Agenda Memo
TO: Honorable Mayor and Members of the City Council
FROM: Kevin Kearney, City Manager
DATE: April 15, 2025
SUBJECT: REQUEST BY THE RETIREMENT COMMUNITY TO UTILIZE THE
CIVIC CENTER'S BACK PARKING LOT
ATTACHMENTS: 1) Notice of Community Meeting
2) 500ft Radius of Back Lot
SUMMARY
The Retirement Community has asked the City if there might be an opportunity for them to lease the back parking lot on a monthly or annual basis, with an agreed-upon fee for its use. Should there be interest to lease the back lot, the City could draft an agreement that stipulates the integrity and cleanliness of the space, and indemnifies the City for the Retirement Community's use.
The first City Council discussion on this item occurred during the March 18, 2025, egularly scheduled meeting. The City Council reviewed the item and solicited community Feedback. The City Council ultimately directed Staff to send out a Notice of Communit Discussion to residents located within 500ft of the parking lot.
RECOMMENDATION
It is recommended that the City Council direct Staff on how to proceed with the Retirement Community's request to lease the back parking lot. If the City Council does not desire a long-term lease, it is recommended that the City Council set a policy (whether formal or informal) for the Retirement Community's usage frequency.

FROM: Kevin Kearney, City Manager
DATE: April 15, 2025
SUBJECT: RESOLUTION NO. 25-08: A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF BRADBURY, CALIFORNIA,
ALLOCATING FUNDS FROM THE CITIZEN'S OPTION FOR
PUBLIC SAFETY ("COPS") PROGRAM, AND DOCUMENTING
THE DETERMINATIONS REQUIRED BY THE SUPPLEMENTAL
LAW ENFORCEMENT OVERSIGHT COMMITTEE
ATTACHMENTS: 1) Resolution No. 25-08
SUMMARY
During the March 18, 2025 regularly scheduled meeting, the City Council directed staff to draft a plan utilizing approximately $30,000 in COPS funds for additional traffic enforcement.
Should the City Council decide to continue with the spending of $30,000 for additional traffic enforcement, it is recommended that the City Council adopt Resolution No. 25-08, which details the City's plan for spending the restricted funding.
The City Council may elect to spend a different amount in COPS funding. If the amount is altered, it is recommended that the City Council amend Resolution No. 25-08 and approve the Resolution with the newly amended amount.
BACKGROUND
Since 1997, the California State Budget Act has included allocations to counties and cities for the COPS program. This funding is intended to fill the need for additional resources FOR CITY COUNCIL AGENDA_ AGENDA ITEM #
Resolution No. 25-08: Designating COPS Spending
at the local level to ensure public safety. Under the provisions of Government Code Section 30061, a percentage of the funds are allocated to counties and cities, based upon population, for law enforcement services. Funds must supplement existing services and cannot be used to supplant any existing funds. The funds must be used to benefit front- line law enforcement efforts.
Historically, the City has limited its use of COPS funding for additional traffic enforcement with the Los Angeles County Sheriffs Department (LASD). When the City does allocate funding, it's usually for a week or two week-long operation at a targeted area. City Staff coordinates with LASD to set certain days and times within the week or two-week period.
Deputies are then stationed in the area for a shift of four (4) hours, which is usually overtime pay for the deputies.
During the March 18, 2025 regularly scheduled meeting, the City Council had an initial discussion on the use of COPS funds. The City Council ultimately directed Staff to draft a plan on utilizing approximately $30,000 in COPS funds for additional traffic control from the Los Angeles County Sheriffs Department (LASD).
At $30,000 a year, there would be approximately six 6) four (4) hour spots per month.
However, pay rates for the deputies could fluctuate as some deputies receive longevity pay and/or bonus pay depending on their positions. Should the City Council decide to move forward with spending COPS funds for additional traffic enforcement, Staff would work with LASD to schedule specific times and days for the enforcement.
FINANCIAL ANALYSIS
The revenues for the COPS funds vary each year depending on the State's yearly allocation. Below is a snapshot of the revenues, expenses, and fund balance from the last few years:
Fund 215 - COPs Fund
Balance in
Fiscal Year Revenue Expenses cash/Bank
2022/2023 124,884.47 124,607.00 400,591.03
2023/2024 185,782.00 118,376.00 482,950.77

Resolution No. 25-08: Designating COPS Spending
The following is a usage breakdown of LASD traffic control time if the City were to allocate $30,000 a year:
$30,000 Year
$2,500 Month
97.04 Deputy Rate/Hour
$388.16 4 Hour shift
6.44 Shifts per Month
The chart shows that $30,000 a year in COPS expenditures would lead to approximately 6 shifts per month, with each shift lasting 4 hours, if total funds are allocated evenly throughout each month.
RECOMMENDATION
Should the City Council decide to continue with the spending of $30,000 for additional traffic enforcement, it is recommended that the City Council adopt Resolution No. 25-08, which details the City's plan for spending the restricted funding.
The City Council may elect to spend a different amount in COPS funding. If the amount is altered, it is recommended that the City Council amend Resolution No. 25-08 and approve the Resolution with the newly amended amount.

RECOMMENDATION
It is recommended that the public hearing for the 1271 Lemon Avenue project be closed. The public hearing had been continued from the October 15, 2024, regular meeting to allow for the applicant to meet with the neighbors and officials of the City of Monrovia and Bradoaks Elementary School to address the concerns that were raised at that meeting. The applicant has not yet held those meetings. The applicant can request a new public hearing when they have held the meetings and are ready to proceed.
Public hearing notices will need to be mailed and posted at least ten (10) days ir advance of when the public hearing is to be re-opened.
SUMMARY
California American Water is proposing to retire and demolish the concrete-lined reservoir at the northeast corner of Lemon Avenue and Barranca Road for the eventual sale of that portion of the property. Retirement and demolition are subject to a Conditional Use Permit. A Tentative Parcel Map has been submitted to split the property into two lots along with a Variance to allow for maximum eight-foot-tall perimeter walls and fences. To facilitate the sale of the new westerly lot, it is requested that the General Plan Land Use Designation of the westerly lot be changed from Public Facilities to Agriculture/Estate Residential-One Acre, and that the zoning be changed from 'OS' Open Space to 'A-1' Agriculture Residential Estate, One Acre Minimum. Three resolutions and an ordinance have been drafted for these land use applications. 1271 Lemon Avenue - Continued Public Hearing Page 2 of 2 At the October 15, 2024 Regular Meeting, the City Council opened the public hearing and accepted testimony from the applicant and several neighbors. The Council continued the public hearing as open to the next regular meeting of November 19, 2024, to allow for the applicant to meet with the neighbors and officials of the City of Monrovia and Bradoaks Elementary School to address their concerns.
The October 15, 2024 agenda packet, which includes the agenda report, the draft resolutions and ordinance, proposed plans, and links to the environmental documents and other related material is available on the City website via this link:
https://www.cityofbradbury.org/2024 10 15%20CC%20Meeting%20Agenda.pdf.
On October 30, 2024, the applicant informed City staff that they had contacted the City ot Monrovia and Bradoaks Elementary School tor meeting dates, but the meetings had not been scheduled. At the November 19, 2024 meeting, the City Council continued the public hearing as open to the January 21, 2025 regular meeting.
For the January 21, 2025 meeting, the applicant informed staff that the meetings had not yet been scheduled, and the public hearing was continued as open to the February 18, 2025 meeting.
The meetings still had not been scheduled, and at the February 18, 2025 meeting, the public hearing was continued as open to the March 18, 2025 regular meeting. RE: City of Monrovia Concerns Regarding Lemon Reservoir Retirement Project (1271 Lemon Avenue, Bradbury, CA 91016)
Mayor Hale,
The Monrovia City Council offers our concerns related to the Lemon Reservoir Project ("Project") as proposed by California American Water ("CalAm"). The City of Monrovia was only recently made aware of the Project in late October 2024. The Project proposes to demolish a large concrete reservoir structure that is no longer in use and haul away the debris. The Project also proposes to haul in over 12,000 cubic yards of soil to "flatten" the site. Finally, the Project proposes a zoning amendment to change the site from "Open Space Zoning" to "A-1 Agriculture Residential Estate." The City of Bradbury adopted findings of Categorical Exemptions in their entirety.
The City of Monrovia expresses our deeply-held concerns as follows:
1. Use of Categorical Exemptions. Although the proposed exemptions might be appropriate for various components of the project, CEQA requires that a project be evaluated as a whole. Further, Section 15300.2(c) of the CEQA Guidelines state that "a categorical exemption shall not be used for an activity where there is a reasonable possibility that the activity will have a significant effect on the environment due to unusual circumstances."
The demolition, removal and backfill of the reservoir constitute "unusual circumstances" especially in the context of the actions taken to prepare the site for the eventual development of a single family dwelling. Demolition of the existing reservoir will require the reservoir's concrete structure to be broken up and removed from the site as well as the approximately 12,000 cubic yards of fill that will need to be imported to the project site. This is unusual for an exempt residential project of any size.
Additionally, the document states the Project does not include the development of residential uses (Lemon Reservoir Retirement Project Categorical Exemption Findings, 415 S. Ivy Avenue, Monrovia, CA 91016-2888

pg 27). However, it should be assumed the property will be developed pursuant to the requirements of the proposed designation, especially because the document states the General Plan Amendment and Zone Change would "facilitate the sale and development of the proposed parcel." Therefore it is appropriate for the redesignation and rezoning of the property to be analyzed on a programmatic level.
2. Traffic Impacts. The City of Monrovia did not identify any detailed traffic plan, staging plan or street sweeping schedule for the Project which will use roadways owned and maintained by the City of Monrovia. According to the staff report (page 3), "Scheduling of the truck trips has been done in coordination with the City Engineer, the City of Monrovia, and the Monrovia Unified School District." The City of Monrovia is unaware of any actual coordination for traffic control/management, and we understand traffic control/management may occur after a Project contractor has been selected. We request the City of Bradbury must urgently consider feedback from the Monrovia Unified School District ("MUSD") and City of Monrovia to formalize a traffic plan, staging plan, street sweeping schedule and schedule for truck hauling. This plan should also be shared and communicated with residents in the adjacent area.
3. Air Quality Impacts. The amount of air pollution caused by this project is significant and includes both dust from the removal of concrete as well as diesel/gasoline particulate matter from the significant level of emissions required for the Project. These pose significant and serious health hazards that have been deemed "categorically exempt" from an environmental review. Dust from demolition will likely contain harmful substances as silica, asbestos, lead and other toxins. Extended exposure to the dust will directly affect residents adjacent to the Project site. In addition, particulate matter which is toxic air contaminate will be released by the heavy duty equipment and poses additional health risks. Section 3 (page 27) reads "The proposed Project would not conflict with the implementation of any regulations set forth by the SCAQMD or violate any air quality standard; or contribute substantially to an existing project's air quality violation. " This summary is insufficient to determine whether there are, in fact, air quality impacts to surrounding properties.
4. Communication. The City of Monrovia is concerned about lack of communication with neighboring residents particularly those who reside in neighborhoods immediately surrounding the project. In the City of Monrovia's experience, it is essential that projects adhere to best practices for regular community outreach. While the City of Bradbury may require only a 500' notice to adjacent neighbors (there are approx. 8 homes within this radius), there are several dozen residences in the area which will all be affected by the dust, noise, pollution and construction traffic.
The City of Monrovia's concerns can be remedied if the cities of Bradbury and Monrovia, along with our residents and CalAm partners, work together to address and mitigate these concerns.
The City of Monrovia has requested CalAm consider project alternatives which would reduce the scope of demolition considerably. CalAm has indicated they are willing to consider project 415 S. Ivy Avenue, Monrovia, CA 91016-2888

alternatives which would address and satisfy our concerns. We respectfully request our cities, along with CalAm, work together to minimize Project impacts to our communities.
In addition and at the very least, an Environmental Checklist (Initial Study) must be completed to determine the appropriate level of environmental review pursuant to CEQA. Of particular concern to the City would be an analysis of impacts to aesthetics, noise, air quality, land use and transportation. The City of Monrovia was not provided any previous communication related to the Project.

INTRODUCTION
The Planning Commission was asked by the City Council to discuss increasing the maximum height for perimeter fences and walls to eight (8) feet in the A-5 zones or the Bradbury Estate properties to enhance security, and it was suggested that entry gates and columns be allowed an additional two (2) feet to enhance the design.
At the March 26, 2025, regular Planning Commission meeting, the Commission discussed the request and reviewed a draft of the attached Ordinance No. 394. The Commission agreed that the increases in height are appropriate and adopted the attached Resolution No. PC 25-328 to recommend that the City Council approve and adopt such an ordinance.
PROPOSED ORDINANCE
The regulations for fences, hedges, walls, and courts are in Chapter 100 of the Development Code. The height limitations are listed in Section 9.100.040. The proposed amendments were reviewed by the Planning Commission and the City Attorney, and the AGENDA ITEM NO.
Ordinance No. 394 - Introduction
April 15, 2025 Page 2 of 3
attached Ordinance No. 394 was drafted to amend Section 9.100.040 - Fences, walls, windscreens and hedge height limitations. A redline version of Chapter 100 is attached.
Proposed Ordinance No. 394 would amend as follows, subsections (5) and (7) of Section

(7) Fence, wall and hedge height exceptions. Fence, wall and hedge heights in the following locations may exceed six feet, but shall not exceed eight feet in height-in the following locations:
a. Rear yards on the south side of Gardi Street; and
b. Perimeter areas abutting Bradbury Read and Wildrose AvenueProperties within the A-5 zone; and
c. Perimeter areas in the A-5 zone, any portion of which abuts property in the City of MonroviaProperties in the A-1 zone on Lemon Avenue adjacent to and immediately to the east and west of Barranca Road.
ENVIRONMENTAL REVIEW
It is recommended that the project be determined to qualify as exempt under the provisions of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3) which states that CEQA only applies to projects which have the potential for causing a significant effect on the environment and where it can be seen with certainty that there is no possibility that the activity will have a significant effect, the activity is not subject to CEQA, and pursuant to CEQA Guidelines Section 15305 as the proposed ordinance would adopt policy affecting minor land use features and will not change the land use, density, or otherwise have effects on the environment.
FINDINGS
Ordinance No. 394 affects minor land use features without changing any density, intensity, or allowed uses. The amendments will not have effects on the environment. It is recommended that the proposed ordinance be found to be consistent with the City's General Plan, and that it is exempt in compliance with the California Environmental Quality Act (CEQA).

(Ord. No. 297, § 9.06.030.010, 3-20-2007)
Sec. 9.100.020. Applicability.
From and after the effective date of the ordinance from which this chapter is derived, no court, fence, hedge, wall or retaining wall shall be built, erected, constructed, enlarged, relocated or structurally altered except in conformity with the provisions of this chapter.
(Ord. No. 297, § 9.06.030.020, 3-20-2007)
Sec. 9.100.030. Definitions.
The following words and phrases, when used in the chapter, shall, for the purpose of this chapter, have the meanings respectively ascribed to them in this section:
Corner lot means a lot or parcel of land situated at the junction of and abutting on two intersecting streets.
Court means a tennis, handball, badminton, volleyball, racquetball and sport court.
Fence means an enclosing structure made of wire, wood, metal, masonry or other materials, having uniformly spaced openings in its vertical surface with a total area of openings equal to 40 percent or more of the total vertical area of the structures. Typical fences are wire fences, ornamental iron fences, wood picket fences, wood lattice fences, wood rail fences and masonry block or brick fences.
Finished ground surface means the ground surface within a yard which has been surfaced with concrete, brick, stones, bituminous materials, crushed rock, gravel, sand or similar materials, or on which grass, flowers, shrubbery or trees have been planted, or which has been graded in preparation for surfacing or planting.
Front yard means a yard between the front line of the lot and the front line of the main building and which extends across the entire width of the lot; provided, however, that upon vacant property the front yard shall be the yard between the front line of the lot and the front yard setback line ascribed to such lot, and which extends across the entire width of the lot.
Lot means a parcel of land recorded as a lot or otherwise approved by the City Council as a building site for the construction of one main building.
Redline version per Ord. 394
Rear yard means a yard between the rear line of the lot and the rear line of the main building which extends across the entire width of the lot. Where a public alley exists at the rear lot line, one-half, but not to exceed ten feet, of such alley may be considered to be a portion of such rear yard; provided, however, that upon vacant property the rear yard shall be the yard between the rear line of the lot and the rear yard setback line ascribed to such lot, and which extends across the entire width of the lot.
Required yards means those portions of a lot or building site upon which no portion of a main building is permitted to be constructed by the provisions of this title, relating to zoning.
Retaining wall means a structure made of wood, metal, masonry or other materials designed to withstand pressure exerted by earth or by water or by both.
Side street line of a corner lot means the side line of a corner lot along the side of the lot abutting on a street.
Side yard means a yard between the side line of the lot and the side line of the main building and which extends from the front yard to the rear yard; provided, however, that upon vacant property the side yard shall be the yard between the side line of the lot and the side yard setback line ascribed to such lot, and which extends across the entire width of the lot.
Yard means that portion of the same lot or building site upon which a building is situated, which remains open and unoccupied except by stairways, porches, landing places, cornices, canopies, eaves, chimneys, fireplaces, detached accessory buildings and garages.
Yard wall means an enclosing structure made of wood, metal, masonry or other material, having openings in its vertical surface with a total area of openings equal to less than 40 percent of the total vertical area of the structure. Typical yard walls are wood panel walls, grapestake walls, plastic-screen walls, monolithic concrete walls and masonry block or brick walls. Any fence covered or partially covered with any view-obscuring material shall be considered a wall for the purpose of this chapter. (Ord. No. 297, § 9.06.030.030, 3-20-2007)
