CITY COUNCIL AGENDA ITEM NO. G.3
3/10/2026
SUBJECT: Establish a policy prohibiting new agreements for City utility services outside of City limits
DEPARTMENT: Public Works
STAFF: Casey Wichert, Director of Public Works
TITLE/RECOMMENDATION
Adopt a resolution approving a policy prohibiting the City from providing utility services outside of City limits.
FISCAL IMPACT
There are no direct fiscal impacts associated with this item.
BACKGROUND
During the City Council meeting on January 13, 2026, staff requested City Council direction on how to treat requests for utility services for projects located on parcels outside City limits. Council discussion led to clear direction to staff, that consistent with voters’ rejection of Measure L in 2019, the City should not provide any new utility services agreements to projects outside of City limits.
As such, staff has prepared the attached draft policy for Council’s consideration.
Generally, it provides that it is the policy of the City to deny any request for City utility services outside of City limits that is submitted to the City after the policy is adopted.
That notwithstanding, if the City Council wants to consider providing new City utility services to a parcel outside of City limits, any member of the City Council may request such item to be brought to a regular City Council meeting following the Future Agenda Item request process set forth in the City Council’s Meeting Rules and Procedures.
At the City Council’s discretion, the City Council may direct staff to enter into a new agreement for services outside of City limits that was previously approved by Council.
CITY COUNCIL AGENDA ITEM NO. G.3
3/10/2026
The City currently has one existing contract that provides utility services outside of City limits. On April 9, 2019, the City Council approved and authorized an agreement for the service of non-potable water to 7901 and 7929 Deer Valley Road in Antioch.
The terms of the contract allow it to continue from year to year unless affirmatively terminated by either party. It thus would not be affected by the proposed new policy.

CITY OF BRENTWOOD
PURPOSE
The City of Brentwood recognizes the value of partnering with other agencies and organizations in providing services that benefit the community and its residents. To that end, non-profit agencies, intergovernmental agencies or community groups that provide community benefit as approved by the City Manager or designee may be granted a reduction and/or waiver of fees that are included in the approved Cost Allocation Plan for use of City property, such as City buildings, building maintenance or use of ball fields. Certain fees for permits, crowd control and solid waste services may also be waived. In an additional effort to support those organizations that provide valuable community services for the public benefit, the following policy has been established to determine when consideration will be given for requests for use of City funds, and any limitations associated with those requests.
POLICY
Priorities and Requirements:
Fee waivers and/or reductions or donations are primarily made to local organizations based in the City of Brentwood. Agencies based in neighboring communities that serve a significant number of City of Brentwood residents may also apply. National agencies will most likely not be considered. Fee waivers and/or reductions or donations are made only to organizations as described within this Policy.
Applications for specific programs, events, equipment needs or general operational support will receive special consideration if they fall under one of the Council Two-Year Strategic Initiatives. The City Council Two-Year Strategic Plan that contain these goals can be found on the Internet under “City Council”.
Special consideration will be given to events for which matching funds have been secured.
Requests for funding must be made in writing by using the application form.
Donation and Fee Waiver and/or Fee Reduction Requests:
Requests are made through completion of a “Request for Fee waiver and/or Fee Reduction/Donation” application. Requests are considered on a case-by-case basis as outlined in this document.
Donations and Fee Waiver and/or Fee Reduction Requests will not be granted for the following expenses:
Office or administrative overhead/staff salaries of the requesting organization.
With the exception of: Contra Costa County Library, Delta Community Services Inc. and Contra Costa County Senior Nutrition Program as approved by the City Council.

1. PURPOSE AND APPLICABILITY
1.1. Purpose To outline City employees’ and officials’ responsibilities regarding accepting gifts from anyone doing business with, seeking to do business with, or seeking a permit or entitlement from the City.
The City strives to provide impartial and exceptional customer service. Gifts can be perceived as attempts to influence City decisions and operations and can erode public confidence. It is important to avoid the appearance of impropriety.
This Policy incorporates some of the applicable FPPC Regulations and also includes regulations specific to Brentwood.
1.2. Applicability This Policy applies to all City employees and officials. The Policy applies whether the gift giver is an individual, business, or organization.
The Fair Political Practices Commission (FPPC) has many regulations in place identifying specific requirements that City officials/employees must follow. For more information see the FPPC Regulations. If there is conflict between this policy and the FPPC Regulations which govern gifts to public employees/officials, the more stringent control applies.
