City of Buellton
Monthly Treasurer’s Report
For the month ending in June 30, 2022
August 11, 2022
This report presents the City’s cash activity and investment portfolio as of June 30, 2022. The report includes:
1) Cash and investments at June 30, 2022 compared to the prior month;
2) A reconciliation of cash and investments to City ledger balances; 3) All investments managed by the City on its own behalf; 4) Beginning of year fund balance, revenues, expenditures and ending fund balance for each fund at June 30, 2022
The following schedule is a summary of the City’s cash and investments based on recorded value as of June 30, 2022 compared with the prior month.
May 31, 2022 June 30, 2022 $ Change
Cash - Pooled $ 10,647,939.66 $ 10,229,255.65 $ (418,684.01) Restricted Cash $ 446,784.30 $ 446,824.14 $ 39.84
Investments held by the City 10,283,804.78 10,277,599.84 $ (6,204.94) TOTAL CASH AND INVESTMENTS $ 21,378,528.74 $ 20,953,679.63 $ (424,849.11) Summary of activity for the Month and Future Liquidity: The majority of the difference in the recorded value for cash held by the City from last month is mainly due to the disbursement to Central Coast Water Authority (CCWA) offset with revenue from May 2022 transient occupancy tax (TOT) and April 2022 sales tax. The value of investments decreased mainly due to unrealized losses on Certificate of Deposits (CDs).
The portfolio is sufficiently liquid to meet expected expenditures for the coming six months.

City of Buellton
Investment Summary
June 30. 2022
Currently, short-term excess cash is primarily invested in the Local Agency Investment Fund (LAIF) administered by the State Treasurer. This is a high quality investment available in terms of safety, liquidity, and yield. Due to fluctuations in the marketplace, the City may have some investments with a current market value that is greater or less than the recorded value. This difference has no effect on investment yield as the City intends to hold the securities to maturity. However, generally accepted accounting principles require that market gains and losses be reported as interest earnings or losses at year-end.

City Council Agenda Staff Report
City Manager Review: SW
Council Agenda Item No.: 4
To: The Honorable Mayor and City Council
From: Gregory Murphy, City Attorney
Meeting Date: August 11, 2022
Subject: Resolution No. 22-26 – “A Resolution of the City Council of the City of Buellton, California, Proclaiming the Continuing Need to Meet by Teleconference”
______________________________________________________________________________
BACKGROUND
On September 16, 2021, Governor Newsom signed Assembly Bill 361 (AB 361), which modified the Brown Act to allow a legislative body to continue to meet under teleconferencing rules during a proclaimed state of emergency and where local officials recommend measures to promote social distancing.
On September 28, 2021, the Santa Barbara County Public Health Department recommended that social distancing continue during public meetings via use of teleconferencing in order to help prevent the spread of COVID-19. This message was set forth in the Santa Barbara County Public Health Department’s press release entitled, “Health Officials AB 361 Social Distance Recommendation”, which is attached to Resolution No. 22-26 as (Exhibit A).
Public Health Officials have recommended measures to promote social distancing, including holding virtual meetings for legislative bodies within the County of Santa Barbara. Therefore, in consideration of the State of Emergency declared by Governor Newsom and findings that the State of Emergency still warrants the option of teleconferencing for public meetings, it is in the interest of public health and safety, and in response to the local recommendation for measures to promote social distancing, it is necessary to invoke provisions of AB 361 related to teleconferencing.
A Special City Council Meeting was held on January 13, 2022, allowing teleconferenced meetings to continue, Resolution No. 22-02 was adopted on February 10, 2022, Resolution No. 22-06 was adopted on March 10, 2022, Resolution No. 22-11 was adopted on April 14, 2022, Resolution No. 22-15 was adopted on May 12, Resolution No. 22-21 was adopted on June 9, and Resolution No. 22-25 was adopted on July 14, 2022, documenting the continued need for meetings to occur via teleconference if necessary, to allow for social distancing to continue for both Council and Commission meetings, especially given the
Resolution No. 22-26 Page 2 July 14, 2022
compact area that houses the Council Chambers. Resolution No. 22-26 would allow teleconferenced meetings to continue for another 30 days, if needed.
RECOMMENDATION
That the City Council consider adoption of Resolution No. 22-26 - “A Resolution of the City Council of the City of Buellton, California, Proclaiming the Continuing Need to Meet by Teleconference”

RESOLUTION NO. 22-26
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BUELLTON, CALIFORNIA, PROCLAIMING THE
CONTINUING NEED TO MEET BY TELECONFERENCE
WHEREAS, the City of Buellton is committed to preserving and nurturing public access and participation in meetings of the City Council; and
WHEREAS, all meetings of the City of Buellton’s legislative bodies are open and public, as required by the Ralph M. Brown Act (Cal. Gov. Code 54950 – 54963), so that any member of the public may attend, participate, and watch the City’s legislative bodies conduct their business; and
WHEREAS, the Brown Act, Government Code section 54953(e), makes provisions for remote teleconferencing participation in meetings by members of a legislative body, without compliance with the requirements of Government Code section 54953(b)(3), subject to the existence of certain conditions; and
WHEREAS, a required condition is that a state of emergency is proclaimed and state or local officials have imposed or recommended measures to promote social distancing; and WHEREAS, on March 4, 2020, Governor Newsom declared a State of Emergency as a result of the COVID-19 pandemic; and
WHEREAS, on September 28, 2021 the Santa Barbara County Public Health Department put into effect measures requiring social distancing and other public health measures and restrictions to help combat the COVID-19 pandemic as referenced in Exhibit A; and WHEREAS, the State of Emergency and social distancing and other public health measures remain in effect; and
WHEREAS, COVID-19 continues to threaten the health and lives of Buellton City residents notwithstanding the City’s vaccination rates and the Omicron variant is highly transmissible in indoor settings; and
WHEREAS, the City of Buellton has a relatively compact City Council chambers that does not allow for social distancing and a return to solely in-person meetings may discourage public participation and expose those present to a risk of COVID-19 transmission.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Buellton that:
Section 1. State of Emergency and Social Distancing. Due to COVID-19, the State of California continues to be in a state of emergency and the County of Santa Barbara continues to impose and recommend measures requiring social distancing and other, which measures make holding solely in-person City Council and other legislative body meetings difficult due to the compactness of the City Council chambers, the inability to have sufficient public presence at the meetings due to social distancing, and the potential of transmission of COVID-19 at meetings.
Resolution No. 22-26 Page 2 August 11, 2022
Section 2. Compliance with Government Code Section 54953. The City Council and other legislative bodies will continue to offer teleconference meetings and provide access to the public in accordance with Government Code section 54953(e).
Section 3. Effective Date of Resolution. This Resolution shall take effect immediately upon its adoption and shall be effective until the earlier of (i) 30 days from the date of adoption of this Resolution, or (ii) such time the City Council adopts a subsequent resolution in accordance with Government Code section 54953(e)(3) to extend the time during which the legislative bodies of Buellton may continue to teleconference without compliance with paragraph (3) of subdivision (b) of section 54953.

City Council Agenda Staff Report
City Manager Review: SW
Council Agenda Item No.: 5
To: The Honorable Mayor and City Council
From: Scott Wolfe, City Manager
(Report prepared by Bill Scott, Contract Planner)
Date: August 11, 2022
Subject: Resolution No. 22-27 – “A Resolution of the City Council of the City of Buellton, California, Establishing the Scope of Work, Issues Relevant to the Project Site and Project Vicinity, Scope of Environmental Review and the Roles and Responsibilities for Preparation for the BUE-17 Mixed Use Specific Plan”
BACKGROUND
On July 7, the Planning Commission and the City Council held a joint meeting to decide on mechanisms to implement the BUE-17 Mixed Use Specific Plan. The project is located on a 17.21-acre property at the southern terminus of Industrial Way (APN 099-690-048) Attachment 1 - Location Map. The BUE-17 Mixed Use Project would replace the Buellton Hub development plan (16FDP-06) and Tentative Tract Map (TTM 31061) which was approved in February 2018 by the City Council to allow 50 apartment units, 74,742 square-feet industrial and office space; and open space use.
The current project envisions 210,045 square-feet of mixed-use development, containing; 116 residential units, including: 2-bedroom condominiums, 1 bedroom apartments, microstudio apartments, live/work studios (total 128,310 square-feet), as well as 71,735 square feet of industrial research and development space, conditioned industrial storage space, a community center; and open space on the 17.21-acre property. A Table listing the land uses proposed by the BUE-17 Mixed Use Project is provided as Attachment 2.
Given the specialized mix of residential and industrial land uses; and the potential increase in land use intensity proposed by the BUE-17 Mixed-use Project, it was recommended by staff that a Specific Plan is the appropriate method to analyze this change in use of the property. The applicant had presented conceptual plans for this modified version of the Buellton Hub development plan to both the Planning Commission (on April 7, 2022) and the City Council (on June 9, 2022).
Resolution No. 22-27 Page 2 August 11, 2022
Specific Plan Process:
Municipal Code Chapter 18.08.140 establishes the procedures for preparation of a specific plan. Section 18.08.140(C) sets forth the following methodology to establish the scope, parameters of study; and preparation responsibilities for preparation of a specific plan:
Within thirty (30) days following initiation of the specific plan process, the planning director shall convene a joint meeting of the planning commission and city council to prescribe the specific methodology to be employed in preparing the specific plan; and Not later than sixty (60) days following initiation of the specific plan process, the city council shall declare its findings by resolution regarding the following matters:
1. The scope, specificity, and format of the documentation to be included in the specific plan, including, as deemed appropriate, site characterization, base maps, environmental data, and design development plans.
2. Issues particular to the site including, as deemed appropriate, special studies required to ascertain market support and project feasibility, economic and fiscal impact, infrastructure capacity; and environmental resources; and
3. Roles and responsibilities relative to the document preparation, project management, consultant involvement, review process, public participation, performance schedule and document reproduction.
The specific plan process was initiated on June 21, 2022, the date the Applicant submitted the required fee deposit for a combined Application (Concurrent General Plan, Rezone and/or Specific Plan). As part of the application package, the Applicant had submitted a draft table of contents which outlined the proposed scope of the Plan. While staff concurred with the general format and contents of the document, staff included additional items that the City Council and Planning Commission may have wanted to consider being addressed in the plan. As specified by the procedures above, the draft table of contents was presented for review and comment at the joint Planning Commission and City Council meeting of July 7, 2022.
Joint City Council and Planning Commission Meeting
During the July 7 meeting the Planning Commission and the City Council considered the preliminary outline of the specific plan as submitted by the Applicant; and including additions by staff. The meeting was then open for discussion by the Planning Commission, the City Council and members of the public. A wide variety of comments were provided.
Comments ranged from environmental considerations such as potential impacts on the adjoining watershed resources, hazardous materials; and potential light and glare impacts.
Other concerns were expressed regarding traffic, access, parking, quality of life and potential fiscal impacts that could result from the project. Additional comments expressed the need for developer funded improvements such as bike and pedestrian amenities and publically accessible trails and open space improvements.
Resolution No. 22-27 Page 3 August 11, 2022
As a clarification, a distinction was noted between the previously approved Buellton Hub project and the current BUE-17 Mixed-Use Project. Particularly, clarifying the current BUE Mixed-Use proposal is only in the beginning stages of consideration and a substantial degree of review, analysis and public outreach would need to occur, before the current proposal could be considered for approvals. A summary list of the comments and suggestions expressed is provided as Attachment 3.
Proposed Methodology
The recommended outline; as revised on July 8, 2022, for the Specific Plan is set forth in Attachment 4 hereto and reflects the redlined version of the Applicant’s proposed table of contents along with the recommended additions. The revised outline establishes the format of the documentation to be included in the specific plan. In addition, the revised outline establishes the issues particular to the site and the project vicinity; as well as an initial list of studies required to ascertain market support and project feasibility, economic and fiscal impact; infrastructure capacity; and environmental resources as specified by Code Section
18.08.140 (C).
Specific Plan Preparation
As noted above, the Applicant has requested that they be the preparer of the Specific Plan.
City staff will provide the review to ensure each component of the Specific Plan is prepared in accordance with state Government Code (65450) guidelines; the City’s General Plan and applicable Municipal Code design and development standards.
Furthermore; staff will oversee the California Environmental Quality Act (CEQA) analysis for the Specific Plan. Staff conducted a preliminary review of the project and will arrange for the preparation of an Initial Study to determine whether an environmental impact report (EIR) or mitigated negative declaration (MND) would be prepared.
In order to inform the findings for the Initial Study, the following technical studies will be required at a minimum (others may be determined during the review process).
Environmental Studies:
• Traffic, Circulation
• Noise
• Air Quality, Greenhouse Gas
• Biological Resources
• Others…
Other Reports:
• Fiscal Impact Analysis.
• Project Demand/Feasibility Report
Resolution No. 22-27 Page 4 August 11, 2022
In addition, a Fiscal Impact Analysis will be prepared to assess both the potential demand for and feasibility of the project and its potential fiscal impacts on the City, to include the Avenue of Flags Specific Plan area.
FISCAL IMPACTS
Fiscal impacts to the City are anticipated to be negligible. Preparation of the Initial Study and technical studies will be done by outside consultants. Staff would proceed to obtain cost estimates and timelines for preparation of the Initial Study; and will require the applicant to submit a deposit to commence the work.
Total costs associated with the preparation of either an MND or DIR will be established once the level of environmental review has been determined. Fiscal feasibility studies and a Fiscal Impact Report would be funded by the applicant.
RECOMMENDATION
That the City Council consider adoption of Resolution No. 22-27 – “A Resolution of the City Council of the City of Buellton, California, Establishing the Scope of Work, Issues Relevant to the Project Site and Project Vicinity, Scope of Environmental Review and the Roles and Responsibilities for Preparation for the BUE-17 Mixed Use Specific Plan” and Direct staff to oversee the preparation of a Specific Plan for the BUE-17 project area in accordance with Attachment 4 (Draft SP Table of Contents/Conceptual Outline).

City Council – Planning Commission comments- July 7, 2022 Joint Meeting - DRAFT City Council
Mayor Sierra:
• Suggested additional outreach to River Grove residents and businesses on Industrial Way. • Likes performance schedule phasing
• Hazardous materials study necessary, effect on river? Vice Mayor King:
• Agrees with PC Chair Hammel, traffic and parking will be a problem, where are they going to park – overflow?
• Doesn’t think that live-work proponent will work. Residents will drive to SB for higher paying jobs.
• Questioned if employees on Ind. Way don’t rent these units, who will? • Requested proof that traffic impacts won’t be an issue Council Member Andrisek:
• Would like comprehensive overview of what is being discussed. Not enough information to give an opinion at CC meeting in August.
Council Member Lewis:
• Wants to confirm that project site will have on-site amenities for residents and not use RDM amenities. Need recreation and open space.
• Market support and project feasibility; can the project size and unique design/concept be supported by Buellton economy?
• Confused as to what is approved and what is not. Outreach to entire community necessary to explain process.
• Access/egress through RDM should be allowed for emergencies only. Concerned about having only one road [Industrial Way] for emergency access.
Council Member Sanchez:
• Asked Applicant for confirmation that the current Hub project is moving forward. • Questioned timing of the bridge construction, was told by the Applicant it is moving forward and will be constructed with either project and that construction access through RDM is approved through the Conditions of Approval of the Hub.
• Asked for clarification of traffic on the bridge; two-way traffic is proposed. Suggested bike lane on bridge
• Important to have alternative route for bicycle ingress/egress on bike trails rather than on roadways. Provide bike trail possibly along Zaca Golf Course, Applicant should pay for some of the bike trail

Planning Commission
Chair Hammel:
• Announced Ex-parte communication with Applicant, Gavin Moores • Suggested 3 levels of research and analysis for parking, traffic and circulation impacts: 1) onsite, 2) Industrial Way and 3)Highway 246 • Parking concerns-more detail on live-work spaces. Are residents of live-work units parking all day/night? Need to overestimate the amount of cars that may be parked on-site • Study concepts re: bike-share and car-share; be realistic in accounting for car needs/use • Include traffic on the bridge, 2 lanes, pedestrian circulation etc. Factor in increased traffic during harvest season
• Provide economic impact report. Job production vs increase in residents. How will the City benefit?
• Provide environmental impact report (EIR)
• Suggested that the City order necessary technical reports to expedite processing, rather than having Applicant prepare and then City to undertake peer review • Reminded the public that the project approval process starts at the Planning Commission and encouraged public participation at the PC meetings
Vice Chair Mercado:
• Economic development study necessary, include Avenue of Flags development. How will this project affect the AOF development?
• Look to the future, what is this going to cost the city and affect the quality of life in Buellton? • More collaboration between the developer and RDM residents • Flooding concerns
Commissioner Blokdyk:
• Mentioned the river trail; how to connect to Industrial Way? • Provide recreation and open space to residents
• Hazardous waste treatment study necessary
• Exterior lighting must be dark sky compliant
Commissioner Sarquilla:
• Stated this is quite a project
• Liked the public participation

CITY OF BUELLTON
City Council Agenda Staff Report
City Manager Review: SW
Council Agenda Item No.: 6
To: The Honorable Mayor and City Council
From: Scott Wolfe, City Manager
Meeting Date: August 11, 2022
Subject: Disposition of City Council Seat Vacancy
______________________________________________________________________________
BACKGROUND
On July 8, 2022, Councilmember Ed Andrisek resigned from the City Council, citing health reasons. This has left a vacant seat on the City Council.
California Government Code Section 36512(b) specifies the methods by which a vacancy in an elected position may be filled and requires that the Council act within 60 days to make a decision on how it will fill the position. The first method to fill the vacancy is to appoint a new Councilmember, while the second is to fill the vacancy by special election.
If a special election is chosen, it must take place at least 114 days after the City Council’s call for such an election.
In the current situation, the term of the vacant seat will expire this year and be refilled in the next regular election within the 114 day period. Therefore the special election is not a viable option. If the Council wishes to fill the vacant seat before the November 8 election, it may only do so by appointment.
The City Council holds complete discretion on whether to appoint a new Councilmember and on the process for appointment of a new Councilmember. Should the City Council decide to fill the vacant seat by appointment, it may appoint a replacement Councilmember immediately, or it may request applications from interested persons. Upon receipt of applications and, if desired, interviews of promising applicants, the Council would make a decision at an upcoming regular or special meeting of the City Council. In the past, the Council has held interviews after a 30 day application period. However, there is no obligation to continue this practice and in fact a decision is needed by September 6 due to the 60-day statutory limitation.
Appointment of a City Councilmember would bring the City Council back its full membership of five. This would eliminate the potential of a “2-2” vote situation, leaving the Council unable to make an affirmative decision on a proposal. Should the Council decide to leave the vacancy until the election, staff would endeavor to identify and hold

off scheduling potentially controversial matters until after the election. At this time, staff is aware of no such items that must come before the City Council before December.
However, the potential for such items still exists. Of course, if an item does come to a 2- 2 vote the Council can simply direct staff to table the item and bring it back after the vacant Council seat is filled.
In summary, the City Council has three options at this time:
1. Leave the vacancy until the next regular election (November 8, 2022).
2. Fill the seat by immediate appointment.
3. Direct staff to accept applications for a set period of time, and identify a date at which time the City Council will meet to consider the applications and make an appointment.
FISCAL IMPACT
A minor fiscal impact may be associated with this item at this time, as filling the vacant seat would result in the monthly stipend ($440 + auto allowance) being paid to the appointed Councilmember for the remainder of the term.
RECOMMENDATION
Staff recommends that the City Council discuss the matter and take action based on one of the three options listed above, namely:
1. Determine to leave the vacancy until the next regular election; or
2. Appoint an individual to fill the vacant seat; or
3. Direct staff to accept applications for a set period of time and identify a date at which time the City Council will meet to consider the applications and make an appointment.

Council Agenda Item No.: 7

From: Scott Wolfe, City Manager
Meeting Date: August 11, 2022
Subject: Recipient of Donation from ENGIE Services
______________________________________________________________________________
BACKGROUND
On December 10, 2020, the City Council authorized an agreement for a comprehensive energy project with ENGIE Services US. This project included the installation of major solar energy facilities at the Post Office/Library parking lots, the City’s Wastewater Treatment Plant, and the City’s water booster station, as well as the replacement of water meters within the City with remote-read meters, the upgrading of lighting and HVAC systems at City Hall, and the installation of solar street lights on Industrial Way and Central Avenue. The project and its component financing is expected to result in savings of $3.7 million in energy costs to the City over the life expectancy of the project’s improvements.
Additionally, as part of their general practices, ENGIE makes a donation to a local nonprofit organization or program in the amount of $25,000. The installation of the project is nearing completion in the next several weeks. Prior to the end of the project, ENGIE would like to have the City designate a recipient of these funds.
FISCAL IMPACT
No fiscal impact is expected to be associated with this item.
RECOMMENDATION
Staff recommends that the City Council discuss this matter and select a non-profit recipient of the funds as appropriate.

To: The Honorable Mayor and City Council
From: Scott Wolfe, City Manager
Meeting Date: August 11, 2022
Subject: Consideration of Recognition of Council Member Andrisek’s Service to the City of Buellton
______________________________________________________________________________
BACKGROUND
On July 8, 2022, Council Member Ed Andrisek resigned from the City Council citing health reasons, after nearly 16 years on the City Council and many more years of service to the Buellton Community through his terms on the Buellton Planning Commission and the Board of Directors of Buellton Community Services District prior to the City’s incorporation.
There have been a number of inquiries regarding some form of permanent recognition of Council Member Andrisek’s service. A prior City Council Member, Russ Hicks, was honored with a permanent bench at River View Park following his passing before his term had expired in 2011. While a bench or other monument at a City facility such as a park or the Zaca Creek Golf Course is one possibility, the City Council is free to decide what type of recognition, if any, would be appropriate at this time.
Staff is looking for any direction the City Council may have, to include type of recognition and a budget.
FISCAL IMPACT
As no budget item has been approved for such recognition, a fiscal impact is expected to be associated with this item if the City Council authorizes such recognition in the amount of the cost authorized.
RECOMMENDATION
Staff recommends that the City Council discuss the matter and direct staff as appropriate.
