City Manager Review: SW
Council Agenda Item No.: 3
To: The Honorable Mayor and City Council
From: Linda Reid, City Clerk
Meeting Date: July 14, 2022
Subject: Designation of Voting Delegate and Alternate for 2022 League of California Cities Annual Conference Business Meeting
______________________________________________________________________________
BACKGROUND
The League of California Cities Annual Conference is scheduled for September 7-9, 2022 in Long Beach. An important part of the Annual Conference is the Annual Business Meeting, scheduled for Friday, September 9, at 12:30 p.m., at which time the League membership considers and takes action on resolutions that establish League policy.
In order to vote at the Annual Business Meeting, the City Council must designate a voting delegate and up to two alternate voting delegates. Designation of the voting delegate and alternate(s) must be done by City Council action and cannot be accomplished by simply notifying the League office of the City’s representatives to the Annual Business Meeting.
Typically, the Mayor and the Vice Mayor are designated as the City’s representatives to the Annual Business Meeting. Both the Mayor and Vice Mayor are planning to attend the Annual Conference. Upon the decision of the City Council as to the voting delegate and the alternate voting delegate, the City Clerk will submit the required designation form with affirmation by the City Clerk of the City Council’s action.
FISCAL IMPACT
This item in itself will not cause any fiscal impact on the City.
RECOMMENDATION
That the City Council designate the Mayor as the City’s voting delegate and the Vice Mayor as the alternate voting delegate to the 2022 League of California Cities Annual Business Meeting.

City Manager Review: SW
Council Agenda Item No.: 4
To: The Honorable Mayor and City Council
From: Gregory Murphy, City Attorney
Meeting Date: July 14, 2022
Subject: Resolution No. 22-25 – “A Resolution of the City Council of the City of Buellton, California, Proclaiming the Continuing Need to Meet by Teleconference”
______________________________________________________________________________
BACKGROUND
On September 16, 2021, Governor Newsom signed Assembly Bill 361 (AB 361), which modified the Brown Act to allow a legislative body to continue to meet under teleconferencing rules during a proclaimed state of emergency and where local officials recommend measures to promote social distancing.
On September 28, 2021, the Santa Barbara County Public Health Department recommended that social distancing continue during public meetings via use of teleconferencing in order to help prevent the spread of COVID-19. This message was set forth in the Santa Barbara County Public Health Department’s press release entitled, “Health Officials AB 361 Social Distance Recommendation”, which is attached to Resolution No. 22-25 as (Exhibit A).
Public Health Officials have recommended measures to promote social distancing, including holding virtual meetings for legislative bodies within the County of Santa Barbara. Therefore, in consideration of the State of Emergency declared by Governor Newsom and findings that the State of Emergency still warrants the option of teleconferencing for public meetings, it is in the interest of public health and safety, and in response to the local recommendation for measures to promote social distancing, it is necessary to invoke provisions of AB 361 related to teleconferencing.
A Special City Council Meeting was held on January 13, 2022, allowing teleconferenced meetings to continue, Resolution No. 22-02 was adopted on February 10, 2022, Resolution No. 22-06 was adopted on March 10, 2022, Resolution No. 22-11 was adopted on April 14, 2022, Resolution No. 22-15 was adopted on May 12 and Resolution No. 22-25 was adopted on June 9, documenting the continued need for meetings to occur via teleconference if necessary, to allow for social distancing to continue for both Council and Commission meetings, especially given the compact area that houses the Council
Resolution No. 22-25 Page 2 July 14, 2022
Chambers. Resolution No. 22-25 would allow teleconferenced meetings to continue for another 30 days, if needed.
RECOMMENDATION
That the City Council consider adoption of Resolution No. 22-25 - “A Resolution of the City Council of the City of Buellton, California, Proclaiming the Continuing Need to Meet by Teleconference”

RESOLUTION NO. 22-25
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BUELLTON, CALIFORNIA, PROCLAIMING THE
CONTINUING NEED TO MEET BY TELECONFERENCE
WHEREAS, the City of Buellton is committed to preserving and nurturing public access and participation in meetings of the City Council; and
WHEREAS, all meetings of the City of Buellton’s legislative bodies are open and public, as required by the Ralph M. Brown Act (Cal. Gov. Code 54950 – 54963), so that any member of the public may attend, participate, and watch the City’s legislative bodies conduct their business; and
WHEREAS, the Brown Act, Government Code section 54953(e), makes provisions for remote teleconferencing participation in meetings by members of a legislative body, without compliance with the requirements of Government Code section 54953(b)(3), subject to the existence of certain conditions; and
WHEREAS, a required condition is that a state of emergency is proclaimed and state or local officials have imposed or recommended measures to promote social distancing; and WHEREAS, on March 4, 2020, Governor Newsom declared a State of Emergency as a result of the COVID-19 pandemic; and
WHEREAS, on September 28, 2021 the Santa Barbara County Public Health Department put into effect measures requiring social distancing and other public health measures and restrictions to help combat the COVID-19 pandemic as referenced in Exhibit A; and WHEREAS, the State of Emergency and social distancing and other public health measures remain in effect; and
WHEREAS, COVID-19 continues to threaten the health and lives of Buellton City residents notwithstanding the City’s vaccination rates and the Omicron variant is highly transmissible in indoor settings; and
WHEREAS, the City of Buellton has a relatively compact City Council chambers that does not allow for social distancing and a return to solely in-person meetings may discourage public participation and expose those present to a risk of COVID-19 transmission.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Buellton that:
Section 1. State of Emergency and Social Distancing. Due to COVID-19, the State of California continues to be in a state of emergency and the County of Santa Barbara continues to impose and recommend measures requiring social distancing and other, which measures make holding solely in-person City Council and other legislative body meetings difficult due to the compactness of the City Council chambers, the inability to have sufficient public presence at the meetings due to social distancing, and the potential of transmission of COVID-19 at meetings.
Resolution No. 22-25 Page 2 July 14, 2022

Council Agenda Item No.: 5
To: The Honorable Mayor and City Council
From: Rose Hess, Director of Public Works
Meeting Date: July 14, 2022
Subject: Approval of Santa Barbara County Association of Governments (SBCAG) Cooperative Agreement for Measure A Safe Routes to School Program
______________________________________________________________________________
BACKGROUND
In June 2020, the Santa Barbara County Association of Governments (SBCAG) Board adopted the Measure A Program of Projects for Fiscal Years 2020/21 to 2024/25 identifying all transportation projects to be funded with Measure A revenues during the next five fiscal years. The City of Buellton’s Active Transportation Plan was identified as one of the projects receiving funding ($3,300). The next step in the process for delivering the project is for SBCAG and the City of Buellton to execute a Cooperative Agreement.
The Cooperative Agreement specifies details such as the amount of Measure A funding allocated to each project, matching fund commitments, responsibilities for notifying the public that a project is Measure A funded (including Measure A construction signage), liabilities and indemnifications for the project, and timely use of funds deadlines.
The attached Cooperative Agreement (Attachment A) describes and allocates funding for planning costs for the Active Transportation Plan in the City of Buellton. The project will combine and update multiple City documents such as the Bicycle and Pedestrian Master Plan and the Safe Routes to School Plan, into one centralized Active Transportation Plan (ATP). The City must ensure that all documents are coordinated for the planning, maintenance and infrastructure needed to address active transportation. With this ATP encompassing all elements including school safety, bicycling, pedestrians, transit and funding, all information can be found and updated in one document.
The SBCAG Board approved this Cooperative Agreement at their June 16, 2022 meeting.
FISCAL IMPACT
Work to complete the Active Transportation Plan is included in the FY 2022/23 budget.
The grant amount of $3,300 will be received via reimbursement.

Within 6 months of Project completion, Sponsor shall provide a Project completion report to Authority that includes final cost, revenues, and schedule of completed and future activities. For construction Projects, pictures of the completed Project must accompany the report. Whenever possible, pictures of the “before” Project conditions should also be submitted. This Report shall accompany the final invoice for payment from Sponsor to provide notice of Agreement account closing by Authority. The Report shall meet all requirements set forth in the Authority’s Program Guidelines.

Extension requests will be presented to the North County Subregional Committee which will make recommendations to the SBCAG Board.
Authority may extend the deadline for timely use of funds no more than one time and only if it finds that an unforeseen and extraordinary circumstance beyond the control of the Sponsor has occurred that justifies the extension. The extension will not exceed the period of delay directly attributed to the extraordinary circumstances and will in no event be for more than the duration described in the above paragraph and in Authority’s Cycle 3 Program Guidelines.
1.9 Public Outreach. The Sponsor is responsible for development and administration of a public outreach effort to ensure public awareness and involvement in the Project development and delivery process. 1.11.b Excess Costs. In the event the actual Project cost exceeds the estimate shown in Exhibit A to this Agreement, this amount will be considered an excess cost. Sponsor is solely responsible for all costs over the amount identified in Section 1.3 or as approved pursuant to Section 1.2.
1.11.c Reconciliation of Excess Costs. Excess Project costs to complete a Project are not eligible for reimbursement unless approved pursuant to Section 1.2. The amount of Measure A funds as identified in Section 1.3 are the maximum funds available for reimbursement to the Sponsor and cannot be increased unless agreed to by the Authority pursuant to Section 1.2. The Sponsor shall request an amendment if needed for this purpose in writing to the Authority. Such amended Agreement shall be effective only if signed and approved by the duly authorized representatives of both the Authority and Sponsor.
1.12 Errors and Omissions. The Sponsor shall diligently monitor and manage all aspects of the Project and shall aggressively pursue any and all remedies, including full restitution and damages from any consultant, contractor or sub-contractor and their insureds and sureties suspected of any acts, errors, or omissions committed during business activities that economically or legally damage the Project.

2.1.a Ineligible Costs. The Authority reserves the right to adjust current or future reimbursement payments to Sponsor if an invoice includes ineligible costs.
2.1.b Suspension of Reimbursement. If the Authority determines that any costs in an invoice are not allowable, or lack supporting progress reports, the Authority shall return the invoice to the Sponsor with an invoice dispute notice outlining the reason for the return and the proposed remedy, if one exists, which would make the invoice acceptable for payment. The Sponsor may re-submit the invoice for payment after reviewing the invoice dispute notice and making any necessary corrections. The Sponsor may also immediately submit a new invoice representing only the amounts which are not in dispute, while setting aside the disputed amounts for review in accordance with the provisions set forth in this Section 2.1.
2.1.b.1 Meeting. Once a dispute has occurred, the Authority shall arrange a meeting between Authority and Sponsor staff to discuss and attempt to resolve the dispute.
2.1.b.2 Subregional Committee. If an agreement cannot be reached at the meeting, then the Sponsor or the Authority shall have the option to take the dispute to the Authority's North County Subregional Committee, as appropriate. In this case reimbursement for the disputed cost item(s) will be delayed until a resolution of the matter is reached.
2.1.b.3 Authority’s Board Decision. If the Sponsor or the Authority disagrees with the resolution by the Subregional Committee then the dispute shall be submitted to the Authority’s Board for resolution. If the Board determines that the disputed cost item(s) is ineligible, the Authority shall not provide reimbursement payment to the Sponsor for the disputed item(s). If the Board determines that the disputed cost item(s) is eligible, then the Authority shall provide reimbursement payment to the Sponsor for the disputed cost.
2.1.b.4 Reservation of Rights. By utilizing the above procedures, the Sponsor does not surrender any rights to pursue available legal remedies if the Sponsor disagrees with the Board decision.
2.2 Authority’s Payment shall not constitute Waiver. Authority’s failure to discover or object to any ineligible Project cost or billing prior to payment shall not constitute a waiver of Authority’s right to require Sponsor to correct such work or billing or seek any other legal remedy.
2.3 Right to Conduct Audit; Record Keeping. The Authority shall have the right to conduct an audit of all Sponsors’ records pertaining to the Agreement at any time during the course of construction and up to a five (5) year period after completion of the Agreement.

Subject: Discussion and Possible Approval of Santa Ynez Valley Botanic Garden Irrigation Request
_____________________________________________________________________________________________
BACKGROUND
The Santa Ynez Valley Botanic Garden Foundation, Inc. (Foundation) requests that the City Council consider a proposal to renovate and replace the aging irrigation system at the Botanic Garden. The existing irrigation system was funded by the City and installed in 2008 during the initial grading and hardscape phase of the Botanic Garden. In the fourteen years since, various portions of the system have been expanded and repaired, but the deterioration has reached the point where the frequency and scale of needed repairs is leading to significantly increasing maintenance costs and necessitating extensive hand watering for some areas where lines are beyond repair.
The Foundation request letter (Attachment 1) outlines the problems with the current irrigation system and proposes the following tasks for irrigation remediation:
• Repurposing obsolete tree bubbler systems to irrigate the newly installed Rain Garden.
• Replacement and adjustment of broken heads to provide better coverage for existing plants.
• Replacement of existing deteriorated drip systems with consistent materials and emitter output to increase efficiency and accuracy of water delivery and reduce overall water usage.
• Repair and expansion of south facing slope systems.
• Locate/Repair/Replace all valves and valve boxes including new rodent exclusion wire and gravel.
Attachment 2 lists estimated costs for the various materials and labor for the proposed upgrades to the Botanic Garden irrigation system. The requested amount of $35,000 would allow the Foundation to upgrade the entire irrigation system while increasing efficiency to save water and volunteer time. The life expectancy of the new system with proper maintenance is approximately fifteen years.
Botanic Garden Request Page 2 July 14, 2022
Staff recommends that the Council discuss and consider approving the Foundation’s request for funds to renovate and replace the Botanic Garden irrigation system.
FISCAL IMPACT
The fiscal impact of this request is $35,000. Since this project was not in the adopted budget, a corresponding budget amendment would be needed.
RECOMMENDATION
That the City Council consider approval of the Foundation request of $35,000 to renovate and repair the Botanic Garden irrigation system and direct staff to make the appropriate budget amendment.

Subject: Consideration of Bike Skills Course Memorandum of Understanding (MOU) with Sage Trail Alliance
_____________________________________________________________________________________________
BACKGROUND
Sage Trail Alliance (Sage), a non-profit corporation, is a chapter of the International Mountain Bicycling Association that was formed in 1988 to serve the mountain bicycling community of Santa Barbara and Ventura Counties. They have extensive experience in designing, constructing, and maintaining trails, bike skills parks, and conservation areas.
After completion of the first phase of the City’s Bike Skills Course through cooperation with volunteers from Santa Ynez Valley Youth Recreation, staff reached out to Sage to discuss the possibility of assistance in the next phase of improvements which would utilize funding from the State Proposition 68 Per Capita Grant funds that were awarded to the City.
Subsequent discussion and site visits to the Bike Skills Park by Dillon Osleger, Sage Executive Director, have led to the proposed Memorandum of Understanding (MOU) between the City and Sage (Attachment 1).
Under the terms of the MOU, Sage agrees to coordinate the design, construction, and maintenance of the the Bike Skills Course at River View Park. This includes the purchase and installation of new wooden ramps, earthwork for berm and trail creation, application of soil stabilizers and amendments to the existing dirt infrastructure, and coordination of regular work days to maintain the park features in a quality and safe condition for public use. In turn, the City agrees to provide the use of Prop. 68 grant funds up to $65,000 for the design, construction, and maintenance of the project, provide safe access to the property, coordinate with Sage on future expansion of features, and collaborate to provide community use of the facility. The initial term of the MOU is for three years, commencing August 1, 2022 and ending June 31, 2025, and is subject to annual renewal by mutual agreement of both parties.
The MOU has been reviewed and approved as to form by the City Attorney.
Staff recommends that the City Council consider approval of the Bike Skills Course MOU with Sage for the design, construction, and maintenance of a complete bike skills park.
Sage Trail Alliance Page 2 July 14, 2022
FISCAL IMPACT
The fiscal impact of this would be $65,000 from Proposition 68 Per Capita Grant funds which the City Council has previously designated for the installation of ramps and skill structures at the Bike Skills Course at River View Park.
RECOMMENDATION
That the City Council consider approval of a Bike Skills Course MOU with Sage Trail Alliance.

City Council Agenda Staff Report
City Manager Review: SW
Council Agenda Item No.: 8
To: The Honorable Mayor and City Council
From: Scott Wolfe, City Manager
Meeting Date: July 14, 2022
Subject: Design Direction of Main Residence at 202 Dairyland Road (“Willemsen Property”)
______________________________________________________________________________
BACKGROUND
On August 26, 2021, the City Council authorized the expenditure of funds for the purpose of designing improvements for use of the Willemsen residence as a municipal building.
Staff’s understanding of City Council direction was that this building would ultimately house the Buellton Library and another revenue generating use. Possible uses discussed included conference or meeting space and space complementary to the conduct of weddings and other events in the barn. However, there was a decided lack of consensus with regard to specific City Council direction on this matter.
Following an RFP process, on March 24, 2022, the City Council authorized the City Manager to engage Brett Marchi to provide architectural designs for the residence. Given staff’s understanding of Council direction, the architect was asked to provide two designs.
One design (Scheme A) was to include library space as well as a room that could be used as a “bridal suite” and two community meeting rooms, one of which could be used for multiple rooms with flexible dividers. Scheme A included the “bridal suite” on the southeast corner of the building. This location was selected as the shape of the room and the windows and exterior door within it lent itself to the use. Additionally, the proximity of the corner of the house to the barn helped to ensure that conflicts between the suite and the library and other building activities were minimized.
The other (Scheme B) was to include library space as well as large conference rooms, accessible from outside so that they could be used independently of library operations.
Scheme B included two additional larger conference spaces, in addition to the two that were included in Scheme A. The two additional spaces are located on the west side of the house that were shown as library area in Scheme A, while the “bridal suite” is replaced with library space.

After consulting with library staff on their equipment and layout needs, Mr. Marchi prepared two preliminary floor plans. Staff presented these plans informally to City Council members as they visited City Hall, and received comments indicating disagreement on the part of the City Council with regard to the use and layout of the building.
In order to keep costs for this project under control, staff is requesting that the City Council give additional direction to the architect so that work can continue.
FISCAL IMPACT
There are no fiscal impacts to City revenues or expenditures anticipated as a result of this exercise.
RECOMMENDATION
Staff recommends that the City Council discuss the potential configuration of the library and other potential uses in the Willemsen house at 202 Dairyland Road, and give staff and the architect direction with regard to design and configuration of the future uses.

City Council Agenda Staff Report
City Manager Review: SW
Council Agenda Item No.: 9
To: The Honorable Mayor and City Council
From: Gregory Murphy, City Attorney
Meeting Date: July 14, 2022
Subject: Consideration of Second Amendment to City Manager Employment Agreement and Discussion of Salary Adjustment for City Manager for Fiscal Year 2022-23
______________________________________________________________________________
BACKGROUND
In closed session on June 23, 2022, following the City Manager’s Annual Performance Evaluation, the City Council generally approved of the City Manager’s job performance and directed the matter of a salary and benefits adjustment be agendized for this City Council meeting.
The City Council also agreed to discuss and consider a salary adjustment for the City Manager in open session. The City Manager’s monthly base salary is currently $15,321 ($183,852 annually). The City Manager has requested that the Council consider a 5% salary increase to reflect his performance, as well as the application of the 3% COLA that the Council provided to the rest of the City staff. Together these would total an 8% increase in the City Manager’s monthly base salary, which works out to $16,547 ($198,560 annually). The City Manager also asked that the $400 increase toward medical premiums that was provided to the rest of the City staff apply to him as well and goes into effect January 1, 2023.
At this time, the City Council may wish to consider the City Manager’s proposal or any alternate salary adjustment and any alternate benefit changes to the City Manager’s contract. As the City Council is aware, no “bonus” or other backward-looking compensation is allowable under California law; compensation must be forward-looking to comply with restrictions on public executive-level employees.
The City Manager Employment Agreement and First Amendment to City Manager Employment Agreement are attached as exhibits to this report for the reference of the City Council in making the above decisions and for the general benefit of the public.
City Manager Contract Extension Page 2 July 14, 2022
FISCAL IMPACT
The Fiscal Impact will depend on the salary adjustment awarded to the City Manager. The budget for Fiscal Year 2022-23 anticipated a 3% COLA and $400 medical premium increase for the City Manager, so no change would be made to the budget if those are granted. The additional 5% performance-related salary increase was not anticipated in the budget, so staff would make the necessary budget amendment if granted by the City Council.
RECOMMENDATION
Staff recommends that the City Council discuss a salary and benefits adjustment for the City Manager for Fiscal Year 2022-23 and any other contract amendments as appropriate, direct staff to draft a Second Amendment to City Manager Employment Agreement to incorporate the changes approved by Council, and authorize the Mayor to sign the Second Amendment after it is finalized.
