Meeting Date: August 10, 2023

Subject: Monthly Treasurer’s Report – June 30, 2023
______________________________________________________________________________

BACKGROUND

California Government Code Section 53646(b)(3) provides mandatory investment reporting requirements for California public agencies. The attached Treasurer’s Report complies with the State’s reporting requirement.

This Treasurer’s Report is for June 30, 2023. Treasurer’s Reports are presented on a monthly basis.

FISCAL IMPACT

There is no fiscal impact; this report is intended to show the City Council the financial performance of the City’s investment portfolio of idle funds.

2) A reconciliation of cash and investments to City ledger balances; 3) All investments managed by the City on its own behalf; 4) Beginning of year fund balance, revenues, expenditures and ending fund balance for each fund at June 30, 2023
The following schedule is a summary of the City’s cash and investments based on recorded value as of June 30, 2023 compared with the prior month.

May 31, 2023 June 30, 2023 $ Change
Cash - Pooled $ 7,236,799.09 $ 6,289,204.49 $ (947,594.60) Investments held by the City 15,885,102.90 16,897,024.58 $ 1,011,921.68 TOTAL CASH AND INVESTMENTS $ 23,121,901.99 $ 23,186,229.07 $ 64,327.08 Summary of activity for the Month and Future Liquidity: The majority of the difference in the recorded value for cash and investments held by the City from last month is mainly due to the acquisition of a United States Treasury bill for about $1 million with a 6-month term with a 5.20% return. The value of investments also changed due to interest earnings on the money market fund and CDs. The portfolio is sufficiently liquid to meet expected expenditures for the coming six months.

City of Buellton
Investment Summary
June 30, 2023
Currently, short-term excess cash is primarily invested in the Local Agency Investment Fund (LAIF) administered by the State Treasurer. This is a high quality investment available in terms of safety, liquidity, and yield. Due to fluctuations in the marketplace, the City may have some investments with a current market value that is greater or less than the recorded value. This difference has no effect on investment yield as the City intends to hold the securities to maturity. However, generally accepted accounting principles require that market gains and losses be reported as interest earnings or losses at year-end.

CITY OF BUELLTON
City Council Agenda Staff Report

City Manager Review: SW
Council Agenda Item No.: 4

To: The Honorable Mayor and City Council
From: Scott Wolfe, City Manager
Meeting Date: August 10, 2023
Subject: Resolution No. 23-18 – “A Resolution of the City Council of the City of Buellton, California, Approving, Authorizing and Directing Execution of A Joint Exercise of Powers Agreement Relating to the California Municipal Finance Authority and Approving A Plan of Finance for the Issuance of Revenue Bonds by the Authority to Finance and Refinance A Qualified Residential Rental Project for the Benefit of Buellton Garden Apartments, L.P., and Certain Other Matters Relating Thereto”
______________________________________________________________________________ BACKGROUND:

Buellton Garden Apartments LLC is the applicant and prospective developer of the Buellton Garden Apartments Project, which is located at 10 McMurray Road, which has been processed under the SB 330 entitlement process. This project will construct an eighty-nine (89) unit project which is to be affordable to tenants at the Low Income affordability level.

In order to finance projects like this at the Low Income affordability level, housing bonds are typically issued. California law authorize cities and certain other public agencies to issue tax exempt revenue bonds to reduce the financing costs of affordable multifamily rental housing developments. Because local jurisdictions typically have neither the size of staff nor staff with the expertise to implement such programs, cities and counties are further authorized to form joint exercise of powers authorities (JPA's) to conduct the sale of bonds on the behalf of JPA members.

Buellton Garden Apartments LLC has requested that the California Municipal Finance Authority (CMFA) serve as the municipal issuer of the Bonds in an aggregate principal amount not to exceed $35,000,000 of tax-exempt revenue bonds. The proceeds of the Bonds will be used to finance the costs of the acquisition, development, construction and equipping of an 89-unit qualified residential rental project for low-income tenants, to be located at 10 McMurray Road within the City of Buellton, California.

Page 27 of 42 ends

Resolution No. 23-18 Page 2 August 10, 2023
In order for all or a portion of the Bonds to qualify as tax-exempt bonds, the City of Buellton must conduct a public hearing (the “TEFRA Hearing”) providing for the members of the community an opportunity to speak in favor of or against the use of taxexempt bonds for the financing of the Project. Prior to such TEFRA Hearing, reasonable notice must be provided to the members of the community. Following the close of the TEFRA Hearing, an “applicable elected representative” of the governmental unit hosting the Project must provide its approval of the issuance of the Bonds for the financing of the Project.

The CMFA was created on January 1, 2004 pursuant to a joint exercise of powers agreement to promote economic, cultural and community development, through the financing of economic development and charitable activities throughout California. To date, over 350 municipalities have become members of CMFA.

The CMFA was formed to assist local governments, non-profit organizations and businesses with the issuance of taxable and tax-exempt bonds aimed at improving the standard of living in California. The CMFA’s representatives and its Board of Directors have considerable experience in bond financing.

In order for CMFA to sell the bonds on behalf of the City of Buellton to finance this project, the City of Buellton must become a member. The attached agreement establishes the City of Buellton as a member agency of CMFA.

Membership in CMFA results in no liability or obligation on the part of the City of Buellton. There are also no costs for membership that the City would incur.

FISCAL IMPACT
There is no fiscal impact anticipated. The City will have no obligation or liability associated with the membership in CMFA, nor will there be any financial obligation or liability as a result of subsequent financing.

RECOMMENDATION
That the City Council approve Resolution No. 23-18 – “A Resolution of the City Council of the City of Buellton, California, Approving, Authorizing and Directing Execution of A Joint Exercise of Powers Agreement Relating to the California Municipal Finance Authority and Approving A Plan of Finance for the Issuance of Revenue Bonds by the Authority to Finance and Refinance A Qualified Residential Rental Project for the Benefit of Buellton Garden Apartments, L.P., and Certain Other Matters Relating Thereto”

connection with Bonds that refund Bonds previously issued by the Authority and approved by the governing board of a Member.

The manner in which the Authority shall exercise its powers and perform its duties is and shall be subject to the restrictions upon the manner in which a California general law city could exercise such powers and perform such duties. The manner in which the Authority shall exercise its powers and perform its duties shall not be subject to any restrictions applicable to the manner in which any other public agency could exercise such powers or perform such duties, whether such agency is a party to this Agreement or not.

The expenses of the Board shall be paid from the proceeds of the Bonds or any other unencumbered funds of the Authority available for such purpose.

Section 8. Bonds Only Limited and Special Obligations of Authority.

The Bonds, together with the interest and premium, if any, thereon, shall not be deemed to constitute a debt of any Member or pledge of the faith and credit of the Members or the Authority. The Bonds shall be only special obligations of the Authority, and the Authority shall under no circumstances be obligated to pay the Bonds except from revenues and other funds pledged therefor. Neither the Members nor the Authority shall be obligated to pay the principal of, premium, if any, or interest on the Bonds, or other costs incidental thereto, except from the revenues and funds pledged therefor, and neither the faith and credit nor the taxing power of the Members nor the faith and credit of the Authority shall be pledged to the payment of the

The Treasurer of the Authority shall cause an independent audit to be made of the books of accounts and financial records of the Authority by a certified public accountant or public accountant in compliance with the provisions of Section 6505 of the Joint Exercise of Powers Act. In each case the minimum requirements of the audit shall be those prescribed by the State Controller for special districts under Section 26909 of the Government Code of the State of California and shall conform to generally accepted auditing standards. When such an audit of accounts and records is made by a certified public accountant or public accountant, a report thereof shall be filed as a public record with each Member and also with the county auditor of each county in which a Member is located; provided, however, that to the extent permitted by law, the Authority may, instead of filing such report with each Member and such county auditor, elect to post such report as a public record electronically on a website designated by the Authority. Such report if made shall be filed within 12 months of the end of the Fiscal Year or Years under examination.

The Treasurer is hereby directed to report in writing on the first day of July, October, January, and April of each year to the Board and the Members which report shall describe the amount of money held by the Treasurer for the Authority, the amount of receipts since the last such report, and the amount paid out since the last such report (which may exclude amounts held by a trustee or other fiduciary in connection with any Bonds to the extent that such trustee or other fiduciary provided regular reports covering such amounts.) Any costs of the audit, including contracts with, or employment of, certified public accountants or public accountants in making an audit pursuant to this Section, shall be borne by the Authority and shall be a charge against any unencumbered funds of the Authority available for that purpose.

Upon satisfaction of such conditions, the Board shall file such executed counterpart of this Agreement as an amendment hereto, effective upon such filing.
