SUBJECT: Returning of SB 1383 Local Assistance Grant Funds
SUMMARY
On April 27, 2022, the City of Bradbury was awarded $20, 103 from CalRecycle as part of their SB 1383 Local Assistance Grant Program. The grant timeline was from April 27, 2022 to November 1, 2024. The grant is heavily restricted and was awarded to support compliance with SB 1383 mandates, including the implementation of organic waste reduction and recycling programs. Due to severe grant restrictions and the City's SB 1383 low population waiver, $18,427.41 remains unused. Staff was aware of potential challenges in fully utilizing the grant funds when the grant was accepted, given the City's unique circumstances. Returning these funds to CalRecycle ensures compliance with grant requirements and maintains the City's good standing for future grant funding opportunities.
DISCUSSION
In January 2022, CalRecycle announced a one-time grant program meant to aid jurisdictions in the implementation of the SB 1383 regulations. SB 1383 is a California law aimed at reducing organic waste disposal in landfills by 75% and recovering at least 20% of edible food for human consumption by 2025 to combat climate change and improve food security. The grant term was from April 2022 through November 2024. Regulation requirements associated with the SB 1383 Local Assistance Grant includes the following:
• Capacity Planning
• Collection
• Edible Food Recovery
• Education and Outreach
• Enforcement and Inspection
• Procurement Requirements
• Record Keeping
Since the City of Bradbury possesses a SB 1383 low population waiver, it is exempt from mostly all of the SB 1383 regulation requirements and staff was aware of potential challenges in fully utilizing the grant funds when the grant was accepted. Staff was restricted to using the funds for the procurement component of the grant regulation requirements and successfully purchased $1,675.59 worth of eligible recycled copy paper.
FINANCIAL ANALYSIS
An amount not-to-exceed $18,427.41 will be allocated from Fund 209, "SB 1383 Organic Waste Recycling."
STAFF RECOMMENDATION
Staff recommends that the City Council authorize the return of $18,427.41 in unused SB 1383 Local Assistance Grant funds to CalRecycle to comply with grant requirements and preserve the City's eligibility for future funding opportunities.
