SUBJECT: ASSIGNMENT AGREEMENT BETWEEN THE CITY OF

BRADBURY, CALIFORNIA AND FOOTHILL TRANSIT FOR

PROPOSITION A LOCAL RETURN FUND EXCHANGE
ATTACHMENTS: 1. Assignment Agreement with Foothill Transit

SUMMARY
It is recommended that the City Council approve Staff to execute an Assignment Agreement for the exchange of $82,250.39 of the City's Proposition A Transit Funds for $61,687.79 of unrestricted general funds from Foothill Transit.

DISCUSSION
Proposition A funds are provided by a ½ cent sales tax distributed to cities on a per capita basis. These restricted funds may only be used for transit services and bus stop maintenance and improvements. The City is proposing to sell $82,250.39 in Proposition A funds this fiscal year. This total comprises of an accumulation from Fiscal Years 21- 22, 22-23, and 23-24. Fiscal year 24-25 is not yet a complete year, so this was excluded from the transition and may be sold at a future transition one or more years from now.

Since the inception of these funds, it has been difficult for the City to find projects with eligible expenses.

Last month, Staff contacted local government agencies throughout the area to find a willing buyer for the City's Proposition A funds. Based on the information received from the listserv, the going exchange rate for Proposition A funds is around $0.70. The highest FOR CITY COUNCIL AGENDA AGENDA ITEM #
Proposition A Fund Exchange

Page 2 of 2 ends

bid to purchase the Proposition A funds was from Foothill Transit. Foothill Transit offered an exchange rate of $0.75 on the dollar, or $61,687.79 of unrestricted general funds.

The City has previously sold Prop A funds, and the following are the agencies and exchange rates involved in the transactions:

Year: Agency: Exchange Rate:
2017 City of Duarte $0.70
2021 City of Beverly Hills $0.80
2025 (Proposed) Foothill Transit $0.75
City Staff had reached out to the City of Beverly Hills to inquire if they were interested in exchanging with Bradbury, especially since they have an unusually high rate.

Unfortunately, Beverly Hills advised City Staff that they were no interested in purchasing Prop. A funds from Bradbury at this time.

The attached Assignment Agreement states that the exchange in funds will be transmitted in one payment by both parties no later than thirty (30) days from the execution of the Assignment Agreement. In addition, Foothill Transit will be responsible for reporting to the Los Angeles County Metropolitan Transit Authority (MTA) regarding the receipt and use of the 'assigned' Proposition A funds.

FINANCIAL ANALYSIS
Should the City Council approve the Assignment Agreement, the City's unrestricted general fund balance would increase by $61,687.79 and the Proposition A fund balance would be reduced by $82,250.39, based upon an exchange rate of $0.75 per $1.00 of Proposition A funds. The additional unrestricted general fund revenue could assist the City with funding other City operations or infrastructure projects.

RECOMMENDATION
It is recommended that the City Council approve a one-time agreement with Foothill Transit to permit the exchange of $82,250.39 of Proposition A Transit funds in return for unrestricted general fund revenue at $0.75 on the dollar.

SUBJECT: 1271 LEMON AVENUE - CALIFORNIA AMERICAN WATER

CONTINUED PUBLIC HEARING

RECOMMENDATION
It is recommended that the public hearing for the 1271 Lemon Avenue project be continued as open to the March 18, 2025 regular City Council meeting.

SUMMARY
California American Water is proposing to retire and demolish the concrete-lined reservoir at the northeast corner of Lemon Avenue and Barranca Road for the eventual sale of that portion of the property. The retirement and demolition are subject to a Conditional Use Permit. A Tentative Parcel Map has been submitted to split the property into two lots along with a Variance to allow for maximum eight-foot-tall perimeter walls and fences. To facilitate the sale of the new westerly lot, it is requested that the General Plan Land Use Designation of that lot be changed from Public Facilities to Agriculture/Estate Residential-One Acre, and that the zoning be changed from 'OS' Open Space to 'A-1' Agriculture Residential Estate, One Acre Minimum. Three resolutions and an ordinance have been drafted for these land use applications.

At the October 15, 2024 Regular Meeting, the City Council opened the public hearing and accepted testimony from the applicant and several neighbors. The Council continued the public hearing as open to the next regular meeting on November 19, 2024 to allow for the applicant to meet with the neighbors and officials of the City of Monrovia and Bradoaks Elementary School to address their concerns. 1271 Lemon Avenue - Continued Public Hearing Page 2 of 2 The October 15, 2024 agenda packet, which includes the agenda report, the draft resolutions and ordinance, proposed plans, and links to the environmental documents and other related material is available on the City website via this link:
https://www.cityofbradbury.org/2024 10 15%20CC%20Meeting%20Agenda.pdf.

On October 30, 2024, the applicant informed City staff that they have contacted the City of Monrovia and Bradoaks Elementary School for meeting dates, but the meetings had yet to be scheduled. As a result, the public hearing was continued as open to the January 21, 2025 regular meeting.

For the January 21, 2025 meeting, the applicant informed staff that the meetings were still not scheduled, and the public hearing was continued as open to the February 18, 2025 meeting.

The applicant has not yet scheduled the meeting(s) with the neighbors and officials of the City of Monrovia and Bradoaks Elementary School. It is therefore recommended that the public hearing for the 1271 Lemon Avenue project be continued as open to the March 18, 2025 regular City Council meeting.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BRADBURY, CALIFORNIA, ADOPTING THE 2025 LOCAL

HAZARD MITIGATION PLAN AND MAKING A CEQA EXEMPTION

DETERMINATION
ATTACHMENTS: 1. Resolution 25-04

2. 2025 Bradbury Local Hazard Mitigation Plan

RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. 25-04 adopting the 2025 City of Bradbury Local Hazard Mitigation Plan and provide the City Manager authorization to sign and submit any additional documentation required to certify Council action approving the Plan.

SUMMARY
The City of Bradbury periodically proposes updates to the Local Hazard Mitigation Plan (LHMP) to ensure that the plan meets local, state, and federal requirements. This is accomplished through the comprehensive review of the current plan, its policies, ano goals. A Hazard Mitigation Planning Committee (HMPC) was created from across the various departments (City Manager, Management Analyst, Planning, LA County Fire Department, and the LA County Sherriff's Department) as well as key stakeholders, and neighboring jurisdictions. To support the effort, the City hired a consulting firm that was tasked with managing the update process, facilitated meetings with the HMPC, updated the planning document and helped coordinate with state and federal reviewers (Cal OES and FEMA, respectively). As part of the update process, the plan is also required to be made available to the public to allow for input, questions, review and comment.

BACKGROUND
The City of Bradbury prepared and adopted its previous LHMP in 2019 to ensure that the natural and human-caused hazards the City faces are adequately understood and the City maintained eligibility for FEMA hazard mitigation related grant funding opportunities.

As part of Bradbury's General Plan adoption that occurred on August 16, 2022, the 2019 LHMP was integrated into the Safety Element. In late 2023 the City began the process to initiate an update to the Health & Safety Element and is currently underway. In early 2024 the City decided to initiate the required 5-year update to the LHMP to ensure continued eligibility of FEMA hazard mitigation grant funding.

Content within the LHMP is governed by the Federal Emergency Management Agency (FEMA), under the Stafford Act as amended by the Disaster Mitigation Act of 2000 (DMA 2000), requires that the City's Local Hazard Mitigation Plan is updated to ensure that a community focuses on the reduction of loss of life and property, human suffering, and economic disruption, and provide disaster assistance for costs resulting from natural disasters. This must be done in order to maintain eligibility for federal grant opportunities under the Hazard Mitigation Grant Program (HMGP), Flood Mitigation Assistance (FMA), and Building Resilient Infrastructure and Communities (BRIC) programs.

One of the many requirements to receive State and Federal approval includes incorporating community feedback, as well as, developing a robust planning team of key community stakeholders with expertise on local hazards. With the leverage of Bradbury's community outreach efforts (emphasizing vulnerable populations), input was received from community members through online surveys, presentations at public meetings (City Council/ Public Safety Committee), the City's Newsletter, and promotional materials made available at community events. The planning team consisted of City departments and various key stakeholders provided with invitations to participate including school districts, utility providers, neighboring cities, and County and State agencies.

The 2025 LHMP received pending approval letter from FEMA on January 13, 2025 allowing the plan to be officially adopted by City Council. Once adopted, the final resolution (Attachment 1) will be submitted to FEMA to meet the continual update requirements of the Disaster Mitigation Act of 2000 and maintain the City's eligibility for mitigation grant funding.

ANALYSIS
The 2025 City of Bradbury LHMP assesses the significant natural and human-caused hazards that may affect the City and its inhabitants. The plan evaluates these relevant hazards, assesses the population and potentially vulnerable structures and recommends mitigation strategies and actions to be implemented in the future to reduce these vulnerabilities, which is intended to create a more resilient community. These future mitigation actions include policies, programs, projects, and tools to implement over the long term to help reduce and eliminate any loss of life, and to prevent future economic, infrastructure or personal property losses community wide. Public noticing for the proposed actions was posted on Friday, February 14, 2025 at City Hall as well as the City website. As of the date of this report, the City has not received any written or oral public comments received in favor or opposition.

ENVIRONMENTAL ANALYSIS
The proposed update to the LHMP is exempt from the requirements of the California Quality Act (CEQA) per CEQA Guidelines Section 15061(b)(3) as the LHMP is an activity covered by the general rule that CEQA applies only to projects, which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Therefore, no further CEQA analysis is required.

CONCLUSION
Adoption of this LHMP affords the City of Bradbury the ability to pursue FEMA grant funding to support mitigation activities within the City. In addition, adoption per Resolution No. 25-04 ensures the City can comply with Assembly Bill 2140 from 2006, allowing the City to integrate the LHMP into the General Plan Safety Element. Compliance with this bill allows the City to receive additional disaster assistance through the California Disaster Assistance Act.

RESOLUTION NO. 25-04

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BRADBURY, CALIFORNIA, ADOPTING THE 2025

LOCAL HAZARD MITIGATION PLAN AND

MAKING A CEQA EXEMPTION DETERMINATION
WHEREAS, The Disaster Mitigation Act of 2000 ("Act") (Pub. L. 106-390), as implemented by 44 CFR § 201.6, mandates that local governments wishing to be eligible for federal hazard mitigation grant funding, adopt a Federal Emergency Management Agency ("FEMA") approved local hazard mitigation plan.

WHEREAS, The California Office of Emergency Services has approved the proposed City of Bradbury 2025 Local Hazard Mitigation Plan ("LHMP", sometimes herein). FEMA has approved the LHMP pending adoption of this Resolution.

WHEREAS, The LHMP identifies and assesses hazards to which the City is most vulnerable and sets forth coordinated mitigation strategies to reduce its vulnerability to the risks inherent in natural and human-caused hazards. The approved and adopted LHMP will make the City eligible to apply for FEMA grant funding to reduce vulnerability to disasters within the community and help it recover more quickly and effectively if and when disasters occur;
NOW, THEREFORE, the City Council of the City of Bradbury does resolve as follows:

SECTION 1. The facts set forth in the Recitals, above, are true and correct.

SECTION 2. The City Council hereby adopts the City of Bradbury 2025 Local Hazard Mitigation Plan, a full, true and correct copy, of which is on file in the Office of the City Manager and is incorporated by reference herein.

SECTION 3. Add the following language to the Bradbury General Plan Safety Element to ensure AB 2140 Compliance:
"The Local Hazard Mitigation Plan (LHMP) for the City of Bradbury planning area was developed in accordance with the Disaster Mitigation Act of 2000 (DMA 2000) and followed FEMA's Local Hazard Mitigation Plan guidance. The LHMP incorporates a process where hazards are identified and profiled, the people and facilities at risk are analyzed, and mitigation actions are developed to reduce or eliminate hazard risk. The implementation of these mitigation actions, which include both short and long-term strategies, involve planning, policy changes, programs, projects, and other activities." (Add LHMP Website Link)
Reso. No. 25-04 February 18, 2025
SECTION 4. Based on its independent judgement, the City Council hereby finds and determines that adoption of the HMP is exempt from the requirements of the California Environmental Quality Act ("CEQA") pursuant to CEQA Guidelines Section 15061 (b)(3) because it can be seen with certainty that there is no possibility that such adoption will have a significant effect on the environment. The adoption of the proposed LHMP is an administrative process of the City that will not result in direct or indirect physical changes in the environment.

APPROVED AND ADOPTED this 1gth day of February, 2025.

SUMMARY
This item prompts a discussion on Bradbury Night Out and recommends approval of the CArts Jazz Band performance and renting of an audio system.

BACKGROUND
The Bradbury Night Out date is tentatively scheduled for June 19, 2025 from 6-8pm. Staff it 1) As such, saveral sio i are eat idea for od
event and look forward to joining the City on this date and time.

Last year, The City invited the CArts Jazz Band which turned out to be a favorite amongst many event participants. Additionally, with City Council approval, staff hired Pacific Productions (Pacific) to provide technical audio services for Bradbury Night Out.

Pacific supplied an audio equipment rental and technical support for $900, ensuring clear sound for background music and the Mayor's speech through four speakers positioned at the front and rear of City Hall. Additionally, the on-site technician assisted the CArts jazz band with audio setup before and during the event, ensuring a seamless performance.

Both City Council and the Public Safety Committee (Committee) have expressed interest in partnering with the CArts Jazz Band this year. Additionally, staff recommends renting audio equipment from Pacific again for this year's Bradbury Night Out. Staff has obtained estimates from Pacific for both renting and purchasing audio equipment suitable for the event, since there was discussion about purchasing and/or renting last year.

Furthermore, staff has fielded some interest from the Committee to seek an additional food vendor for the event. However, due to the January Eaton Fire and February rains, the Committee has been unable to meet. In the meantime, staff is seeking City Council direction on how to proceed with inviting the CArts Jazz Band and contracting with Pacific for audio. Staff may come back in March if the Committee wants to solidify a second food vendor which would increase the cost of the event.

ANALYSIS
CArts Jazz Band
Last year, the CArts asked the City for a minimum donation of $500 to perform at Bradbury Night Out. Staff is anticipating the minimum donation cost to be around the same this year. The City Council can elect to donate a different amount.

Audio Equipment
Below is a comparison of the rental estimate and the purchase estimate for audio equipment at Bradbury Night Out:

Goods & Services Fee Estimate
Audio Equipment Rental & Technical Support $900
(Attachment 2)
Audio Equipment Purchase (Attachment 3) $4,741.28
To determine the most cost-effective and efficient approach for providing audio support at Bradbury Night Out, staff has evaluated two options: renting audio equipment annually versus making a one-time purchase of the necessary equipment. Based on this evaluation, staff recommends renting the equipment due to the technical support provided through the rental service and the assurance of seamless performance with the CArts Jazz Band. Staff does not feel capable of providing technical audio assistance to the Jazz Band without technical support from the rental company's technical team.

STAFF RECOMMENDATION
It is recommended that the City Council approve the CArts Jazz Band and audio rental equipment for Bradbury Night Out.
