Adoption of the ordinance, which would modify the City’s regulatory requirements to be consistent with Article 2 and 3 of Chapter 13, Division 1, Title 7 of the California Government Code is statutorily exempt from the California Environmental Quality Act (CEQA) under Public Resources Code Section 21080.17. Additionally, the ordinance is exempt from CEQA pursuant to Public Resources Code Section 21065, and CEQA Guidelines Sections 15060(c)(2), 15378, and 15061(b)(3) as it can be seen with certainty that there is no possibility that it may have a significant effect on the environment in that the ordinance merely incorporates and implements state statutory provisions governing ADUs and JADUs that are already permitted by state law regardless of the adoption of the local ordinance
