A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BLYTHE, CALIFORNIA, APPROVING THE ENGINEER'S
REPORT AND CONFIRMING THE DIAGRAM AND
ASSESSMENTS FOR FISCAL YEAR 2026-2027 FOR THE
CITY OF BLYTHE LIGHTING DISTRICT NO. 2
The City Council of the City of Blythe hereby finds and declares as follows:
WHEREAS, the City of Blythe Lighting District No. 2 (the "District") has been established pursuant to the Landscaping and Lighting Act of 19/2 (California Streets anc tighways Code Section 22500 et seq.) (the "Act") to fund the operation and/or maintenance of certain public landscaping, streetlights, and appurtenant facilities in the District; and
WHEREAS, in connection with the District, the City annually levies an assessment against real property; and
WHEREAS, by its Resolution No. 2026-007, adopted May 12, 2026, the City Council directed Willdan Financial Services, as assessment engineer (the "Engineer"), to prepare and file a report regarding the District; and
WHEREAS, the Engineer filed said report, entitled "City of Blythe, Lighting District No. 2, 2026-2027 Engineer's Annual Levy Report" (the "Report"), which is on file and available for public inspection in the Office of the City Clerk and is incorporated herein by reference; and
WHEREAS, by its Resolution No. 2026-008, adopted May 12, 2026, the City Council preliminarily approved the Report, declared its intention to levy assessments within the District for Fiscal Year 2026-2027, and set a public hearing on the assessments for June 16, 2026; and
WHEREAS, by its Resolution No. 2026-019, adopted June 16, 2026, the City Council redeclared its intention to levy and collect assessments within the District for Fiscal Year 2026-2027 and set a public hearing for July 14, 2026 (the "Hearing"); and WHEREAS, at the Hearing, which was noticed as required by law, all interested persons were afforded the opportunity to hear and be heard and the City Council considered all oral and written statements and all written protests made or filed by any interested person; and
WHEREAS, the City Council now desires to levy the assessments for Fiscal Year 2026-2027 as set forth in the Report.
Resolution No. 2026-023
-233-
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BLYTHE, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council approves the Report as filed.
SECTION 2. The City Council confirms the diagram and assessments for the District for Fiscal Year 2026-2027 as set forth in the Report.
SECTION 3. Pursuant to Section 22631 of the Act, the adoption of this Resolution shall constitute the levy of the assessments for Fiscal Year 2026-2027.
SECTION 4. Lots or parcels of land within the District that are owned or used by any county, city, city and county, special district or any other local governmental entity, the State of California, or the United States shall be assessed unless the entity demonstrates by clear and convincing evidence that such lots or parcels receive no special benefit from the proposed improvements.
SECTION 5. All railroad, gas, water and electric utility right-of-way or electric line right-of-way are included within the District and shall be assessed in accordance with the benefits to be received from the improvements.
SECTION 6. The City Council finds and determines that the levy and collection of the assessments is categorically exempt from the California Environmental Quality Act ("CEQA") pursuant to Section 15301 (Existing Facilities) of the CEQA Guidelines, in that the proceeds of the assessments are to be used for the maintenance and operation of existing facilities involving negligible or no expansion of existing or former use. The City Council also finds and determines that the levy and collection of the assessments is exempt from CEQA pursuant to Section 15061(b)(3) (Common Sense Exemption) of the CEQA Guidelines, in that it can be seen with certainty that there is no possibility that the levy and collection of the assessments to fund maintenance and operations costs for the District will have a significant impact on the environment.
SECTION 7. The City Clerk is directed to file the diagram and assessments, or a certified copy thereof, with the Riverside County Auditor-Controller. The assessments shall be collected at the same time and in the same manner as County taxes are collected, and all laws providing for the collection and enforcement of County taxes shall apply to the collection and enforcement of the assessments.

1. OVERVIEW
A. INTRODUCTION
Pursuant to the order of the City Council of the City of Blythe (the "City"), this requiremen of Alice 4, Chapter or hey an prepared in compliance with the Part 2 of Division 15 of the Streets and Highways Code of the State of California ("the 1972 Act).
This Report presents the engineering analysis for Fiscal Year 2026/2027 for the District known as: City of Blythe Lighting District No. 2 (Hereinafter referred to as "District").
This District, by special benefit assessments, provides funding for the operation and/or maintenance of landscaped areas owned by the City, and/or maintenance and servicing of streetlights and appurtenant facilities owned and maintained by Southern California Edison Company, all of which are located in and along public rights-of-way in the District.
The word "parcel," for the purposes of this Report, refers to an individual property assigned its own Assessor's Parcel Number ("APN") by the Riverside County Assessor's Office. The Riverside County Auditor/Controller uses APNs and specific Fund Numbers to identify properties to be assessed on the tax roll for the District assessments.
HISTORICAL BACKGROUND AND CURRENT LEGISLATION
Section 22573 of the 1972 Act requires assessments to be levied according to benefit rather than according to assessed value. The section states:
"The net amount to be assessed upon lands within an assessment district may be apportioned by any formula or method which fairly distributes the net amount among all assessable lots or parcels in proportion to the estimated benefits to be received by each such lot or parcel from the improvements."
Furthermore, Section 4 of Article XIIID of the California Constitution requires that no assessment shall be imposed on any parcel which exceeds the reasonable cost of the proportional special benefit conferred on that parcel.
The 1972 Act also provides for the classification of various areas within an assessment district into different zones where,

"...by reason of variations in the nature, location and extent of the improvements, the various areas will receive differing degrees of benefit from the improvements. A zone shall consist of all territory which will receive substantially the same degree of benefit from the improvements. " An assessment district may consist of contiguous or noncontiguous areas. As the assessments are levied on the basis of benefit, they are considered a special benefit assessment, not a tax, and therefore, are not governed by Article XIlIA or Article XIIIC of the California Constitution. Properties owned by public agencies, such as a city, county, state or the federal government must be assessed by law unless it can be demonstrated that they receive no special benefit from the improvements.
C. IMPROVEMENTS AUTHORIZED BY THE 1972 ACT
As applicable or may be applicable to this District, the 1972 Act defines improvements to mean one or any combination of the following:
• The installation or planting of landscaping.
• The installation or construction of statuary, fountains, and other ornamental structures and facilities.
• The installation or construction of public lighting facilities. • The installation or construction of any facilities which are appurtenant to any of the foregoing or which are necessary or convenient for the maintenance or servicing thereof, including, but not limited to, grading, clearing, removal of debris, the installation or construction of curbs, gutters, walls, sidewalks, or paving, or water, irrigation, drainage, or electrical facilities. • The maintenance or servicing, or both, of any of the foregoing. • The acquisition of any existing improvement otherwise authorized pursuant to this section.
Incidental expenses associated with the improvements including, but not limited to:
The cost of preparation of the Report, including plans, specifications, estimates, diagram, and assessment.
• The costs of printing, advertising, and the publishing, posting and mailing of notices.
• Compensation payable to the County for collection of assessments. 2026/2027 Lighting District No. 2 Page 2

• Compensation of any engineer or attorney employed to render services. • Any other expenses incidental to the construction, installation, or maintenance and servicing of the improvements.
• Any expenses incidental to the issuance of bonds or notes pursuant to Section 22662.5.
• Costs associated with any elections held for the approval of a new or increased assessment.
The 1972 Act defines "maintain" or "maintenance" to mean furnishing of services and materials for the ordinary and usual maintenance, operation, and servicing of any improvement, including:
• Repair, removal, or replacement of all or any part of any improvement. • Providing for the life, growth, health, and beauty of landscaping, including cultivation, irrigation, trimming, spraying, fertilizing, or treating for disease or injury.
• The removal of trimmings, rubbish, debris, and other solid waste. • The cleaning, sandblasting, and painting of walls and other improvements to remove or cover graffiti.
II. BOUNDARIES OF THE DISTRICT
The boundary of the District is completely within the city limits of the City of Blythe and is shown on the Boundary Map (on file in the office of the City Clerk as Exhibit "A" and incorporated herein by reference). Exhibit "A" serves as the assessment diagram for the District. The boundary includes the parcels of land that are located in the vicinity of street lighting improvements that were installed during or after Fiscal Year 1996/1997 or street lighting improvements which were installed during Fiscal Year 2012/2013 and are not included in Lighting District No. 1. Any parcels or lots within or annexed into the District / benefit zones that are within the boundary of Lighting District No.1 ("LD No. 1") shall be de-annexed from LD No. 1 thereafter. All parcels of real property included within the District are described in detail on maps on file in the Riverside County Assessor's office. 2026/2027 Lighting District No. 2 Page 3

III. IMPROVEMENTS
The facilities and items of servicing and maintenance included within the District are as follows:
A. STREET LIGHTS
A map showing the location of all lighting zones within the District, is on file in the office of the City Clerk as Exhibit "B". The areas in which street light facilities are being operated and maintained during Fiscal Year 2026/2027 are designated as Zones 1 through 16, inclusive. There are no traffic signals within the District.
Servicing means the furnishing of electric current or energy, gas or other illuminating agent for public street lighting and appurtenant facilities.
Maintenance means the furnishing of services and materials for the ordinary and usual maintenance, operation and servicing of any improvement, including repair, removal, or replacement of all or any part of a component of the street lighting system, and the cleaning, sandblasting and painting of improvements to remove or cover graffiti.
For the purposes of establishing benefit zone boundaries, a distance of 200 feet from a streetlight is used. The 200-foot distance establishes the usable area of light around a streetlight. This distance is used to include both full lighting coverage and partial lighting coverage of a parcel. That is, if a portion of a parcel is within 200 feet of a streetlight, it is subject to an assessment.
B. LANDSCAPE AND ORNAMENTAL STRUCTURES
A map showing the location of all landscaping zones within the District, is on file in the office of the City Clerk as Exhibit"C"
Servicing means the furnishing of water for the irrigation of any landscaping, the operation of any fountains, or the maintenance of any other improvements.
Maintenance means the furnishing of services and materials for the ordinary and usual maintenance, operation and servicing of any improvement, including:
1. Repair, removal or replacement of all or any part of any improvement.
2. Providing for the life, growth, health and beauty of landscaping, including cultivation, irrigation, trimming, spraying, fertilizing, or treating for disease or injury.
3. The removal of trimmings, rubbish, debris and other solid waste. 2026/2027 Lighting District No. 2 Page 4

W WILLDAN
4. The cleaning, sandblasting and painting of walls and other improvements to remove or cover graffiti.
Note: There are no new landscaping and ornamental structure zones in Fiscal Year 2026/2027.
C. PLANS AND SPECIFICATION
The plans and specifications showing and describing the general nature, location and extent of the improvements are on file in the office of the City Clerk and are incorporated herein by reference.
IV. METHOD OF APPORTIONMENT
The net amount to be assessed upon lands within the District in accordance with this Report is apportioned by a formula and method which fairly distributes the amount among all assessable lots or parcels in proportion to the estimated special benefits to be received by each lot or parcel from the improvements, namely the maintenance and servicing of public street lighting and appurtenant facilities within the District. The maintenance and servicing of public lighting and appurtenant facilities installed and constructed in public places in the District provides a special benefit which is received by each and every assessed lot or parcel within the specified zones of benefit in the District, tending to specifically enhance their value. The streets within the District provide access to all lots or parcels assessed. Streetlights improve ingress and egress from such lots or parcels by illuminating access after sunset. Such streetlights, by so improving ingress and egress, improve the security of such lots or parcels by improving the nighttime visibility of such lots or parcels and improve the access of emergency vehicles thereto and in the case of commercial lots or parcels, facilitate the opening and operation of business uses after sunset.
Their ropen fis or te lighing are conventore atey, Securiy and protection of
1. Improvement to traffic circulation and reduction in night-time accidents and attendant human misery and decrease in personal property loss.
2. Less vulnerability to criminal assault at night.
3. Promotion of business during nighttime hours.
4. Improved ingress and egress to lots and parcels.
5. Reduction in vandalism and other criminal acts resulting in damage to improvements.

B. ASSESSMENT FORMULA
The basic formula used to calculate the amount spread to each parcel within the District for street lighting starts with the basic assessment unit. The basic assessment unit (AU) is given a value of one (1) for a single-family residential parcel. From this base, the remaining parcels are related according to their equivalent benefit within the District. The assignment of assessment units is shown in Table I below.

Notes:
1. DU = Dwelling Unit. Duplex, triplex, fourplex and mobile home parcels, as well as each space in a mobile home park, are assessed at a rate of 0.80 AU per parcel/space because such units are generally smaller than single. family residences.
2. The assessment formula for standard apartment complexes is 0.60 AU per DU. Apartment units are assessed less than a single family dwelling because such units generally have a greater density per parcel than SFR's, are often located on upper stories, may be located a great distance from public rights-of-way, and generally are smaller units (in terms of floor area than SFR's. Studio apartment complexes are assessed at a rate of 0.40 AU per DU because these units are generally smaller than standard apartment units with a single room living area with a bathroom and a small closet.
Recreational vehicle (RV) park parcels are assessed at a rate of 0.30 AU per space because RV parks tend to have seasonal business and often have a high number of vacancies. Therefore, they are assessed at a substantially lower rate than mobile home parks.
4. Commercial parcels are assessed at a rate of five (5) units per acre. This is based on the basic assessment unit
5. Parcels owned by public agencies such as the federal government, states, counties, cities, water District, irrigation District, etc. are subject to assessment unless it can be shown that the parcel receives no special benefit from the facilities being maintained and serviced with the assessment proceeds.
6. Vacant parcels are assessed 0.50 units per parcel for street lighting. Said vacant parcels do receive a special benefit from streetlights which tends to reduce vandalism and trash dumping in spite of the fact that they are not
7. Public utility parcels are assessed in the same manner as commercial properties. 2026/2027 Lighting District No. 2 Page 8
-246-
Attachment A to Resolution No. 2026-023
W WILLDAN
8. Churches and fraternal organizations are assessed at 1.00 AU per parcel because they generally have less intensive usage of the land than other non-residential uses, such as commercial parcels, and therefore benefit less from the improvements.
9. Railroad and Palo Verde Irrigation District (PVID) parcels are assessed at one-half the amount applied to commercial properties or public utilities because their parcels are railroad track or irrigation canal rights-of way which receive a safety benefit due to grade crossing lighting (RR) or general lighting (PVID), but whose improvements are less susceptible to vandalism than commercial property improvements.
10. Agricultural parcels can have different types of use. Agricultural properties with no residence are assessed 0.25 AU per acre with a minimum of 0.50 AU per parcel (similar to other vacant property). Agricultural parcels with residences are assessed 0.25 AU per acre with a minimum of 1.00 AU per residence per parcel (similar to other residential parcels).
1. Special Benefit Analysis
Special benefit is defined as a particular and distinct benefit over and above the general benefit conferred on real property located in the District or to the public at large. General enhancement of property value does not constitute special benefit.
Only special benefits are assessable, and the District must separate the special benefits from the general benefits conferred on a parcel.
General benefit is gained by lots or parcels outside of the District and by the general public. That is, lots or parcels outside of the zone in question, or a member of the general public that occasionally uses the street improvements within that zone, are gaining a benefit that is general in nature and for which cannot be assessed.
The maintenance and servicing of public landscaping, ornamental structures, and appurtenant facilities installed and constructed in and along public roadways, streets and rights-of-way in the City provides a special benefit which is received by each and every lot or parcel within the specified zones of benefit in the District, tending to enhance their value. Landscaping within the District enhances the aesthetic appeal of parcels within the landscaping zones. In addition, landscaping and ornamental structures improve erosion resistance and dust control. The streets within the District provide access to all lots or parcels assessed.
The primary benefits of landscaping are as set forth below:
1. Improved aesthetic appeal of nearby parcels.
2. Improved erosion resistance.
3. Improved dust control.
4. Enhancement of the value of property which results from the foregoing benefits.
In general, there is no component of general benefit for landscaping since each landscaping zone is set up on a tract-by-tract basis, thereby generating special benefit only.

Concerning this District, the general benefit component of the total benefit to each lot or parcel gained from street lighting is determined from the classification of each street which has public streetlights. It follows that when a street is used between sunset and sunrise, streetlighting is also used and is of benefit. The City has five (5) separate street classifications, which are discussed below.
Starting with the lowest classification first, the benefit derived from street lighting by properties fronting on or in close proximity to Local (residential) Streets is readily determined to be 100% special benefit because all trips on Local Streets end on those streets with no "pass-through" trips.
The benefit derived by parcels or lots fronting on or in close proximity to streetlights on Collector Streets is determined to be 95% special benefit because approximately 95% of the trips on Collector Streets end on or near such streets. It is estimated that 5% of the trips on Collector Streets are "pass-through" trips, which represent general benefit.
The benefit derived from parcels or lots fronting on, or in close proximity to, streetlights on Major Collector Streets is determined to be 90% special benefit because approximately 90% of the trips on Major Collector Streets end on or near such streets. It is estimated that 10% of the trips on Major Collector Streets are "pass-through" trips which represent general benefit.
The benefit derived from parcels or lots fronting on, or in close proximity to, streetlights on Arterial Streets is determined to be 85% special benefit because approximately 85% of the trips on Arterial Streets end on or near such streets. It is estimated that 15% of the trips on Arterial Streets are "pass-through" trips, which represent general benefit.
The benefit derived from parcels or lots fronting on, or in close proximity to, streetlights on Major Arterial Streets is determined to be 80% special benefit because approximately 80% of the trips on Major Arterial Streets end on or near such streets. It is estimated that 20% of the trips on Major Arterial Streets are "pass-through" trips, which represent general benefit.

If a parcel is located at an intersection of two streets with different classifications, the higher classification shall govern for establishing an assessment.
General Examples
Street Classification Benefit (%)
Major Arteries (96' RM) 20%
Arterial (94' RAM) 15% Hobsonway, Intake Boulevard,
14th Avenue, 7th Street
Major Collector (80' RM) 10% Chanslor Way (Riverside Avenue) Collector (74' R/) 5% Wells Road, 4th Avenue, Dekens Court 0% Riviera Drive, Bell Lane, Briar Lane, Juan Circle,
Local (60' R/W) Toro Circle, Lido Lane, Arrowhead Boulevard
2. Assessment of Public Property
Since the passage of Proposition 218 in November of 1996, it has been required that lots and parcels owned by public agencies be assessed in the same manner and by the same formula as all other property. However, in order to be assessed any lot or parcel must receive a distinct and special benefit from the facilities and improvements which are being maintained and serviced by the assessment District proceeds. An example of a public parcel which would be subject to assessment would be a City-owned vacant parcel which is near a streetlight. That vacant parcel would be assessed at a rate of 0.50 AU just as a privately-owned vacant parcel would be.
3. Assessment Examples
Lighting
The number of assessment units (AU) generated within Zone 1 is 445.17. The dollars required in Zone 1 are $8,832.17. The assessment rate per AU is:
$8,832.17 / 445.17 AU = $19.84 / AU
Example A: Commercial property on a 0.75-acre parcel within Zone 1.
Assessment Unit Chart shows commercial property is assessed at a rate of five (5) AU per acre.
Formula:
0.75 Acres x 5 AU/Acre = 3.75 AU
The Fiscal Year 2026/2027 assessment for this commercial parcel is:
3.75 AU x $19.84/AU = $74.40

Example B: Standard apartment complex with 22-dwelling units on one (1) parcel within Zone 1.
Assessment Unit Chart shows an apartment complex is assessed at the rate of 0.6 AU per dwelling unit:
Formula:
22 DU × 0.6 AU/DU = 13.20 AU
The assessment for this apartment complex for Fiscal Year 2026/2027 is:
13.20 AU x $19.84/AU = $261.88
Landscaping
The number of assessment units (AU) generated within Zone 85 is 42.00. The funding required in Zone 85 is $5,944.68. The dollar value of each AU is:
$5, 944.68 / 42.00 AU = $141.54 / AU
Each residence in Zone 85 is assessed for one AU, or $141.54.
Note: If any assessment amount is an odd penny, it will be rounded down to an even penny as the County of Riverside does not accept odd cents and a parcel cannot be assessed over maximum.
C. LIMITATIONS ON INCREASE OF ANNUAL ASSESSMENT
Generally, any new or increased assessments require certain noticing, meeting, and balloting requirements by law. However, the Brown Act (Government Code Section 54954.6(o)) provides that a "new or increased assessment" does not include "an assessment which does not exceed an assessment formula or range of assessments previously adopted by the City or approved by the voters in the area where the assessment is imposed". This definition for a new or increased assessment was also addressed in Senate Bill 919 (the implementing legislation for Proposition 218).
If the proposed assessment (Rate per AU) for the current fiscal year is less than or equal to the maximum assessment established in the prior fiscal year plus the adjustments described in the following paragraph, then the new assessment is not considered an increased assessment. This assessment range formula provides for reasonable increases and inflationary adjustments to the assessment amounts without requiring costly noticing, balloting, and mailing procedures, which would be added to the Destits coin a halse.
The following describes the assessment range formula for all zones within the District. The City Council will automatically increase assessments in accordance with the Consumer Price Index for all Urban Consumers for the Riverside-San Bernardino-Ontario, CA, ("CPI") published by the United States Department of Labor, Bureau of Labor Statistics; from March to March provided however, that any 2026/2027 Lighting District No. 2 Page 12

such annual increase shall not exceed five percent (5.00%). The annual percentage change used for Fiscal Year 2026/2027 is 3.09% 2026/2027 Lighting District No. 2 Page 13

VI. ASSESSMENT ROLL
Parcel identification, for each lot or parcel within the District, shall be the parcel as shown on the Riverside County Assessor's Parcel Maps for the year in which this Report is prepared. The land use classification and specific parcel data for each parcel is based on property information available from the Riverside County Assessor's Office or provided y the City, and by reterence is made part of this Report. A listing of parcels to be assessed within this District for Fiscal Year 2026/2027, along with the proposer assessment amounts is provided on the following pages.
Approval of this Report (as submitted or as modified) confirms the method of apportionment and the proposed assessment rates to be levied against each eligible parcel within the District and thereby constitutes the approved levy and collection of assessments for Fiscal Year 2026/2027. The parcels and the amount of assessment to be levied shall be submitted to the Riverside County Auditor/Controller and included on the property tax roll for the fiscal year.
If any parcel submitted for collection is identified by the Riverside County Auditor/Controller to be an invalid parcel number for the current fiscal year, a corrected parcel number and/or new parcel number will be identified and resubmitted to the Riverside County Auditor/Controller. The assessment amount to be levied and collected for the resubmitted parcel or parcels shall be based on the method of apportionment and assessment rate approved in this Report. Therefore, if a single parcel has changed to multiple parcels, the assessment amount applied to each of the new parcels shall be recalculated and applied according to the approved method of apportionment and assessment rate rather than a proportionate share of the original assessment. 2026/2027 Lighting District No. 2 Page 17

CITY OF BLYTHE
Blythe CITY COUNCIL MEETING
SLAINISHE STAFF REPORT
MEETING DATE: July 14, 2026
SUBJECT: Palo Verde Hospital Ad Hoc Committee Update
PRESENTED BY: Mallory Crecelius, interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended Council receive and file the report.
FISCAL IMPACT: None
BACKGROUND: After receiving information from concerned citizens related to the financial state of the Palo Verde Healthcare District, the City contacted Riverside County Supervisor V.
Manual Perez's Office to offer assistance and request assistance in identifying an oversight body for the Palo Verde Healthcare District.
After learning the hospital had shuttered operations except for the Emergency Room, Laboratory and Radiology, City officials contacted State and Federal officials requesting assistance. The City sent a letter to the Riverside Local Agency Formation Commission (LAFCO) requesting that LAFCO conduct a Municipal Service Review (MSR) of the Palo Verde Healthcare District. The item was placed on June 26, 2025, Agenda and the Commissioners unanimously voted to direct staff to proceed with the MSR.
On September 25, 2025, the MSR report was presented to the LAFCO Board of Directors. The LAFCO Commissioners requested a dissolution plan that includes establishing a successor agency. Once a successor is in place, LAFCO will move to dissolve the Palo Verde Healthcare District. The County of Riverside, in partnership with the City of Blythe, formed a joint working group to develop a succession plan. Later, the Palo Verde Health Care District Board of Directors field Chapter 9 Bankruptcy further complicating matters.
On January 7, 2026, the Palo Verde Health Care District Board of Directors posted an Emergency Meeting notice. The Staff report stated the hospital would close on Saturday, January 10, unless $2 million was obtained. In a Special Meeting on January 9, 2026, the City Council voted to provide Bridge Loan Funding in the amount of $330,000 to keep the hospital operational for another week to allow time for the County to come in and assist. The Loan was contingent upon the Board allowing the County to provide oversight and the day-to-day management of the hospital.
On January 27, 2026, the County Board of Supervisors ratified a $1 million loan to the PVHD and approved a strike force led by the Riverside University Heath System to independently stabilize and manage the Palo Verde Hospital Emergency Department for a period of 180 days.
STAFF REPORT: The Ad Hoc Committee will provide an update.

MEETING DATE: July 14, 2026
SUBJECT: Issuance of a Commercial Cannabis Business Cultivation Permit to Edelweiss Expansion LLC at 1455 W. Hobsonway
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
RECOMMENDATION: It is recommended that Council approve the issuance of a Commercial Cannabis Cultivation Permit to Edelweiss Expansion LLC for the expansion of the commercial cannabis cultivation operation at 1455 W. Hobsonway in Blythe.
If approved by Council, the Commercial Cannabis Cultivation Permit will be issued once Business License fees have been paid and the State Cannabis License is awarded.
FISCAL IMPACT: Additional cannabis tax revenue from Edelweiss once the second phase of the development is operational.
BACKGROUND: In 2017, the City Council adopted Ordinance No. 883-17 establishing regulations for commercial cannabis activity within the City of Blythe. The provisions of Ordinance No. 883-17 are codified in Chapter 5.10 (Commercial Cannabis Activity) of Title 5 (Business Licenses and Regulations) and Chapter 17.63E (Commercial Cannabis Related Uses and Activity) of Title 17 (Zoning) of the Blythe Municipal Code (BMC). The City Council also adopted, by resolution, regulations for permitting such businesses. In February 2023, the City Council adopted Ordinance No. 920-23, amending Chapter 5.10 of the BMC for consistency with State law. Pursuant to Chapter
5.10 of the BMC, there are no limits on the number of cannabis cultivation, manufacturer or distributor business permits that may be awarded by the City Council.
Applications for commercial cannabis cultivation, manufacturer, and distributor permits are processed on an on-going basis.
On September 12, 2023, Edelweiss Enterprises, LLC was awarded a Commercial Cannabis Business Permit for a Cultivation and Distribution operation to be located in a vacant building at 1455 W. Hobsonway (the former Kmart) after successfully completing the City's commercial cannabis licensing process. On March 24, 2025, a Business License was issued to Edelweiss Enterprises, LLC for cannabis cultivation at that site.
Edelweiss has been in business since that time.
Earlier this year, Edelweiss contacted the City about expanding their operation at their current location. They are currently operating under a State license which allows for a cultivation site with up to 22,000 square feet of canopy. Edelweiss wished to add an additional 13,000 square feet of canopy to their existing operation. To expand, the State is requiring Edelweiss to establish a separate "premises" at their location and apply for an additional cannabis license. Had the State not had these requirements, Edelweiss -277-
would have been allowed to expand their operation at the existing site under the Cannabis Business Permit previously issued by the City. As the State is requiring a separate license, the City asked Edelweiss to submit a Commercial Cannabis Cultivation Application to the City for review and approval.
STAFF REPORT: To complete the expansion of the Edelweiss cultivation operation, Patrick Kelly, James Shaffer, and Shaenon Adamson submitted an application for a Commercial Cannabis Business Permit for a cultivation operation at 1455 W.
Hobsonway. The site is legally described as APN 836-180-022 and is zoned General Commercial (C-G) which allows for the development of commercial cannabis businesses. The site is currently in operation as a commercial cannabis cultivation facility operated by the above principals.
Staff met with principals of Edelweiss Expansion who provided the information necessary to complete the Commercial Cannabis Cultivation Application process.
Principals for Edelweiss previously completed a background investigation in which nothing was found to preclude them from being issued a Commercial Cannabis Business Permit. On June 30, 2026, staff met with principals of Edelweiss for the Phase Ill interview required of the application process. Staff recommends that Council approve the issuance of an additional Commercial Cannabis Cultivation Permit to Edelweiss for the expansion of the commercial cannabis cultivation operation at 1455 W. Hobsonway in Blythe.

Blythe CITY COUNCIL MEETING
CHATTRES STAFF REPORT
MEETING DATE: July 14, 2026
SUBJECT: Introduction of Ordinance No. 946-26 Prohibiting the Sale and Distribution of Kratom Products in the City of Blythe
PRESENTED BY: Mallory Crecelius, Interim City Manager
PREPARED BY: Mallory Crecelius, Interim City Manager
Brittany Roberto, City Attorney
RECOMMENDATION: It is recommended that the City Council introduce Ordinance No. 946-26:
ORDINANCE NO. 946-26. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BLYTHE, CALIFORNIA, ADDING A NEW CHAPTER 9.96 (PROHIBITION ON SALE AND DISTRIBUTION OF KRATOM PRODUCTS) TO ARTICLE IX (MISCELLANEOUS) OF TITLE 9 (PUBLIC PEACE, MORALS AND WELFARE) OF THE BLYTHE
MUNICIPAL CODE AND FINDING THE ORDINANCE IS EXEMPT FROM ENVIRONMENTAL REVIEW UNDER
THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO CEQA GUIDELINES SECTION 15061(b)(3) (COMMON SENSE EXEMPTION)
FISCAL IMPACT: None
BACKGROUND: Kratom is a tropical tree (mitragyna speciosa) native to Southeast Asia with opioid effects due to its active compounds of mitragynine and 7- hydroxymitragynine (7-OH). According to the United States Drug Enforcement Administration (DEA), consumption of its leaves produces both stimulant effects (in low doses) and sedative effects (in high doses), and can lead to psychotic symptoms, and psychological and physiological dependence. Kratom and 7-OH are not approved by the Food and Drug Administration (FDA) as a food, drug, or dietary supplement. Kratom is often found in energy drinks and pills at gas stations, smoke shops and other retail and online venues. Narcotics experts believe that high concentrate 7-OH can have similar effects as opioids, creating withdrawal, dependency and, in some cases, overdose.
Kratom is largely unregulated in the United States, but rising concerns and health risks including addiction, overdose, liver injury and death have prompted new federal and state regulation efforts. In July 2025, the FDA issued warning letters to companies for illegally marketing products containing 7-OH and recommended that the DEA place 7- OH products on the controlled substances list. In October 2025, the California Department of Public Health (CDPH) issued a statewide consumer warning declaring that foods, dietary supplements, and medical drugs containing kratom or 7-OH are dangerous and illegal to sell in California. As of March 2026, CDPH had seized more than $5 million worth of kratom and 7-OH products under its authority pursuant to the Sherman Food, Drug, and Cosmetic Act. Several counties and cities in California have adopted ordinances to regulate or ban kratom products, recognizing the need to protect public health and safety, especially among vulnerable populations. In October 2025, the Riverside County Board of Supervisors adopted Ordinance No. 1004 to prohibit the sale -279-
or distribution of any kratom product or 7-OH product to a person under 21 years of age, and to prohibit the sale or distribution of any kratom product or 7-OH product with a level of 7-OH that is greater than 2% of the total kratom alkaloids in the product.
Earlier this year, Council directed staff to prepare an ordinance regulating the sale of kratom products modeled after the Riverside County Ordinance.
STAFF REPORT: The Riverside County Ordinance sets a minimum purchase age of 21 for kratom and 7-OH products, prohibits the sale or distribution of products with a level of 7-OH that is greater than 2% of the of the total kratom alkaloids, prohibits the sale or distribution of kratom or 7-OH products that are attractive to children (as defined), prohibits the sale of synthetic kratom products, requires age verification and establishes penalties to ensure safe marketing and protection of minors.
The attached proposed Ordinance largely mirrors the Riverside County Ordinance related to the prohibition on the sale and distribution of kratom and 7-OH products. The main substantive difference between the proposed City Ordinance and the Riverside County Ordinance is that the County Ordinance prohibits the sale of products with a level of 7-OH greater than 2%. After further discussion with the Blythe Police Department, staff believes enforcement of a 2% 7-OH level in kratom products would not be practical, in that vendors would intentionally misrepresent the true concentration of 7-OH in their products and laboratory testing of suspect products would be time consuming and expensive. Other local law enforcement agencies in the County of Riverside, including the City of Riverside, have taken a similar position. Instead, the City's Ordinance, as presented, limits the sale of kratom and 7-OH products to those 21 years of age or older.
Therefore, it is recommended that the City Council introduce Ordinance No. 946-26.
