CALIFORNIA AMERICAN WATER
SUMMARY: California American Water is proposing to retire and demolish the concrete-lined reservoir at the northeast corner of Lemon Avenue and Barranca Road for the eventual sale of that portion of the property. The retirement and demolition are subject to a Conditional Use Permit. After the demolition and grading is completed, the proposal is to sell that portion of the property. A Tentative Parcel Map has been submitted to split the property into two lots along with a Variance to allow for maximum eight-foot-tall perimeter walls and fences. A 20-foot street dedication along Lemon Avenue is a requirement for the subdivision. To facilitate the sale of the property, it is requested that the land use designation and zoning be changed from Public Facilities/Open Space to One-Acre Agriculture Residential Estate.
Three resolutions and an ordinance have been drafted for the land use applications - see Attachments 'A', 'B', 'C' and 'D'. It is recommended that the City Council adopt the three resolutions to approve the Conditional Use Permit, Tentative Parcel Map, Variance, and General Plan Amendment, and introduce the ordinance for the Zone Change.

INTRODUCTION
California American Water owns and operates a water production and supply facility at 1271 Lemon Avenue - see Attachment 'E' for the Assessor Map and Aerial Photo. An open, concrete-lined reservoir is at the westerly portion of the property. This reservoir has been out-of-use for several years, and California American Water has determined that this portion of the property is not needed for their operations. Initially, after retirement and demolition of the reservoir, it was proposed that this portion of the property could be used for equipment and materials storage and staging. California American Water has since decided to sell this portion of the property after the concrete- lined reservoir is demolished and that area backfilled and graded. To sell the property, it needs to be subdivided, and it has been requested that the new westerly lot be available for residential development by amending the General Plan and rezoning the property.
Mr. Shem Hawes of Civiltec Engineering, Inc. fifed Conditional Use Permit Application No. CUP 24-001 for the alterations to the facilities at 1271 Lemon Avenue, Tentative Parcel Map No. 084353 for the lot split, Variance Application No. V 24-003 for eight- foot-tall perimeter walls and fences, and General Plan Amendment No. GPA 24-001 and Zone Change No. ZC 24-001 to designate and rezone the new westerly lot for residential use.
Project Description
The retirement of the open, concrete-lined reservoir includes its demolition along with the pump, pipes and equipment; the backfilling and grading of the reservoir area to bring it up to a level that is consistent with the adjacent areas. Initially, the proposal was to grade the entire westerly portion of the site to be level with the easterly portion. This was estimated to require 26,000 cubic yards of import with an estimate of 3,250 truck October 15, 2024 Page 4 of 11
trips. To reduce this need, the proposed grading was revised to retain some of the slopes along the perimeter of the reservoir area. This revised proposal will require the import of approximately 12,000 cubic yards of structural fill material along with the export of approximately 2,190 tons of demolition debris. Truck trips are to be limited to a maximum of 25 trips per day. All roads and driveways are to remain open during the demolition, grading and construction activities with a traffic control plan that is to be approved by the City Engineer. The haul route will be Lemon Avenue and Mountain Avenue to Interstate 210, and truck trip scheduling has been done in coordination with the City Engineer, the City of Monrovia, and the Monrovia Unified School District.
Hauling is to be done from 8:30 a.m. to 2:00 p.m. when school is in session at Bradoaks Elementary School and from 8:30 a.m. to 12:00 noon on Wednesdays. At other times, truck traffic is to be as stipulated by the City Engineer and the City of Monrovia.
A new drainpipe is to be installed to the east of the reservoir area. A Conditional Use Permit is required for the proposed alterations to the facilities at 1271 Lemon Avenue.
An Oak tree protection plan has been prepared for the areas around the reservoir, and the area will be landscaped with a mixture of hydroseed ground-covering. The proposed plans are provided as Attachment 'G' and are available on the City of Bradbury website and through this link:
https://www.cityofbradbury.org/Lemon%20Reservoir%20Retirement%20Plans.pdf The existing property is a 2.94-acre site. The property is proposed to be split into two lots - see Attachment 'H' for the proposed Tentative Parcel Map, which is available on the City website and through this link:
https://www.cityofbradbury.org/CalAm%20Tentative%20Parcel%20Map%20084353.pdf An easterly 1.12-acre lot (Parcel 'A') is for the existing tank reservoir and equipment, and a westerly lot of 1.65 acres (Parcel 'B') will be the demolished reservoir area. A twenty-foot dedication will be provided for the Lemon Avenue right-of-way, and the berm, retaining walls and fencing along Lemon Avenue in front of the concrete-lined reservoir will be replaced with a new wrought-iron fence set back ten feet from the new property line. A maximum height of eight feet for the new perimeter walls and fences is requested because of the slope of the site.
The property is currently designated for Public Facilities by the Bradbury General Pian Land Use Element and is zoned Open Space by the Bradbury Development Code. The General Plan Land Use Map and Zoning Map are provided as Attachment 'F'. The City of Bradbury General Plan is on the City website and can be accessed by this link:

It is requested that the General Plan Land Use Designation of the new westerly lot be changed to Agriculture/Estate Residential-One Acre and rezoned to A-1 - Agriculture Residential Estate-One Acre Minimum. This would allow the new westerly lot to be sold for residential use, which is consistent with other properties on the north side of Lemon October 15, 2024 Page 5 of 11
Avenue. The easterly lot will retain the Public Facilities designation and Open Space zoning
Environmental Document
The applicant engaged Meridian Consultants to examine the project in accordance with the California Environmental Quality Act (CEQA). It was determined that the project is included in the classes of projects that are exempt from the CEQA provisions. These classes of projects are: Class 1 - Existing Facilities; Class 2 - Replacement or Reconstruction; Class 3 - New Construction or Conversion of Small Structures; Class 4 - Minor Alterations to Land; and Class 15 - Minor Land Divisions. The Categorical Exemption Findings by Meridian Consultants can be accessed on the City of Bradbury website and through this link:
https://www.cityofbradbury.org/Lemon%20Reservoir%20Categorical%20Exemptions%2 0-%20June%202024.pdf
Additionally, the applicant's variance request qualifies as exempt under Class 5 - Minor Alterations in Land Use Limitations; and there is a "Common Sense" exemption for activities such as land use designations and zone changes that do not have the potential for causing a significant effect on the environment.
Planning Commission Actions
At the September 25, 2024, regular meeting, the Planning Commission of the City of Bradbury held a public hearing on the proposed land use applications. After the close of the public hearing, the Planning Commission adopted Resolution No. PC 24-323 (Attachment 'J') to conditionally approve Conditional Use Permit No. CUP 24-001, adopted Resolution No. PC 24-324 (Attachment 'K) to recommend that the City Council conditionally approve Tentative Parcel Map No. 084353 and Variance No. V 24-003, and adopted Resolution No. PC 24-325 (Attachment 'L') to recommend that the City Council approve General Plan Amendment No. GPA 24-001 and Zone Change No. ZC 24-001.
Tentative Parcel Maps, General Plan Amendments, and Zone Changes are subject to City Council approval following a recommendation by the Planning Commission.
Conditional Use Permits are subject to Planning Commission approval provided the decision is not appealed or called up to the City Council. The Planning Commission decision on Conditional Use Permit Application No. CUP 24-001 was called up by a member of the City Council at the Special City Council Meeting on September 30, 2024.
A. CONDITIONAL USE PERMIT NO. CUP 24-001
The Open Space Zone allows for water production and supply facilities with a Conditional Use Permit. The most recent conditional use permit for this California American Water property is CUP No. 13-001 granted by Resolution No. PC 14-236 on August 27, 2014, for a new well, pipelines and equipment.
October 15, 2024 Page 6 of 11
Conditional Use Permit Application No. CUP 24-001 is for the retirement and demolition of the out-of-use, open, concrete-lined reservoir on the westerly portion of the property, and the installation of a new drain pipe along the east area of the reservoir. The demolition of the reservoir and attendant facilities will result in approximately 2,190 tons of demolition debris that will be removed from the site. No soil is to be exported. The demolished reservoir area is to be backfilled and graded to bring it up to a grade level that is consistent with the adjacent areas. This will require the import of approximately 12,000 cubic yards of structural fill material. Grading operations are to average approximately 2,000 cubic yards per day. An Oak tree protection plan has been prepared for the areas around the reservoir, and the area will be landscaped with a mixture of hydroseed ground-covering. The proposed plans are provided as Attachment 'G' and are available on the City of Bradbury website and through this link:
https://www.cityofbradbury.org/Lemon%20Reservoir%20Retirement%20Plans.pdf All roads and driveways are to remain open during the demolition, grading and construction activities with a traffic control plan that is to be approved by the City Engineer. The haul route will be Lemon Avenue and Mountain Avenue to Interstate 210.
Truck trips are to be limited to a maximum of 25 trips per day and scheduling of the truck trips has been done in coordination with the City Engineer, the City of Monrovia, and the Monrovia Unified School District.
It is recommended that Conditional Use Permit No. CUP 24-001 be found to be Categorically Exempt under the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15301 of the CEQA Guidelines for the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. Additional Categorical Exemptions are applicable per Section 15302 of the CEQA Guidelines for replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced; and Section 15304 for minor public or private alterations in the condition of land, water, and/or vegetation which do not invoive removal of healthy, scenic trees except for forestry or agricultural purposes.
The Planning Commission made a series of findings for the decision to approve Conditional Use Permit No. CUP 24-001. The required findings are listed in Section
9.49.030 of Chapter 49 of the Bradbury Development Code. During the public hearing at the September 25, 2024, Planning Commission meeting, several concerns were raised by the neighbors in attendance. The Planning Commission adopted Resolution No. PC 24-323 (Attachment 'J') to approve Conditional Use Permit No. CUP 24-001, which includes conditions to address the neighbors' concerns.
For the City Council review and action, the required findings and recommended conditions are included in the attached draft Resolution No. 24-25 (Attachment 'A'). It is recommended that the City Council adopt Resolution No. 24-25 as presented to October 15, 2024
conditionally approve Conditional Use Permit No. CUP 24-001 with a Categorical Exemption.
B. TENTATIVE PARCEL MAP NO. 084353 AND VARIANCE NO. V 24-003 The existing property is a 2.94-acre site. The easterly portion has a tank reservoir and water supply equipment that is fully operational. The westerly portion has the open, concrete-lined reservoir that has been out-of-use for several years. California American Water has determined that the westerly portion of the property is not needed for their operations, and has decided to sell it, which requires that the property be split into two lots. Tentative Parcel Map No. 084353 has been submitted for this lot split and is attached as Attachment 'H' and is available on the City website at this link:
https://www.cityofbradbury.org/CalAm%20Tentative%20Parcel%20Map%20084353.pdf An easterly 1.12-acre lot (Parcel "A') will be for the existing tank reservoir and equipment, and a westerly lot of 1.65 acres (Parcel 'B') will be the demolished and graded reservoir area that is to be sold. A twenty-foot dedication will be provided for the Lemon Avenue right-of-way. The berm, retaining walls, landscaping and fencing along Lemon Avenue in front of the concrete-lined reservoir will be replaced with new walls and fences set back ten feet from the new property line in accordance with the Lemon/Winston/Royal Oaks Drive North Overlay (Chapter 82). The parkway and ten- foot clear area are to be finished with landscaping and decomposed granite.
Variance Application No. V 24-003 is for a maximum height of eight feet to be allowed for new perimeter walls and fences. This is being requested because of the slope of the site and is being processed in conjunction with the Tentative Parcel Map because the new perimeter walls and fences are for the new westerly lot.
Development Code, and the findings for a variance are listed in Section 9.46.030. The Bradbury Development Code can be accessed on the City website and through this link:
https://library.municode.com/ca/bradbury/codes/code_of ordinances?nodeld=COOR_TI TIXECO. The Planning Commission adopted Resolution No. PC 24-324 (Attachment 'K) to recommend approval of Tentative Parcel Map 084353 and Variance No. V 24-003.
It is recommended that the City Council determine that Tentative Parcel Map No. 084353 and Variance No. V 24-003 be found to be Categorically Exempt under the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15315 for the division of property in urbanized areas zoned for residential, commercial, or industrial use into four or fewer parcels when the division is in conformance with the General Plan and zoning, no variances or exceptions are required, all services and access to the proposed parcels to local standards are available, the parcel was not involved in a division of a larger parcel within the previous two years, and the parcel does not have an average slope greater than 20 percent. Section 15305 of the CEQA Guidelines is for minor alterations in land use limitations in areas with an average slope of less than 20 percent and which do not result in any change in land use or density.
October 15, 2024 Page 8 of 11
For the City Council review and action, the required findings are included in the attached draft Resolution No. 24-26 (Attachment 'B'). It is recommended that the City Council adopt Resolution No. 24-26 as presented to conditionally approve Tentative Parcel Map No. 084353 and Variance No. V 24-003 with Categorical Exemptions.
C. GENERAL PLAN AMENDMENT NO. GPA 24-001 & ZONE CHANGE NO. ZC 24-001 The open, concrete-lined reservoir on the westerly portion of the property has been out of operation for several years and California American Water has determined that this portion of the property is not needed for their operations and should be sold. To facilitate the sale of the property, it is being requested that the land be designated and zoned for residential use.
The property is currently designated for Public Facilities by the Bradbury General Plan Land Use Element and zoned for Open Space by the Zoning Map of the Bradbury Development Code. The General Plan Land Use Map and Zoning Map are provided as Attachment 'F'. The City of Bradbury General Plan is on the City website and can be accessed by this link: BRADBURY GENERAL PLAN.pdf (revize.com). TIXDECO
The Open Space zone allows for public and private recreation and utility facilities with a conditional use permit. Other permitted uses in the Open Space zone are dedicated open spaces, nurseries, and horticultural uses. Residential, commercial and industrial uses are expressly prohibited.
To facilitate the sale of the westerly portion of the property (Parcel 'B' of Tentative Parcel Map No. 084353) California American Water has submitted General Plan Amendment Application No. GPA 24-001 and Zone Change Application No. ZC 24-001 to have the General Plan Land Use Designation changed to Agriculture/Estate Residential-One Acre and rezoned to A-1 - Agriculture Residential Estate-One Acre Minimum. This will allow the new Parcel 'B' to be developed for residential use, which is consistent with the plans, purposes, policies, goais, and objectives of the General Plan and with other properties on the north side of Lemon Avenue. The easterly lot (Parcel 'A') will retain the Public Facilities designation and Open Space zoning and will continue to be operated as a water production, treatment, and supply facility.
When changing the Land Use Designation or Zoning of a property, Senate Bill 18 (Chapter 905, Statutes of 2004, Government Code Section 65352.3) requires that the lead agency (i.e., the City of Bradbury) notify California Native American Tribes that are identified by the Native American Heritage Commission as potentially having traditional lands or cultural places within the jurisdiction of the City, of the opportunity to consult on the proposed project. Native American Tribes wishing to consult with the City are required to contact the City within 90 days of having received the notice. Notices were mailed and emailed on June 28, 2024. The Gabrieleño Band of Mission Indians - Kizh Nation requested consultation. A meeting was held with representatives of the Tribe on October 15, 2024 Page 9 of 11
September 17, 2024, and it was explained that the subject property and this region are part of the ancestral territories of the Tribe and that cultural artifacts and remains may be uncovered by the excavation activities for the reservoir retirement project. To protect any cultural artifacts and remains that may be discovered, the Tribe has provided Tribal Cultural Resource Mitigation Measures (Attachment T) that are to be implemented during applicable activities.
For the decision to recommend approval of General Plan Amendment No. GPA 24-001 and Zone Change No. ZC 24-001, the Planning Commission found that the project is consistent with the City of Bradbury General Plan and Bradbury Development Code.
The Planning Commission adopted Resolution No. PC 24-325 (Attachment 'L') to recommend approval of General Plan Amendment No. GPA 24-001 and Zone Change No. ZG 24-001.
It is recommended that the City Council determine that General Plan Amendment No.
GPA 24-001 and Zone Change No. ZC 24-001 be determined to qualify as exempt under the provisions of the California Environmental Quality Act (CEQA) pursuant to the common sense exemption set forth in Section 15061(b)(3) of the CEQA Guidelines that CEQA only applies to projects which have the potential for causing a significant effect on the environment and where it can be seen with certainty that there is no possibility that the activity will have a significant effect, the activity is not subject to CEQA. The change to the Land Use Designation and Zone Change of the property will not have any physical impacts on the environment. Furthermore, a development of the property in accordance with the new Land Use Designation and Zoning would be Categorically Exempt under the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15303 for new construction of one single-family residence, or a second dwelling unit in a residential zone; or in an urbanized area, up to three single- family residences; and accessory (appurtenant) structures including garages, carports, patios, swimming pools, and fences.
For the City Council review and action, the required findings are included in the attached draft Resolution No. 24-27 (Attachment 'C') for the General Plan Amendment, and in the attached draft Ordinance No. 394 (Attachment 'D') for the Zone Change.
It is recommended that the City Council adopt Resolution No. 24-27 as presented to approve General Plan Amendment No. GPA 24-001 with an Exemption pursuant to CEQA Guidelines.
It is further recommended that the City Council approve Zone Change No. ZC 24-001, and introduce Ordinance No. 394 as presented with an Exemption pursuant to CEQA Guidelines, and schedule a second reading and adoption of Ordinance No. 394 for the November 19, 2024, regular City Council meeting.

CalAm - 1271 Lemon Avenue -8-
Resolution No. 24-25
i. All plans must be coordinated with each other and with the Arborist Report regarding existing trees. All existing trees must be shown accurately on all the plans, with indication of which will be protected, and which are proposed for removal. Tree protection notes must be added to all plans, and locations of structures, utilities, storm water facilities, paving, and soil compaction are to be checked for any conflicts with protected and proposed new and relocated trees.
j. The completed landscape plans must be coordinated with building, grading, and utility plans, as well as with the project Arborist in finalizing trees to be removed, relocated, or protected in place, and in locating and detailing tree protection fencing and other protective measures. Tree removals require a Tree Permit, and the project design shall be coordinated with the Arborist and City Landscape Architect to verify that the removals are necessary, and for the provision of any relocation and replacement trees. k. Tree preservation notes shall be included on the plan check submittal Landscape Plan, Site Plan, and Grading Plans, and must be coordinated with the project Arborist's recommendations. Notes must be added requiring chain-link fencing at driplines for all protected Oak trees on the property throughout construction, and notes prohibiting hardscape construction, grading, compaction, trenching, storage of materials, vehicles, or debris, and washing of chemicals or equipment within protection zones for any trees to remain (not just Oaks) must be on the plans. Any demolition or disturbance of soil within tree protection zones shall be done with hand tools under an Arborist's supervision. These measures must be continuously maintained throughout construction.
I. The Grading Plan shall be developed to avoid impacts on existing trees, with appropriate drainage patterns, and erosion control measures. Site storm water is to be captured on the property and allowed to percolate into the ground to the greatest extent possible based on the City Engineer's direction. In developing the grading layout, the project Civil Engineer must allow the existing elevation levels to be maintained at the bases of trees to remain because any cut or fill in excess of two inches tends to destabilize or kill trees. Additionally, because good drainage is essential for tree health, grading shall not allow storm water to settle around the bases of trees.
SECTION G. Pursuant to Development Code Chapter 7 (Permit/Entitlement Implementation and Time Extensions). To ensure continued compliance with the provisions of this chapter, each approved permit or entitlement shall be exercised within 18 months from the date of approval, unless otherwise specified in the permit or entitlement. Time extensions may be granted by the Review Authority. If a permit or entitlement has not been exercised with the established time frame, or any extension thereof, the approval shall be deemed void. If litigation is filed prior to the exercise of such rights attacking the validity of such permit or entitlement, the time for exercising such rights shall be automatically extended pending a final determination of such litigation. An application for an extension of time shall be filed by the applicant with the City at least 30 days before the expiration of the subject permit or entitlement. The applicant shall present substantial evidence that the applicant has made a good faith effort to establish the permit or entitlement. If the Review Authority determines that the permittee has proceeded in good faith and has exercised due diligence in seeking to establish the permit or CalAm - 1271 Lemon Avenue -9-

A MAXIMUM HEIGHT OF EIGHT FEET FOR THE PERIMETER WALLS,
FENCES AND GATES OF THE NEW WESTERLY LOT (PARCEL 'B' OF TENTATIVE PARCEL MAP NO. 084353) AT 1271 LEMON AVENUE
WHEREAS, on September 25, 2024, the Planning Commission of the City of Bradbury, California held a duly noticed public hearing on applications for Tentative Parcel Map No. 084353 and Variance No. V 24-003 that were filed by Mr. Shem Hawes of Civiltec Engineering, Inc. for the property owner, California American Water for a two-from-one lot split and eight-foot-tall perimeter walls, fences and gates on the new westerly lot at 1271 Lemon Avenue. The property is zoned OS (Open Space) has an area of 2.34 acres and is assigned Assessor Parcel Number 8527-025-020; and WHEREAS, after the close of the public hearing and the consideration of all evidence presented, both written and oral, the Planning Commission adopted Resolution No. PC 24-324 to recommend that the City Council conditionally approve Tentative Parcel Map No. 084353 and Variance No. V 24-003; and
WHEREAS, on October 15, 2024, the City Council of the City of Bradbury, California held a duly noticed public hearing to consider the applications for Tentative Parcel Map No. 084353 and Variance No. V 24-003, at which time the City Council considered all evidence presented, both written and oral;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BRADBURY, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION A. The City Council finds that the foregoing recitals are true and correct.
SECTION B. The City Council finds that the information in the agenda report, and the testimony at the public hearing are incorporated in this Resolution and comprises the bases on which the findings have been made.
SECTION C. The City Council finds that the lot split complies with the standards of the Bradbury Development Code and that the subdivision will meet all of the required findings for approval.
SECTION D. The City Council finds that the project satisfies the following findings stated in Section 9.46.030 of Chapter 46 (Variance) of the Bradbury Development Code:
1. That there are special circumstances applicable to the property, including size, CalAm - 1271 Lemon Avenue -1- Resolution No. 24-26
shape, topography, location, or surroundings, which do not generally apply to other properties in the same vicinity and zone. The topography and terrain of the property are such that the requested height of eight feet for the perimeter walls, fences and gates are necessary to adequately secure the property.
2. That because of such circumstances or conditions, such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property similarly situated, but which is denied to the property in question. The size, topography, terrain and configuration of the property necessitates the additional height to adequately secure the property.
3. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the adjacent properties. The additional height will not result in any adverse impacts to the adjacent neighbors, and the adjacent rights-of-way.
4. That the granting of the variance will not adversely affect the General Plan nor the purpose and intent of the provisions of the Bradbury Development Code. The requested variance will not have an adverse effect on the General Plan or the Development Code. The proposed project is in furtherance of the General Plan, and the Development Code provides for such a variance.
5. The proposed entitlement has been reviewed in compliance with the provisions of the California Environmental Quality Act (CEQA) and is in compliance with the provisions of CEQA. The variance is exempt as a minor alteration in land use limits per the CEQA Guidelines.

TRIBAL CULTURAL RESOURCE MITIGATION MEASURES
GABRIELEÑO BAND OF MISSION INDIANS - KIZH NATION
GABRIELEÑO BAND OF MISSION INDIANS - KIZH
NATION
California State Recognized Aboriginal Tribe of the Los Angeles Basin (Historically known as the Gabrieleño Tribal Council - San Gabriel Band of Mission Indians) Kish Nation Kich Nation
GABRIELENO BAND OF MISSION INDIANS - KIZH NATION - PROPOSED TCR MITIGATION MEASURES TCR-1: Retain a Native American Monitor Prior to Commencement of Ground-Disturbing Activities A. The project applicant/lead agency shall retain a Native American Monitor from or approved by the Gabrieleño Band of Mission Indians - Kizh Nation. The monitor shall be retained prior to the commencement of any "ground-disturbing activity" for the subject project at all project locations (i.e., both on-site and any off-site locations that are included in the project description/definition and/or required in connection with the project, such as public improvement work). "Ground- disturbing activity" shall include, but is not limited to, demolition, pavement removal, potholing, auguring, grubbing, tree removal, boring, grading, excavation, drilling, and trenching.
B. A copy of the executed monitoring agreement shall be submitted to the lead agency prior to the earlier of the commencement of any ground-disturbing activity, or the issuance of any permit necessary to commence a ground-disturbing activity.
C. The monitor will complete daily monitoring logs that will provide descriptions of the relevant ground-disturbing activities, the type of construction activities performed, locations of ground- disturbing activities, soil types, cultural-related materials, and any other facts, conditions, materials, or discoveries of significance to the Tribe. Monitor logs will identify and describe any discovered TCRs, including but not limited to, Native American cultural and historical artifacts, remains, places of significance, etc., (collectively, tribal cultural resources, or "TCR"), as well as any discovered Native American (ancestral) human remains and burial goods. Copies of monitor logs will be provided to the project applicant/lead agency upon written request to the Tribe.
D. On-site tribal monitoring shall conclude upon the latter of the following (1) written confirmation to the Kizh from a designated point of contact for the project applicant/lead agency that all ground-disturbing activities and phases that may involve ground-disturbing activities on the project site or in connection with the project are complete; or (2) a determination and written notification by the Kizh to the project applicant/lead agency that no future, planned construction activity and/or development/construction phase at the project site possesses the potential to impact Kizh TCRs.
TCR-2: Unanticipated Discovery of Tribal Cultural Resource Objects (Non-Funerary/Non-Ceremonial) A. Upon discovery of any TCRs, all construction activities in the immediate vicinity of the discovery shall cease (i.e., not less than the surrounding 50 feet) and shall not resume until the discovered TCR has been fully assessed by the Kizh monitor and/or Kizh archaeologist. The Kizh will recover and retain all discovered TCRs in the form and/or manner the Tribe deems appropriate, in the Tribe's sole discretion, and for any purpose the Tribe deems appropriate, including for educational, cultural and/or historic purposes.
TCR-3: Unanticipated Discovery of Human Remains and Associated Funerary or Ceremonial Objects A. Native American human remains are defined in PRC 5097.98 (d)(1) as an inhumation or cremation, and in any state of decomposition or skeletal completeness. Funerary objects, called associated grave goods in Public Resources Code Section 5097.98, are also to be treated according to this statute.
B. If Native American human remains and/or grave goods are discovered or recognized on the project site, then Public Resource Code 5097.9 as well as Health and Safety Code Section 7050.5 shall be followed.
C. Human remains and grave/burial goods shall be treated alike per California Public Resources Code section 5097.98(d)(1) and (2).
D. Preservation in place (i.e., avoidance) is the preferred manner of treatment for discovered human remains and/or burial goods.
E. Any discovery of human remains/burial goods shall be kept confidential to prevent further disturbance.
PLEASE NOTE THE FOLLOWING:
Any/all revisions to the Kizh's proposed TCR mitigations set forth above must be requested in writing, and not more than ten (30) calendar days from the date that we consulted on the subject Project so that we can conclude consultation. Requested revisions shall be delivered to the Kizh via email at [email protected], and in a Word document, redline format. Please include as the email subject: "REQUEST FOR MITIGATION REVISIONS," and identify the project name and location/address. If revisions are not requested within 10 calendar days of consultation, the Kizh's proposed mitigations are presumed accepted as proposed (i.e., as set forth above). SECTION A. The Planning Commission finds that a duly noticed public hearing has been conducted at the regular meeting on September 25, 2024, in accordance with the provisions of the Bradbury Municipal Code relative to this matter.
SECTION B. The Planning Commission finds and declares that the information in the agenda report, and the testimony at the public hearing are incorporated in this Resolution and comprises the bases on which the findings have been made.
SECTION C. The Planning Commission finds and declares that the lot split complies with the standards of the Bradbury Development Code.
SECTION D. The Planning Commission declares that the project satisfies the following findings stated in Section 9.46.030 of Chapter 46 (Variance) of the Bradbury Development Code:
1. That there are special circumstances applicable to the property, including size, shape, topography, location, or surroundings, which do not generally apply to other properties in the same vicinity and zone. The topography and terrain of the property are such that the requested height of eight feet for the perimeter walls, fences and gates are necessary to adequately secure the property.
2. That because of such circumstances or conditions, such variance is necessary for the preservation and enjoyment of a substantial property right CalAm - 1271 Lemon Avenue 1 PC 24-324
possessed by other property similarly situated, but which is denied to the property in question.
The requested variance will not have an effect on the General Plan or the Development Code.
SECTION E. The Planning Commission finds and declares that the Tribal Cultural Protection Measures as determined to be applicable through the SB 18 consultation will be implemented.
SECTION F. The Planning Commission finds that the project is Categorically Exempt under the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15305 of the CEQA Guidelines for minor alterations in land use limitations in areas with an average slope of less than 20 percent and which do not result in any change in land use or density; and pursuant to Section 15315 for the division of property in urbanized areas zoned for residential, commercial, or industrial use into four or fewer parcels when the division is in conformance with the General Plan and zoning, no variances or exceptions are required, all services and access to the proposed parcels to local standards are available, the parcel was not involved in a division of a larger parcel within the previous two years, and the parcel does not have an average slope greater than 20 percent.
SECTION G. The Planning Commission hereby recommends to the City Council conditional approval of Tentative Parcel Map No. 084353 and Variance No. V 24-003 for the project based on the submitted information and plans, subject to the following conditions to be complied with to the satisfaction of the City Manager or designees:

VIA EMAIL - Saturday, October 5, 2024
Dear Gentlepersons:
This letter is in regards to the proposed demolition and construction projects (collectively, the "Project") under discussion for Lemon Avenue in Bradbury/Monrovia, down the street from Bradoaks Elementary School. I write as the owner of 500 Terrado Drive (the "Property"), which sits directly across from the site of the proposed work.
First and foremost, we must agree that it is incumbent on the members of the Bradbury City Council, in partnership with California American Water, to reassure all affected residents that the Project will have no negative effect, financially or otherwise, on the health, personal safety or property of those living in the immediate area. It is therefore demanded that Bradbury City Council, California American Water, and all involved parties take no additional action that could result in financial or physical harm without consideration and formal response to the concerns stated herein.
Some questions repeated amongst the residents living closest to the Project are as follows:
1. What benefit to the affected residents, Bradoaks Elementary School students, and staff is there in requesting an EPA waiver, versus the benefit to each if all EPA guidelines were instead followed?
2. What steps will be taken to ensure no latent chemicals, toxic earth or building materials will be released into the immediate environment during the demolition and construction phases of the Project?
3. Should any residents experience adverse health effects during or after completion of the Project, presumed caused directly or indirectly by the Project, which partner entity to the Project will be held liable?
4. If personal vehicles parked on or near the Property are vandalized, damaged, or otherwise devalued, presumed caused directly or indirectly by the Project, which partner entity to the Project will be held liable?
5. If the Property is vandalized, damaged, or otherwise devalued, presumed caused directly or indirectly by the Project, which partner entity to the Project will be held liable?
State, City and Community guidelines (including Bradbury) encourage open-air ventilation during warmer months both for economic and environmental conservation reasons.
6. What allotment of funds has been set aside in the Project to compensate residents who are unable to leave windows open due to air pollution, dust, particles, and noise, directly caused by the Project?
We understand plans for the Project presently include dozens of heavy vehicles trafficking a very narrow residential route daily.
7. Following each day's work, which entity will be responsible for cleaning and removing debris, nails, scrap metal, etc. from the roadway, so as to responsibly protect residential property and personal safety?
8. If any vehicle or property is damaged or otherwise devalued following an incident involving the aforementioned road debris, which partner entity to the Project will be held liable?
It is impossible to imagine a scenario in with the Project doesn't interfere with my ability to work from home. I'm a full-time employee of Warner Bros. Discovery, with an elevated interest in maintaining acceptable noise levels in order to conduct my business, which is often over the phone and thru video conferencing.
9. Assuming a Project-timeline of months (if not a year or more), what steps will be taken to eliminate noise pollution for the surrounding homes during business hours 8:00AM - 6:00PM, Monday thru Friday?
Each of the affected residents were living here during Bradbury's last approved demolition project at this exact location in 2015-2017 (California American Water/water tank demo/rehabilitation), and suffered long-lasting damage to both our property, security and happiness (i.e. several blown tires from debris in the road, constant, thick layers of dirt both inside our Property and out, acute health issues, security guards having nighttime trysts in full view, etc.) despite assurances similar to those being offered in this case.
Please know that in the years since the 2015-2017 California American Water fiasco, the number of young families with children living on our block has in fact grown considerably, and with that our concern that for the duration of this new Project, the air they breathe will be less clean, their birdsongs replaced by the constant grind of machinery heard through our now-always-closed windows, and perhaps most striking, their morning walks to Bradoaks Elementary now far less safe and secure.
"ALL THIS FOR ONE HOUSE"
You must understand the frustration already apparent amongst the residents of this block, and that our legitimate concerns will not be ignored. Should you wish to approach each of the residents as partners in this endeavor, we remain open to those discussions. In that hope, our neighborhood can remain the quiet, peaceful block it has been for many more years.
This letter has been circulated to all parties, and will be discussed in-person at first opportunity. All rights reserved.
Sincerely,
Andrew Fash

Contract Negotiations Update - Bradbury Road Widening Project
SUMMARY
On August 20, 2024, City Council rejected the single bid received for the Bradbury Road Widening project as it was more than triple the amount of the Engineer's estimate. The City Council also authorized staff to contact several local contractors in order to negotiate a more reasonable construction bid for the proposed work.
work. Due to the complexity of the project, the contractors have not returned with complete City staff has been in communication with several contractors interested in performing the remaining bid items so that the City has a complete bid. bid schedules and staff is continuing to work with the prospective bidders to finalize the last It is recommended that the City Council: 1) allow City staff to continue contract negotiations with two (2) contractors; and 2) set a value cap of $600,000 for the total construction cost to use for negotiations.
BACKGROUNDIANALYSIS
Following the rejection of bids on the August 20, 2024 City Council meeting, City staff Bradbury Road Widening project. Initial conversations from the contractors have shown that promptly made contact with contractors willing and capable of performing the work for the existing considerable workloads would result in a slower than usual response time for a construction bid.
As the contractors started compiling their costs for the items listed in the bid schedule, they found it difficult to find quotes for certain items requested in the bid. that are willing to perform the work. As a result, City staff is currently examining certain modifications to portions of the contract, as well as aiding the contractors to find subcontractors that are willing and able to perform the work.
Partial bid schedules have been submitted to the City while the remaining quotes for specific items are obtained. From analyzing the partial bids already submitted and inputting estimated amounts for the remaining items, City staff has determined that the construction contract should be in the $500,000 - $600,000 range. Staff is recommending that the City Council allow for a cap of $600,000 to use to continue negotiations with the contractors.
Once negotiations are complete, City staff will bring back a negotiated contract amount for City Council approval of a formal contract. Staff anticipates that this will be completed for the November City Council meeting.
FINANCIAL REVIEW
No fiscal impact results from the action of the City Council on this item. Future fiscal information will be obtained when the contract is finalized and will be presented at the time of contract award.
STAFF RECOMMENDATION
It is recommended that the City Council:
1. Instruct City Staff to continue in contract negotiations with two (2) contractors;
2. Set a value cap of $600,000 for the total construction cost to use for contract negotiations.
