City of Buellton
Investment Summary
December 31, 2022
Currently, short-term excess cash is primarily invested in the Local Agency Investment Fund (LAIF) administered by the State Treasurer. This is a high quality investment available in terms of safety, liquidity, and yield. Due to fluctuations in the marketplace, the City may have some investments with a current market value that is greater or less than the recorded value. This difference has no effect on investment yield as the City intends to hold the securities to maturity. However, generally accepted accounting principles require that market gains and losses be reported as interest earnings or losses at year-end.

From: Rose Hess, Public Works Director
Meeting Date: January 26, 2023
Subject: Discussion Regarding Flood Review in Development Process ______________________________________________________________________________
BACKGROUND
At the City Council meeting of January 12, 2023, members of the City Council requested a discussion item regarding flood considerations during development review, particularly with the recent flood events and evident flooding of the property between the Rancho de Maria neighborhood and Zaca Creek. For reference, attached as Attachment 1 is an excerpt from FEMA maps that shows the area of discussion.
Flooding did occur within the flood areas identified on the FEMA map. The information that is unknown at this time, however, is the depth of the floodwaters during the storm events around January 9, 2023. The depth of that flooding should not be confused with the 100 year base flood elevations (BFE) as shown on the FEMA map. For reference, the ground elevations are noted in red.
When a project in flood (and potential) hazard areas are in the approval process, the proposed development must provide a complete drainage study that shows pre- and postdevelopment flood conditions. The project must be built so that there is no negative flood-related impact to adjacent community up and downstream from the project. This requires engineering, certainly on the project site but often also off-site, in order to meet the conditions required before the project may be completed.
Development is allowed within the floodplain, in other words, provided that the above criteria are met. In addition, the developer is required to raise finished floor elevations, pad elevations, and/or meet flood-proofing design criteria as set forth by City staff and the relevant jurisdictions with control over flood-related issues. Generally, minimum pad or finished floor elevations should be 2’ above the base flood elevation (BFE), which can be met through different engineered methods. The project’s ability to meet these flood requirements is what is considered during the environmental review process.
Flood Review Page 2 January 26, 2023
Once a project goes through the environmental review process and is approved, laterdiscovered facts do not provide sufficient reason to revoke or withdraw the approvals.
Rather, if later-discovered facts are deemed sufficient to re-open studies or analyses then those studies would be undertaken and the environmental review updated (See CEQA Guidelines 15162(a)(2) and (a)(3) discussing substantial changes and new information).
This does not generally result in the disapproval of the project but rather results in new conditions of approval or mitigation measures. The process is also a highly-technical one, with City staff (and perhaps consultants) analyzing the new information or changed circumstances as against the original conditions of approval and then, if the conditions do not mitigate the impacts of the new information or changed circumstances, proposing to update the environmental documents and project approvals with appropriate conditions.
In the case of the property between the Rancho de Maria neighborhood and Zaca Creek, the relevant study would of course relate to the chance of Zaca Creek flooding and the mitigation measures and conditions of approval that are intended to ensure that there is no negative flood-related impact to adjacent community up and downstream from the project, as well as conditions related to handling potential flooding on the property.
At this time, the recent storms and flooding are not considered changed circumstances or new information that would change the original studies and approvals, due to the manner in which potential flooding from Zaca Creek was studied as part of the project. However, should the City Council desire to direct staff to review the flooding against the studies to determine more concretely whether there is new information or changed circumstances that meet the legal requirements for reopening the environmental documents, staff can do so.
FISCAL IMPACT
There is no fiscal impact for this discussion item.
RECOMMENDATION
Staff recommends that the City Council receive flood information for discussion and give direction to staff on additional actions to be taken, if any.

CITY OF BUELLTON
City Council Agenda Staff Report
City Manager Review: SW
Council Agenda Item No.: 6
To: The Honorable Mayor and City Council
From: Rose Hess, Public Works Director
Meeting Date: January 26, 2023
Subject: Discussion Regarding Village Park Playground Facilities ______________________________________________________________________________
BACKGROUND
During the past year City Council has requested staff research into additional playground facilities (swing set and shade structure) at Village Park. Two playground structures were installed with park construction designed for age range of 2-12 years (refer to Attachment 1). The existing structures are manufactured by Playworld Products. Staff has reached out to Dave Bang Associates, Inc. who is the local representative for the manufacturer and discussed the requested facilities.
Swing Set: Neither of the existing structures offer an option to expand or switch parts for a swing set feature. A separate swing structure would need to be provided. In reviewing the Village Park site, the most suitable location is across the existing playground area towards the middle of the park (refer to Attachment 2). A new area would need to be graded with enough clearance and curbing to ensure the facility meets safety guidelines.
Attachment 3 provides a concept of what the swing set would look like. The age range proposed as shown is infant – adult. The cost estimate provided is approximately $24,000.
Shade Structure: Two alternatives were reviewed for this request – Option1 – Shading Offered as part of the structure and Option 2 Free standing shading over the entire area of the existing playground structures. The only equipment that had an available shade option is the larger climbing structure. Attachment 4 provides a concept of the shade option and a cost estimate (approximately $27,000). The alternative proposal is to install a single, larger, freestanding shade structure that would cover both equipment. Attachment 5 provides a concept of this shade option and a cost estimate (approximately $39,000).
Village Park Playground Page 2 January 26, 2023
In discussion with Dave Bang Associates, their estimates include design, grading (for Swing Set area), and installation. Should council decide to move forward, a budget amendment would be required to create a new Capital Improvement Project for the desired improvements and direction to staff to proceed with the project. At the most expensive option (installing a swing set and the larger freestanding shade structure), the cost estimate is $66,000 which is well within the City’s ability to perform an informal bid. The City must request informal bids for equivalent facilities from other playground manufacturers since the items would require separate installations from existing equipment. If the Council chooses shade option 1, that must be procured through Dave Bang Associates since it is physically part of the existing structure.
FISCAL IMPACT
The costs associated will depend on the facility options that Council chooses. At any option, a budget amendment will need to be made to create a new Capital Improvement Project. Funding source would be General Fund.
RECOMMENDATION
Staff recommends that the City Council discuss the options presented and provide direction to staff.

The lay-out for this custom playscape, design number C22237SP, has been configured to meet the requirements of the ASTM F1487 standard. In addition, each of the above components listed as "Certified" have been tested and are IPEMA certified. Components listed as "Not Applicable" do not fall within the scope of the ASTM F1487 standard and have not been tested. IPEMA certification can be verified on the IPEMA website, www.ipema.org. In the interest of playground safety, IPEMA provides a Third Party Certification Service which validates compliance.
The CO2e (carbon footprint given in Kilograms and Metric Tons) listed above is a measure of the environmental impact this play structure represents from harvesting raw materials to the time it leaves our shipping dock. Playworld Systems nurtures a total corporate culture that is focused on eliminating carbon producing processes and products, reducing our use of precious raw materials, reusing materials whenever possible and recycling materials at every opportunity. Playworld Systems elected to adopt the Publicly Available Specification; PAS 2050 as published by the British Standards Institute and sponsored by Defra and the Carbon Trust. The PAS 2050 has gained international acceptance as a specification that measures the greenhouse gas emissions in services and goods throughout their entire life cycle.
The lay-out was also designed to meet the 2010 Standards published 15-Sep-2010, by the Department of Justice when installed over a properly maintained surfacing material that is in compliance with ASTM F1951 "Accessibility of Surface Systems Under and Around Playground Equipment" as well as ASTM F1292, "Impact Attenuation of Surfacing Materials Within the Use Zone of Playground Equipment", appropriate for the fall height of the structure.
Installation times are based on one experienced installer. A crew of three experienced individuals can perform the installation within the given time, each member working 1/3 of the given hours. [Eg. Installation Time = 30 hours. For a crew of three, each member will work 10 hours on the installation for a total of 30 hours on the project.]
A measurement, in pounds, that qualifies the amount of material that was captured as waste and diverted from landfill during an initial manufacturing process and is being redirected to a separate manufacturing process to become a different product. E.g. 100% of our Aluminum Tubing is made from captured waste material during the manufacturing process of extruded Aluminum products such as rods, flat bars and H-channels.
A measurement, in pounds, that qualifies the amount of material that was once another product that has completed its lifecycle and has been diverted from a landfill as a solid waste through recycling and is now being used in a Playworld Systems' product. E.g. **20% to 40% of the steel in our steel tubing and sheet steel have been diverted from landfills. Automobiles are scrapped and recyclable steel is purchased by the steel mill that produces our raw product. ** The amount of Post-Consumer recycled steel fluctuates daily based on the availability of the recycled steel.

The lay-out for this custom playscape, design number C22568CH, has been configured to meet the requirements of the ASTM F1487 standard.
