Subject: Push back on State Housing mandates - fight to maintain local land use decisions I want to urge the City of Brisbane its Honorable Council members to join Huntington Beach in their lawsuit against the State of California.

The State is not following is own rules regarding housing laws. The State should not have the right to dictate to the our local elected officials how to vote on housing development projects.

Loosely quoting Michael Gates, city attorney of Huntington Beach- "They know the needs of their communities and so the rub really is it's not partisan it's whether the community should have local control, local decision-making authority over what's best for the community with regard to housing or whether the state should dictate it from on high.

They're basically telling local city councils how they have to vote taking duly elected officials who were vested at the local city council level with the discretion to make decisions for the communities. They're vested with that Authority by the voters. You have to make the decisions we tell you to make in order to advance our housing agenda. There's some constitutional concerns and constitutional challenges that we've mounted against the state of California alleging First Amendment violations."

Thank you,
Danny Ames

"Michael Gates, city attorney of Huntington Beach. Discusses how the housing mandates can change California’s beach towns and what he is doing to protect his city. "The unfortunate thing is, if this were to succeed, you would be looking then at high-density development and high-density living in only the 5 percent of the territory, where 95 percent of California's population lives, leaving the other 95 percent of the territory untouched."
