Meeting Date: July 25, 2024
Subject: Designation of Voting Delegate and Alternate for 2024 League of California Cities Annual Conference Business Meeting
______________________________________________________________________________
BACKGROUND
The League of California Cities Annual Conference is scheduled for October 16-18, 2024 in Long Beach. An important part of the Annual Conference is the Annual Business Meeting, scheduled for Friday, October 18, at 12:30 p.m., at which time the League membership considers and takes action on resolutions that establish League policy.
In order to vote at the Annual Business Meeting, the City Council must designate a voting delegate and up to two alternate voting delegates. Designation of the voting delegate and alternate(s) must be done by City Council action and cannot be accomplished by simply notifying the League office of the City’s representatives to the Annual Business Meeting.
Typically, the Mayor and the Vice Mayor are designated as the City’s representatives to the Annual Business Meeting. Both the Mayor and Vice Mayor are planning to attend the Annual Conference. Upon the decision of the City Council as to the voting delegate and the alternate voting delegate, the City Clerk will submit the required designation information through the League of California Cities online submission portal.
RECOMMENDATION
That the City Council designate the Mayor as the City’s voting delegate and the Vice Mayor as the alternate voting delegate to the 2024 League of California Cities Annual Business Meeting.

City Council Agenda Staff Report
City Manager Review: SW
Council Agenda Item No.: 5
To: The Honorable Mayor and City Council
From: Rose Hess, Public Works Director/City Engineer
Meeting Date: July 25, 2024
Subject: Approval of Tract Map 31061for the BUE17 Project ______________________________________________________________________________
BACKGROUND
At their regular meeting on February 22, 2018, the City Council approved Resolution No. 18-03, approving the Final Development Plan and Tentative Tract Map 31061 for the HUB Project (BUE17), which is a 3-lot tentative tract map for airspace condominium purposes.
The property is situated east of Industrial Way, west of Rancho de Maria and between Zaca Creek and the Santa Ynez River.
The required subdivision improvement plans are not yet complete nor have been approved.
The Tract Map has been reviewed for technical merit and its substantial compliance with the previously approved tentative map in the formation of 3 lots for airspace condominium purposes. Two public easements are proposed: Public Trails and Public Water. They are shown on the Tract Map (Attachment 1) and also supplemented on Grant of Easement documents.
Since the subdivision map is being processed separately from the development improvements, the applicant has provided an access restriction on the map and to be recorded concurrently. This is in relation to the “emergency” access restriction requirements through the existing “ingress/egress” easement via the Rancho de Maria property to the east. The access restriction will ensure that, following construction, access to and from Rancho de Maria neighborhood will be limited to emergency use only. A note on the map identifies a covenant limiting the access. The attached agreement specifies that the Covenant is to be recorded within 120 days of the map recordation. Failure to record this covenant within 120 days of map recordation will result in withholding of any future approvals of permits on any of the BUE 17 property until the covenant is recorded. The agreement is binding on the current property owner and any future owner of the property.
Village Tract Map 31061 Page 2 July 25, 2024
FISCAL IMPACT
The listing of this item in itself will not have any fiscal impact on the City.
RECOMMENDATION
That the Council authorize the City Manager to execute the accompanying access agreement, and authorize, subsequent to this execution, the recordation of Tract Map 31061 and all supporting documents upon receipt of all fees and bonds.

City Council Agenda Staff Report
City Manager Review: SW
Council Agenda Item No.: 6
To: The Honorable Mayor and Council Members
From: Andrea Keefer, Planning Director
Meeting Date: July 25, 2024
Subject: Story Pole Waiver Request Regarding:
The 518 Mixed-Use Project, 518 Avenue of Flags and
Creekside Village Mixed-Use Project, 480 Avenue of Flags ______________________________________________________________________________
BACKGROUND
Owner: The 518 LLC and Creekside Village (AoF) LLC
Agent/Applicant: MB Development Company, Brandon Mann, Manager General Plan Designation: Avenue of Flags Specific Plan Zoning: CR-SP (General Commercial-Specific Plan)
On behalf of property owners The 518 LLC and Creekside Village (AoF) LLC, Brandon Mann of MB Development Company (Agent/Applicant) has submitted two Development Plan Modification (DPM) applications (24-DPM-01 and 24-DPM-02) requesting modifications to previously-approved final development plan (FDP) permits and related development agreements for both The 518 Mixed Use Project (21-FDP-05, 21-DA-01 ) and Creekside Village Mixed-Use Project (19-FDP-01, 19-LLA-01, 20-DA-01).
See attached vicinity map showing location of the two projects. (Attachment 1) DPM applications for both projects have been submitted and are currently being processed for public hearings by the Planning Commission and subsequently the City Council. The modification requests for both projects consist of: height increases (6 feet and 9 feet, respectively); and change of use (introduction of live/work).
Buellton Municipal Code (BMC) Section 19.08.120 I.2, requires the installation of story poles for projects exceeding 25 feet in height; said poles shall be erected at least 30 days prior to the first public hearing on a project and shall remain in place until a final decision is made on the project. Story poles were erected for both projects during the original FDP entitlement review and approval process.
Story Pole Waiver Request Page 2 July 25, 2024
BMC Section 19.08.120 I.2 also allows the City Council to waive the requirement for story poles upon a written request from the Applicant demonstrating that these items would not provide clarification for review of the project(s) which, in the current subject case, consists of the two modification requests.
Attached for the City Council’s consideration is the Applicant’s “Story Pole Exemption Request” which includes the request to waive the story pole requirement, a narrative justification for the request and supporting exhibits pertaining to both projects, (Attachment 2)
RECOMMENDATION
That the City Council consider the following two actions:
1. Require installation of story poles per BMC 19.08.120 for both projects; - OR -
2. Approve the Applicant’s request to waive the story pole requirement for both projects.

Re: Story Pole Exemption Request
Dear Honorable City Council Members,
I am writing on behalf of MB Development Company, in reference to the projects located at 480 and 518 Avenue of Flags, to respectfully request an exemption from Buellton Municipal Code Section 19.08.120, which requires the installation of story poles and the provision of scale models or graphic presentations for projects exceeding 25 feet in height.
The 480 and 518 Avenue of Flags projects were previously approved with story poles erected as part of the initial development process. We are currently seeking modifications and updates to these entitlements, which include changes to the building heights. For the 480 Avenue of Flags project, the approved height was 38 feet, and we are now requesting an increase to 47 feet. This additional height is set back over 39 feet from the property line and is located on the fourth story, making it virtually unnoticeable from the sidewalk.
Similarly, for the 518 Avenue of Flags project, the approved height was 41 feet, and we are now requesting an increase to 47 feet. While this height increase is also primarily on the fourth story, it will result in a slightly higher massing on the frontage. However, much of this additional height is part of the interior design and set back from the street level. This increase is still inconsequential to the overall design and does not significantly impact the visual aesthetics of the project.
Given that the primary modifications involve height increases that are either set back or minimally impactful to the streetscape, we believe that the requirement for additional story poles, scale models, or graphic presentations will not provide substantial clarification for the review of these modifications. The existing approvals and the nature of the proposed changes render these requirements unnecessary for an informed decision-making process.
We appreciate the City Council's consideration of this request and are committed to working closely with the City to ensure the successful development of these projects. We believe that granting this exemption will streamline the review process without compromising the quality or transparency of the project evaluation.
Thank you for your attention to this matter. We look forward to your favorable response.
Sincerely,
Brandon Mann

Manager

City Council Agenda Staff Report
City Manager Review: SW
Council Agenda Item No.: 8
To: The Honorable Mayor and City Council
From: Rose Hess, Public Works Director
Meeting Date: July 25, 2024
Subject: Schedule Update for Old and New Library Construction Projects ______________________________________________________________________________
BACKGROUND
On December 14, 2023, the City Council approved the construction contract for the renovation of 202 Dairyland to a new public library. Construction Notice to Proceed was issued and allowed construction to start mid-January 2024. Since that time, several items such as rain, lead time on materials, clarifications on structural, electrical, mechanical items once substructures were exposed, and modifications to design has required extensions of time. The latest anticipated construction completion date is October 2024. Library staff/books move-in would take approximately another month.
This directly impacts the construction commencement/completion of the renovation of the old (existing) library at 140 W. Highway 246 for the Santa Ynez Valley Community Outreach CDBG Project. City Council approved the construction contracts for the CDBG Project on January 25, 2024 and March 14, 2024. The Notice to Proceed for procurement of materials was issued for all 4 prime CDBG contracts, but construction has been on hold until the new library is (near) completed.
The CDBG Project has a construction deadline of December 30, 2024, which has already been extended from June 30, 2024.
Ideally the CDBG Project would commence immediately upon completion of the new library, to minimize downtime for a library to be open to the public. However, as time draws closer to grant deadlines, this will not be feasible. It is our intent to work with library staff to close and pack the existing library starting the end of August/beginning September so that CDBG Project construction activities can start by mid-September to be completed by the December deadline.
RECOMMENDATION
That the City Council receive the update and authorize staff to undertake library closures as needed to facilitate both projects.
