keep the hospital open. They do not want to see it closed. They will commit funds to keep current operations until the MSR is done.

No public comment. The item was received and filed
ORAL REPORTS:

Council Member Burton stated I have been an umpire for the past 20+ years and have refereed. I don't want the narrative to be that we don't care about the kids because we do. Parents are involved when their kids are in school but then they leave. We want to commend the people that stay and continue. I want to commend our Interim City Manager Mallory Crecelius, Council Member Summer Spraggins and Assembly Member Gonzalez's Chief of Staff Ashley Yanez for attending a musical competition at Ironwood State Prison. The Inmate population is part of the City and for them to take their time to come out makes a positive impact.

Council Member Halby recognized the Office Jerry White who assisted with the recent drowning.

PUBLIC COMMENT:

Ryan Copple made comments related to unsafe and outdated parks and fields and sports leagues and sign-ups. This season one of my players tripped and fell and lost his front teeth. At Miller Park flooding happens and there are unsanitary restroom conditions and no shade. Solutions exist but are told that the City has stopped volunteers from addressing these issues. Our Interim City Manager is stretched too thin and needs support. Blythe needs a full-time City Manager with a team that can focus on the needs of the community.

Interim City Manager Crecelius stated last year there were conversations about extending sign- ups, taking them through skills assessments and the late fee. This year changes were made. There are no late fees. Sign-ups were extended by 1 week to this Friday. Skills assessments are on Tuesday with Monday being a holiday. By the time signups end on Monday night at 7:30pm we have Tuesday to get everything ready for sills assessment. Sign-ups lasted for 8 weeks, starting in June and ending this Friday. Little League maintains the ball fields. Yes, let's help them if they have needs, but their Board is good about emailing me if they have issues. Parks are under Public Works, and I am not aware of some of these issues; but would be happy to work with Public Works to get them addressed. Things are happening as fast as they can and we are willing to work with everyone. I am unaware of a situation in which we told someone they couldn't volunteer. Yes, there are certain things we must do, you can't just bring a tractor into the park and get to work but our staff is willing to work with you. I think there is a lot of miscommunication when you year the "City said". That is very broad; and unless you hear it from me or Mirasol it is not the rule and it's not what happened. Mirasol and I would be happy to work with the Council and the community to address these issues if they are not already in the works.

David Goad said you have a police employee in an unmarked car driving like a maniac.

Shelly Soto of 251 Mariposa Trail stated we must remember it is more than what the City can do to clean the restroom. For many years I was there, and we would clean the restrooms every day and by the end of the night they were trashed by the players and parents. We redid one restroom and that very night someone went in and smashed the sink. I understand the City needs to do something but parents and the kids at these games need to be more responsible too.

ADJOURN: The City Council meeting was adjourned at 7:04pm.

Joseph DeConinck, Mayor

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: September 9, 2025
SUBJECT: Request to Waive Temporary Use Permit Fees for Calvary Chapel's Trunk-or-Treat Event on October 31, 2025
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council waive the Temporary Use Permit Fee of $262.00 for Calvary Chapel's Trunk-or-Treat event on October 31, 2025.

FISCAL IMPACT: Loss of revenue in the amount of $262.00 BACKGROUND: Calvary Chapel hosts an annual Trunk-or-Treat event on Halloween. The event site is 155 and 175 N. Spring street, a vacant lot adjacent to Calvary Chapel located at 145 N. Spring Street.

The family friendly event, which runs from 6-8pm, is free and open to the public. The Church invites local organizations, agencies and vendors to set up booths at the event, but sales are prohibited as this is a completely free event for attendees.

STAFF REPORT: As the Calvary Chapel Trunk-or-Treat is a community event, free and open to the public, providing a safe environment to celebrate the holiday, staff recommends the Council waive the Temporary Use Permit fee of $262.00.

Calvary Chapel has supplied the required information, including property owner permission for staff to issue a Temporary Use Permit for this event.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: September 9, 2025
SUBJECT: Application for Financial Assistance with State Water Resources Control Board's Division of Financial Assistance
PRESENTED BY: Christa Elms, Director of Finance
PREPARED BY: Christa Elms, Director of Finance
RECOMMENDATION: It is recommended the City Council adopt Resolution No. 2025- 025:

RESOLUTION NO. 2025-025 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BLYTHE,

CALIFORNIA, DESIGNATING THE INTERIM CITY MANAGER AS THE CITY'S AUTHORIZED

REPRESENTATIVE TO SIGNAND FILE A FINANCIAL ASSISTANCE APPLICATION WITH THE STATE

WATER RESOURCES CONTROL BOARD FOR THE BIRCH STREET MANGANESE TREATMENT

PROJECT, EXECUTE ALL DOCUMENTS REQUIRED TO APPLY FOR AND RECEIVE THE FINANCIAL

ASSISTANCE, AND TAKE ANY ACTIONS REQUIRED TO RECEIVE AND ACCEPT FINANCIAL

ASSISTANCE
FISCAL IMPACT: No fiscal impact for submitting application for financial assistance. If application is approved, funding opportunity from the State in an undetermined amount.

BACKGROUND: Through its Division of Drinking Water (DDW), the State Water Resources Control Board (State Water Board) has primary authority to enforce federal and state drinking water statues and is responsible for the regulatory oversight of over 7,000 public water systems. The City owns and operates three water systems that supply potable water to the residents of Blythe. The City of Blythe Water System No. CA331000 is one of these systems and serves water to the largest portion of the City's population. In August 2024, the City received Compliance Order No. 06_20_24R_001 (Order) from the State Water Board's DDW for a Secondary Maximum Contaminant Level Violation related to manganese levels at Well EB 04 (Birch Street Well).

The State Water Board's DDW and Division of Financial Assistance (DFA) work cooperatively to protect California's drinking water and help ensure that all Californians have access to clean, safe, accessible, and affordable drinking water through several regulatory and financial assistance programs. Funding opportunities are offered through the Drinking Water State Revolving Fund (DWSRF) program and various other complementary funding programs in the form of loans and grants for infrastructure improvements aimed to mitigate drinking water risks and support the human right to water.

STAFF REPORT: The State Water Board's DWSRF Intended Use Plan prioritizes funding for helping small, disadvantaged communities, such as Blythe, and addressing the most serious health risks for these small communities. Funding can be in the form of a loan, typically with favorable terms, or in the form of a grant. The infrastructure improvements needed to address -43-
the manganese issue at Birch Street Well meet the general guidelines for the City to submit application for financial assistance programs administered by DFA.

State Water Board is required to allocate funding to operate a Technical Assistance (TA) Program focused on assisting systems serving small, disadvantaged communities with priority given to those addressing drinking water needs. Shortly after the Order was issued for Birch Street Well, Staff completed a TA Request Form asking for technical, environmental and financial assistance to address the contamination violation.. The City was approved for assistance in the planning stage of the project. After lengthy conversations with the Technical Assistance Provider (Provider), State Water Board and various other divisions of the Board, Blythe was later approved for TA for both the planning and construction phase of the project.

The Provider will assist the City with the development, planning, and design of the project and submission of the financial assistance application for the construction phase of the project. The TA is at no cost to the City and funded through a grant to the Provider. Once planning phase of the project is complete, the Provider will submit application for funding for the construction phase of the project. As part of the application, the SWRCB requires City Council to adopt by Resolution authorization to file the financial assistance application, and designate a representative to receive, accept, and carry out all tasks associated with making application including, if awarded, accepting award and executing agreement.

Once the financial assistance application is submitted DFA will determine if the City is eligible for funding and which funding source, if any, it plans to allocate. Funding allocated to small disadvantage communities addressing drinking water needs generally comes in the form of a grant or forgivable loan.

Staff recommend that the City Council adopt Resolution 2025-025 authorizing the filing of a financial assistance application with the SWRCB for the Birch Street Manganese Treatment Project and, if awarded, authorize and designate the Interim City Manager, or designee, to take actions required to receive and accept financial assistance.

SUBJECT: Resolution No. 2025-024 Designating Camping Areas in Quechan Park for the ECV Event October 9 - 12, 2025
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: Adopt Resolution No. 2025-024:

RESOLUTION NO. 2025-024. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BLYTHE, CALIFORNIA,

DESIGNATING AREAS OF QUECHAN PARK THAT MAY BE USED FOR CAMPING PURPOSES FOR THE PERIOD OF OCTOBER 9, 2025 THROUGH OCTOBER 12, 2025 IN ACCORDANCE WITH SECTION 12.32.030.A OF THE

BLYTHE MUNICIPAL CODE
FISCAL IMPACT: Loss of parking revenue at Quechan Park.

BACKGROUND: E Clampus Vitus (ECV) describes itself as a unique American fraternal society combining shenanigans, camaraderie, and a deep love of Western U.S. History, especially that of the Gold Rush and Mother Lode regions. The group was originally founded in 1845 but died out around 1916. The group was re-established in the early 1930s. This is when they began to embrace historical preservation and dedicating plaques and monuments (over 2,000 to date). Today, ECV spans dozens of chapters across the Western United States.

The City received a request from Kati Cusick, Community Outreach at Blythe Speedway, to allow ECV the exclusive use of Quechan Park, at no cost, for the period of October 9-12, 2025, for a private historical event and monument dedication.

During the visit, ECV intends to install a permanent bronze historical monument at Quechan Park for the Bradshaw Trail and Bradshaw Ferry. According to ECV, Quechan Park was chosen as the Ferry passed between Ehrenberg and Blythe in the late 1800s.

STAFF REPORT: On August 5, 2025, the City Council met in a Special Meeting to discuss a request by ECV for exclusive use of Quechan Park, including overnight camping for their event October 9 - 12, 2025. The City Council authorized the use of the park, including camping for.

ECV will have exclusive use of the park during the event except for holders of an Annual Pass for the Boat Launch at the park.

Overnight camping is not presently allowed in City Parks. However, the Blythe Municipal Code provides that the City Council may, by ordinance or resolution, designate one or more specified areas of public property for camping.

As the City Council approved the use of Quechan Park by ECV October 9 - 12, 2025 it is recommended that the City Council Adopt Resolution No. 2025-024 designating the areas of Quechan Park that may be used for camping purposes in accordance with Section 12.32.030 A of the Blythe Municipal Code.

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING

STAFF REPORT
MEETING DATE: September 9, 2025
SUBJECT: Palo Verde Hospital Ad Hoc Committee Update
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council receive and file a report from the Hospital Ad Hoc Committee.

FISCAL IMPACT: None
BACKGROUND: After receiving information from concerned citizens related to the financial state of the Palo Verde Healthcare District earlier this year, the City contacted Riverside County Supervisor V. Manual Perez's Office to offer assistance. The City requested assistance in identifying the oversight body for the Palo Verde Healthcare District's Board of Directors.

After learning the hospital had shuttered operations except for the Emergency Room, Laboratory and Radiology, City officials contacted our State and Federal partners requesting assistance. In May, the Mayor appointed Vice Mayor Rodriguez and Council Member Burton to serve on a Hospital Ad Hoc Committee. In June, the City sent a letter to the Riverside Local Agency Formation Commission (LAFCO) requesting that LAFCO conduct a Municipal Service Review (MSR) of the Palo Verde Healthcare District. The item was placed on June 26, 2025, Agenda and the Commissioners unanimously voted to direct staff to proceed with the MSR. It is the City's understanding that the MR report will be presented to the LAFCO Board of Directors at their September meeting. The MSR will include several options and recommendations for the Palo Verde Healthcare District to undertake to improve their current financial position.

In July, the City released a Press Release providing the Community with information related to the current situation at Palo Verde Hospital. Another Press Release is planned after the MSR is published.

The County of Riverside has been instrumental in providing support to the Hospital and community. This summer several working groups formed to address care and to support displaced staff after hospital workers were furloughed and laid off.

STAFF REPORT: Although the City has no jurisdiction over Palo Verde Healthcare District, it is a critical aspect of our community. The City is committed to working with the current or a re- organized Board of Directors and our elected representatives to ensure the hospital remains open and operational.

The Ad Hoc Committee will provide an update.

MEETING DATE: September 9, 2025
SUBJECT: Consideration of Adoption of Urgency Ordinance No. 943-25-U Amending Title 17 (Zoning) of the Blythe Municipal Code to Establish Regulation elating to Commercial Solar Energy Facilities and Review of Ordinanc No. 944-25 Amending Title 17 (Zoning) to Establish Regulations Relating PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
Brittany Roberto, City Attorney
RECOMMENDATION: It is recommended that the City Council, acting as the City's Planning Agency, conduct a public hearing on Ordinance No. 944-25, establishing regulations relating to commercial solar energy facilities. After the public hearing, it is recommended that the City Council, by a four-fifths vote, adopt Urgency Ordinance No. 943-25-U:

ORDINANCE NO. 943-25-U. AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BLYTHE, CALIFORNIA, AMENDING CHAPTER 17.04 (DEFINITIONS) AND CHAPTER 17.08 (PERMITTED USES) AND ADDING A NEW CHAPTER 17.57 (SOLAR ENERGY FACILITIES) TO THE BLYTHE MUNICIPAL CODE RELATING

TO COMMERCIAL SOLAR ENERGY FACILITIES AND FINDING THE ORDINANCE IS EXEMPT FROM

ORDINANCE NO. 944-25. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BLYTHE, CALIFORNIA, AMENDING CHAPTER 17.04 (DEFINITIONS) AND CHAPTER 17.08 (PERMITTED USES) AND ADDING A NEW CHAPTER 17.57 (SOLAR ENERGY FACILITIES) TO THE BLYTHE MUNICIPAL CODE RELATING TO COMMERCIAL

SOLAR ENERGY FACILITIES AND FINDING THE ORDINANCE IS EXEMPT FROM ENVIRONMENTAL REVIEW

UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT PURSUANT TO CEQA GUIDELINES SECTION 15061(b)(3)
FISCAL IMPACT: None.

BACKGROUND: The Blythe Zoning Code does not define or regulate commercial solar energy facilities. For purposes of this staff report and the proposed ordinances, "commercial solar energy facility" refers to a solar energy facility that is designed to collect, store, and distribute solar energy that will be used to meet off-site energy demand. "Commercial solar energy facility" does not include an accessory solar energy facility, which refers to a solar energy facility that is designed to collect, store, and distribute no more solar energy than what is necessary to meet on-site energy demand. Commercial solar energy facilities are commonly known as solar farms.

The Colorado River Corridor Plan ("Plan"), adopted in March 2007, is a comprehensively planned, waterfront-oriented land use plan intended to complement other areas of the City. The City's vision for the Plan area includes providing a variety of housing opportunities to establish viable and -56-
livable neighborhoods; preserving valuable open space; developing additional recreational and resort land uses; protecting existing agricultural land uses; creating a multi-purpose recreational trail system; providing additional river access points; and preserving open space while balancing circulation needs.

The Plan establishes connections between all of the lands within its boundaries to provide integration and balance between the Riverfront and the rest of the City. Goals of the Plan include maintaining a small-town atmosphere, encouraging development of resorts, hotels, and other visitor-serving commercial uses, and managing growth and development timing.

On October 10, 2023, the City Council, by a four-fifths vote, adopted Urgency Ordinance No. 925- 23-U, establishing a 45-day temporary moratorium on the establishment of new commercial solar energy facilities in the City as authorized by California Government Code section 65858. On November 14, 2023, the City Council, by a four-fifths vote, adopted Urgency Ordinance No. 926- 23-U, extending the temporary moratorium for 10 months and 15 days as authorized by California Government Code section 65858. On October 8, 2024, the City Council adopted Urgency Ordinance No. 933-24-U, extending the temporary moratorium for one year as authorized by California Government Code section 65858. The moratorium will expire on October 9, 2025.

On August 5, 2025 the City Council held a Study Session to provide direction to staff on the preparation of an ordinance to regulate the development of commercial solar energy facilities in the City.

STAFF REPORT: Without established regulations for the development of commercial solar energy facilities, the City would be unable to review projects and set project conditions to preserve the scale and character of established neighborhoods, encourage development of the Downtown as a mixed-use activity, achieve compatibility between industrial development and surrounding neighborhoods or have projects developed that are consistent with the City's General Plan.

Establishing regulations relating to commercial solar energy facilities is needed to protect the integrity of the Plan area and residential, agricultural, commercial, and public/quasi-public zones.

At the Study Session held on August 5, 2025, the Council provided direction to staff regarding desired regulations for commercial solar energy facilities, including where to allow such facilities to be located, permitting requirements, and development standards. If adopted, commercial solar energy facility projects would be permitted in the Service Industrial (I-S) and General Industrial (I-G) zones with a Conditional Use Permit. Development would be prohibited in the Plan area, on any land that is or has been in agricultural production in the past 5 years, and within 600 feet of any interstate, highway, or residentially zoned property.

Other development standards include:
• Minimum lot size of 10 acres
• Maximum height restrictions for both ground and roof mounted facilities of 25 feet and four feet respectively.
• Commercial solar energy facilities visible from the public-right-of-way must be installed to minimize visual and aesthetic impacts and may not include illumination other than what is necessary to operate the facility.
-57-
• Commercial solar energy facilities cannot be developed above a septic system without approval from Riverside County Department of Environmental Health. • Commercial solar energy facilities cannot be located within 50 feet of any aquatic habitat unless the City makes specified findings.

As commercial solar energy facility projects have a functional lifespan of 25-30 years, the Ordinance as proposed would require developers to provide the City with a site restoration plan to return the subject property to its pre-existing condition, including a requirement that the developer deposit a bond to ensure the completion of the restoration work.

Staff will also address screening requirements, vehicle access, and glare and erosion control through the Conditional Use Permit process. This will ensure that commercial solar energy facilities are permitted in a way that protects the public health, safety and welfare of the community and surrounding neighborhoods.

Benefits of commercial solar energy facilities include property tax revenue, jobs during construction and sales/use tax for purchases made during construction. Staff cannot find any long- term benefits to the City from the development of these projects.

General Plan
The Service Industrial land use designation is intended to provide areas appropriate for moderate- to low-intensity industrial uses capable of being located next to commercial and residential areas with minimum buffering, and the General Industrial land use designation is intended to provide and protect industrial lands for the full range of manufacturing, agricultural, and industrial processing, general service, and distribution uses. Commercial solar energy facilities are compatible with industrial uses.

The City's General Plan Guiding Policies provide as follows: preserve the scale and character of established neighborhoods (General Plan Land Use Element Guiding Policy 1), encourage development of the Downtown as a mixed-use activity with retail and visitor-oriented uses, business and personal services, government and professional offices, communications facilities, civic uses, and high-density residential uses (General Plan Land Use Element Guiding Policy 9), and achieve compatibility between industrial development and surrounding neighborhoods through buffering requirements and standards intended to minimize harmful effects of excessive noise, light, and glare and other adverse environmental impacts (General Plan Land Use Element Guiding Policy 18). Allowing commercial solar energy facilities without regulations and within the residential, agricultural, commercial, and public/quasi-public zones would be inconsistent with these General Plan Land Use Guiding Policies. However, by establishing regulations fo commercial solar energy facilities, including restricting where such facilities can be located, the City is implementing these General Plan Land Use Guiding Policies.

California Environmental Quality Act
Both ordinances are exempt from the California Environmental Quality Act (CEQA) because there is no possibility that the adoption of the ordinances will have a significant effect on the -58-
environment. The ordinances amend Title 17 of the Blythe Municipal Code and do not provide for any actual development. The ordinances are therefore exempt from the environmental review requirements of the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) (Common Sense Exemption) of the CEQA Guidelines.

It is necessary for the City to immediately adopt regulations for commercial solar energy facilities prior to the expiration of the moratorium on October 9, 2025 to ensure that such regulations apply to any development applications received for such projects prior to having an effective regular ordinance. Urgency Ordinance No. 943-25-U amends Title 17 to establish regulations relating to commercial solar energy facilities to be effective immediately. Ordinance No. 944-25 contains the exact same changes to Title 17, but is being brought forth through the normal procedures in order to provide the public with an opportunity to be heard on the matter.

Therefore, subsequent to the public hearing, it is recommended Council, by a four-fifths vote, adopt Urgency Ordinance No. 943-25-U.
