Subject: Public comment - 8/11 council meeting agenda item I.2 Date: Saturday, August 8, 2026 10:10:44 AM
Hi -
As a resident of Shadow Lakes subdivision, I would like for the Brentwood City Council to take up the agenda item I.2 proposed by council member Mendoza. This is the proposal to review the use of "Flock" or other similar surveillance devices, as well as to review the existing installations in Shadow Lakes.

Other city councils, including nearby cities like San Jose have exercised their authority in limiting or outright banning these invasive and illegal mass surveillance devices.

If indeed the installation of these cameras happened without the city council's review, that is a major issue. Failure to provide adequate oversight does not absolve the city council of their responsibility to ensure the rights of the citizens of this community are protected.

California civil code 1798.90.5 requires any HOA using cameras of this type to create written privacy standards, retention periods, and maintain a log of anyone accessing the data. I do not see any of these items addressed on the HOA website, and I have serious doubts whether they exist. At a minimum, this opens the HOA members to personal liability, and their adherence to the law is certainly an appropriate matter for the city council.

I urge the council to take up this matter, and by doing so, to pursue the easiest path to a resolution that is in the interest of the city's citizens.
