The Ordinance would update and streamline the City’s existing Subdivision Ordinance to comply with recent State law requiring local jurisdictions to provide a ministerial review process for certain subdivisions and housing developments on multi-family and single-family lots that meet specific eligibility requirements.

Adoption of the Ordinance is not an action subject to the California Environmental Quality Act (CEQA), as it has no potential for resulting in a physical change to the environment (14 Cal. Code. Regs. § 15358). Further, Government Code Sections 65852.28(e), 65913.4.5(b), and 66499.41(i) state that an ordinance adopted by a local agency to implement the streamlined ministerial approval requirements of SB 684 is not considered a project under CEQA.

2. An ordinance approving an amendment (Rezone No. 24-005) to Brentwood Municipal Code Chapter 17.850 Temporary Use Permits to add regulations related to Long-Term Mobile Vending Facilities and Commissaries.

These two ordinances and text amendments are exempt from the requirements of the California Environmental Quality Act (“CEQA”) pursuant to State CEQA Guidelines, as they are not a “project” and have no potential to result in a direct or reasonably foreseeable indirect physical change to the environment. 14 Cal. Code Regs. § 15378(a). Further, the Ordinances are exempt from CEQA as there is no possibility that either Ordinance or their implementation would have a significant negative effect on the environment. 14 Cal. Code Regs. § 15061(b)(3).

Title/Recommendation
Adopt an ordinance approving a zoning text amendment (RZ 24-009) to various sections of the Brentwood Municipal Code for Accessory Dwelling Units (ADUs) and Junior Accessory Dwelling Units (JADUs), in compliance with State planning law.

Adoption of the ordinance, which would modify the City’s existing regulatory requirements to be consistent with Article 2, Chapter 13, Division 1, Title 7 of the California Government Code and Article 3 Chapter 13 Division 1 Title 7 of the California Government Code, is exempt from the California Environmental Quality Act (CEQA), pursuant to Section 21080.17 of the Public Resources Code and Section 15282 of the CEQA Guidelines. In addition, amendments to conform to Section 65852.27 of the California Government Code are exempt under the “common sense” exemption, found at CEQA Guidelines Section 15061(b)(3), in that it can be seen with certainty that there is no possibility that adoption of the amendments will have a significant effect on the environment, in that ADUs permitted under the ordinance incorporating these statutory sections will be permitted by state statute regardless of the adoption of the local ordinance.
