Subject: Monthly Treasurer’s Report – May 31, 2025
______________________________________________________________________________

BACKGROUND

California Government Code Section 53646(b)(3) provides mandatory investment reporting requirements for California public agencies. The attached Treasurer’s Report complies with the State’s reporting requirement.

On June 13, 2024, Council adopted the current Investment Policy per Resolution 24-18 which states the City Finance Director, as the investment officer, must submit monthly reports to City Council to demonstrate that sufficient cash flow liquidity is available to meet the succeeding month’s estimated expenditures.

This Treasurer’s Report is for May 31, 2025. Treasurer’s Reports are presented on a monthly basis.

FISCAL IMPACT

There is no fiscal impact; this report is intended to show the City Council the financial performance of the City’s investment portfolio of idle funds.

City of Buellton
Monthly Treasurer’s Report
For the month ending in May 31, 2025
June 26, 2025
This report presents the City’s cash activity and investment portfolio as of May 31, 2025. The report includes:
1) Cash and investments at May 31, 2025 compared to the prior month;

2) A reconciliation of cash and investments to City ledger balances; 3) All investments managed by the City on its own behalf; 4) Beginning of year fund balance, revenues, expenditures and ending fund balance for each fund at May 31, 2025
The following schedule is a summary of the City’s cash and investments based on recorded value as of May 31, 2025 compared with the prior month.

April 30, 2025 May 31, 2025 $ Change
Cash - Pooled $ 6,327,479.68 $ 5,994,903.11 $ (332,576.57) Investments held by the City 18,389,263.68 18,413,798.85 $ 24,535.17 TOTAL CASH AND INVESTMENTS $ 24,716,743.36 $ 24,408,701.96 $ (308,041.40) Summary of activity for the Month and Future Liquidity: The majority of the difference in the recorded value for cash and investments held by the City from last month is mainly due to revenue received from property taxes, March 2025 sales tax and from April 2025 transient occupancy tax.

This increase is offset by payments for May 2025 police services from the Santa Barbara Sheriff’s Department and annual state water charges to Central Coast Water Authority. Additionally, investment values changed due to interest earnings on money market funds, the Local Agency Investment Fund (LAIF), and Certificates of Deposit (CDs). The portfolio is sufficiently liquid to meet expected expenditures for the coming six months.

City of Buellton
Investment Summary
May 31, 2025
Currently, short-term excess cash is primarily invested in the Local Agency Investment Fund (LAIF) administered by the State Treasurer. This is a high quality investment available in terms of safety, liquidity, and yield. Due to fluctuations in the marketplace, the City may have some investments with a current market value that is greater or less than the recorded value. This difference has no effect on investment yield as the City intends to hold the securities to maturity. However, generally accepted accounting principles require that market gains and losses be reported as interest earnings or losses at year-end.

CITY OF BUELLTON
City Council Agenda Staff Report
City Manager Review: SW
Council Agenda Item No.: 4
To: The Honorable Mayor and City Council
From: Shannel Zamora, Finance Director
Meeting Date: June 26, 2025
Subject: Resolution No. 25-21 – “A Resolution of the City Council of the City of Buellton, California, Establishing an Appropriation Limit for Fiscal Year 2025-26”
______________________________________________________________________________

BACKGROUND
In 1979, the voters of the State of California passed Proposition 4, the “Gann Initiative”, which added Article XIII-B to the State Constitution. This Article provides that the City’s annual appropriations be subject to certain State limitations based upon budgeted appropriations for Fiscal Year 1978-79 and adjusted annually for changes in population and cost of living or personal income. New legislation under Propositions 98 and 111 modified the original provisions of the law, allowing exemptions for qualified capital projects and adjustment factor changes.

The limitation for Fiscal Year 2025-26 is $17,777,051. The Gann spending limitation is calculated by taking the prior year’s limitation of $16,343,299 and adjusting it by the growth factor in the California Per Capita Personal Income and the change in the population within the City of Buellton, or County of Santa Barbara whichever is greater.

The appropriations subject to the limit is $8,511,486 which is under the appropriation limit by $9,265,565.

Therefore, the City of Buellton is in compliance with Article XIII-B of the California Constitution for Fiscal Year 2025-26. The Article XIII-B is not a restricting factor for the City of Buellton due to the combination of modest population growth and continued General Fund spending on qualified capital projects. These factors will continue to be monitored annually and if the use of alternative growth factors as authorized by Proposition 111 would result in a more advantageous appropriation limit, staff will revise the appropriations limit.

Under Government Code section 7910, documentation used in the determination of the appropriations limit is available to the public upon request.

Resolution No. 25-21 Page 2 June 26, 2025

FISCAL IMPACT
There will be no fiscal impact to the City because appropriations are below the limit.

RECOMMENDATION
That the City Council consider adoption of Resolution No. 25-21 – “A Resolution of the City Council of the City of Buellton, California, Establishing an Appropriation Limit for Fiscal Year 2025-26”

RESOLUTION NO. 25-21

A RESOLUTION OF THE CITY COUNCIL OF THE CITY

OF BUELLTON, CALIFORNIA, ESTABLISHING AN
APPROPRIATION LIMIT FOR FISCAL YEAR 2025-26
WHEREAS, Article XIII-B of the California Constitution provides that the total annual appropriations limit of this City shall not exceed the appropriations limit for the prior year, except as adjusted for changes in the cost of living or personal income and population, or as otherwise provided for in said Article XIII-B and implementing State statutes; and WHEREAS, pursuant to said Article XIII-B of said California Constitution, the City is required to set its appropriation limit for each fiscal year, and has made available to the public the documentation used in the determination of said appropriation limit; and WHEREAS, in 1990, the voters of California adopted Proposition 111 which amended Article XIII-B of the California Constitution; and
WHEREAS, among the changes implemented by Proposition 111 are adjustments to the growth factors used to calculate the annual appropriation limit; and WHEREAS, Proposition 111 established Fiscal Year 1986-87 as the base year for calculating the annual Appropriation Limit and permits the City to re-establish the annual Appropriation Limit for all succeeding years based upon the new growth factors; and WHEREAS, a resolution establishing the annual appropriations limit is to be adopted at a regularly scheduled meeting of the City Council; and
WHEREAS, all legal prerequisites have occurred prior to the adoption of this Resolution.

NOW, THEREFORE, THE CITY COUNCIL DOES RESOLVE, DECLARE, DETERMINE, AND REQUEST AS FOLLOWS:

SECTION 1. The City Council hereby finds that the above recitations are true and correct and, accordingly, are incorporated as a material part of this Resolution.

SECTION 2. The Council of the City of Buellton elects to use the change in California per capita income as the cost of living adjustment factor and the annual population change for the City of Buellton as the population adjustment.

Dear Fiscal Officer:

Subject: Price Factor and Population Information
Appropriations Limit
California Revenue and Taxation Code Section 2227 requires the Department of Finance to transmit an estimate of the percentage change in population to local governments. Each local jurisdiction must use their percentage change in population factor for January 1, 2025, in conjunction with a change in the cost of living, or price factor, to calculate their appropriations limit for fiscal year 2025-26. Attachment A provides the change in California’s per capita personal income and an example for utilizing the price factor and population percentage change factor to calculate the 2025-26 appropriations limit. Attachment B provides the city and unincorporated county population percentage change along with the population percentage change for counties and their summed incorporated areas. The population percentage change data excludes federal and state institutionalized populations and military populations.

Population Percent Change for Special Districts
Some special districts must establish an annual appropriations limit. California Revenue and Taxation Code Section 2228 provides additional information regarding the appropriations limit.

Article XIII B, Section 9(C) of the California Constitution exempts certain special districts from the appropriations limit calculation mandate. The code section and the California Constitution can be accessed at the following website: http://leginfo.legislature.ca.gov/faces/codes.xhtml.

Special districts required by law to calculate their appropriations limit must present the calculation as part of their annual audit. Any questions special districts have on this requirement should be directed to their county, district legal counsel, or the law itself. No state agency reviews the local appropriations limits.

Population Certification
The population certification program applies only to cities and counties. California Revenue and Taxation Code Section 11005.6 mandates Finance to automatically certify any population estimate that exceeds the current certified population with the State Controller’s Office. Finance will certify the higher estimate to the State Controller by June 1, 2025.

Please Note: The prior year’s city population estimates may be revised. The per capita personal income change is based on historical data.

If you have any questions regarding this data, please contact the Demographic Research Unit at (916) 323-4086.

May 2025
Attachment A
A. Price Factor: Article XIII B specifies that local jurisdictions select their cost of living factor to compute their appropriation limit by a vote of their governing body. The cost of living factor provided here is per capita personal income. If the percentage change in per capita personal income is selected, the percentage change to be used in setting the fiscal year 2025-26 appropriation limit is:

Per Capita Personal Income
Fiscal Year Percentage change
(FY) over prior year
2025-26 6.44
B. Following is an example using sample population change and the change in California per capita personal income as growth factors in computing a 2025-26 appropriation limit.
2025-26:

Per Capita Cost of Living Change = 6.44 percent
Population Change = 0.28 percent
Per Capita Cost of Living converted to a ratio: 6.44 + 100 = 1.0644 100
Population converted to a ratio: 0.28 + 100 = 1.0028
100
Calculation of factor for FY 2025-26: 1.0644 x 1.0028 = 1.0674

Subject: Resolution No. 25-22 – “A Resolution of the City Council of the City of Buellton, California, Acknowledging the Receipt of and Ordering the Filing of the Annual Statement of Investment Policy for Fiscal Year 2025-26 with the City Council”
______________________________________________________________________________

BACKGROUND
California Government Code section 53646(a)(2) previously required the annual filing of a Statement of Investment Policy with the State Controller’s Office. The law has now been revised to state that the policy “may” be filed annually. The City of Buellton elects to adopt an annual Investment Policy.

The City of Buellton Investment Policy is attached for filing under Resolution No. 25-22 and Exhibit A. The basic premise underlying the City’s Investment Policy is to ensure that money is always safe and available when needed. The objective of this Policy is to accurately monitor and forecast expenditures and revenues through daily projected cash flow analysis to enable investment of funds to the greatest extent possible. The City’s Investment Portfolio as of May 2025 is shown on Attachment 1.

FISCAL IMPACT
The adoption of the accompanying draft resolution will not have any fiscal impact on the City.

RECOMMENDATION

CITY OF BUELLTON

STATEMENT OF INVESTMENT POLICY

PURPOSE
This Statement is intended to provide guidelines for the prudent investment of the City’s temporary idle cash and outlines the policies for maximizing the efficiency of the City’s cash management system. The goal is to enhance the economic status of the City while protecting its pooled cash.

OBJECTIVE
The City’s cash management system is designed to accurately monitor and forecast expenditures and revenues, thus enabling the City to invest funds to the fullest extent possible. The City attempts to obtain the highest yield obtainable as long as investments meet the criteria established for safety and liquidity. Yield shall become a consideration only after the basic requirements of safety and liquidity have been met.

POLICY
The City of Buellton operates its temporary pooled idle cash investments under the “Prudent Investor Standard” (Government Code Section 53600.3). The Prudent Investor Standard states, in essence, that in investing or managing property for the benefit of another, a trustee shall exercise the judgment and care, under the circumstances then prevailing, including, but not limited to, the general economic conditions and the anticipated needs of the agency. This affords the City a broad spectrum of investment opportunities as long as the investment is deemed prudent and permissible under applicable law including Government Code Section 53600 et seq.

Investments may be made in the following media:
 Securities of the United States Government or its agencies, 5-year max maturity  Certificate of Deposit (or time deposits) placed with commercial banks and/or savings and loan companies, 5-year max maturity, 50% max allocation  Negotiable Certificates of Deposit, 5-year max maturity, 30% max allocation  Commercial Paper, 270 days or less, 40% max allocation, A1/P1 minimum rating  Medium-Term Notes, 5-year max maturity, 30% max allocation, A minimum rating  Supranational Obligations, 5-year max maturity, 30% max allocation, AA minimum rating  Mortgage Pass-Through and Asset-Backed Securities, 5-year max maturity, 20% max allocation, AA minimum rating

 Joint Powers Authority Fund (CAMP, CLASS CalTRUST)
 Local Agency Investment Fund (State Pool) Demand and Deposits  Repurchase Agreements (Repos), 1-year max maturity
Criteria for selecting investments and the order of priority are:

1. Safety: The safety and risk associated with an investment refer to the potential loss of principal, interest or a combination of these amounts. The City only operates in those investments that are considered very safe.

2. Liquidity: This refers to the ability to “cash in” at any moment in time with a minimal chance of losing some portion of principal or interest. Liquidity is an important investment quality especially when the unexpected need for funds occurs.

3. Yield: Yield is the potential dollar earnings an investment can provide, and sometimes is described as the rate of return.

SAFEKEEPING
Securities purchased from brokers/dealers will be held in third-party custodial account designated in the name of the City of Buellton.

INVESTMENT OBJECTIVE
The cash management system of the City of Buellton is designed to accurately monitor and forecast expenditures and revenues, thus insuring the investment of monies to the fullest extent possible.

Attempts are made to obtain the highest interest yields possible as long as investments meet the criteria required for safety and liquidity.

MONTHLY REPORTS
The City Finance Director, as the investment officer, is to submit monthly reports to the local governing body to demonstrate that sufficient cash flow liquidity is available to meet the succeeding month’s estimated expenditures. In addition, a monthly report of investments with a maturity greater than one year from the date of purchase will be submitted to the local governing body.

CITY CONSTRAINTS
Buellton strives to maintain the level of investment of all idle funds, as near 100 percent as possible, through daily and projected cash flow determinations. Idle cash management and investment transactions are the responsibility of the City Finance Director. The basic premise underlying the City’s investment philosophy is, and will continue to be, to insure that money is always safe and available when needed.

DEPOSITORIES
The Finance Director will establish selection criteria for pre-approval of institutions with which to do business. To qualify for selection, an institution must have an office in California. A written listing of approved institutions will be maintained by the Finance Director.

BROKER/DEALERS
To provide for the optimum yield in the investment of the City’s funds, the City’s investment procedures shall be designed to encourage competitive bidding on transactions from approved brokers/dealers. In order to be approved by the City, the dealer must be experienced in institutional trading practices and familiar with the California Government Code as related to investments; and other criteria as may be established in the investment procedures.

The Finance Director will periodically conduct a credit analysis of each financial institution and securities broker/dealer to determine the financial condition of such agency and reduce the risk of default.

LIMIT ON TERM TO MATURITY
The City Finance Director or his/her representative is not to invest any City monies in investments allowed under this policy that have a term remaining to maturity in excess of five years from the date of investment, unless the City Council has granted express authority to make such investment.

The City Finance Director must request authority from the legislative body three months prior to the date of investment.

SAFEKEEPING AND CUSTODY
To protect against potential fraud and embezzlement, the assets of the City shall be secured through third-party custody and safekeeping procedures. The Finance Director shall be bonded to protect the public against possible embezzlement and malfeasance. Safekeeping procedures shall be reviewed annually by the independent auditor and any irregularities noted should be reported promptly to the City Manager and the City Council.

PERFORMANCE EVALUATION AND OPERATIONS AUDIT
The monthly investment reports submitted to the City Council shall contain sufficient information to permit an independent organization to evaluate the performance of the investment program.

CITY OF BUELLTON
City Council Agenda Staff Report

City Manager Review: SW
Council Agenda Item No.: 6

To: The Honorable Mayor and City Council
From: Shannel Zamora, Finance Director
Meeting Date: June 26, 2025
Subject: Acceptance of City of Buellton Transportation Development Act (TDA) Fund Financial Statements for Years Ended June 30, 2024 and June 30, 2023 with Independent Auditor’s Report
________________________________________________________________________

BACKGROUND
An audit of the City’s Transportation Development Act Fund has been performed by Moss, Levy & Hartzheim LLP, a firm of Certified Public Accountants. The purpose of the audit is to determine compliance with the Transportation Development Act (TDA) (California Public Utilities Code sections 99234 and 99400(a)), and compliance with the rules and regulations of the Santa Barbara County Association of Governments (SBCAG).

The audit is presented herewith for your review and acceptance. The audit includes an examination of the assets, liabilities and fund balance of the TDA Fund as of June 30, 2024 and June 30, 2023, and the related statements of revenue, expenditures and changes in fund balance.

The Independent Accountant’s Report on Compliance with Requirements Applicable to the TDA, dated June 10, 2025 states that the City complied with applicable statutes, rules, regulations of the TDA and the allocation instructions and resolutions of the Santa Barbara County Association of Governments as required by Section 6666 of Title 21, Division 3, Chapter 2, Article 5.5 of the California Code of Regulations during the year ended June 30, 2024.

The auditors expressed an opinion that financial statements of the City of Buellton TDA Fund for the fiscal year ended June 30, 2024 and June 30, 2023, and the changes in its financial position are fairly stated in conformity with accounting principles generally accepted in the United States. This is the most favorable conclusion and is commonly known as an “unqualified” or “clean” opinion.

In our opinion, the financial statements referred to above present fairly, in all material respects, the financial posltlon of the City of Buellton Transportation Development Act Fund as of June 30, 2424 and June 34, 2423, and the changes ïn its financial position for the fiscal years then ended ïn accordance with accounting principles generally accepted in the United States of America.

Basis for ~lpinïons
We conducted our audit in accordance with auditing standards generally accepted in the United States of America. {fur responsibilities under those standards are further described ïn the Auditor's Responslbilltles for the Audit of the Financial Statements section of our report. We are required to be independent of the City of Buellton and to meet our other ethical responsibilities, ïn accordance with the relevant ethical requirements relating to our audit. we believe that the audit evidence we have obtained is sufficient and appropriate to provide a basis for our audit opinions.

Emphasis of 1Vlatter
As d1sCUssed in Notei, the financial statements present only the Transportation Development Act Fund and do not purport to, and donat, present fairly the financial position ofthe City of Buellton as ofJune 34, 2424 and June 34, 2423, the changes in its financial position for the fiscal years then ended in accordance with accounting principles generally accepted in the United States of America. ~3ur opinion is not modified with respect to this matter.

Responsïbïlïtïes of Management for the Financial Statements Management is responsible for the preparation and fair presentation of the financial statements ïn accordance with accounting principles generally accepted ïn the United States of America, and for the design, implementation, and maintenance of internal control relevant to the preparation and fair presentation of financial statements that are free from material misstatement, whether due to fraud or error.

In preparing the financial statements, management ïs required to evaluate whether there are conditions or events, considered in the aggregate, that raise substantial doubt about the City of Buellton's Transportation Development Act Fund's ability to continue as a going concern for twelve months beyond the financial statement date, including any currently known information that may raise substantial doubt shortly thereafter.

Auditor's Responsïbïlïtïes for the .Audit of the Financial Statements C}ur objectives are to obtain reasonable assurance about whether the financial statements as a whole are free from material misstatement, whether due to fraud or error, and to issue an auditor's report that includes our opinions. I~.easonable assurance is a high level of assurance but is not absolute assurance and therefore is not a guarantee that an audit conducted in accordance with generally accepted auditing standards will always detect a material misstatement when it exists, The risk of not detecting a material misstatement resulting from fraud ïs higher than for one resulting from error, as fraud may involve collusion, forgery, intentional omissions, misrepresentations, or the override of internal control. Misstatements are considered material if there ïs a substantial likelihood that, individually or in the aggregate, they would influence the judgment made by a reasonable user based on the financial statements.

CITY OF BUELLTON
City Council Agenda Staff Report
City Manager Review: SW
Council Agenda Item No.: 8
To: The Honorable Mayor and City Council
From: Rose Hess, Public Works Director
Meeting Date: June 26, 2025
Subject: Acceptance of Bid and Award of Construction Contract for the Combined 2023/24 and 2024/25 Road Maintenance Project

BACKGROUND
In April 2025 the City published a Notice to Contractors inviting sealed bids for the combined 2023/24 and 2024/25 Road Maintenance Project. The Project will include slurry seal and pavement repair and maintenance of Ave of Flags, Reservoir 1/2 access road and the WWTP access road, as well as localized asphalt repairs in various locations throughout the city. In addition, repairs include pavement striping, localized concrete repairs, and traffic sign replacements.

On May 28, two (2) bids were received for the project from the following contractors:

JF Will Co. Union Pavement
Bid Schedule A Base Annual
Road
Maintenance
$1,262,856.45 $1,116,031.81
Bid Schedule B Resin
Replacement
$37,152.00 $17,819.20
Total Bid
Schedules
(A+B)
Recommended
$1,300,008.45 $1,133,851.01
Staff recommends combining Bid Schedules A and B. The apparent low bidder was Union Pavement with a total bid (A+B) of $1,133,851.01. However, upon further review of Union Pavement’s bid documents, particularly the subcontract work, we found that their percentage of work required to be performed (at least 50% of the contract price, pursuant to the Standard Specifications for Public Works Construction Greenbook) was less than 37%. Unfortunately, this led to the disqualification of their bid.

The next bid, from JF Will, had a total bid (A+B) of $1,300,008.45. The review of their bid documents has found them to be complete. Bid amounts have also been verified. Staff has reviewed and verified license, bonds and references for JF Will Co.

Page 68 of 114 ends

Road Maintenance Contract Page 2 June 26, 2025
In addition, staff recommends adding a contingency amount of 10%, $130,000 for additional repairs that may be needed. This would bring the total contract amount to $1,430,008.45.

It is anticipated that the effective date of the Notice to Proceed for work will be issued in July, 2025. The project term is 60 working days (approximate completion is October/November 2025).

FISCAL IMPACT
Both the 23/24 and 24/25 Road Maintenance Projects are budgeted in the Capital Improvement Project List. (092-322 and 092-323, respectively). Funding is appropriated in the 2023/24-2024/25 Biennial budget for construction ($540,000 + $350,000 = $890,000) and project management/inspections ($80,000 + $75,000 = $155,000) through General Fund, Gas Tax (including SB1), and Measure A. A budget adjustment will need to be made to increase the construction budget by an additional $540,008.45, for a total combined construction budget of $1,430,008.45.

RECOMMENDATION
That the Council award the combined 2023/24 and 2024/25 Road Maintenance Project construction contract to JF Will Construction in the amount of $1,300,008.45 plus a contingency amount of 10%, ($130,000) for a total contract amount of $1,430,008.45 and in approve a budget amendment of an additional $540,008.45 to Account 092-322/323- 74100.

From: Scott Wolfe, City Manager

Meeting Date: June 26, 2025

Subject: Lease Agreement for the Provision of Library Management Services Between the City of Buellton and the City of Goleta at the Buellton Library
______________________________________________________________________________

BACKGROUND

The City’s Library Services contract with the City of Goleta expires on June 30, 2025.

Goleta has provided a contract to provide service for the coming fiscal year, with an option for both Buellton and Goleta to mutually extend the agreement for up to five (5) additional one-year terms. The new contract provides lease of the Library space to Goleta and for Library services to be provided by Goleta at the City’s new Library site at 202 Dairyland Road. The new agreement was specifically drafted to accommodate service levels which are anticipated at this new facility, along with establishing expectations of each party associated with the operation of the facility.

The contract reflects an increase in costs to be borne by the City, and this increase reflects the lack of increase in Buellton’s payment for these services over the term of the current agreement to account for general inflation and periodic increases to Goleta’s staffing costs during the current agreement’s term. The cost to the City for the coming Fiscal Year 2025- 26 will be $288,961.64. This represents 62.7% of the total costs associated with operating Buellton’s library, with the remaining funds being provided by the County’s “per capita” contribution for library services and by other, undefined revenues and donations.

The City cannot provide the same level of services for the amount charged through the Agreement. Goleta has been more than satisfactory in the providing library services within the City of Buellton for the duration of the current agreement, and Goleta’s library staff has been enthusiastic about the potential to provide new and exciting services and programming through Buellton’s Library.

FISCAL IMPACT

The cost to the City’s General Fund for this agreement for the coming Fiscal Year 2025- 26 is $288,961.64. This amount has been included in the adopted Fiscal Year 2025-26 budget.

RECOMMENDATION
That the City Council approve and authorize the City Manager to sign the Lease Agreement for the Provision of Library Management Services between the City of Buellton and the City of Goleta at the Buellton Library.

3. LEVEL OF SERVICE AND STAFFING LEVELS.

The level of service and staffing levels for general library management services, along with its proposed operational budget for the following fiscal year to BUELLTON will be recommended by GOLETA on or before March 1 of each year with service level adjustments (if needed) occurring July 1 of the following year. GOLETA will provide BUELLTON with a list of its proposed staffing levels for the library for review. Staffing levels shall not be reduced by GOLETA without the approval of BUELLTON, including proposed reductions due to any furloughs or other work-schedule reductions, staffing and scheduling of GOLETA employees. Where proposed reductions in staffing levels are the result of midyear budgeting changes by GOLETA or an unexpected reduction in funding from the County of Santa Barbara, BUELLTON shall have the option of providing additional financial support to maintain staffing levels previously agreed to between the PARTIES as set forth herein.

B. LEVEL OF SERVICE ENHANCEMENT: BUELLTON may request
GOLETA to provide an enhanced level of regular library-related services, including without limitation, additional staffing and/or hours of operation, one-time or periodic services. BUELLTON will provide GOLETA with this request in writing and GOLETA must provide a written response within 30 days, including a proposed budget detailing the cost of such enhanced services and a list of any added or different type of personnel necessitated by such requested changes.

Any enhancements in operations, staffing levels, or hours of operations must be agreed to by the PARTIES. For any enhanced level of regular library-related

services, GOLETA will charge the applicable management fee commensurate with costs estimated to be incurred for the enhanced services. Proposed changes shall be presented as needed to the City of Buellton City Council, Goleta Library Advisory Commission, and County Library Advisory Committee for input, as described in the Agreement for Operations between GOLETA and the County of Santa Barbara.

C. LIBRARY STAFFING: All persons required for the performance of GOLETA'S responsibilities under this AGREEMENT must be selected and employed by GOLETA, and must at all times be and remain agents or employees of GOLETA. No persons employed or retained by GOLETA for performance of its duties under this AGREEMENT shall at any time be deemed or considered to be the agents or employees of BUELLTON.

GOLETA shall be responsible for the selection, supervision, training, discipline, and scheduling of all LIBRARY staff. The operating and personnel procedures of the Library Department of GOLETA will at all times apply to GOLETA'S operation of the LIBRARY.

Prior to any change to a Branch Supervisor of the LIBRARY, GOLETA shall, through its City Librarian, meet and discuss with BUELLTON, the proposed appointment or transfer. 4. GRANT ADMINISTRATION AND PROGRAMS.

The administrative function will also include the ability and authority for GOLETA to apply, administer and implement grant opportunities for the benefit of BUELLTON with the expressed written permission of the Designated Representative of BUELLTON. If the additional level of service is tied to a grant program, BUELLTON will be invoiced for actual, additional costs above the grant award for the applicable time period unless GOLETA and BUELLTON agree otherwise. This assumes that any grant funds are received directly by GOLETA, BUELLTON may request and GOLETA may provide cost estimates prior to implementation of a grant and/or program. BUELLTON understands that actual, additional costs may vary slightly (high or low) from original estimates.

Any supplemental, material expenses related to ongoing programs will be recommended by GOLETA to BUELLTON in advance of purchase. BUELLTON understands and accepts that if a supplemental item related to an ongoing program is not approved by GOLETA, BUELLTON may exercise the option to refrain from further work on the grant or program. GOLETA will apply departmental and or city-wide overhead to a grant cost when the provisions of the grant allow for the accounting of overhead expense. BUELLTON understands and accepts that the net cost of grant overhead may become an expense to BUELLTON when other provisions are not agreed upon in writing by both parties in advance of the implementation of the grant. BUELLTON understands and accepts any ongoing fiscal, staffing, and/or programmatic obligations incurred in the acceptance of a grant. An example of such obligation may include a grant requirement to retain a staffing position for a time period beyond the original grant award period.

Exhibit C
Cost Model
The cost model determines the overall cost of providing Library Management Services to BUELLTON, including the estimated management fee of support staff. The cost model is inclusive of budget line items to operate the branch library, and includes accounts related to staff salary and benefits, services and supplies, and capital outlay. In addition to the cost estimates, GOLETA’S cost model includes a management fee that is representative of the administrative overhead from support staff of providing library management services. The annual proposed operating budget represents the total cost for the library management operations for the following fiscal year.

1. Proposed Operating Budget
On or before March 1 of each year of this AGREEMENT, GOLETA will provide BUELLTON with a copy of its proposed operating budget for BUELLTON library for the following fiscal year. For planning purposes, BUELLTON and GOLETA have agreed to a 3% escalation cost annually. Any changes to the LIBRARY budget during the current fiscal year of this AGREEMENT, including any unanticipated reductions or increases, which would affect services or hours open to the public, will be communicated to BUELLTON as soon as possible. BUELLTON shall have the exclusive authority to accept or reject any changes or reductions in service levels or service hours requested by GOLETA. Where proposed reductions in service are the result of mid-year budgeting changes by GOLETA or an unexpected reduction in funding from the County of Santa Barbara, BUELLTON shall have the option of providing additional financial support to maintain service levels previously agreed to between THE PARTIES as set forth herein.

2. Salary and Benefits
This is the actual hourly cost of salary and benefits paid to the Library employee’s classification for library management services based on staffing levels approved. Subject to future increases due to benefit and salary changes.

3. Services and Supplies
This category is the estimated direct cost of services and supplies to support the BUELLTON library. The line item accounts are consistent with GOLETA’S chart of accounts and were originally estimated based on information received at the time. This section of costs accounts for expenditures that can be directly charged against the library and clearly identified. Major costs include Black Gold Fees, IT services, courier delivery services, and GOLETA’s management fee. Subject to future changes, due to changes in cost of contracts fees, or unanticipated direct costs.

23 Page 90 of 114
City of Goleta
Buellton Library Management Services Agreement

Page 20 of 24 ends

4. Capital Equipment/Outlay.

This category is the estimated direct cost of book acquisitions (including processing fees) or other future capital outlay.

5. Management Fee.

The management fee is the estimated cost of support and administration provided by GOLETA support department staff. It includes support from General Government, Finance, Human Resources and Goleta Library. The management fee is calculated using a time and materials survey cost model that incorporates the hourly labor and benefit rate of GOLETA staff that would be directly supporting the BUELLTON library. The model identifies direct tasks performed by staff and other direct costs provided to the library branches with reasonable assumptions. The cost model will increase 3% annually and will never exceed the maximum allowance of the total budget per the County Agreement for Library Services.

6. Annual Reporting.

Upon completion of the fiscal year, any remaining funds from the City of BUELLTON will be deposited into a Fund Balance. The purpose of the Fund Balance will build a six month operation reserve to be utilized to cover any expenses related to the BUELLTON Library in the following scenarios:

A. The program experiences unbudgeted expenses that are agreed upon in writing by both BUELLTON and GOLETA, and/or
B. There is an unforeseen change to the Per Capita funding from the County of Santa Barabara, and/or
C. The City of BUELLTON decide to take on Library Services and terminate the contract, there would be sufficient funding to close down the operations for transition, and/or
D. The City of BUELLTON elect to request a reimbursement of the funds for other Library related business.

Annually, representatives from the City of GOLETA’s will provide BUELLTON with a report on expenses and fund balance. This report will be in writing, but BUELLTON may request a formal presentation to their City Council. This presentation can occur no sooner than October of the year following the fiscal year operations.

CITY OF BUELLTON
City Council Agenda Staff Report

City Manager Review: SW
Council Agenda Item No.: 10

To: The Honorable Mayor and City Council

From: Scott Wolfe, City Manager

Meeting Date: June 26, 2025

Subject: Notice of Rate Adjustment for City Attorney Services ______________________________________________________________________________

BACKGROUND

The City Council contracts with the firm Burke, Williams, and Sorensen, LLP (BWS) for City Attorney services. These services are conducted by BWS staff, to include our City Attorney Gregory Murphy, our Assistant City Attorney Stephanie Gutierrez, and other partners and associates of the firm. General City Attorney services are provided under a retainer, while legal services which fall outside those covered by the retainer are billed separately.

The Biennial Budget for Fiscal Years 2025-26 and 2026-27 was approved by the City Council at its meeting of June 12, 2025. The City Attorney’s budget was included within the overall budget and reflects increases in line with general inflationary assumptions of 3%.

BWS informed the City Manager of a rate increase to be effective this coming fiscal year in the amount of 3.0% (see Attachment 1), and this increase was included and is reflected in the adopted budget. As the amount of the increase is the same as the increase in the budget, there is no appreciable effect on the budgeted numbers for the City Attorney’s Department. However, a public disclosure of an increase in rates is legally required but was inadvertently omitted from the budget document by staff during preparation. This report serves as the public disclosure of this rate increase.

The function of this agenda item is simply to disclose this rate increase for the benefit of the public. Therefore, no action is required of the City Council beyond receipt and filing of the item.

FISCAL IMPACT

This item is a public disclosure of a rate increase which is reflected in the most recently adopted budget. Therefore, there is no fiscal impact associated with this item.

Re: Contract Amendment and Rate Adjustment for Fiscal Year 2025/26 Dear Mr. Wolfe:

As a starting point I want to thank you on behalf of Burke, Williams & Sorensen for the opportunity to serve as City Attorney for the City of Buellton since November 2018. It has been an honor and a pleasure. Section 5 of the contract authorizes periodic rate adjustments to reflect the increasing costs of doing business, not unlike the periodic increases in compensation for City staff. Specifically, the rate adjustment called for by Section 5 would be equal to the Consumer Price Index (CPI) for the last four quarters.

The CPI index for the last four quarters, published in January of this year, is slightly more than 3.0%. I am asking for a rate increase at 3.0%, as laid out more fully on the attached chart. This will help to offset Burke’s rising costs while not unduly affecting the City’s financial outlook. I further propose that the increase be effective July 1, 2025 rather than have immediate effect, so that the increase might be incorporated in the discussion of the City Attorney budget for the next fiscal year.

If you have any questions, please do not hesitate to contact me.

Sincerely,
Gregory M. Murphy

Meeting Date: June 26, 2025
Subject: Discussion of Community Meeting Room Rental Application – 202 Dairyland
______________________________________________________________________________

BACKGROUND
With the completion of the new City facilities at 202 Dairyland, two meeting rooms were constructed with the anticipation of use for public and community meetings. Staff has prepared a draft rental application package for discussion. The rental application provides rules, regulations and requirements, along with requested information for the rental use details. The application package is based on the templates from CJPIA, the City’s insurance and risk management agency, as well as applications from other similar publicly owned rental facilities in the area.

The areas available for potential rental are the two meeting rooms and the south lawn.

Staff would like input on:
*General application rules and regulations (the draft rules and regulations are consistent with our municipal code);
*Hours of availability (the draft hours have taken into consideration the comments and concerns from the adjacent neighborhood);
*Rental fees

FISCAL IMPACT
The discussion of the Community Room Rental Application has no fiscal impact in and of itself. However, future action will impact operational costs for the facility.

RECOMMENDATION
That the City Council review and discuss the draft community room rental application package and provide staff direction.

CITY OF BUELLTON
City Council Agenda Staff Report

City Manager Review: SW
Council Agenda Item No.: 12

To: The Honorable Mayor and City Council

From: Scott Wolfe, City Manager

Meeting Date: June 26, 2025

Subject: Alternate Use of Library Building Meeting Room #1 by Friends of the Buellton Library
______________________________________________________________________________

BACKGROUND

At its regular meeting of June 12, 2025, the City Council gave direction to City staff to return with an agenda item to discuss a proposal by the Friends of the Buellton Library (FOBL) to allow the continued use of the entirety of Meeting Room #1, located in the former “garage” area of the Library building.

FOBL has been using Meeting Room #1 to establish their operations and fund raising to provide support to the Library and its programming. The original intent was to allow FOBL to occupy a portion of the former “garage” space, with the remainder to be used for a smaller community room. However, as the City has investigated options for partitioning the community room space, FOBL has had use of the entire space. The partitioning of the space has proven problematic as ventilation, lighting, sound transmission, and access have all presented challenges. Staff is currently working on solutions to these issues and intends to bring forward a proposal for design change for partition of the space unless the City Council accepts FOBL’s current proposal.

FOBL has used the northern portion of the space for the sale of used books and general FOBL activities, while the rest of the room has been opened to the public for use by small children who play in the space with toys that were previously held in the Children’s portion of the old library location. This has proven to be an effective aid in raising funds for FOBL, as parents of these small children will frequently visit the room for extended periods donating funds and purchasing books.

FOBL has been contacted by the School District with a request to open the room for use by some groups of students for different activities after school hours and on weekends.

FOBL President Holly Sierra has indicated a willingness to open the space to such student groups, and to provide varied programming in the space as the volunteer corps of FOBL develops to the point that additional hours of operation of the space can be accommodated.

Page 112 of 114 ends

Alternate Use of Library Meeting Room Page 2 June 26, 2025 While the proposal by FOBL may limit the use of this meeting room space for ad hoc meetings by various groups, it may provide a more consistent use of the space and serve a wider range of clientele in the form of various groups of youth, as well as book clubs, crafting groups, and other community-based groups. Beneficially, increased use of this space under the control of FOBL could have positive impacts upon FOBL’s ability to raise funds to provide improvements to the Buellton Library’s facilities and programming.

This item is presented to the City Council for discussion without a recommendation for a decision. Staff requests that the City Council discuss the matter and give direction as appropriate.

FISCAL IMPACT

There is no fiscal impact associated with this item.

RECOMMENDATION
That the City Council discuss the matter and provide direction to staff.
