Review of Two Existing General Municipal Taxes in the City of Brea

TO PREPARED BY
Honorable Mayor and City Council Members Faith Madrazo, Financial Services Manager, Revenue

DEPARTMENT HEAD APPROVAL CITY MANAGER APPROVAL
Monica Lo, Administrative Services Director Kristin Griffith, City Manager

RECOMMENDATION

1. Provide direction to staff on whether to pursue options to modernize local tax measures.

BACKGROUND/DISCUSSION
The City currently collects two local taxes: the Transient Occupancy Tax (TOT) and the Business License Tax. Both taxes were adopted by ordinance before Proposition 218, approved by voters on November 5, 1996. Under Proposition 218, voter approval is now required for any substantial changes, including tax restructuring. Unlike fees, taxes are not subject to cost justification requirements. These two taxes support General Fund expenditures, including public safety, streets, infrastructure maintenance, and other general City operations, including community services. The revenue is not restricted to specific programs but is intended to address the general needs of the community.

Transient Occupancy Tax - Hotel Tax or Hotel Bed Tax
The Transient Occupancy Tax (TOT) is currently under review as the rate has remained unchanged for the past 37 years. TOT is a tax applied to stays in hotels, motels, inns, short-term rentals, and other lodging establishments within the City of Brea. Commonly referred to as the “hotel bed tax,” TOT is charged to visitors who stay for fewer than 30 consecutive days and is included as part of the room charge. Hotel and lodging operators are responsible for collecting this tax from guests and remitting it to the City by the following month. Because TOT is a visitor-based tax, it places little direct burden on City residents.

The Brea City Council adopted Ordinance No. 363 establishing the Transient Occupancy Tax on July 20, 1964, with an initial tax rate of 4 percent. Over the past 62 years, the rate has increased by 6 percent from 4 percent in 1964 to the current rate of 10 percent.

Subsequent rate adjustments were adopted as follows:
6 percent effective July 1, 1978;
8 percent effective February 7, 1987; and
10 percent effective August 1, 1989.

Because these rate increases were adopted before November 1996, voter approval was not required. Within Orange County, TOT rates currently range from 0 percent to 15 percent, with the City of Anaheim imposing the highest rate. The cities of La Habra, Rancho Santa Margarita, and Villa Park do not collect TOT. La Habra does not have any major nationally branded hotels such as Marriott or Hilton. Additionally, Rancho Santa Margarita and Villa Park have no hotels within their city limits. The average TOT rate in Orange County is approximately 10.47 percent.

The City of Brea currently collects approximately $2.6 million annually in TOT revenue at the existing 10 percent rate, which is slightly below the countywide average. This amount excludes any additional revenue anticipated from the recently adopted ordinance allowing short-term rentals. There are currently six hotels/motels operating within the City.

If voters approve an increase to the TOT rate, the estimated additional annual revenues are as follows:
11 percent (+1%): approximately $260,000
12 percent (+2%): approximately $520,000
13 percent (+3%): approximately $780,000
15 percent (+5%): approximately $1.3 million
Staff recommends presenting a 3 percent increase, resulting in a proposed 13 percent TOT rate.

With the concurrence of the City Attorney, staff also recommends minor amendments to the TOT ordinance, including revisions to the definitions of Hotel, Occupancy, Rent, and Transient. These revisions, along with any proposed rate change, would require voter approval. An additional amendment—extending the record retention requirement for operators from three years to four years—would not require voter approval.

Business License Tax
The Business License Tax is paid by businesses operating within the City of Brea. Business license provisions were first established in 1961 by Ordinance No. 402, and the tax structure has remained largely unchanged since 1976 (no changes for 50 years). Similar to TOT, voter approval was not required before Proposition 218.

Currently, Brea has approximately 6,200 registered businesses, generating about $1.1 million in annual revenue.

On November 2, 2004, Measure C was presented to voters to update terminology, increase the minimum tax, and lift the maximum tax cap. The measure received 15,987 votes, but failed to pass, with 40.5% yes votes and 59.5% no votes, falling short of the required simple majority (>50%).

Since Measure C, City staff have consulted with the City Council on whether to propose a ballot measure to modernize the Business License Ordinance, update outdated terminology, and revise the tax structure. A key question is whether a business license fee might be more appropriate than a tax. Under Proposition 218, a fee can be adopted by City Council ordinance and updated via resolution, but it must have a direct correlation to the cost of providing the service. In other words, the fee must be justified by the cost of issuing the license. Conversely, any changes to a tax or modifications to the tax structure still require voter approval.

Both tax- and fee-based structures have advantages and disadvantages. Fees are transparent, easy to calculate, and can be adjusted by the City Council; however, they are limited to cost recovery. Currently, the cost to process a business is substantially lower than the revenue generated under the existing tax structure. As a result, adopting a fee-based system could lead to a significant reduction in revenue, estimated at approximately $1 million in General Fund revenue.

Business tax revenue fluctuates with local economic activity and business growth. However, the current ordinance imposes a maximum tax cap, which limits revenue generation. This cap applies to retail, wholesale, manufacturing, and business and personal services, ranging from $500 to $1,000. Approximately 280 businesses in Brea reach the maximum annually. For example, retail businesses reach the maximum tax once gross revenue hits $4 million, meaning a business earning $4 million pays the same tax as one earning $70 million. This creates inequities, as the tax does not account for the additional demand larger businesses place on City services such as police, fire, and street maintenance. If the maximum tax were lifted, an additional $1.1 million in revenue could be generated to help support these services.

A Business License Study is currently underway to review Brea’s existing tax structure and compare it with similar cities. Staff recommends updates to the Business License Ordinance, which may include:

Modifying the minimum tax
Removing the maximum tax cap
Reducing the number of business categories to simplify calculations Updating terminology to reflect modern business practices With City Council approval, staff will return at a future meeting to present recommended updates to the Business License Tax Ordinance for Council consideration.

FISCAL IMPACT/SUMMARY
Both the Transient Occupancy Tax (TOT) and the Business License Tax are ongoing revenue sources that support the City’s financial stability. As general taxes, these revenues are not restricted to specific programs, providing the City with flexibility to address evolving priorities.

With voter approval, modernizing these taxes would generate additional revenue to support essential public safety services, such as police, fire, and street maintenance, as well as community programs like recreation. The goal of modernization is to ensure the funding of core municipal services while aligning tax structures with visitor activity and local economic conditions.

Approve Change Orders for Required Modifications to Three Existing Type 1 Fire Engines and One Ladder/Tiller Truck

TO PREPARED BY
Honorable Mayor and City Council Members James Flores, Deputy Chief – Operations

DEPARTMENT HEAD APPROVAL CITY MANAGER APPROVAL
Dan Mielke, Fire Chief Kristin Griffith, City Manager

RECOMMENDATION
Staff recommends that the City Council take the following actions:

1. Approve a change order in the amount of $39,264, plus applicable tax, for required modifications to three (3) Type 1 fire engines purchased in 2022 and currently in production with Pierce Manufacturing;

2. Authorize a contingency amount not to exceed five percent (5%) of the original contract amount ($135,929) for the three (3) Type 1 fire engines to address potential manufacturer-driven specification changes prior to final acceptance;

3. Approve a change order in the amount of $23,046, plus applicable tax, for required modifications to the ladder/tiller truck purchased in 2023 and currently in production with Pierce Manufacturing;

4. Authorize a contingency amount not to exceed five percent (5%) of the original contract amount ($99,408) for the ladder/tiller truck purchased in 2023 to address potential manufacturer-driven specification changes prior to final acceptance; and

5. Authorize the City Manager or designee to approve change orders within the approved contingency limits.

BACKGROUND/DISCUSSION
On October 18, 2022, the City Council approved the purchase of three (3) Type 1 fire engines from Pierce Manufacturing for $2,718,583 as part of the City's long-term vehicle replacement plan and operational readiness initiative. Staff developed the fire engine specifications and received bids based on available technology and industry standards at that time.

In 2023, the City also approved the purchase of a Pierce ladder/tiller truck for $1,988,161.75. Fire Department personnel and Public Works staff conducted the Type 1 engine pre-construction meeting with Pierce Manufacturing in September 2025 and the truck pre-construction meeting for the ladder/tiller truck in November 2025.

As both projects have now progressed into the pre-build and mid-build phases, Pierce Manufacturing (Pierce) has identified several components that staff initially specified but are no longer available due to manufacturer discontinuation. Additionally, staff identified several operational enhancements to align the apparatus with the City's modernized traffic preemption system and current response standards.

GPS Traffic-Signal Preemption Controllers:

Staff did not include the GPS traffic-signal preemption controllers in the original 2022 specifications. Each unit costs approximately $9,545 and enables fire apparatus responding Code 3 to change red lights to green lights as they approach intersections, improving response efficiency and safety.

In 2022, under the City's seven-year Capital Improvement Project (CIP 7218), the City began upgrading traffic signal controllers from infrared (IR) Opticom to GPS-based preemption. The majority of signalized intersections are now GPS-equipped, making GPS-capable fire apparatus essential for full system compatibility.

The 2022 Citygate Standards of Coverage and Community Risk Assessment found that:
"Brea's street layout and topography create non-uniform travel paths and congestion points that limit the Fire Department's ability to achieve consistent travel time performance citywide." The addition of GPS preemption directly supports this finding and aligns apparatus functionality with the City's current traffic infrastructure.

Required Specification Updates:

Several components specified in 2022 have been discontinued by the manufacturer and replaced with current, functionally equivalent alternatives that meet today's operational and safety standards. These substitutions include a combination of deleted items and upgraded replacements, resulting in a net cost increase of $3,543 per engine, or $10,629 plus applicable tax for all three units.

Similar specification issues with the ladder truck. Components originally specified in 2022 are discontinued and replaced with current alternatives that meet today's standards. These changes likewise include a combination of credits and additions, resulting in a net increase of $13,501, plus applicable tax, with the majority of the increase attributable to the need for heavier-duty axles and suspension components to support the ladder truck's operational weight safely.

COMMISSION/COMMITTEE RECOMMENDATION
During the January 27, 2026 Finance Committee meeting, the Committee evaluated the item and issued a recommendation for City Council approval.

FISCAL IMPACT/SUMMARY
The total combined change order for all required modifications to the three (3) Type 1 fire engines is $39,264 plus applicable tax, which represents approximately 1.45% of the original $2,718,583 contract amount. This equates to about $13,088 per unit and remains well below the typical contingency range of 5–10% for projects of this size.

Similarly, the total combined change order for all required modifications to the ladder/tiller truck is $23,046 plus applicable tax, which represents approximately 1.16% of the original $1,988,161.75 purchase price and remains well within the typical contingency range of 5–10% for a project of this scale.

Given continued supply-chain fluctuations, manufacturer product discontinuations, and mid-build technology updates, staff recommends establishing a not-to-exceed contingency of 5% for each apparatus project:

Type 1 Fire Engines Contingency (5%): $135,929
Ladder/Tiller Truck Contingency (5%): $99,408
This contingency will allow staff to address manufacturer-driven specification changes administratively without returning to the Finance Committee for each minor adjustment, while maintaining strict not-to-exceed limits and full fiscal oversight. Pierce has requested confirmation of City approval to continue production without delay. Pierce Manufacturing will invoice the City after final inspection and delivery, and Finance may modify the existing purchase order or issue a separate purchase order.

There are sufficient funds in the Equipment & Vehicle Maintenance Fund 480 under the mobile equipment account (480-51-5161-4641) to cover these changes orders.
