STAFF REPORT
To: City Council
From: Nikkie Chamberland, Deputy Chief Fire Marshal
Prepared by: Nikkie Chamberland, Deputy Chief Fire Marshal Subject: Approval of Contract with Brycer for Use of The Compliance Engine RECOMMENDATION:

Staff recommends that the City Council approve the use of The Compliance Engine, a digital reporting platform provided by Brycer, to assist in the tracking and management of required fire protection system reports, including semi-annual, annual, and bi-annual inspections.

BACKGROUND INFORMATION:

Currently, the City of Brawley lacks a centralized system to monitor compliance with NFPA 25 standards, which require business owners to maintain documentation for fire protection systems. These standards are mandated by the State of California, and the absence of a tracking mechanism places a burden on Fire Department staff to manually collect and verify compliance documentation.

The Compliance Engine offers a streamlined, cloud-based solution that enables service providers to submit inspection reports directly to the Fire Department. This ensures timely compliance, reduces administrative workload, and enhances public safety oversight.

FISCAL IMPACT:

There is no direct fiscal impact to the City. The cost of using The Compliance Engine is borne by the fire protection service providers, who pay a fee to submit reports through the platform. This approach eliminates the need for City staff to spend time and resources locating and managing NFPA 25 documentation.

ALTERNATIVES:

None at this time.

Re: “The Compliance Engine”
Dear Brawley Fire-Rescue:

We look forward to providing you with “The Compliance Engine” (the “Solution”) and the advisory services described below related to the Solution (the “Advisory Services”). This proposal letter provides the basic terms by which Brycer, L.P. (“Brycer”) and Brycer Advisory Group, L.P. (“BAGLP”) will provide you, Brawley Fire-Rescue (“Client”), with the Solution and the Advisory Services. The use of the Solution, the Advisory Services and all matters among Brycer, BAGLP and Client will be subject to the standard “Terms and Conditions” attached to this proposal as Exhibit A. The basic terms are as follows:

1. Term: Brycer will provide Client with the Solution and BAGLP will provide the Advisory Services for three years, commencing ________________ (the “Initial Term”). Thereafter, the Term shall automatically renew for successive three-year periods unless terminated by, as the case may be, Brycer or BAGLP, or Client in writing at least 180 days prior to the expiration of the then current Term (each, a “Renewal Term” and together with the Initial Term, the “Term”). Following the expiration or termination of the Term (as provided in the Terms and Conditions), Client shall stop using the Solution and BAGLP shall stop providing the Advisory Services; provided, however, Brycer shall make available, and Client shall have the right to download, Client’s data from the Solution for a period of 60 days after the expiration or termination of the Term. STAFF REPORT
To: City Council
From: Rebecca Terrazas-Baxter, City Manager
Prepared by: Rebecca Terrazas-Baxter, City Manager
Subject: Presentation/Discussion of Infrastructure Finance District Tools RECOMMENDATION:

Receive a presentation regarding available Infrastructure Finance District tools available for municipalities to finance a wide range of infrastructure projects and provide feedback or questions for staff consideration.

BACKGROUND INFORMATION:

At the request of Mayor Pro Tem Tim Kelley, the City Council will receive an informational presentation on Infrastructure Finance District (IFD) tools available to municipalities to support infrastructure investment and economic development. The presentation will provide a high-level overview of tax increment–based financing mechanisms authorized under State law, including Enhanced Infrastructure Financing Districts (EIFDs), and how such tools have been used by other jurisdictions.

Infrastructure Finance District tools are one of several economic development and public financing mechanisms available to local governments in California. These tools allow cities and counties to fund certain public infrastructure and community improvements by leveraging a portion of future property tax increment generated by new development within a defined area.

Enhanced Infrastructure Financing Districts (EIFDs), authorized by Senate Bill 628 (2014), were created following the dissolution of Redevelopment Agencies and are one of the primary tax increment financing (TIF) tools currently available to municipalities. EIFDs and related tools may be used, subject to statutory requirements, to finance a wide range of public infrastructure, including but not limited to transportation improvements, utilities, flood control, climate adaptation, housing-related infrastructure, and facilities that support economic development.

As economic development has emerged as a key City Council priority for the coming year, this presentation is intended to provide context on one category of tools that may be considered in the future, alongside other economic development strategies. The presentation will focus on:
- The basic structure and purpose of IFD/TIF tools
- General eligibility and governance concepts
- Examples of infrastructure types that may be financed - Key considerations and limitations
5a
This item is intended to provide the City Council with an overview of available infrastructure financing tools as part of broader discussions regarding economic development priorities for the coming year.

The presentation is informational in nature and is designed to support future policy discussions, should the City Council wish to explore these tools further at a later date.

FISCAL IMPACT:

There is no fiscal impact associated with receiving this presentation.

No City funds are requested or proposed, and no studies, analyses, or implementation activities are being initiated as part of this item. Any future consideration of infrastructure financing tools would require separate City Council direction and would include a detailed analysis of costs, benefits, and funding options, including the potential availability of outside or grant funding.

ALTERNATIVES:

The City Council may:

1. Receive the presentation and take no further action.

2. Request additional general information on economic development or infrastructure financing tools at a future meeting.

3. Defer further discussion of infrastructure financing tools to a later time as part of broader economic development planning discussions.

Why are Public Agencies Authorizing TIF Districts?
8 1. Return on Investment (“ROI”): Private sector investment induced by district commitment on a “but for” basis accelerates growth of net fiscal revenues, job creation, housing production, essential infrastructure improvements

2. Ability to attract additional funds / other public money (“OPM”) – tax increment from other entities (county, special districts), federal / state grants / loans (e.g., for TOD, water, housing, parks, remediation)

10 Potential Cash Flow / Debt Issuance Approaches
• Kosmont Financial Services is in active discussions with public finance underwriters regarding TIF debt issuances in other jurisdictions
• Underwriters have proposed several approaches for the leverage of tax increment for accelerated debt issuance (e.g., 2-3 years from district formation), for example:
a) Tax increment only
b) Overlapping TIF and CFD (CFD Backstop) – landowners / developers must be willing to pay CFD special taxes in the short term (e.g., 5-10 years) until tax increment reaches a level to cover debt service
c) Tax increment with City or County general fund backstop • There are advantages and disadvantages with each approach (e.g., upfront proceeds available, public agency risk, cost of capital)
• Additional alternatives are available if private sector partners (e.g., landowners / developers are willing to advance infrastructure funding in exchange for reimbursement from TIF proceeds) 5a.1
11 Financing Districts work better with a Multi-Agency Partnership & Attract Other Funding
Other Public Sources
▪ Cap-and-Trade / HCD grant & loan
programs (AHSC, IIG, TCC,CERF)
▪ Prop 4 Climate Bond Fundings
▪ Prop 68 parks & open space grants
▪ Prop 1 water/sewer funds
▪ Caltrans ATP / HSIP grants
▪ Federal EDA / DOT / EPA funding
▪ Federal ARPA, Invest Act, IIJ Act
Other Private Sources
▪ Development Agreement / impact fees
▪ Benefit assessments (e.g., contribution
from CFD)
▪ Private investment
• Ideal strategy includes City / County partnership
• Districts which involve a multi-agency joint effort are more likely to win state grant funding sources • Districts explicitly increase scoring for CA state housing grants (e.g., IIG, AHSC, TCC) 5a.1
12 Illustrative TIF Formation Schedule
▪ Tax increment allocation begins fiscal year following district formation ▪ Debt issuance, if desired, would occur after a stabilized level of tax increment has been established (may be 3-5 years) Target Date Task
Q1 2026 a) Conduct outreach/discussion among City staff and Council, County staff and Board of Supervisors, other relevant stakeholders b) Final determination of TIF district boundaries, targeted projects, governing Public Financing Authority (PFA) Board composition Q1 2026 c) Participating taxing agencies consider Resolution(s) of Intention (ROI) to form district and formally establish PFA Board Q2 2026 d) PFA directs the drafting of the Infrastructure Financing Plan (IFP) Q2 2026 e) Distribute draft IFP to property owners, affected taxing entities, planning commission Q3 2026 f) PFA holds an initial public meeting to present the draft IFP to the public and property owners Q3 2026 g) City Council/legislative bodies of other affected taxing entity contributing increment consider resolution(s) approving IFP Q3 2026 h) PFA holds first public hearing to hear additional comments and take action to modify or reject IFP (at least 30 days after “f”) Q4 2026 i) PFA holds second public hearing to consider oral and written protests and take action to terminate proceedings or adopt IFP and form the district by resolution (at least 30 days after “h”) 5a.1

STAFF REPORT
To: City Council
From: Rebecca Terrazas-Baxter, City Manager
Prepared by: William Smerdon, City Attorney
Subject: Approval of Revised Mayor’s Message Provided Prior to Public Comments RECOMMENDATION:

Adopt the proposed revision to the Mayor’s Message provided prior to Public Comments at City Council meetings to include a prohibition on profanity.

BACKGROUND INFORMATION:

During recent discussions, Council Member Grass suggested modifying the Mayor’s Message delivered prior to Public Comments to prohibit the use of profanity. Similar provisions are commonly included in the public comment guidelines or opening statements used by other municipalities and governing bodies.

In response to this suggestion, the City Manager, in consultation with Mayor Galvan, developed a proposed revision to the Mayor’s Message reflecting this change. While there is no legal requirement for City Council approval of the revised language, staff and the Mayor believe it is appropriate to seek Council direction and concurrence prior to implementation.

The proposed revision is intended to promote a respectful and orderly meeting environment while preserving the public’s right to address the Council.

FISCAL IMPACT:

There is no fiscal impact associated with the proposed action. Implementation would not require additional staffing, resources, or expenditures.

ALTERNATIVES:

1. Take no action and retain the current Mayor’s Message without modification.

2. Direct staff to revise the proposed language to include additional changes or clarifications for Council consideration at a future meeting.

Prepared by: Silvia Luna, Finance Director
Subject: Fiscal Year 2026/27 Operating and Capital Improvement Program Budget Timeline
RECOMMENDATION:

Review and approve the Fiscal Year 2026/27 Operating and Capital Improvement Program Budget Timeline
BACKGROUND INFORMATION:

Community input is greatly appreciated and necessary to ensure a vibrant and inclusive budget, therefore, a budget timeline is provided for consideration and input in advance of public meetings.

The following is recommended for the Fiscal Year 2026/27 Budget:
• A total of six (6) public meetings held during regularly scheduled Council meetings from February through June 2026.
• The goal of each study session will be to provide an overview of the Funds being presented, and then allow for time to meet with Council Members and other interested parties to address details that may not be easily conveyed in a study session format.
• To encourage community engagement, the information presented in each study session will be added to a dedicated City website page.
• The budget format will stay relatively similar to the current 2025/26 budget document.

FISCAL IMPACT:

None to approve the budget timeline.

ALTERNATIVES:

City Council may elect to not approve the recommended budget timeline or provide additional direction to staff for the 2026/27 budget process.
