STAFF REPORT
To: City Council
From: Ana Gutierrez, Acting Public Works Operations Manager Prepared by: Ana Gutierrez, Acting Public Works Operations Manager Subject: NV5 Professional Engineering Consultant Amendment No. 4 Approval.

RECOMMENDATION:

Approve Amendment No. 4 to the Professional Services Agreement between the City and NV5, Inc. in an amount of $85,000 for continued City Engineering Services and authorize the City Manager to execute all necessary documents.

BACKGROUND INFORMATION:

The Council previously authorized Amendment No. 3 to the contract for continued professional engineering services with NV5, which ended on March 31, 2026. City Staff is requesting approval of Amendment No. 4 to extend the contract for another year, with an increase of $85,000 for Engineering Services to support the Engineering department while the City evaluates organizational restructuring and implements improved efficiency measures.

Amendment No. 4 will extend the agreement's term and provide additional compensation for continued engineering services. NV5 has demonstrated the technical expertise, responsiveness, and professional support necessary to assist the City as its Engineer and meet the City's engineering needs.

The continuation of these services will allow the City to:
• Maintain City Engineer services and engineering oversight. • Continue support for capital improvement projects.
• Review development plans and engineering submittals.
• Provide technical engineering assistance to City staff and City Council. • Ensure compliance with state and federal engineering requirements. • Support grant-funded infrastructure projects and related reporting requirements.

Staff have reviewed NV5's proposal and find the proposed scope of services and compensation to be reasonable and necessary for the continued operation of the City's engineering functions.

FISCAL IMPACT:

The total cost of Amendment No. 4 is not to exceed $85,000 and will be funded through the approved Fiscal Year 25/26 budget. Sufficient funds are available within the Engineering accounts to support the proposed amendment.

STAFF REPORT
To: City Council
From: Ana Gutierrez, Acting Public Works Operations Manager Prepared by: Ana Gutierrez, Acting Public Works Operations Manager Subject: Correction to Previously Approved Purchase and Installation Amounts for the Generator at the Jones Tank.

RECOMMENDATION:

Authorize the corrected amount of $79,250.00 for the purchase of the emergency backup generator to be installed at the Jones Tank site near the Airport from Empire CAT. Authorize installation services by AA Electric in an amount not to exceed $34,006.59. Approve the use of the Sole Source Procurement Method for the generator purchase and authorize the City Manager to execute all necessary documentation required for the purchase, installation, and implementation of the generator project.

BACKGROUND INFORMATION:

The City previously approved the purchase and installation of a backup generator for the Jones Tank site located near the Airport. During the preparation of the purchase documents, it was discovered that the amount presented for approval was based on an outdated proposal rather than the current quotation provided by the vendor. As a result, the previously approved purchase amount was incorrect and requires correction to accurately reflect the current cost of the equipment and installation services.

To address the discrepancy, staff is requesting authorization of the corrected purchase amount for the generator from Empire Cat in the amount of $79,250.00, authorization of installation services by AA Electric in an amount not to exceed $34,006.59, and approval of the Sole Source Procurement Method for the generator purchase.

Description Amount
Generator Purchase – Empire CAT $ 79,250.00
Installation – AA Electric $ 34,006.59
Total Project Cost $113,256.59
FISCAL IMPACT:

The Airport Generator for the Jones Tank is included in the FY 2025/26 Capital Improvement Budget under Project No. 2025-18 in the amount of $95,000.

The latest project estimate reflects a total project cost of $113,256.59, requiring a budget adjustment of $18,256.59 from the Water Treatment Fund as follows:
501-321.000-800.400 – Equipment Expense ........................................ $18,256.59 5j

STAFF REPORT
To: City Council
From: Ana Gutierrez, Acting Public Works Operations Manager Prepared by: Ana Gutierrez/Juan Manuel Cabrera, Acting PW Operations Manager/Interim Lead/Senior Engineer
Subject: Authorize Change Order No. 1 to the Traffic Signal Synchronization & Intelligent Transportation System project.

RECOMMENDATION:

Authorize Balancing Change Order No. 1 to Contract No. 2025-03, Traffic Signal Synchronization & Intelligent Transportation System Project, in the amount of $3,092.45, and authorize the City Manager to execute all related documentation.

BACKGROUND INFORMATION:

On April 15, 2025, the City awarded Contract No. 2025-03 to HMS Construction, Inc. for the Traffic Signal Synchronization & Intelligent Transportation System (ITS) Project in the amount of $975,000.00, with an approved contingency f $146,250.00 for unforeseen conditions for a total amount of $1,121,250.00.

The (ITS) Project included modifications to the traffic signals at the intersections of Main Street and 3rd Street and Main Street and 6th Street. The project improvements consisted of installing new fiber optic cable along Main Street, upgraded traffic signal equipment, and new traffic signal controller cabinets at both intersections.

During construction, adjustments were necessary to account for differences between estimated and actual quantities of work performed, as well as field conditions encountered during installation. Such adjustments are common in transportation infrastructure projects and are reconciled through balancing change orders upon completion of the work.

Balancing Change Order No. 1 consists of the following adjustments:
• Increase of $11,393.14 for additional work performed Traffic Signal Modification. • Increase of $9,241.36 for material substitutions and the Install of a CCTV System Complete. • Credit of $17,542.05 to the City for bid item work reduction.

The net result of these adjustments is an increase of $3,092.45 to the contract, bringing the final contract amount to $978,092.45.
5k
The approved project contingency is sufficient to cover the additional cost associated with this balancing change order. No additional project funding is required.

Approval of Balancing Change Order No. 1 will reconcile the final quantities and costs associated with the project and allow for the final project to be closed out.

FISCAL IMPACT:

Funding for Balancing Change Order No. 1, in the amount of $3,092.45, is available within the approved project contingency budget for the Traffic Signal Synchronization & Intelligent Transportation System Project. No additional appropriation is required.

STAFF REPORT
To: City Council
From: Ana Gutierrez, Acting Public Works & Operations Manager Prepared by: Ana Gutierrez, Acting Public Works & Operations Manager Subject: Award Best Avenue Improvements Project to Rove Engineering.

RECOMMENDATION:

Award Specification No. 2025-12 Best Avenue Improvements Project from Main Street to Jones Street to Rove Engineering for an amount of $1,099,778.30 and authorize a 15% contingency in an amount of $164,966.74 for a total amount of $1,264,745.04 and authorize the City Manager to execute all documentation concerning this project.

BACKGROUND INFORMATION:

The City receives monthly revenues from the Road Repair and Accountability Act of 2017, commonly known as Senate Bill 1 (SB 1). The SB 1 Road Maintenance and Rehabilitation Program (RMRP) was established to address deferred maintenance on state and local roadway systems. The City utilizes these gas tax revenues to fund roadway maintenance and rehabilitation projects throughout the community.

SB 1 revenues have been accumulated over the past three years to fund the rehabilitation of Best Avenue from Main Street to Jones Street. The proposed improvements include cold milling of the through lanes and shoulder areas, placement of a hot mix asphalt leveling course, application of an Asphalt Rubber Aggregate Membrane (ARAM), and installation of Asphalt Rubber Hot Mix (ARHM).

Additional improvements include adjusting water valves and manholes with new concrete collars, pavement striping, pavement markings, and pavement markers.

On April 29, 2026, the Engineering Division advertised the project plans and specifications. Bid openings were conducted on June 2, 2026, and the City received four responsive bids as follows:

Rove Engineering, Inc.

El Centro, CA $1,099,778.30
Vance Corporation
Beaumont, CA $1,293,713.60
Pavement Coating, Co.

Jurupa Valley, CA $1,332,777.00
Hazard Construction, Inc.
5l
Lakeside, CA $1,374,902.00
Staff reviewed all bids for responsiveness, accuracy, and completeness and verified that Rove Engineering Inc. possesses the required licenses, bonding capacity, and documentation necessary to perform the work. Rove Engineering, Inc. was determined to be the lowest responsive and responsible bidder.

Staff is also requesting authorization for a 15% contingency in the amount of $164,966.74, bringing the total authorized project amount to $1,264,745.04. The contingency will provide flexibility to address unforeseen field conditions, quantity adjustments, or other construction-related issues that may arise during the course of the project without causing delays.

Approval of this contract will allow the City to proceed with critical roadway improvements that will extend pavement life, improve roadway safety, enhance ride quality, and preserve transportation infrastructure for residents and businesses.

The local bidding preference factor was evaluated and did not affect the determination of the lowest responsive bidder.

FISCAL IMPACT:

The project is included in the FY 2025/26 Capital Improvement Budget under Project No. 2025-13.

The project includes various funding sources, such as SB 1 and Measure D. The total project budget is $2.6 million, which covers the different phases of design and construction.

At this stage, no additional funding allocations are required.

All costs associated with this contract shall be tracked under Project Code 2025-13.

STAFF REPORT

From: Denise Garcia, Special Projects Manager
Prepared by: Denise Garcia, Special Projects Manager
Subject: Adopt Resolution 2026-30 Authorizing the Acceptance of an Additional $14,387 in Grant Funding from the Imperial Irrigation District for the 2026 GLOW LED Light Grant Program and Approve the Corresponding Budget Amendment as necessary.

RECOMMENDATION:

Adopt Resolution 2026-30 authorizing the acceptance of an additional $14,387 in grant funding from the Imperial Irrigation District for the 2026 GLOW LED Light Grant Program and approve the corresponding budget amendment as necessary.

BACKGROUND INFORMATION:

On June 2, 2026, the City Council adopted Resolution 2026-17 approving the acceptance of $18,500 in grant funding from the Imperial Irrigation District 2026 GLOW LED Light Grant program to support the Lion Center Aquatic Complex lighting upgrades.

Since that time, the I.I.D. has offered an additional $14,387 to fund the original scope of work submitted with the grant application totaling $32,887.00. The original scope of work included lighting upgrades to Alyce Gereaux Basketball Courts and Scott Pace Basketball & Volleyball Courts. The additional funds will now allow the Parks and Recreation department to replace existing lights with LED energy-efficient lights at both facilities. This expansion aligns with the original project goals and will increase the GLOW Grant program’s impact on the community.

FISCAL IMPACT:

This project, in part, has been included in the adopted FY 2025/26 Capital Improvement Budget.

However, a budget amendment is necessary to recognize the additional grant revenue and appropriate the corresponding expenditures as follows:
101-521.000-430.403 – Revenue: $14,387
101-521.000-800.300 – Expenditures: $14,387
All revenues and expenditures associated with this project will be tracked under Project Code 2025- 41 within the Recreation Department General Fund budget.

The GLOW Grant Award does not require a City match; therefore, the grant will fully fund 100% of the project-related costs. Approval of this item will result in no net fiscal impact to the General Fund, as all project costs are fully offset by grant funding.
5m
ALTERNATIVES:

Council may elect not to accept the additional grant award funds from IID, and staff would need to seek other funding sources for LED light fixtures at these locations.

STAFF REPORT
To: City Council
From: Silvia Luna, Finance Director
Prepared by: Silvia Luna, Finance Director
Subject: Resolution Authorizing and Approving Interim Expenditures Prior to Adoption of the FY 2026-27 Operating and Capital Improvement Budget (REGULAR) RECOMMENDATION:

Adopt Resolution No. 2026-25 authorizing interim expenditures at the levels established by the approved Fiscal Year 2025–26 Budget to allow for the continued payment of routine and necessary operating expenses, including payroll, benefits, utilities, vendor commitments, contractual obligations, and essential service costs, until the FY 2026–27 Operating and Capital Budget is adopted.

BACKGROUND INFORMATION:

Each year, the City Council adopts an annual budget that serves as the City’s financial plan for the fiscal year. The current FY 2025–26 Budget covers the period from July 1, 2025, through June 30, 2026.

The City’s annual budget is typically presented to the City Council and the public through budget study sessions and public hearings prior to adoption and before the beginning of the new fiscal year on July

1. However, due to ongoing labor negotiations and the need to further refine revenue estimates, salary and benefit assumptions, operating needs, and capital priorities, additional time is needed to complete the FY 2026–27 budget process.

To ensure the uninterrupted delivery of essential public services, including public safety, water distribution, sewer collection, utility billing, payroll processing, and other core City operations, City Council authorization is needed to allow interim expenditures after the close of the current fiscal year and before formal adoption of the FY 2026–27 Budget.

Without this authorization, the City may be unable to timely process payroll, benefits, vendor payments, and other financial obligations necessary to maintain City operations. This could result in disruptions to essential services and administrative operations.

Approval of this resolution will allow the City to continue routine and necessary expenditures at FY 2025–26 approved budget levels on an interim basis while staff, the City Council, and the public continue the FY 2026–27 budget development process. This action does not approve new programs, new capital projects, or expenditures outside routine operations unless otherwise previously authorized by the City Council.
6a
Staff recommends that the City Council adopt Resolution No. 2026-25 authorizing interim expenditures at FY 2025–26 approved budget levels until the FY 2026–27 Operating and Capital Budget is formally adopted.

FISCAL IMPACT:

Interim expenditures will be limited to the levels established by the approved FY 2025–26 Budget and will be used only for routine and necessary operating expenses, including payroll, benefits, utilities, vendor commitments, contractual obligations, and essential service costs.

This action does not approve additional spending, new programs, or new capital projects. It authorizes the temporary continuation of regular operational expenses until the FY 2026–27 Operating and Capital Budget is adopted.

ALTERNATIVES:

The City Council may choose not to approve the resolution authorizing interim expenditures. If the resolution is not approved, the City may be unable to process payroll, benefits, vendor payments, and other financial obligations after June 30, 2026, until the FY 2026–27 Budget is adopted. This may result in disruption to City services and operations.

STAFF REPORT
To: City Council
From: William Smerdon, City Attorney
Prepared by: William Smerdon, City Attorney
Subject: Resolution Directing Staff to Amend the Zoning Ordinance to Address Large‑Scale Data Centers and Related Supporting Infrastructure RECOMMENDATION:

Staff recommends that the City Council adopt Resolution No. 2026‑29, directing staff to prepare amendments to the City’s Zoning Ordinance to effectively regulate large‑scale data centers and related supporting infrastructure.

BACKGROUND INFORMATION:

At the June 2, 2026 City Council meeting, the Council considered Proposed Ordinance No. 2026‑03, which would have imposed a temporary moratorium on the development of large‑scale data centers and related supporting infrastructure while the City reviewed and updated its zoning regulations.

After discussion, motion, and vote of 3-2, the City Council directed staff to remove the moratorium provisions and return instead with an item that:
• Confirms the Council’s commitment to updating the zoning ordinance, • Ensures that any proposed large-scale data center project undergoes a transparent process, • Requires public input, and
• Ensures full compliance with applicable environmental protection laws.

Because an ordinance is not required merely to direct staff to complete zoning amendments, staff prepared Resolution No. 2026‑29 as the appropriate mechanism to implement Council’s direction.

The resolution:
• States that the current zoning ordinance is insufficient to regulate large‑scale data centers and related supporting infrastructure,
• Directs staff to make zoning amendments a top priority, and • Authorizes the City Manager to engage consultants as necessary within spending authority.

Resolution No. 2026‑29 accurately reflects the Council’s direction to remove moratorium language and instead direct staff to prioritize drafting zoning ordinance amendments addressing large‑scale data centers and related supporting infrastructure. Adoption will allow this work to begin immediately and ensure that the City is prepared to thoughtfully and transparently evaluate any such proposals.

FISCAL IMPACT:
6b
There will be fiscal impacts associated with staff time, City Attorney services, and any consultants engaged to assist with the zoning ordinance update. The cost is not yet determined and would be brought back for Council approval if consultant contracts exceed the City Manager’s spending authority.

ALTERNATIVES:

1. Adopt Resolution No. 2026‑29 as presented. This implements the direction the Council provided on June 2, 2026.

2. Direct staff to revise the resolution.

3. Not adopt Resolution No. 2026-29 as presented.

4. Reconsider a moratorium approach.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRAWLEY, CALIFORNIA, DIRECTING STAFF TO

AMEND THE ZONING ORDINANCE TO ADDRESS LARGE-SCALE DATA CENTERS AND RELATED

SUPPORTING INFRASTRUCTURE IN THE CITY OF BRAWLEY
WHEREAS, The City Council finds that the City’s current zoning ordinance is not adequate to deal with the development of large-scale data centers and related supporting infrastructure; WHEREAS, the City Council previously considered Proposed Ordinance No. 2026-03, which would have imposed a temporary moratorium on the development of large-scale data centers and related supporting infrastructure while the City reviewed and updated its zoning ordinance; WHEREAS, at its meeting of June 2, 2026, the City Council directed staff to remove all moratorium-related provisions from the proposed ordinance and instead return with a resolution directing staff to prioritize amendments to the zoning ordinance to regulate large-scale data centers, and related supporting infrastructure;
WHEREAS, developers have shown interest in locating large-scale data centers and related supporting infrastructure within the Imperial Valley region; and WHEREAS, the City Council is committed to ensuring that any such proposal within the City of Brawley is subject to an open, transparent process that includes public input and complies with all applicable environmental protection laws;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BRAWLEY AS FOLLOWS:

SECTION 1. Staff is hereby directed to make it a top priority to prepare and propose necessary amendments to the Brawley Zoning Ordinance to ensure that and proposed large-scale data center or related supporting infrastructure is governed by clear and appropriate regulations, including but not limited to:
• Establishing clear definitions and classifications;

Section 2. To achieve this objective, the City Manager is authorized to engage consultants as necessary, within the limits of the City Manager’s spending authority.
