CITY COUNCIL AGENDA ITEM NO. C.1

SUBJECT: Consideration and Potential Action to Close the Creekside Park Pickleball Courts Once Temporary Pickleball Courts at Sunset Park Are Ready for Use, as Determined by the City Manager or Designee; Temporary Alternative Pickleball Operations at Sunset Park;and Adoption of a Resolution Codifying Council Direction DEPARTMENT: Parks and Recreation
STAFF: E. Harith Aleem Jr., Director of Parks and Recreation Thomas Lloyd Smith, City Attorney
TITLE/RECOMMENDATION
Staff recommends that the City Council receive public comment and adopt the attached resolution, which expressly considers and directs the following actions:
1. Reserve $1,726,871 in the General Fund for Future Capital Projects as of June 30, 2026;
2. Close the Creekside Park pickleball courts as soon as the temporary pickleball courts at Sunset Park are determined by the City Manager or designee to be Ready for Use, as defined in the proposed resolution;
3. Prioritize preparation of temporary pickleball courts in the back parking lot at Sunset Park and make them available for public pickleball play as soon as possible after they are determined to be Ready for Use; and
4. Send notice to residents residing within 1,000 feet of Creekside Park seeking input regarding a feasibility study for the future use of the existing pickleball courts, including consideration of noise and residential parking impacts.
The resolution would constitute the City Council's current and controlling direction concerning these matters and would supersede the September 21, 2026 motion only to the extent of any inconsistency.
FISCAL IMPACT
The September 21, 2026 staff report estimated the cost of a new pickleball facility to be between $1,020,081 and $1,726,871, depending on features and amenities.
These costs would be funded by the General Fund.
On September 21, 2026, the City Council directed staff to set aside a General Fund reserve equal to the upper estimated cost of $1,726,871 using FY 2025/26 General Fund personnel vacancy savings as the funding source.
CITY COUNCIL AGENDA ITEM NO. C.1
10/19/2026
Currently, annual staffing costs associated with locking and unlocking the Creekside Park pickleball courts are approximately $24,000 and the costs are included in the FY 2026/27 - 2027/28 General Fund Operating Budget.
Annual staffing costs of $29,000 for the proposed enhanced six-court permanent pickleball facility are not currently included in the FY 2026/27 – 2027/28 General Fund Operating Budget and would require a budget amendment. Additional ongoing expenses would be incurred for maintenance, with the exact dollar amount dependent on amenities such as lights and restrooms. Cost estimates for maintenance range between $10,000 and $15,000 annually.
BACKGROUND
The Creekside Park pickleball courts were completed in August 2024 and consist of four dedicated regulation courts. The site previously operated as a full basketball court. Creekside Park is the City's only dedicated public pickleball facility, although portable equipment is also available for shared-use pickleball at Pioneer Park.
In March 2025, the City Council reduced the operating hours of the Creekside Park pickleball courts to 7:00 a.m. to 7:00 p.m. in response to neighborhood concerns regarding noise and evening activity and directed staff to explore future pickleball facilities outside residential neighborhoods. On August 12, 2025, the Council affirmed the hours and directed continued evaluation of non-residential locations.
On September 21, 2026, the City Council considered Agenda Item E.1 concerning pickleball operations at Creekside Park and future pickleball court development. The staff report identified a potential permanent six-court facility at 2251 Elkins Way and requested direction regarding the long-term role of the Creekside Park pickleball courts. During public comment, residents spoke both in opposition to and in support of continued pickleball use at Creekside Park.
Following public comment and Council deliberation, the Council voted 5-0 to direct staff to: (1) set aside a reserve of $1,726,871 in the General Fund for future capital projects; (2) close the Creekside Park pickleball courts as soon as the temporary courts at Sunset Park are ready for use; (3) prioritize preparation of temporary pickleball courts in the back parking lot at Sunset Park and make them available for use as soon as possible; and (4) notify residents within 1,000 feet of Creekside Park and seek input regarding a feasibility study for the future use of the existing pickleball courts, including noise and residential parking impacts.
CITY COUNCIL AGENDA ITEM NO. C.1
10/19/2026
On September 24, 2026, the City received a written demand under Government Code section 54960.1 alleging that the September 21, 2026 agenda did not adequately disclose that the Council could direct closure of the Creekside Park pickleball courts before completion of the proposed permanent facility. The demand requested, among other relief, that the matter be re-calendared with an agenda description expressly identifying potential closure and that the public be provided an opportunity to comment on closure.
DISCUSSION
Express Notice of Potential Closure and Temporary Alternative Pickleball Operations
This item expressly notifies the public that the City Council will consider and may take action to close the Creekside Park pickleball courts to pickleball use once the temporary pickleball courts in the back parking lot at Sunset Park are determined by the City Manager or designee to be Ready for Use. The Council will also consider providing temporary alternative pickleball operations at Sunset Park while the City pursues development of a permanent pickleball facility.
Under the proposed resolution, “Ready for Use” means that the City Manager or designee has determined, in the City’s sole administrative discretion, that the temporary Sunset Park pickleball courts may be opened to the public for pickleball play. That determination will be final and controlling for purposes of implementing the resolution. Ready for Use does not require completion of every planned improvement or amenity or require the temporary Sunset Park pickleball courts to be identical or equivalent to the Creekside Park pickleball courts in the number of courts, dimensions, playing surface, lighting, fencing, amenities, operating hours, or other features, except as required by applicable law.
The temporary Sunset Park pickleball courts and the proposed permanent six-court facility at 2251 Elkins Way are separate facilities. The proposed resolution does not authorize demolition, removal of permanent court infrastructure at, or permanent conversion of the Creekside Park court area and does not determine its permanent future recreational use. Any permanent repurposing of that area will be considered separately.
Closure may include ordinary administrative measures necessary to discontinue authorized public pickleball use, including securing access, posting closure notices, and removing or securing nets and other movable pickleball equipment. The
CITY COUNCIL AGENDA ITEM NO. C.1

feasibility study and notice to residents within 1,000 feet concern the permanent future recreational use of the Creekside Park court area and are not conditions that must be completed before the Creekside Park pickleball courts may close once the temporary Sunset Park pickleball courts are Ready for Use. The 1,000-foot notice area will be determined by City staff using the City’s geographic information system, parcel, address, or other reasonably available records, measured from the exterior boundary of Creekside Park.
Resolution Codifying Council Direction
The attached resolution substantially conforms to the September 21, 2026 motion reflected in the approved meeting minutes and codifies that direction in a formal resolution. The resolution would be the City Council's current and controlling direction concerning the matters addressed and would supersede the September 21 motion only to the extent of any inconsistency.
Government Code section 54960.1 recognizes subsequent action by a legislative body in response to an alleged Brown Act violation and provides that such action shall not be construed, or be admissible, as evidence of a violation. The agenda and this staff report provide express notice that closure of the Creekside Park pickleball courts and temporary alternative pickleball operations at Sunset Park are before the Council.
The Council will receive public comment before taking action. To the extent any further action is required under Government Code section 54960.1, adoption of the resolution is intended to constitute subsequent action addressing the alleged notice deficiency. Adoption would not constitute an admission that the September 21 agenda or action violated the Brown Act.

ENVIRONMENTAL DETERMINATION
The temporary use and minor alteration of an existing paved public facility at Sunset Park for temporary pickleball courts, together with cessation of pickleball operations at an existing recreational facility, are categorically exempt from the California Environmental Quality Act under CEQA Guidelines section 15301 (Existing Facilities) because the actions involve operation or minor alteration of existing public facilities with negligible or no expansion of use. The resolution does not authorize permanent repurposing of the Creekside Park court area. Any future permanent repurposing will be considered separately with any required environmental review.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood as follows:
Section 1. Recitals.
The foregoing recitals are true and correct and are incorporated into this Resolution.
Section 2. Council Direction and Superseding Effect.
The City Council hereby directs staff to:
1. Reserve $1,726,871 in the General Fund for Future Capital Projects as of June 30, 2026;
2. Close the Creekside Park pickleball courts as soon as the temporary pickleball courts at Sunset Park are “Ready for Use,” as determined pursuant to Section 3;

This Resolution constitutes the City Council's current and controlling direction concerning the matters addressed herein and supersedes the September 21, 2026 motion only to the extent of any inconsistency.
Section 3. Scope and Implementation of Closure Direction.
The direction in Section 2 authorizes closure of the Creekside Park pickleball courts to pickleball use once the temporary Sunset Park pickleball courts are Ready for Use.
1. Ready for Use. “Ready for Use” means the City Manager or designee has determined, in the City’s sole administrative discretion, that the temporary Sunset Park pickleball courts may be opened for public pickleball play. That determination controls implementation of this Resolution. Ready for Use does not require completion of every planned improvement or amenity or equivalency with the Creekside Park pickleball courts in number, dimensions, playing surface, lighting, fencing, amenities, operating hours, or other features, except as required by applicable law.
2. Closure. “Closure” means cessation of authorized public pickleball use at the Creekside Park pickleball courts and may include securing access, posting closure notices, and removing or securing nets and other movable equipment.
Closure does not authorize demolition, removal of permanent court infrastructure, or permanent conversion of the Creekside Park court area.
3. Future Use. Permanent repurposing of the Creekside Park court area is outside the scope of this Resolution and will be considered separately. The feasibility study and resident-notice process described in Section 2 concern the
permanent future use of the court area and are not conditions precedent to closure once the temporary Sunset Park pickleball courts are Ready for Use.
4. Notice Area. For purposes of the resident-notice process, the 1,000-foot notice area shall be measured from the exterior boundary of Creekside Park using the City’s geographic information system, parcel, address, or other reasonably available records.
Section 4. Effect of Resolution.
The City Council expressly finds that the agenda and staff report for this meeting provided clear and unequivocal notice that the Council would consider closure of the Creekside Park pickleball courts and temporary alternative pickleball courts at Sunset Park. The Council has considered the matter after receiving public comment and has taken subsequent action through this Resolution.
To the extent any further action is required under Government Code section 54960.1, this Resolution constitutes subsequent action in response to the September 24, 2026 demand and the alleged notice deficiency. Adoption of this Resolution does not constitute an admission that the September 21 agenda or action violated the Brown Act.
Section 5. Budget and Implementation.
The City Manager or designee is authorized to take all administrative actions necessary to implement this Resolution. To the extent formal Capital Improvement Program or budget amendments remain necessary to implement the funding direction in Section 2, staff shall present those amendments to the City Council in accordance with applicable City procedures.
Section 6. Effective Date.
This Resolution shall take effect immediately upon adoption.
