City of Buellton
Investment Summary
November 30, 2024
Currently, short-term excess cash is primarily invested in the Local Agency Investment Fund (LAIF) administered by the State Treasurer. This is a high quality investment available in terms of safety, liquidity, and yield. Due to fluctuations in the marketplace, the City may have some investments with a current market value that is greater or less than the recorded value. This difference has no effect on investment yield as the City intends to hold the securities to maturity. However, generally accepted accounting principles require that market gains and losses be reported as interest earnings or losses at year-end.

CITY OF BUELLTON
City Council Agenda Staff Report
City Manager Review: SW
Council Agenda Item No.: 4
To: The Honorable Mayor and City Council
From: Scott Wolfe, City Manager
Meeting Date: January 9, 2025
Subject: Approval of First Amendment to Lease and Agreement for the Provision of Library Management Services between the City of Buellton and the City of Goleta at the Buellton Library ______________________________________________________________________________

BACKGROUND
Effective July 1, 2019, the City of Buellton entered into an agreement (Attachment 1) with the City of Goleta for the provision of library management services and lease of a library facility at the City’s existing library facility located at 140 W. Highway 246. The Agreement outlines the terms of provision of library management services, identifies the location at which such services take place, and establishes an annual lease payment of one dollar for the term of the lease, which is set to expire at the end of June, 2025.

While negotiation of a subsequent library service and lease agreement will need to take place in short order, the opening of the new library facility at 202 Dairyland Road will take place prior to the expiration of the current agreement and, in order to continue service until the new agreement is set, this First Amendment is intended to allow operation to continue in the new location.

The First Amendment to the Joint Use Agreement (Attachment 2) contains two changes:

1. Location of services and leased area: The Amendment calls for the provision of library management services and the lease area to be moved to 202 Dairyland Road within the “library” portion of the former “Willemsen Residence” on site.

2. Updated notice information: The recipients of notices related to this Agreement are intended to be the City Manager of each City. As the City Manager of each City has changed since the time that the Agreement was drafted, the current City Manager has been listed within the document.

Library Agreement Amendment Page 2 January 9, 2025
There have been proposed changes to library services requested and discussed by the City Council over the past two years. The most notable of these changes included the expansion of library hours. Such a change may require additional staffing levels, depending on the days/hours requested. Library staff will be reviewing the new usage patterns and desires expressed by Library patrons in the initial months of operation at the new Facility, and it is staff’s goal that this data can inform options that the City Council may consider at the time that the next Agreement is negotiated and considered for approval.

The cities and their respective City Attorneys have reviewed this First Amendment to the Agreement, and has found that the Amendment will suffice to continue library management operations at the new location and allow for the opening of the new facility when the Library staff is ready. The staff recommendation is that the City Council review and approve the First Amended Joint Use Agreement.

FISCAL IMPACT
This First Amendment is not anticipated to result in any fiscal impact to the City.

RECOMMENDATION
Staff recommends that the City Council review and approve the First Amendment to Lease and Agreement for the Provision of Library Management Services between the City of Buellton and the City of Goleta at the Buellton Library.

BUELLTON shall endeavor to afford GOLETA advance notice of structural alterations performed in such circumstances.

GOLETA shall not be obligated to nor shall it make any structural alteration to the LIBRARY without the express written consent of BUELLTON. For purposes of this provision, a “structural alteration” shall be any modification that results in a change in the structural integrity of the LIBRARY, or change in the location, design, area or size of any wall, window or door. A “structural alteration” also shall include any modification that alters the gross cubic area of the LIBRARY and any substantive modification to finish materials.

Section 21 (Notices) of the AGREEMENT is hereby amended to read as follows:

Any notice required to be given hereunder shall be deemed to have been given by depositing said notice in the United States mail, postage prepaid, and addressed as follows:

Meeting Date: January 9, 2025
Subject: Ordinance 25-01 - “An Ordinance of the City Council of the City of Buellton, California, to Increase the Buellton Transient Occupancy Tax (TOT) Rate” (Introduction and First Reading)
______________________________________________________________________________

BACKGROUND
At the November 2024 general election, the voters of the City of Buellton adopted Measure "D2024" to amend the Buellton Municipal Code to allow the City Council to increase the amount of the Transient Occupancy Tax (TOT) rate from twelve percent (12%) to a maximum fourteen percent (14%). More specifically, Measure "D2024" amended Section

3.28.030 of the Buellton Municipal Code as follows:
“3.28.030 Rate.

For the privilege of occupancy in any hotel, each transient is subject to and shall pay a tax in the amount of fourteen percent (14%) of the rent actually charged or customarily charged by the operator for the rooms and/or facilities occupied by the transient. This tax constitutes a debt owed by the transient to the city which is extinguished only by payment to the operator of the hotel at the time the rent is paid. The unpaid tax is due upon the transient’s ceasing to occupy space in the hotel. If, for any reason, the tax due is not paid to the operator of the hotel, the tax administrator may require that such tax be paid directly to the tax administrator. The amount of the tax shall automatically revert to twelve percent (12%), the previous amount of the tax, on the twenty-fifth anniversary of the effective date of this ordinance unless extended by a then-qualifying vote of the electorate.” Attached for Council consideration is an ordinance to increase the TOT rate consistent with the voter approved authority of Measure "D2024". Voters authorized the 14% TOT tax rate and the Council is asked to effectuate that with the ordinance

FISCAL IMPACT
Staff estimates that this action will increase the general fund revenues generated by collection of the TOT in an amount of approximately $600,000 per year.

RECOMMENDATION
That the City Council conduct the public hearing and introduce for first reading Ordinance No. 25-01- “An Ordinance of the City Council of the City of Buellton, California, to Increase the Buellton Transient Occupancy Tax (TOT) Rate” by title only and waive further reading.

CITY OF BUELLTON
City Council Agenda Staff Report
City Manager Review: SW
Council Agenda Item No.: 8
To: The Honorable Mayor and City Council
From: Scott Wolfe, City Manager
Meeting Date: January 9, 2025
Subject: Consider Appointment to Vacant City Council Seat – District 4 ______________________________________________________________________________

BACKGROUND
Based upon the certified results of the November 5, 2024 Election, District 4 Councilmember has been elected Mayor for the 2024-2026 term. This results in a midterm vacancy of the District 4 City Council seat. At the December 12, 2024 meeting, City Council indicated a desire to make an appointment to fill the vacancy rather than hold a special election. At the Council’s direction, staff posted a Notice of Vacancy, and directed any interested applicants to contact City Council members directly to discuss appointment.

There is no required process for the selection of an appointee. The City Council has indicated a desire to have individual Councilmembers suggest appointees, and then have the selection made by the City Council collectively. The City Council must fill this vacancy by appointment before February 10, 2025, to avoid a special election.

Appointment of a Councilmember at tonight’s meeting would allow for a newly appointed Councilmember to attend the League of California Cities’ New Mayor and Councilmember Academy, which provides valuable training for brand-new Councilmembers. This is only offered in January each year.

The process of filling of this City Council vacancy is entirely a City Council function. The City Council has considerable discretion pertaining to the process used to decide upon an appointment. The City Attorney and City Manager will be available to answer questions in support of the City Council in this process.

FISCAL IMPACT
Filling the District 4 City Council vacancy by appointment would result in no significant fiscal impact.

RECOMMENDATION
Staff recommends that the City Council receive the report, discuss the matter, and make an appointment to the vacant District 4 seat as deemed appropriate.

City Manager Review: SW
Council Agenda Item No.: 9
To: The Honorable Mayor and City Council
From: Scott Wolfe, City Manager
Meeting Date: January 9, 2025
Subject: Consideration of Appointments to the Planning Commission _____________________________________________________________________________

BACKGROUND
At the December 12, 2024 City Council meeting, the City Council agreed by consensus to review the Planning Commission applications and be prepared to make appointments at the January 9, 2025 Council meeting.

As mentioned at the December 12, 2024 City Council meeting, Planning Commissioners Reese and Sarquilla are currently serving terms that end in 2026. Per the ordinance adopting the changes to the Planning Commission terms, these two Commissioners will be deemed the appointments of the Councilmembers from District 2 (Lewis) and District 3 (Sanchez), respectively. This leaves appointments necessary for Mayor Silva and for Councilmembers for Districts 1 (Hornick) and 4 (vacant).

The recently adopted approach to appointing Planning Commissioners allows each Councilmember to appoint a Planning Commissioner, with each appointment subject to ratification of the entire City Council. Planning Commissioners need not reside within the District of the appointing Councilmember. The City Clerk has announced vacancies on the Commission to be filled, and has collected applications during the advertised application period. Each City Councilmember has received copies of the applications before this meeting from the following applicants: Brian Campbell, Daniel Contreras, Kasey Kump, and Art Mercado (Attachment 2).

Past practice has been to have the City Council (as a body) interview applicants at a City Council meeting prior to selecting and appointing them. The City Council may wish to continue with this practice, however, the new process by which Planning Commissioners are appointed by individual Councilmembers (then ratified by the entire Council) may render this process moot, as individual Councilmembers may contact applicants in advance of the January 9 meeting to interview them and determine which applicant they would like to appoint. That would allow the three Councilmembers who will appoint Commissioners to nominate them at the meeting, at which time the Council would act to ratify the nominations, without the need for in-person interviews by the entire Council.

CITY OF BUELLTON
City Council Agenda Staff Report
City Manager Review: SW
Council Agenda Item No.: 10
To: The Honorable Mayor and City Council
From: Linda Reid, City Clerk
Meeting Date: January 9, 2025
Subject: Appointments to Boards, Commissions, and Committees

BACKGROUND
Following the reorganization of the City Council, it is appropriate for the Council to consider appointments to various boards, commissions, and committees. To assist in the consideration and possible action as to the appointments, staff has listed below the respective agency or body, has provided brief comments as to the purpose of said agency or body, and has provided additional comments as to an appointment. Copies of agency by-laws, membership rosters, and other information pertaining to the respective agency, board, body, committee, commission, or organization are not included with this staff report but are available for review. Attachment 1 is a meeting schedule for the various boards, commissions, and committees on which Council Members may serve and lists the current representatives to each board, commission, and committee.

A. Central Coast Water Authority (CCWA)
The Central Coast Water Authority was formed under the provisions of the State of California as a public entity to plan, develop, finance, design, construct, and manage certain extensions of the California Aqueduct of the State Water Project. The business of the Authority is conducted by a Board of Directors consisting of one Director appointed by each Member Agency. Each Director and an alternate Director shall be appointed or selected by the governing body of the respective Member Agency and may, but need not be, a member of the governing body of the Member Agency. The Board meets monthly on the fourth Thursday at 9:00 a.m. in Buellton. It would be appropriate for the Council to appoint two representatives for the up-coming year, with one appointee being an alternate representative.

Page 99 of 104 ends

Appointments to Boards, Commissions, Page 2 January 9, 2025 and Committees

B. County Library Advisory Committee
This Committee meets quarterly on the third Wednesday at 10:00 a.m. at a varied location to formulate and oversee policy regarding the operation of the Santa Barbara County Library system, which includes the Buellton Library. It would be appropriate for the Council to appoint a City representative and an alternate representative to the Library Advisory Committee.

C. Santa Barbara County Association of Governments (SBCAG) The Council of Governments, which serves Santa Barbara County, is responsible for review of OMB Circular A-95 federal grant applications, transportation planning and programming, annual allocation of Transportation Development Act funds, coordination of regional planning activities, distribution of U.S. Census data, and other duties as per a Joint Powers Agreement. The Board meets on the third Thursday of each month in Santa Barbara or Santa Maria. Membership includes the five County Supervisors and one representative from each of the incorporated cities in the County. It would be appropriate for the Council to appoint a City representative and an alternate to the Association of Governments Board.

D. Air Pollution Control District (APCD)
Assembly Bill 75, known as the Hauser Bill, required the addition of elected Mayors and/or City Council Members to the Air Pollution Control District Board of Directors. Senate Bill 113 was recently adopted that allows for alternates to serve on the Board. The responsibilities of the Board include setting policy for local clean air programs through the adoption and implementation of clean air plans, adopting locally developed rules and regulations to improve air quality, lobbying for effective laws relating to air pollution control, seeking innovative measures to provide air quality benefits, and other related duties.

Usually the City representative to the Santa Barbara County Association of Governments Board also serves as the City representative on the APCD Board of Directors, but this is not a legal requirement. Because SBCAG and APCD meet on the same date and location, it would be appropriate for the Council to appoint the City’s SBCAG Board member and alternate to serve on the APCD Board.

E. California Joint Powers Insurance Authority (CJPIA)
The California Joint Powers Insurance Authority is an agency created to provide programs to protect its members, their officers and employees, and property against unavoidable losses through purchase of insurance, self-insurance, and pooling of losses. The Authority is governed by a Board of Directors and an Executive Committee. The Board meets on an annual basis each July and also in special session on an as needed basis. Each member has a representative on the CJPIA Board of Directors. In the past, the City representative has been the Mayor or in his/her absence, the Vice Mayor. It would be appropriate for the Council to appoint a representative and an alternate to the CJPIA Board of Directors.

Page 100 of 104 ends

Appointments to Boards, Commissions, Page 3 January 9, 2025 and Committees

F. League of California Cities (LOCC) – Voting Delegate Each year prior to the Annual Conference, the League formally requests the appointment of a City representative and an alternate to the League business meeting. It has been standard practice for the Mayor to be the City’s representative, if attending the conference, and for the Vice Mayor to be the City’s alternate representative. It is recommended that the Council continue to follow this standard procedure.
