STAFF REPORT
To: City Council
From: Petra Ortega, Library Manager
Prepared by: Petra Ortega, Library Manager
Subject: Library IT Infrastructure Expansion and Safety Improvement Project RECOMMENDATION:
Approve the use of Library Development Impact Fee (DIF) funds in the amount of $8,600 for the expansion, improvement, and safety enhancement of the Library’s wall-mounted IT cabinet infrastructure to support the addition and expansion of library technology services.
BACKGROUND INFORMATION:
The purpose of this project is to improve and expand the Library’s existing information technology infrastructure to accommodate current and future library service enhancements, while also addressing an emerging facility safety concern.
The Library’s existing wall-mounted IT cabinet has reached full capacity and no longer provides adequate space to support additional hardware, equipment, and technology improvements associated with planned library service expansions. In addition, the existing cabinet has begun detaching from the wall, creating a potential safety hazard and increasing the risk of service disruptions to multiple City facilities.
The proposed project will modernize and expand the Library’s existing IT cabinet infrastructure through the installation of a larger and properly supported rack cabinet system. The quoted cost of $8,600 from Total Technology Inc. includes:
- Removal of the existing wall-mounted cabinet;
- Temporary removal and protection of installed network equipment; - Installation of a new expanded rack cabinet;
- Reinstallation and organization of existing equipment and cabling; and - Extension and improvement of data cabling, as necessary.
The expanded cabinet capacity is necessary to support the continued enhancement and addition of library technology services and infrastructure improvements, including:
- Outdoor Wi-Fi expansion to improve public internet accessibility; - Installation of a Patron Server and time-management solution for public computer access; - Additional file storage capacity to support the Adult Literacy Classroom program; and - Proper mounting and integration of the outdoor audio system. 4c
In addition to supporting expanded library services, the project will improve the reliability and safety of the City’s network infrastructure. Failure to address the deteriorating condition of the existing cabinet may result in interruptions to internet, phone, email, camera, and network services impacting the Library, Building and Planning Department, and Transit Station facilities. The current condition also presents a potential risk of injury to employees working near the equipment area.
This project represents an improvement and expansion of existing library infrastructure that will enhance service capacity, improve operational reliability, and support future technology-related library programming and services.
FISCAL IMPACT:
The Wall-Mounted IT Cabinet project was not included in the FY 2025/26 Capital Improvement Program (CIP) budget; therefore, a budget adjustment is required. The proposed adjustment is as follows:
Account 460-551.0400-721.900 (Small Tools & Minor Equipment): $8,600 Funding will be provided from the Library Development Impact Fee (DIF) Fund (Fund 460), which currently has an available balance of approximately $536,216.
ALTERNATIVES:
The council can choose not to approve the project.

Agenda Item No 4d
STAFF REPORT
To: City Council
From: Sylvia Vizcarra, Human Resources Administrator
Prepared by: Isabel Safie, BBK Special Counsel
Subject: Potential Action to Approve Salary Schedules and Uniform Allowance Language
RECOMMENDATION:
Adopt a Resolution approving and ratifying publicly available pay schedules for executive and contracted positions, a publicly available pay schedule for elected officials, and uniform allowance policy language for safety executive positions, to ensure compliance with California Public Employees Retirement System (“CalPERS”) requirements.
BACKGROUND INFORMATION:
As a contracting agency of CalPERS, the City of Brawley is subject to statutory and regulatory requirements that govern whether compensation is reportable for pension calculation purposes. The Public Employees’ Retirement Law (“PERL”), the Public Employees’ Pension Reform Act of 2013 (“PEPRA”), and related regulations codified in the California Code of Regulations (“CCR”) require that contracting agencies must accurately reflect information related to compensation items in publicly available documentation approved by the City Council.
Base salary must be contained on a publicly available pay schedule which meets the requirements of Title 2 CCR section 570.5 for classic members, and section 571.1(a)(4) for PEPRA members as follows:
• Has been duly approved and adopted by the employer’s governing body in accordance with requirements of applicable public meeting laws;
• Identifies the position title for every employee position; • Shows the pay rate for each identified position, which may be state as a single amount or as multiple amounts within a range;
• Indicates the time base, including, but not limited to, whether the time base is hourly, daily, biweekly, monthly, bi-monthly, or annually; • Is posted at the office of the employer or immediately accessible and available for public review from the employer during normal business hours or posted on the employer’s internet website; • Indicates an effective date and date of any revisions; • Is retained by the employer and available for public inspection for not less than five years; and • Does not reference another document in lieu of disclosing the pay rate.
All items of compensation which are reportable to CalPERS aside from salary are delineated and defined in the exclusive list of special compensation items under Title 2 CCR sections 571(a) for classic members, and section 571.1(b) for PEPRA members. All special compensation items must also meet 4d
the requirements of CCR sections 571(b) and 571.1(a), which require that every special compensation item is included in a publicly available written labor policy or agreement that:
• Has been duly approved and adopted by an employer's governing body in accordance with requirements of applicable public meetings laws;
• Indicates the conditions for payment of the item of special compensation, including, but not limited to, eligibility for, and amount of, the special compensation; • Is posted at the office of the employer or immediately accessible and available for public review from the employer during normal business hours or posted on the employer's internet website; • Indicates an effective date and date of any revisions • Is retained by the employer and available for public inspection for not less than five years; and • Does not reference another document in lieu of disclosing the item of special compensation.
The City received a determination letter from CalPERS dated January 12, 2026 citing compliance concerns with compensation reported on behalf of a recently retired employee. The determination letter asserts that base salary rates and uniform allowance reported to CalPERS were not compliant because the base salary and uniform allowance were not contained in a publicly available document as required by the PERL and applicable regulations.
After reviewing relevant information, legal counsel has recommended that the City Council approve publicly available pay schedules and a written labor policy for executive contract employees to comply with the PERL and applicable regulations. Legal counsel also recommended that the City appeal the determination letter in order to preserve the City’s ability to work with CalPERS to bring the disputed compensation into compliance to the extent feasible. Accordingly, an appeal letter was submitted to CalPERS on March 13, 2026.
Moreover, legal counsel also suggested approving a publicly available pay schedule for elected positions, since the PERL requires publicly available pay schedules for all positions. As such, a publicly available pay schedule for elected positions, effective July 1, 2021, was prepared for that purpose.
Thus, the purpose of approving this resolution is to ensure that the City’s publicly available pay schedules and uniform allowance language meet all the applicable requirements of Title 2 CCR sections 570.5, 571, and 571.1. The publicly available pay schedules and uniform allowance language will be posted on the City’s website. Any subsequent revisions of either document will be similarly presented to the City Council for adoption and approval at a future meeting to maintain compliance with CalPERS requirements.
FISCAL IMPACT:
There is no fiscal impact associated with the proposed action. The publicly available pay schedules and uniform allowance language do not authorize any additional compensation or obligate City Council to provide any future increases.
ALTERNATIVES:
1. Take no action, remaining out of compliance with CalPERS requirements.
2. Adopt the Resolution approving publicly available pay schedules and the uniform allowance language

STAFF REPORT
To: City Council
From: Silvia Luna, Finance Director
Prepared by: Silvia Luna, Finance Director
Subject: Approval of Revised Job Description- Senior Accountant- Revenue Administration & Utility Billing
RECOMMENDATION:
Staff recommends that the City Council approve the revised job description for the position of Senior Accountant – Revenue Administration & Utility Billing within the Finance Department.
BACKGROUND INFORMATION:
The Finance Department has evaluated the operational and administrative needs associated with the City’s revenue-related functions, including utility billing, accounts receivable, business licensing, fee administration, and revenue reconciliation processes. As part of this evaluation, staff identified the need to modernize and realign the existing Accountant position to better support operational continuity, strengthen internal controls, improve revenue oversight, and enhance coordination between accounting and revenue administration functions.
Historically, various revenue-related processes have been distributed among multiple operational functions. As the City continues to manage increasing operational, reporting, compliance, and customer service demands, staff has determined that additional technical oversight and coordination within the Finance Department is necessary to support the integrity of the City’s revenue cycle.
The revised job description updates and formalizes responsibilities associated with:
• Revenue administration and reconciliation
• Utility billing oversight and support
• Accounts receivable and business license revenue monitoring • Fee schedule administration and compliance
• Revenue analysis and reporting
• Internal controls and revenue accountability
• Financial systems and data analysis support
The revised position remains a professional-level accounting classification and does not create a new management-level position or add formal supervisory authority.
The proposed revisions are intended to strengthen accountability over the City’s revenue processes while maintaining the existing accounting support functions currently assigned to the Finance Department. The updated classification better reflects the operational and technical responsibilities 4e
necessary to support utility billing operations, revenue reconciliation, fee implementation, and financial reporting activities.
The revised position will assist the City in:
• Improving coordination between accounting and operational revenue functions • Strengthening internal controls and revenue reconciliation processes • Supporting accurate billing, collections, and financial reporting • Enhancing oversight of fee implementation and revenue compliance • Supporting continuity of operations during staffing transitions or operational demands • Improving efficiency and accountability related to revenue administration Additionally, the revised job description modernizes the technical qualifications associated with the position, including experience with enterprise resource planning (ERP) systems, utility billing systems, large financial datasets, and advanced financial reporting tools.
The proposed revisions do not fundamentally alter the classification of the Accountant position, but rather clarify and formalize revenue oversight responsibilities already associated with the Finance Department’s accounting and accounts receivable functions.
FISCAL IMPACT:
The proposed revision to the job description does not create a new position and does not require additional budget appropriations. The revised duties will remain within the existing authorized staffing structure and salary range for the position.
ALTERNATIVES:
•Approve the revised job description as presented to strengthen revenue administration, operational support, and internal controls within the Finance Department. •Maintain the existing Accountant job description.
•Provide alternative direction to staff.

Subject: Ratification of Emergency Proclamation
RECOMMENDATION:
Adopt Resolution Ratifying the Proclamation of the Existence of a Local Emergency Made by the City Manager
BACKGROUND INFORMATION:
Commencing on May 9, 2026, the City began to experience multiple earthquakes, commonly referred to as an earthquake swarm. The City has experienced earthquake swarms in the past, and experience has shown that damage caused by these events can remain undetected until well after the swarm subsides. Additionally, it is impossible to predict how long the swarm may continue or the magnitude of future earthquakes that the City may experience.
In response to these events, and in her capacity as Director of Emergency Services, the City Manager signed a Proclamation of the Existence of a Local Emergency on May 13, 2026. The proclamation positions the City to potentially qualify for state and/or federal funding for infrastructure damages incurred as a result of the earthquake swarm, as well as reimbursement for emergency services rendered in response to the event.
Pursuant to Government Code requirements, the proclamation must be ratified by the City Council within seven days of its issuance in order to remain in effect.
FISCAL IMPACT:
None associated with ratification of the proclamation. It is unknown at this time whether the City will ultimately qualify for any state or federal funding as a result of the proclamation and ratification.
ALTERNATIVES:
Do not ratify the proclamation or provide alternative direction to staff.

From: Ana Gutierrez, Interim Public Works Operations Manager Prepared by: Ana Gutierrez, Interim Public Works Operations Manager Subject: Award Western Avenue Pedestrian Improvements to Rove Engineering.
RECOMMENDATION:
Approve the award of Specification No. 2025-13 for the Pedestrian Improvements on Western Avenue from Main Street to Highway 86 to Rove Engineering in the amount of $201,227.00; authorize a 15% contingency in the amount of $30,184.05 for a total project authorization of $231,411.05; authorize the addition of this project to the Capital Improvement Program (CIP) Project List; and authorize the City Manager to execute all documents necessary for the completion of the project.
BACKGROUND INFORMATION:
On February 23, 2026, the City received authorization from the California Transportation Commission to proceed with the Local Partnership Program (LPP SB1) Grant in the amount of $152,000.00. The grant requires a City matching contribution of 50% ($152,000.00), for a total project cost of $304,000.00.
The grant funding was awarded for pedestrian improvements along Western Avenue from Main Street to Highway 86. The proposed improvements include the installation of Portland Cement Concrete (P.C.C.) curb and gutter, P.C.C. sidewalks, and ADA-compliant handicap ramps.
The Engineering Department advertised the project for public bidding on March 18, 2026.
On April 20, 2026, the City publicly opened four (4) bids for the project as follows:
Rove Engineering, Inc.
El Centro, CA $201,227.00
Granite Construction
Indio, CA $225,000.00
LC Paving & Sealing, Inc.
Lakeside, CA $296,939.00
Farmers Land Leveling
Brawley, CA $311,430.00
5b
After reviewing the bid documents, staff determined that Rove Engineering, Inc. submitted the lowest responsive and responsible bid.
Western Avenue is a major collector roadway and one of the City’s primary thoroughfares and routes to local schools and commercial areas. The proposed pedestrian improvements will enhance accessibility and provide residents with a safer route for walking to schools, shopping, and surrounding neighborhoods.
Approval of the construction contract will allow the City to proceed with these critical pedestrian safety improvements, improve ADA accessibility, and enhance overall neighborhood livability.
The local bidding preference factor is not applicable to this state-funded project.
FISCAL IMPACT:
Funding for this project will be provided through the California Transportation Commission Local Partnership Program (LPPSB1) Grant in the amount of $152,000. The required City matching funds will be budgeted through the ADA Annual Allocation in the amount of $75,000 and Measure D funds in the amount of $77,000.
The Western Pedestrian Improvements Project was not included in the originally adopted FY 2025/26 Capital Improvement Program Budget; therefore, a budget adjustment is required as follows:
Transfer to Cap Pro- Streets - Expense...........................................................................$75,000 Transfer to Streets CIP- Expense.....................................................................................$77,000 Street Grants - Revenue - 421-310.000-430.417 ......................................................... $ 152,000 Transfer from Bicycle & Pedestrian Fund -Revenue -421-310.000-600.213 ..................$ 75,000 Transfer from Measure D - Revenue - 421-310.000-600.215.......................................... $ 77,000 All project-related costs and revenues shall be tracked under Project Code 2025-39.

STAFF REPORT

From: Emmet Fried, Assistant to the City Manager
Prepared by: Emmet Fried, Assistant to the City Manager Subject: Proposed Fee Waiver Ordinance – Establishing an Objective Policy for Considering Event‑Related Fee Waivers for Temporary Use of City Services and Facilities for Public Events
RECOMMENDATION:
Staff recommends that the City Council discuss and provide feedback and/or direction to staff regarding proposed Ordinance No. 2026‑02, Establishing an Objective Policy for Considering Event‑Related Fee Waivers for the Temporary Use of City Services and Facilities for Public Events, prior to initiation of the formal ordinance adoption process, including first reading.
BACKGROUND INFORMATION:
The City of Brawley periodically receives requests from nonprofit organizations, community groups, and event organizers seeking waivers or reductions of fees associated with the temporary use of City facilities, parks, streets, and municipal support services for public events.
The attached proposed ordinance recognizes that the City has limited financial and operational resources and that the City’s general policy is to recover the actual costs associated with providing City services and facilities for public events. At the same time, the Council may determine that certain events provide substantial community benefit that may warrant consideration of a partial or full waiver of eligible event-related fees.
Historically, requests for fee waivers or fee reductions have been evaluated on a case-by-case basis without a formally established policy framework. This approach has created challenges related to consistency, transparency, equity, administrative efficiency, and long-term budget planning.
The proposed ordinance establishes a clear and objective process for evaluating event-related fee waiver requests while preserving the City Council’s discretion to approve, deny, or condition such requests based on identified public benefits, fiscal impacts, and operational considerations. The ordinance is intended to improve transparency and consistency in the evaluation process while supporting responsible fiscal management and equitable treatment of applicants.
FISCAL IMPACT:
Adoption of this ordinance does not create a direct fiscal impact to the City’s General Fund at this time. The ordinance establishes a formal policy and evaluation framework for consideration of eventrelated fee waivers and fee reductions associated with temporary public events conducted on City property or requiring City services.
5c
Any future fee waivers or fee reductions considered under this ordinance may result in reduced cost recovery revenues to the City and/or increased operational costs associated with City support services, including but not limited to public safety, public works, facility use, and administrative support. The fiscal impact of each individual request shall be evaluated and disclosed to the City Council as part of the corresponding agenda item prior to approval consideration.
The ordinance also authorizes the City Council to establish annual limits on the number and/or dollar amount of approved fee waivers or reductions in order to support fiscal oversight, transparency, and budgetary control.
ALTERNATIVES:
1. Provide feedback and/or direction on the proposed ordinance and direct staff to proceed with preparation of the ordinance for first reading.
2. Provide feedback and direct staff to revise the proposed ordinance and return with modifications prior to first reading.
3. Decline to proceed with the proposed ordinance and continue evaluating event-related fee waiver requests on a case-by-case basis.

ORDINANCE NO. 2026- 02
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BRAWLEY, CALIFORNIA,
ESTABLISING AN OBJECTIVE POLICY FOR CONSIDERING EVENT- RELATED FEE
WAIVERS FOR THE TEMPORARY USE OF CITY SERVICES AND FACILITIES FOR
PUBLIC EVENTS
THE CITY COUNCIL OF THE CITY OF BRAWLEY, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
1. Findings:
The City Council finds as follows:
a. The Council is supportive of persons and organizations that wish to use City services and facilities for the purpose of hosting temporary community events.
b. The Council finds that many public events held at City facilities provide important benefits for the residents of Brawley.
c. With that said, the Council recognizes that the City has limited resources and is committed to the principle of imposing fees in order to recover the actual costs to the City when City services and facilities are used for public events.
2. Purpose:
The purpose of this ordinance is to establish clear, consistent, objective guidelines for evaluating requests for fee waivers and fee reductions associated with public events and event-related activities conducted on City property or requiring City services.
The City of Brawley seeks to ensure that municipal fees support cost recovery, reflect the true cost of providing services, and are applied equitably. Fee waivers will be granted only under limited, exceptional circumstances when a proposed event will provide a substantial public benefit aligned with City priorities.
This ordinance applies solely to requests for waivers or reductions of fees associated with the temporary use of City facilities, City property, or City services in connection with public events or event-related activities. This ordinance shall not apply to development impact fees, utility fees, permit fees unrelated to events, licensing fees, penalties, fines, or any other fee established by the City unless expressly authorized by the City Council.
DRAFT 5c.1
2. 1. Applicability: This ordinance governs only requests for fee waivers or fee reductions related to public events conducted on City property or requiring City services in support of such events. Nothing in this ordinance shall be interpreted to authorize waivers or reductions of development- related fees, utility charges, franchise fees, business license fees, administrative penalties, code enforcement fines, or other non- event- related fees unless separately authorized by the City Council or required by law.
3. Definitions:
When used in this ordinance, the following terms are defined below. a. Fee Waiver: A complete elimination of an established eventrelated fee for the temporary use of a City service, City facility, or City property associated with a public event. b. Fee Reduction: A partial decrease in an established eventrelated fee for the temporary use of a City service, City facility, or City property associated with a public event. c. Special Consideration: A narrowly defined set of
circumstances in which a waiver or reduction may be considered due to exceptional public benefit or statutory requirement. d. Public Event: A temporary gathering, activity,
celebration, exhibition, or community function conducted on City property or requiring City services that is open to the public or intended primarily to benefit the public.
4. Eligibility for Special Consideration:
A fee waiver or reduction may be considered only for a public event when all of the following criteria are met:
4. 1. Public Benefit: The public event must provide a
significant, measurable public benefit, such as:
a. Advancing public health, safety, or welfare
b. Providing free or low- cost services to underserved Brawley residents
c. Supporting youth, seniors, or vulnerable populations DRAFT 5c.1
d. Advancing City Council priorities or adopted strategic goals
4. 2. Local Nonprofit Status: The applicant must be:
a. A registered 501( c)( 3) nonprofit organization; and b. Primarily serving the Brawley community.
Regional or national organizations may be considered only if the event directly benefits Brawley residents.
4. 3. Financial Necessity: The applicant must demonstrate that paying the fee would create a substantial financial hardship and that the public event cannot occur without the waiver.
4. 4. No Commercial or Fundraising Benefit: The public event must not generate revenue for the applicant beyond cost recovery.
Fundraising events are not eligible for fee waivers or fee reductions unless the City Council determines the cause to be of extraordinary public value to Brawley.
5. Waiver Presumed:
Council may by resolution establish a list of certain annual public events that will be entitled to a fee waiver or fee reduction without the need for a request.
5. 1. The following procedure shall be used for adopting such a resolution:
a. A Council Member may at a properly agendized meeting of the City Council propose that a particular event be placed on a future Council agenda for consideration of a presumed waiver or reduction. If one or more other present Council Members join in that request, the item shall be placed on a future Council agenda for consideration; or
b. A Council Member may present a written request to the City Manager proposing that a particular event be placed on a future Council agenda for consideration of a presumed waiver or reduction. STAFF REPORT
From: Gil Rebollar, Councilmember
Prepared by: Emmet Fried, Assistant to the City Manager Subject: Discussion and Direction Regarding a One‑Year Temporary Moratorium on Large‑Scale Data Centers and Related Brawley Municipal Code Amendments RECOMMENDATION:
Discuss a potential one-year moratorium on large-scale data centers and related Brawley municipal code amendments and potentially provide direction to staff.
BACKGROUND INFORMATION:
Data centers and related high-intensity technology facilities are becoming an increasingly significant land use issue in California and across the country. These facilities may bring private investment and construction activity, but they may also create impacts related to energy demand, water use, air quality, noise, backup generators, battery storage, fire protection, emergency response, traffic, utility capacity, and neighborhood compatibility.
The City of Brawley’s zoning code does not appear to clearly define data centers, artificial intelligence computing facilities, cryptocurrency mining facilities, hyperscale computing facilities, server farms, or similar high-intensity technology uses as separate land uses.
This creates a potential zoning gap. Without clear local regulations, a large-scale data center could potentially seek to be processed as a warehouse, storage facility, communication equipment building, utility facility, manufacturing use, office use, light industrial use, heavy industrial use, or similar use, even though such facilities may operate differently and create different impacts.
Community members have expressed concern that large-scale data centers should not be considered or processed until the City has clear regulations in place. A temporary moratorium could provide the City additional time to review its zoning code, evaluate potential impacts, conduct public outreach, and consider whether permanent regulations may be appropriate.
Purpose of the One-Year Moratorium
The purpose of a potential moratorium would be to create a temporary pause while the City studies and evaluates appropriate standards and regulations.
A moratorium would not approve or deny any specific project. Rather, it could temporarily pause the submission, processing, or approval of applications for large-scale data centers and related uses while the City evaluates whether additional zoning regulations or policy direction may be necessary. 5d
Any potential moratorium could be narrowly tailored and may exclude ordinary computer servers, network equipment, data storage, or technology systems that are accessory and incidental to a permitted primary use, such as systems used by schools, hospitals, banks, offices, public agencies, local businesses, or other ordinary users.
Potential policy considerations raised for discussion include:
• Whether data centers should be treated differently than traditional warehouse or industrial uses; • Whether existing zoning classifications adequately address large-scale data centers and related facilities; and
• Whether additional regulations should be adopted before such uses are considered within the City.
A one-year period would allow the City to review its code, evaluate industrially zoned areas, hear from the public, consult with outside agencies, and consider permanent zoning standards, if desired by the City Council.
Discussion
The City Council may discuss whether to direct staff and the City Attorney to provide potential options for an interim urgency ordinance establishing a temporary moratorium on large-scale data centers and related high-intensity technology uses.
Under California law, an interim urgency ordinance is initially effective for 45 days and may be extended after notice and public hearing. If directed by the City Council, staff could evaluate options for a moratorium lasting up to one year, consistent with applicable law and subject to future Council consideration.
Potential moratorium provisions could include the temporary suspension of the acceptance, processing, or approval of applications or permits related to the establishment, expansion, construction, operation, or occupancy of large-scale data centers, artificial intelligence computing facilities, cryptocurrency mining facilities, hyperscale computing facilities, server farms, backup power generation facilities serving data centers, battery energy storage systems serving data centers, and similar high-intensity technology infrastructure uses.
Potential findings for consideration could include the current lack of specific zoning definitions, the possibility that data centers could be processed under existing warehouse or industrial categories, and the need to evaluate potential impacts to public health, safety, welfare, infrastructure, utilities, neighborhoods, and public trust while permanent standards are considered.
Potential Municipal Code Amendment Considerations:
If directed by the City Council, staff could evaluate potential code amendment options during the moratorium period and return with recommendations addressing the following issues:
1. Define Data Centers as a Separate Land Use
Potential definitions for “data center” and related uses, including artificial intelligence computing facilities, cryptocurrency mining facilities, hyperscale computing facilities, server farms, backup power 5d
generation facilities, battery energy storage systems, and similar high-intensity technology infrastructure uses.
2. Amend the Definition of Warehouse
Potential amendments clarifying that a warehouse does not include a data center or similar highintensity technology use.
Suggested concept:
“Warehouse” means a building used primarily for the storage of merchandise, goods, materials, equipment, or commodities, but does not include a data center, artificial intelligence computing facility, cryptocurrency mining facility, server farm, hyperscale data center, high-performance computing facility, cloud computing facility, co-location facility, backup power generation facility serving a data center, or similar high-intensity technology infrastructure use.
3. Review Similar-Use Classifications
Evaluate whether data centers and related uses should be separately classified rather than processed as any of the following unless expressly authorized by a data center-specific ordinance adopted by the City Council:
• Warehouse • Manufacturing use
• Storage facility • Light industrial use
• Communication equipment building • Heavy industrial use • Office • Accessory industrial use
• Utility facility • Similar use
• Electric substation
4. Establish No By-Right Approval
A key policy issue for City Council consideration is whether large-scale data centers and related highintensity technology uses should be permitted by right in any zoning district, absent the adoption of specific City regulations governing such uses.
The City Council may wish to consider whether data centers and related facilities should require discretionary review and approval through mechanisms such as a Conditional Use Permit, Development Agreement, Public Benefit Agreement, specific zoning authorization, or direct City Council approval.
The City Council may also consider whether such uses should be temporarily prohibited, conditionally permitted, or otherwise restricted unless and until the City adopts comprehensive standards specifically addressing data centers and related high-intensity technology infrastructure.
5. Protect Ordinary Accessory Technology Uses
Potential language clarifying that ordinary computer servers, data storage, network equipment, or similar technology systems accessory to a permitted primary use would not be affected.
Suggested concept:
5d
This section shall not apply to ordinary computer servers, data storage, network equipment, or similar technology systems that are accessory and incidental to a permitted primary use and do not operate as a principal data center use.
6. Transparency and Non-Disclosure Agreements
Potential evaluation of policies related to non-disclosure agreements, confidentiality agreements, or similar agreements associated with data center proposals, including review by the City Attorney and consistency with public records laws, open meeting laws, environmental review requirements, conflictof-interest laws, and other applicable legal requirements.
Such evaluation could include whether City elected officials, officers, employees, consultants, or agents should be restricted from entering into non-disclosure agreements or similar confidentiality arrangements related to data center proposals unless reviewed by the City Attorney and expressly authorized by the City Council or other legally authorized City authority.
Potential policy considerations may also include ensuring that no private agreement limits the City’s ability to comply with public disclosure obligations, environmental review requirements, open government laws, or the City’s broader obligations to protect the public interest.
The City Council may also wish to consider whether requests for non-disclosure agreements associated with data center proposals should be disclosed to the City Council, to the extent legally permissible.
Additional Potential Review Areas:
M-1 and M-2 Zoning Review
If directed, staff could prepare a map-based and parcel-level review of M-1 Light Manufacturing and M2 Heavy Manufacturing zoned properties within the City to evaluate factors such as surrounding land uses, proximity to sensitive receptors (homes, schools, parks, public facilities, etc.), infrastructure availability, emergency access, and future growth considerations.
The purpose is to determine whether any industrial areas are appropriate, conditionally appropriate, or not appropriate for data centers or related high-intensity technology uses.
Pending or Informal Inquiries
The City Council may also wish to consider whether staff should report any formal or informal inquiries, pre-application requests, entitlement applications, building permit requests, utility inquiries, or other communications related to potential data centers or similar facilities within the City limits, Sphere of Influence, or nearby unincorporated areas, to the extent such information may be legally disclosed.
Environmental, Utility, and Public Safety Review
The City Council may wish to consider whether any future data center proposal should be required to provide applicant-funded studies addressing energy demand, water demand, wastewater capacity, stormwater and drainage, air quality, backup generators, battery storage, noise, traffic, fire protection, emergency response, hazardous materials, police and security impacts, fiscal impacts, and infrastructure capacity.
5d
The City Council may also wish to consider whether such studies should be independently reviewed by third-party experts, with all costs paid by the applicant.
Public Benefit Agreements
The City Council may wish to consider whether future large-scale data center proposals should include a Public Benefit Agreement or Development Agreement addressing potential community benefits.
Any such agreement should ensure that if a project creates private economic value, it also creates clear, measurable, and enforceable public value for Brawley residents.
Potential public benefits may include local hiring, apprenticeship programs, workforce training, public safety equipment, fire and emergency response resources, road improvements, utility infrastructure improvements, parks and recreation funding, youth programs, community investment funds, annual reporting, and enforcement provisions.
Public benefits should be separate from and in addition to any legally required mitigation, environmental protection, infrastructure improvements, or public safety conditions.
Public Workshop
During the moratorium, the City Council may consider directing staff to conduct at least one public outreach or workshop to receive input from residents, businesses, labor, schools, public safety agencies, utility providers, and other stakeholders.
The purpose of the workshop would be to hear public concerns and identify what standards, protections, and community benefits should be required before any data center-related use is considered in or near Brawley.
Projects Near Brawley
The City Council may also wish to consider whether the City should establish a formal process for reviewing and commenting on data center projects proposed near the City limits or within the City’s Sphere of Influence.
The City would not exercise authority beyond its jurisdiction, but could consider procedures for monitoring and commenting on nearby projects that may affect Brawley residents or infrastructure.
FISCAL IMPACT:
There is no immediate fiscal impact associated with discussing this item and providing direction to staff.
Future costs may depend on whether the City Council directs staff to prepare an interim urgency ordinance, zoning amendments, public workshops, technical studies, environmental review standards, public benefit agreement templates, or other related materials. 5d
Staff should also evaluate whether future applicants can be required to pay for project-specific studies, legal review, environmental analysis, public outreach costs, and independent third-party technical review.
ALTERNATIVES:
Take no action — Council may choose not to pursue a temporary moratorium or related Brawley Municipal Code amendments at this time.
Provide alternative direction to staff — Council may direct staff to explore different regulatory approaches, timelines, or scopes for addressing large‑scale data centers.
Direct staff to return with additional information, draft ordinance language, or potential zoning amendment options for future consideration — Council may instruct staff to prepare a draft urgency or non‑urgency ordinance establishing a temporary moratorium and any related Brawley Municipal Code amendments.
