City Council

Agenda Item No 4c
STAFF REPORT
To: City Council
From: Rebecca Terrazas-Baxter, City Manager
Prepared by: Ana Gutierrez, Acting Public Works Operations Manager Subject: R3 Solid Waste Management Consulting Services Agreement.
RECOMMENDATION:
Authorize the Solid Waste Management Consulting Services Agreement with R3 Consulting Group, Inc. in an amount not to exceed $169,265.00 and authorize the City Manager to execute all documents necessary to carry out the Agreement.
BACKGROUND INFORMATION:
On July 29, 2026, the City of Brawley advertised a Request for Proposals (RFP) for Solid Waste Management Consulting Services. The purpose of the RFP was to evaluate the City's existing Exclusive Solid Waste Franchise Agreement and provide consulting services to assist the City with negotiations with Republic Services.
In August 2006, the City entered into an Exclusive Solid Waste Franchise Agreement with Allied Waste Transportation, Inc., a Delaware corporation doing business as Republic Services, for the collection, transportation, processing, recycling, and disposal of residential, commercial, and industrial solid waste generated within the City of Brawley. Since the execution of the original Agreement, the franchise has been amended four (4) times to address operational and regulatory changes.
Since the original Agreement was executed, California's solid waste regulatory environment has changed significantly. New state mandates, particularly Senate Bill 1383 (SB 1383), have substantially expanded local government responsibilities related to organic waste diversion, edible food recovery, recycling, contamination monitoring, procurement requirements, public education, and regulatory reporting.
The City seeks to evaluate the existing franchise agreement to determine whether it continues to provide value to the community, appropriately allocates responsibilities between the City and the franchisee, complies with current state regulatory requirements, and positions the City to address future solid waste management needs while maintaining reasonable customer rates.
On August 25, 2026, the City received four (4) proposals from the following firms:
• R3 Consulting Group, Inc. – Irvine, CA
• MSW Consultants – Murrieta, CA
4c
• Raftelis Financial Consultants – Los Angeles, CA
• Climate & Waste Systems Advisory – Carlsbad, CA
Staff conducted an evaluation of the submitted proposals based on the firm’s qualifications, relevant experience, understanding of the City's needs, proposed approach, and overall ability to provide the requested services.
Based on the evaluation, R3 Consulting Group, Inc., was identified as the firm best qualified to provide the requested solid waste management consulting services. R3 has extensive experience assisting municipalities with solid waste franchise agreements, regulatory compliance, rate analysis, and negotiations with solid waste service providers.
The proposed agreement with R3 Consulting Group, Inc. is for an amount up to $169,265.00.
Republic Services has agreed to reimburse the City for the full cost of the consulting services associated with the franchise agreement evaluation and negotiation process. Staff will return to the City Council with an amendment to the existing Republic Services franchise agreement, incorporating the terms and conditions necessary to formalize the reimbursement by Republic Services.
FISCAL IMPACT:
The total cost of the Solid Waste Management Consulting Services Agreement with R3 Consulting Group, Inc. is not to exceed $169,265.00. The FY 2026–27 Adopted Budget does not currently include an appropriation for these consulting services. Therefore, a budget adjustment of $169,265.00 is required in Fund 521 – Solid Waste, Account 521-341.000-730.100 – Professional Services.
The City anticipates seeking reimbursement from Republic Services for the consulting costs associated with the franchise agreement evaluation and negotiation process. Any reimbursement arrangement will be subject to the terms of an amendment to the existing Republic Services Franchise Agreement and will be presented to the City Council for consideration.
No reimbursement revenue is included in the proposed budget adjustment at this time. If the reimbursement arrangement is subsequently approved and executed, the City will recognize and budget the reimbursement revenue at that time.
ALTERNATIVES:
No alternative is recommended at this time.

Subject: Adoption of Resolution No. 2026-46 Approving a Memorandum of Understanding Between the Brawley Police Department and WomanHaven and Delegating Authority to the City Manager to Execute the Agreement RECOMMENDATION:

STAFF REPORT
To: City Council
From: Jonathan Blackstone, Interim Chief of Police
Prepared by: John Tang, Interim Assistant Chief
Subject: Potential Action to Approve a Memorandum of Understanding (MOU) with Brawley Elementary School District and the City of Brawley for Youth Programs
RECOMMENDATION:
Staff recommends that the City Council approve and accept the Memorandum of Understanding (MOU) between the City of Brawley and the Brawley Elementary School District (BESD) for the operation of expanded learning youth programs, including Soccer Clinics, Leadership Curriculum, Boxing Program, and E-Sports Program, for the 2026-2027 school year.
BACKGROUND INFORMATION:
The Brawley Elementary School District operates an Expanded Learning Opportunities Program (ELOP) and a local initiative known as Growing Leaders, Opening Worlds (GLOW). The district seeks to expand enrichment, physical activity, leadership, and digital learning opportunities for its students.
The City of Brawley, through the Brawley Police Department (BPD), operates youth engagement, mentorship, and physical training programs that align with the district’s educational goals and foster positive youth-police relationships.
The MOU formalizes a partnership that leverages City and District resources to deliver high-quality, inclusive youth programs. It ensures compliance with state and local regulations, provides clear roles and responsibilities, and establishes mechanisms for oversight, reporting, and evaluation. The programs promote student engagement, physical fitness, leadership, and digital literacy, supporting both educational and community goals.
Programs operate across multiple seasons (summer, winter, fall, spring), supporting continuous engagement and preventing learning and social regression during breaks. Students participate in skill-building activities that promote physical health, coordination, teamwork, discipline, and athletic development through soccer and boxing clinics.
The curriculum fosters communication skills, decision-making, conflict resolution, civic engagement, perseverance, and respect. Students develop emotional regulation strategies, positive decisionmaking habits, self-advocacy, and community stewardship—skills shown to improve student behavior, confidence, and long-term resiliency.
4g
Trained BPD youth program staff provide consistent mentorship, model appropriate behavior, and support students with positive communication and setting. These sustained adult relationships build trust, enhance emotional safety, and encourage positive youth police interactions that benefit the entire community.
Approval of this MOU will enable the City of Brawley, through the Brawley Police Department, to deliver expanded learning programs for youth in partnership with BESD, benefiting local students and families. Staff recommends Council acceptance and approval.
FISCAL IMPACT:
Implementing the Youth Program will require funding for personnel, equipment, materials, and other program-related expenses. Under the MOU, Brawley Elementary School District (BESD) will contribute $500,000 for the 2026-2027 school year to operate the Expanded Learning Youth Programs, including the Soccer Clinics, Leadership Curriculum, Boxing Program, and E-Sports Program.

NOW, THEREFORE, in consideration of the mutual covenants and promises contained herein, the Parties agree as follows:
I. PARTIES, CONTACTS, AND NOTICES

Extended Day District Manager. The City's initial Point of Contact is Raul Niebla, Brawley Police Department Youth Program Coordinator. A Party shall give written notice of any change within five (5) business days. The City shall also identify, in writing, the Site Coordinator assigned to each program location and shall notify the District of any change before that person's first session.

City: City Manager, 383 Main Street, Brawley, CA 92227, rebecca.terrazas[email protected].
II. PURPOSE AND SCOPE
The City shall design, staff, and operate the programs described in Section III as a component of the District's ELOP and GLOW. The District remains responsible for its own compliance with Education Code section 46120, including its program plan, offer-and-provide-access obligations, and apportionment reporting. Nothing in this MOU transfers that responsibility to the City.
The City, through BPD, shall operate the following programs for District students, as further described in Section III:
1. Soccer Clinics
• Winter Clinic
• Summer Clinic
2. Leadership Curriculum, addressing communication, character development, mentorship, conflict resolution, civic engagement, and personal growth.
3. Boxing Program, addressing discipline, conditioning, goal-setting, and structured noncontact instruction.
4. E-Sports Program, including supervised gaming sessions, tournaments, team strategy, and digital citizenship.
The City shall operate each program in compliance with the requirements applicable to expanded learning opportunity programs under Education Code sections 46120 and 8483.4, including the staffing qualifications and pupil-to-staff ratios stated in Section III.
III. PROGRAM DESCRIPTION
The programs are a coordinated set of enrichment, physical fitness, leadership, and technologybased activities delivered throughout the year. All programming shall be aligned to the District's 2026-2027 instructional calendar, including intersession days, and shall be staffed and operated by the City through BPD.
A. District Authority Over Participation. The District retains sole authority over student enrollment eligibility and prioritization under ELOP and GLOW. The District may remove a student 4g.1
Youth Program MOU - City of Brawley and Brawley Elementary School District
from participation for safety or disciplinary reasons at any time; the District will consult the City where practicable, but consultation is not a condition of removal.
B. Enrollment of Record. The District holds the enrollment record for each program. A student is enrolled when a parent or guardian has submitted an ELOP registration form to the District and that form is on file, consistent with Education Code section 46120(g)(6). The City shall not enroll, waitlist, or remove a student from a program roster except as directed in writing by the District, and shall submit any registration materials it collects to the District within two (2) business days of receipt.
C. Capacity Figures. Capacity and sponsorship figures stated in this Section are program slots used to size staffing, ratios, and equipment. They are not counts of unduplicated students, and a single student may occupy slots in more than one program.
D. Staffing Qualifications and Ratios. All City personnel who directly supervise students shall meet the District's minimum qualifications for an instructional aide, as required by Education Code sections 46120(b)(5)(D) and 8483.4(a): a high school diploma or its equivalent, demonstrated proficiency in basic reading, writing, and mathematics consistent with Education Code sections 45344.5 and 45330, and prior paid or volunteer experience in the care and supervision of children.
Only personnel meeting these qualifications count toward the pupil-to-staff ratio. The City shall assign staff to each session sufficient to maintain a pupil-to-staff ratio of no more than 20 to 1, and no more than 10 to 1 for any group that includes a transitional kindergarten or kindergarten student, measured against the students in attendance. Compliance is determined by the staff assigned to and present at the session. A brief, temporary absence of an assigned staff member to attend to a student need, an emergency, or personal necessity does not breach this Section, provided no group of students is left without adult supervision and assigned staffing is promptly restored. Only staff meeting these qualifications count toward ratio. The City shall certify compliance in Exhibit A and with each monthly performance report required by Section V.
E. Adult Visitors. Guest speakers, community mentors, and other adults who are not cleared City personnel may not have contact with students unless the District approves the visit in writing in advance and the visitor is supervised at all times by a cleared adult.
F. Soccer Clinics
The Soccer Clinic is a structured, seasonal enrichment program designed for students in grades TK–8. The curriculum emphasizes the development of fundamental athletic skills, teamwork, coordination, sportsmanship, and confidence through age-appropriate instruction. To facilitate safe and developmentally suitable learning, students will be organized by age, ensuring each group receives training appropriate to their physical and social development. The clinic is conducted through guided practices, interactive drills, and supervised lessons. Two clinics are conducted annually, one in summer and one in winter, each comprising four (4) sessions per week at each school. Each session will consist of two (2) hours per age group. If an audit disallows a cost paid under this MOU, the City shall repay it within sixty (60) calendar days of written demand.

• Weather and site conditions, including heat-illness precautions for outdoor physical activity; and
• The District's right to relocate or cancel a session on notice where a site is needed for instructional purposes, maintenance, an emergency, or another District program. The District will give as much notice as circumstances allow.

B. Termination
The District may terminate this MOU for convenience on thirty (30) calendar days' written notice.
Either Party may terminate for cause on ten (10) business days' written notice if the other Party has not cured a material breach within that period. The District may suspend any program immediately, without prior notice, if it determines that student health or safety requires it. Either Party may also terminate on sixty (60) calendar days' written notice on loss of funding or by mutual agreement. A sudden or unforeseen cessation of ELOP or GLOW funding is not subject to the sixty-day notice.
On termination or expiration, the Parties shall cooperate in good faith to close out the programs with minimal disruption to students and families. The indemnity obligations in this Section apply in place of the pro rata contribution formula in Government Code section 895.6 and survive expiration or termination of this MOU.

C. No Third-Party Beneficiaries. This MOU is for the benefit of the Parties only. It creates no right or remedy in any student, parent, guardian, employee, or other person.
D. Assignment and Subcontracting. Neither Party may assign this MOU or delegate any duty under it without the other Party's prior written consent. The City shall not subcontract any service involving contact with students without the District's prior written consent, and any approved subcontractor is subject to every clearance, training, insurance, indemnity, and records requirement of this MOU.

Neither Party is liable for a delay or failure in performance caused by an event beyond its reasonable control, including natural disaster, fire, epidemic, public health order, or civil disturbance. The affected Party shall notify the other promptly and resume performance as soon as practicable. This provision does not excuse any payment obligation for services already delivered, and does not extend the term.
G. Survival. The obligations in Section V (records and audit, repayment), Section VI (pupil records and data security), and Section VIII (insurance and indemnification) survive expiration or termination of this MOU.
H. Counterparts and Electronic Signature. This MOU may be executed in counterparts, each of which is an original and all of which together are one instrument. Signatures delivered electronically or by facsimile have the same effect as original signatures.
I. Construction. The language and all parts of this MOU shall be construed according to their fair meaning and in compliance with law. Each Party has reviewed this MOU, and no rule of construction resolving ambiguities against the drafting party shall apply; the MOU shall be interpreted as if the Parties contributed equally to its drafting.
XII. GOVERNING LAW, VENUE, AND ATTORNEY'S FEES
In any action between the Parties to enforce or interpret this MOU, each Party shall bear its own attorney's fees and costs, whether or not it is the prevailing party.

STAFF REPORT
To: City Council
From: Rebecca Terrazas-Baxter, City Manager
Prepared by: Emmet Fried, Assistant to the City Manager Subject: Ratification of Letter and City Manager's Transmittal Requesting Governor's Veto of SB 675 (Padilla)
RECOMMENDATION:
Ratify the September 11, 2026 letter from the City of Brawley to Governor Gavin Newsom requesting a veto of Senate Bill 675 (Padilla), relating to the Imperial County Air Pollution Control District; and ratify the City Manager's transmittal of the September 11, 2026 letter to the Governor's Office and appropriate legislative representatives.
BACKGROUND INFORMATION:
Senate Bill 675 (Padilla) proposes changes to the governance structure of the Imperial County Air Pollution Control District, including expansion of the governing board, broader representation for cities and communities throughout Imperial County, inclusion of public health, environmental justice, labor, and agricultural voices, and increased public access to permitting and enforcement information.
On July 21, 2026, the City Council authorized the City to take a position in opposition to SB 675.
Consistent with that direction, the City submitted a letter to the Assembly Committee on Appropriations expressing opposition to the bill and identifying concerns regarding potentially significant ongoing costs, the absence of a clearly identified sustainable funding source, and the potential for those costs to be passed on to local governments.
SB 675 subsequently passed the Legislature and was presented to Governor Gavin Newsom for consideration. The Governor's deadline to sign or veto the legislation is September 30, 2026.
Because the deadline occurs before the City's next regularly scheduled City Council meeting on October 6, 2026, the City Manager, on behalf of the City, transmitted a letter to Governor Newsom on September 11, 2026, requesting that the Governor veto SB 675. The letter was transmitted to ensure that the City's previously established position was communicated to the Governor while the bill remained under consideration.
The September 11 letter identifies the potential fiscal impact on local governments as the basis for the City's veto request. A copy of the letter is included as Attachment 1.
Staff is presenting the September 11 letter and its transmittal to the City Council for formal ratification.
DISCUSSION
4h
The City's request for a veto is focused on the fiscal structure of SB 675 and the potential recurring financial obligation it could place on local governments.
SB 675 adds subdivision (e) to Section 40701.5 of the California Health and Safety Code. Under the bill, any expenses of the Imperial County Air Pollution Control District not covered by grants, permit fees, subventions, or penalties would be funded through an annual per capita assessment on each city within Imperial County and on the County itself. The assessment amount would be established annually by the governing board of the Imperial County Air Pollution Control District. Local agencies would receive notice and an opportunity to participate in a public hearing before the assessment is adopted; however, the legislation does not provide cities with approval authority over the assessment amount and does not establish a statutory cap on the amount that may be imposed.
According to information provided by the County, SB 675 does not include state funding for implementation. The County further reports that an independent analysis concluded that the Air District could not absorb the anticipated costs through permit fees or other currently available revenue sources.
Potential Impact to the City of Brawley
The potential financial impact on individual cities is significant. Based on the County's analysis and a countywide population of approximately 181,411 residents, a $1 million annual Air District shortfall would translate to approximately $55,000 per year for every 10,000 residents, while a $4.5 million shortfall would translate to approximately $248,000 per year for every 10,000 residents.
For the City of Brawley, with a population of approximately 28,000 residents, those scenarios would equate to approximately $154,000 to $694,000 annually, depending on the size of the Air District's shortfall. These figures are illustrative based on population and the County's analysis and are not intended to represent a prediction of the City's actual assessment. Rather, they demonstrate the potential magnitude of a recurring financial obligation that could be imposed on the City.
As a municipal government, the City of Brawley has a responsibility to carefully evaluate any new recurring financial obligation that could affect its General Fund and, ultimately, its residents. The City's concern is particularly significant because the assessment would be recurring, would not be subject to a statutory dollar limit, and would not require approval by the affected city council.
The City's September 11 letter therefore requests that the Governor veto SB 675.
Ratification of Letter and Transmittal
The City Manager's September 11 transmittal was made in advance of the Governor's September 30 deadline because the deadline occurs before the City's next regularly scheduled Council meeting on October 6, 2026. The transmittal was consistent with the City Council's previously established opposition to SB 675 and allowed the City to communicate its position to the Governor while the legislation remained pending.
Staff is therefore requesting that the City Council ratify both the September 11, 2026 veto request letter and the Mayor's transmittal of the letter on behalf of the City.
FISCAL IMPACT:
4h
There is no direct fiscal impact associated with ratification of the September 11, 2026 letter or its transmittal.
However, if SB 675 is enacted, the legislation could have a significant future fiscal impact on the City.
Based on the County's analysis, a $1 million annual Air District shortfall would result in an estimated assessment of approximately $154,000 annually for the City of Brawley, based on the City's approximate population of 28,000 residents. A $4.5 million annual shortfall would result in an estimated assessment of approximately $694,000 annually.
These figures are illustrative scenarios based on population and the County's analysis. They do not represent a prediction of the City's actual assessment, which would depend on the Air District's future expenditures, available revenues, and resulting annual shortfall.
ALTERNATIVES:
The City Council may:
1. Approve ratification of letter and transmittal of letter.
2. Deny ratification of the execution and transmittal of the letter.
3. Direct staff to communicate a different position regarding SB 675 (Padilla).
4. Provide other direction as determined appropriate by the City Council.

WHAT SB 675 COSTS YOUR CITY
Five things every Imperial County city should know
1. Your city will be billed every year.
SB 675 lets the air district charge every city in Imperial County for whatever its own budget does not cover.
All seven cities pay, not just the ones with a seat on the board. Cities pay nothing today.
2. The air district board decides the amount. Your council does not vote on it.
Here is how your city’s bill gets set. Each year the air district adopts its budget. Whatever grants, permit fees, and fines do not cover is the shortfall. The board then splits that shortfall among the seven cities and the County according to population and bills each one. The bill calls this an “annual per capita assessment.” The eleven-member air district board decides the shortfall amount, and therefore your city’s share. Your council does not vote on it, cannot reject it, and has no appeal. The only requirement is that the board hold one public hearing 30 days before imposing it. Nothing in SB 675 sets a ceiling on how large the assessment can be.
3. The bill costs millions, and the State pays none of it.
The County’s independent analysis puts one-time transition costs at $75,000 to $650,000 and ongoing annual costs at $140,000 to $650,000, before facilities, and finds that building an independent IT system alone would run into the millions. SB 675 provides no state funding for any of it.
Permit fees cannot close the gap. State law caps annual permit fee increases at 15 percent. The district collected about $1.7 million in permit fees last year, so year one can add only about $250,000. And 79 percent of the district’s revenue is restricted grant money, spendable only on the programs it was awarded for. The Legislature has adjusted that fee cap for other districts; South Coast is exempt outright, San Diego has set fees closer to actual cost since 1998. Imperial got nothing, in a county with a fraction of San Diego’s population and twice its poverty rate. Whatever the County pays comes out of the same general fund that supports sheriff patrols, roads, and public health in our rural, unincorporated communities.
And because the Air District’s only other option is raising permit fees, the cost also lands on the growers, feedlots, and small businesses that make up Imperial County’s economic base. Those costs get passed on to customers and employees. Every resident of Imperial County pays for SB 675 one way or another.
4. Here is the math for your city.
Take your population, divide by 10,000, and multiply. Based on a countywide population of 181,411:
If the district comes up short by… Your city pays, per 10,000 residents $1 million a year $55,000 a year
$2.5 million a year $138,000 a year
$4.5 million a year $248,000 a year
Ex: a city of 20,000 residents pays about $110,000 a year if the shortfall is $1 million — and about $496,000 a year if it is $4.5 million.
5. Cities get 5 of 11 seats. Two cities get none.
The new board is one supervisor, five city council members, one irrigation district member, and four appointed members. The five city seats are assigned one per supervisorial district. With seven cities and five seats, at least two cities will have no one on the board that sets their bill.
WHAT WE ARE ASKING
SB 675 requires all of this to be done by July 1, 2027. An independent analysis concludes it would take at least three years. San Diego’s change took from 2019 to 2021 and is still not finished.
The Governor must sign or veto SB 675 by September 30. The County has requested a veto so the bill can return in 2027 with real funding and a workable deadline.
We are asking your city to send the Governor a letter requesting a veto. The County will provide the draft, ready for your letterhead and signature.
Letters must reach the Governor’s Office by September 4, 2026. 4h.3

RECOMMENDATION:
It is recommended that the City Council:
1. Approve the Memorandum of Understanding (MOU) between the City of Brawley and the Chamber of Commerce for Greater Brawley for the 2026 Cattle Call Festivities;
2. Approve the requested road closures and authorization for alcohol service/sales associated with applicable Cattle Call events, subject to applicable laws, permits, and City conditions;
3. Approve the provision of City in-kind support identified in the MOU, including public safety, event cleanup, and City liaison services, subject to available resources and applicable City policies;
4. Approve waivers of applicable City fees associated with the 2026 Cattle Call Festivities; and
5. Authorize a one-time $10,000 sponsorship payment to the Chamber of Commerce for Greater Brawley in accordance with the MOU.
BACKGROUND INFORMATION:
The City of Brawley has received requests from the Chamber of Commerce for Greater Brawley regarding the 2026 Cattle Call Festivities, including event coordination, road closures, alcohol service/sales, public safety and operational support, fee waivers, and a $10,000 City sponsorship.
Cattle Call is a longstanding community celebration that includes multiple events throughout the City and brings together residents, visitors, businesses, community organizations, and participants from throughout the Imperial Valley. The 2026 festivities include events requiring varying levels of traffic control, public safety, cleanup, and operational coordination.
To establish the respective responsibilities of the City and the Chamber, the parties have prepared a Memorandum of Understanding for the 2026 Cattle Call Festivities. The MOU establishes the Chamber as the event producer and identifies the City's financial and in-kind support. It also establishes requirements for event planning, permitting, insurance, event operations, and post-event reporting.
City Support Under the MOU
Subject to available resources, applicable laws, and adopted City policies, the MOU provides for the following City support:
5a
- A one-time $10,000 sponsorship toward eligible Cattle Call Festivities costs; - Public safety services as determined by the Police and Fire Departments; - Pre-, during-, and post-event cleanup support coordinated with applicable City departments; - Designation of a City liaison to coordinate with the Chamber; - Waiver of Cattle Call-related City fees, subject to City Council approval; and - For events involving alcohol, authorization by the City, as applicable, for alcohol service/sales on City property, subject to Council approval, City conditions, and compliance with all required California Department of Alcoholic Beverage Control permits and regulations.
Chamber Responsibilities
Under the MOU, the Chamber is responsible for organizing and managing the festivities, including event planning, required permits and approvals, coordination with City and other agencies, event logistics, and required insurance. The Chamber must maintain specified insurance coverage, including general liability, automobile liability, workers’ compensation, and liquor liability when applicable, with the City named as an additional insured. The MOU also includes indemnification provisions in favor of the City. Following the events, the Chamber is required to provide a post-event report. City funds provided under the MOU must be used for Cattle Call-related costs, and the $10,000 sponsorship is payable upon receipt of the required invoice, insurance documentation, and other required documentation.
2026 Event Requests and City Staffing
In addition to the MOU, staff has reviewed the operational requirements associated with the principal Cattle Call events and identified the anticipated City staffing necessary to provide public safety, traffic control, event operations, cleanup, road closure, and related support.
Chili Cook-Off – November 7, 2026
The Chili Cook-Off is scheduled from 9:00 a.m. to 1:00 p.m. on Main Street. The event organizer is requesting a road closure and authorization for alcohol service/sales.
The anticipated City staffing includes 10 Police Department employees, five Parks and Recreation employees, and four Public Works employees. The estimated staffing period for overtime purposes is approximately 6.5 hours.
Mariachi Night – November 11, 2026
Mariachi Night is scheduled from 6:00 p.m. to 11:00 p.m. and will require Police Department, Parks and Recreation, and Public Works support.
The anticipated staffing includes six Parks and Recreation employees for approximately 7.5 hours, 16 Police Department employees for approximately six hours, and four hours of Public Works support for event setup and takedown.
Cattle Call Parade – November 14, 2026
The Cattle Call Parade is scheduled to begin at 9:00 a.m., with road closure and traffic-control preparations beginning at approximately 4:00 a.m.
5a
The anticipated staffing includes approximately 20 Police Department employees for five hours, 10 Parks and Recreation employees for nine hours, and four Public Works employees for five hours to assist with road closures, barricades, barricade removal, and related operational needs.
The specific staffing levels identified above are operational estimates developed by City staff and are not fixed staffing requirements established by the MOU. The MOU provides for public safety and other City support as determined by the applicable City departments.
FISCAL IMPACT:
Approval of this item would authorize a $10,000 sponsorship contribution, which is included in the FY 2026–27 Adopted Budget under Account 101-521.000-750.300 (Advertising & Promotion – Expense).
In addition, the estimated overtime cost associated with Police Department, Parks and Recreation, and Public Works staffing for the three events is $28,348.
The total identified fiscal impact is $38,348, consisting of the $10,000 sponsorship and $28,348 in estimated overtime staffing costs. This amount does not include the value of any additional City fees or event-related costs that may be waived.
The sponsorship and applicable staffing costs will be charged to the respective approved FY 2026–27 departmental budgets. No budget adjustment is required for the $10,000 sponsorship contribution.
ALTERNATIVES:
Council may choose to

STAFF REPORT
To: City Council
From: April Hodgson, Parks and Recreation Manager
Prepared by: April Hodgson, Parks and Recreation Manager Subject: GameTime Playground Equipment Grant Opportunity RECOMMENDATION:
Staff recommends that the City Council receive and file the information regarding the GameTime Playground Equipment Grant opportunity and provide any direction deemed appropriate.
BACKGROUND INFORMATION:
The City of Brawley currently has approximately $100,000 allocated for playground equipment improvements under Project 2024-15. These funds have been carried forward specifically for playground equipment improvements.
GameTime, a playground equipment manufacturer whose equipment is currently utilized at approximately 80% of the City's parks, is offering a grant opportunity that may provide approximately 80%–100% matching assistance toward qualifying GameTime playground equipment.
The grant does not provide the City with a direct cash payment or reimbursement. Rather, if awarded, GameTime would reduce the City's cost for qualifying playground equipment. This could allow the City's existing playground equipment allocation to be used more efficiently and potentially preserve funding for other project-related costs, such as demolition, installation, site preparation, and safety surfacing.
For example, based on a recent preliminary quote:
- Regular playground equipment cost: $67,250, plus tax and freight - Estimated City cost with grant: $27,239.84, plus tax and freight - Approximate grant contribution: $40,000
The example above is provided for illustrative purposes only and is based on preliminary pricing.
Actual costs and grant assistance would depend on the equipment selected, the final proposal, and the terms of any grant award.
Staff is bringing this opportunity forward to ensure transparency regarding the City's existing playground equipment funds and to inform the City Council of staff's intent to pursue grant funding that could extend the purchasing power of those funds.
5b
Submitting a grant application does not commit the City to purchasing playground equipment from GameTime. However, if the City is awarded and accepts the grant, any grant funding would be subject to the terms and conditions of the grant and would be required to be used toward qualifying GameTime playground equipment.
Any future purchase of playground equipment or expenditure of City funds would remain subject to the City's applicable purchasing requirements, available appropriations, and any required City Council authorization.
FISCAL IMPACT:
There is no fiscal impact associated with submitting the GameTime grant application. The City currently has approximately $100,000 allocated for playground equipment improvements under Project 2024-15. Funding is available through Account 101-511.000-920.411 (Transfer to Parks CIP) and the applicable Parks CIP accounts.
If a grant is awarded and the City subsequently elects to proceed with a qualifying playground equipment purchase, the fiscal impact and proposed use of the City's existing funds would be presented to the City Council as part of the applicable purchasing and project approval process.
ALTERNATIVES:
The City Council may choose to:
1. Receive and file the information regarding the GameTime Playground Equipment Grant opportunity and provide any direction deemed appropriate; or
2. Provide alternative direction to staff regarding pursuit of the grant opportunity.

The Police Chief will report to the City Manager and will be responsible for the overall leadership and administration of the Police Department, consistent with the City's Police Chief Job Description and the terms of the Employment Agreement.
The proposed agreement has been reviewed as to form by the City Attorney and is presented to the City Council for ratification.
