Subject: Monthly Treasurer’s Report – June 30, 2025
______________________________________________________________________________

City of Buellton
Monthly Treasurer’s Report
For the month ending in June 30, 2025
August 14, 2025
This report presents the City’s cash activity and investment portfolio as of June 30, 2025. The report includes:
1) Cash and investments at June 30, 2025 compared to the prior month; 2) A reconciliation of cash and investments to City ledger balances; 3) All investments managed by the City on its own behalf; 4) Beginning of year fund balance, revenues, expenditures and ending fund balance for each fund at June 30, 2025
The following schedule is a summary of the City’s cash and investments based on recorded value as of June 30, 2025, compared with the prior month.

May 31, 2025 June 30, 2025 $ Change
Cash - Pooled $ 5,994,903.11 $ 5,648,582.93 $ (346,320.18) Investments held by the City 18,413,798.85 18,462,155.98 $ 48,357.13 TOTAL CASH AND INVESTMENTS $ 24,408,701.96 $ 24,110,738.91 $ (297,963.05) Summary of activity for the Month and Future Liquidity: The majority of the variance in the City's reported cash and investment balances from the prior month is attributable to the receipt of revenues from April 2025 sales tax collections, and May 2025 transient occupancy tax. These inflows were partially offset by disbursements for June 2025 law enforcement services provided by the Santa Barbara Sheriff’s Department, as well as expenditures related to ongoing capital improvement projects, including construction at the Willemsen parking lot and the McMurray Road widening initiative. Additionally, investment values changed due to interest earnings on money market funds, the Local Agency Investment Fund (LAIF), and Certificates of Deposit (CDs). The portfolio is sufficiently liquid to meet expected expenditures for the coming six months.

City of Buellton
Investment Summary
June 30, 2025
Currently, short-term excess cash is primarily invested in the Local Agency Investment Fund (LAIF) administered by the State Treasurer. This is a high-quality investment available in terms of safety, liquidity, and yield. Due to fluctuations in the marketplace, the City may have some investments with a current market value that is greater or less than the recorded value. This difference has no effect on investment yield as the City intends to hold the securities to maturity. However, generally accepted accounting principles require that market gains and losses be reported as interest earnings or losses at year-end.

From: Rose Hess, Public Works Director
Meeting Date: August 14, 2025
Subject: Acceptance of Public Trail and Pedestrian Access Easements (Village Senior Apartments)
____________________________________________________________________________________

BACKGROUND
On June 16, 2022, the Planning Commission approved Resolution 22-06, for the Final Development Plan for the Village Senior Apartments. In compliance with project conditions, frontage improvements shall include adequate bus turnout and shelter. Design of these facilities shall include adequate public sidewalk with appropriate ADA width behind the shelter. Therefore, a pedestrian access easement is required for dedication. In addition, an easement is conditioned to be dedicated for public access and trails along the east property line.

The developer has prepared the Grant of Easement for public dedication as provided as Attachment 1.

FISCAL IMPACT
The acceptance of the Public Trail and Pedestrian Access Easements and the offer of dedication, in themselves, will not have any fiscal impact on the City.

RECOMMENDATION
That the City Council accept the Grant of Easement dedication for public trail and pedestrian access and authorize their recordation.

Council Agenda Item No.: 5
To: The Honorable Mayor and City Council
From: Rose Hess, Public Works Director
Meeting Date: August 14, 2025
Subject: Acceptance of Bid and Award of Construction Contract for the WWTP Groundwater Monitoring Wells Project

BACKGROUND
In June 2025 the City published a Notice to Contractors inviting sealed informal bids for the WWTP Groundwater Monitoring Wells Project. The Project includes the installation of three new groundwater monitoring wells for sampling and reporting purposes for compliance with the Regional Water Quality Control Board.

On July 31st, three (3) bids were received for the project from the following contractors:

ABC Liovin Gregg Drilling J&H Drilling
Total Bid $47,051.50 $43,155.00 $41,475.00
The low bidder is J&H Drilling with a total bid of $41,475.00. The review of their bid documents has found them to be complete. Bid amounts have also been verified. Staff has reviewed and verified license, bonds and references for J&H.

In addition, staff recommends adding a contingency amount of 20%, $8,295.00 for additional repairs that may be needed. This would bring the total contract amount to $49,770.

It is anticipated that the effective date of the Notice to Proceed for work will be issued by the end of August 2025. The project term is 30 working days (approximate completion is October 2025).

CITY OF BUELLTON
City Council Agenda Staff Report
City Manager Review: SW
Council Agenda Item No.: 6

To: The Honorable Mayor and City Council
From: Scott Wolfe, City Manager

Meeting Date: August 14, 2025
Subject: Ordinance No. 25-06 - “An Ordinance of the City Council of the City of Buellton, California Amending Chapter 3.28.060 of the Buellton Municipal Code Pertaining to Registration Requirements of Hotel Operators Subject to Transient Occupancy Tax, and Adding Chapter 19.06.290 of the Buellton Municipal Code Pertaining to the Operation of Hotels for Short Term Rental Use Only (25-ZOA-01)” (Introduction and First Reading)
______________________________________________________________________________

BACKGROUND
The Buellton Municipal Code establishes land use requirements as well as operational, taxation, and reporting requirements for hotels and motels within the City.

Long prior to the incorporation of the City, the former US Highway 101 commercial corridor that is now Avenue of Flags (AoF) was populated by a series of motels, providing lodging for travelers who stopped in Buellton for food, fuel, or automotive service. Over time, the traditional “motel use” of these businesses gradually changed to largely reflect a longer-term, full-time residential use, with the former motel rooms becoming single room occupancy (SRO) housing units. These SRO units existed largely illegally under the City’s zoning ordinance.

However, as the state began to steadily erode the traditional local control that City’s had over their land use decisions (particularly regarding housing), legislative changes were made, enhanced by administrative interpretations, that eventually resulted in these motel rooms being deemed “housing units” by the state. Additionally, a settlement agreement coming from litigation involving the destruction of housing units to make way for the Vintage Walk project on AoF resulted in changes to the City’s Municipal Code requiring replacement of any motel units that had been occupied by long-term tenants within a 90- day period of an application for removal or demolition of those units.

Page 43 of 65 ends

Ordinance No. 25-06 Page 2 August 14, 2025
These requirements effectively precluded the large-scale revitalization of AoF that was adopted as City policy through the Avenue of Flags Specific Plan in 2017. The small size of the motel properties, coupled with the requirement to build replacement units, rendered redevelopment unlikely as there was neither the space on the properties nor the financial incentives to construct replacement units along with improvements that the City was seeking.

DISCUSSION
In order to aid in the redevelopment of these properties that will be required in order to achieve the City’s long-term policy goals on AoF as stated in the City’s General Plan, the City’s Vision Plan, and the Avenue of Flags Specific Plan, staff engaged in an effort to partner with an affordable housing developer (Palm Communities) and local advocates (People Helping People [PHP] and the Housing Authority of Santa Barbara County [HASBARCO]) to assist in the development of affordable housing away from AoF that could be deemed replacement housing for the purposes of converting the former motel units back to short-term occupancy rather than long-term residential use.

The City’s efforts were both procedural and economic, with effective cooperation with Palm Communities to engage PHP and HASBARCO in an initial survey of motel residents to determine a unit mix needed to accommodate the population of the motels at the time, working with Palm Communities to resolve issues that arose throughout construction, a financial contribution to Palm Communities from the City’s Affordable Housing In-Lieu Fund, and working with PHP and HASBARCO to work with motel residents to qualify them for residency at Palm Communities’ project (Polo Village). The result is that 14 families were moved from the motels on AoF to the Polo Village project in the Spring of 2025. This represented nearly 50% of the households that were identified in the survey taken early in the Polo Village entitlement process.

With the replacement housing issue seemingly resolved, the final action needed to convert the AoF motels is the amendment of the City’s municipal code which would prohibit the long-term (greater than 30 days) occupancy of any building built as a hotel or motel, and the restatement of the requirement that Transient Occupancy Tax be collected for each room in a hotel or motel that has reverted to short-term rental.

The attached draft ordinance seeks to accomplish this goal. There are two changes to the Municipal Code which are established in this ordinance. The first is an amendment to Section 3.28.060, which requires hotels and motels to register and collect transient occupancy tax (TOT). The change being proposed to this section simply applies the requirement to register and collect TOT to those businesses reverting to hotel use pursuant to the ordinance.

Page 44 of 65 ends

Ordinance No. 25-06 Page 3 August 14, 2025
The second change is the addition of Section 19.06.290 to the Zoning chapter of the Municipal Code. This new section prohibits the use of any building built or operated as a hotel or motel on or after the City’s incorporation date for long-term residential use, and requires motels uses that have converted to long-term residential use to revert to short-term rental by the end of the 2025 calendar year. There is one exception to this requirement: Red Rose Court is a motel that has been operated as an SRO facility for many years. It is in good repair, has been very stable over the years, and has been designated as a City Historic Landmark. As the state requires that the City allow SRO units as part of its Housing Element review program, Red Rose Court will be exempted from the requirement for conversion to short-term rental.

Staff is continuing efforts to re-house the remaining residents of AoF motels. Staff is in discussions with the developers of both the Village Senior Apartments and Buellton Garden Apartments to attempt to pre-qualify AoF motel residents for units within these developments, though the occupancy of these projects may take place after the requirement for the motels to revert to short-term rental takes place. Residents who do not pre-qualify for either of these projects will be required to relocate upon the later of either the effective date of the ordinance or January 1, 2026, and may qualify for relocation assistance from the owner of their current residence.

The draft ordinance attached represents the final step in clearing the path to the revitalization of AoF and will enable current or future owners the ability to invest in their properties to enhance their appearance or change their use without the extreme costs associated with the construction of replacement units on-site. This should result in the improvement of overall appearance of AoF and the eventual increase in property values and development interest that can make downtown revitalization possible.

At its July 17, 2025, meeting, the Planning Commission held a public hearing on this matter, and adopted Resolution No. 25-08 (Attachment 1), recommending approval of the proposed ordinance, with modifications. The modifications recommended by the Commission centered on the expansion of potential extensions to be granted to individual tenants who were awaiting housing in a project that was not yet occupied, but for which they have been pre-qualified. The original draft ordinance specifically referred to the Buellton Senior Apartments and the Buellton Garden Apartments projects as the projects for which pre-qualification was considered grounds for extension beyond the December 31, 2025, deadline. However, the Planning Commission felt that there may be other projects in surrounding jurisdictions which current motel residents may be pre-qualified for, and that if that were to be the case, that extensions should be granted in those instances as well, but not past June 30, 2026. This change has been made to the draft ordinance (see Attachment 2).

Ordinance No. 25-06 Page 4 August 14, 2025

GENERAL PLAN CONSISTENCY
Staff has determined that the proposed Amendments are consistent with the General Plan, the Avenue of Flags Specific Plan, the requirements of state planning and zoning laws, and Title 19 of the Zoning Ordinance.

ENVIRONMENTAL REVIEW
The adoption of the ordinance associated with this item is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061 (b) (3), because the proposed Ordinance is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. The Ordinance re-establishes and requires compliance with City Municipal Code requirements and project approvals which have been violated over many years and therefore would have no significant effect on the environment.

RECOMMENDATION
That the City Council consider the introduction and first reading of Ordinance No. 25-06 - “An Ordinance of the City Council of the City of Buellton, California Amending Chapter

3.28.060 of the Buellton Municipal Code Pertaining to Registration Requirements of Hotel Operators Subject to Transient Occupancy Tax, and Adding Chapter 19.06.290 of the Buellton Municipal Code Pertaining to the Operation of Hotels for Short Term Rental Use Only (25-ZOA-01)” by title only and waive further reading.

CITY OF BUELLTON
City Council Agenda Staff Report
City Manager Review: SW
Council Agenda Item No.: 7
To: The Honorable Mayor and City Council
From: Allison Firey, Recreation Coordinator
Meeting date: August 14, 2025
Subject: Consideration of Arts and Culture Project Application:

Buellton Theatre Project
______________________________________________________________________________

BACKGROUND
Buellton Theatre Project
Benefits for Children: Community theatre offers children a unique and valuable opportunity to develop confidence, creativity, and communication skills in a supportive, collaborative environment. By participating in theatre productions, children learn to express themselves, work as part of a team, and take responsibility for their roles—both on stage and behind the scenes. This experience not only enhances their social and emotional growth but also fosters empathy by encouraging them to step into different characters’ perspectives.

Involving children in community theatre alongside adults in their community and professional performers offers a unique and invaluable learning experience that extends far beyond the stage. It fosters a sense of responsibility, teamwork, and discipline, while exposing young actors to high standards of performance and work. Additionally, the intergenerational collaboration nurtures mutual respect and mentorship, helping young participants grow not only as artists but also as thoughtful, engaged members of their community.

Benefits for Adults: Currently, there are no community theatre opportunities for adult performers in the Santa Ynez Valley. This program would offer both educational and performance opportunities for adults interested in the performing arts. Additionally, community theatre connects residents of all ages to their local culture and neighbors, strengthening their sense of belonging and civic engagement.

The Project
Over the course of a 14-week theatre arts program, participants will engage in an immersive journey that builds performance skills, fosters collaboration, and culminates in a fully staged production of Annie to be held at the Solvang Theatre Fest. Designed for aspiring performers of all experience levels, this program combines training in acting, voice, and movement with hands-on rehearsal experience. A unique highlight of the production is the integration of

Page 54 of 65 ends

Arts & Culture Project Page 2 August 14, 2025
three professional actors, who will work alongside local thespians both onstage and in mentorship roles, elevating the overall artistic quality while offering valuable learning opportunities. From auditions and character development to final curtain call, the program offers a comprehensive and inspiring theatrical experience for the entire community. But this is more than just a play—it’s a celebration of the performing arts, a platform to inspire artists of all ages, and a powerful reminder of the importance of multi-generational theatre in the Santa Ynez Valley. Through this program, we aim to foster connection, creativity, and a renewed appreciation for the arts in our community.

Additional Educational Workshops Included in Program

1. Vocal Workshop
A Vocal Workshop will be led by professional vocalist Lloyd Alexander-Holt, focusing on audition technique and performance enhancement. This hands-on session is perfect for aspiring singers looking to improve their vocal confidence and stage presence. This workshop would be held at the Buellton Rec and free for all Buellton residents, with a $5 registration fee for all other registrants, creating the opportunity to learn from a seasoned performer in a supportive environment.

2. Broadway-style dance workshop
This workshop will be led by professional choreographer and educator Jordan Alexander-Holt. Participants will learn a dynamic Broadway dance combination while also focusing on proper technique and performance skills. Jordan will provide personalized feedback throughout the workshop to help dancers grow and refine their abilities. This workshop would be held at the Buellton Rec and free to all Buellton residents, with a $5 registration fee for all other registrants. providing an opportunity to dance, learn, and be inspired.

3. Children’s Theatre Workshop
Children’s theatre director and professional performer Evie Hutton will lead an engaging and imaginative workshop designed for elementary and middle school students, introducing them to the fundamentals of theatre and improvisation. Through interactive games, creative movement, and character-building exercises, participants will explore the basics of stage presence, voice projection, and storytelling. Evie’s energetic and inclusive teaching style encourages self-expression, teamwork, and confidence as students learn to think on their feet and collaborate in fun improv activities. This workshop would be held at the Buellton Rec and free to all Buellton residents, with a $5 registration fee for all other registrants.

FISCAL IMPACT
The grant request is for $48,800. The FY 2024/2025 budget has $173,383 remaining. If approved, the remaining funds available for other projects would be $124,583.

RECOMMENDATION
The Arts and Culture Committee met on the evening of August 5th and was very excited about this project. The Committee is thrilled that the Solvang Theatre Fest board has given these applicants a significant discount to use their beautiful facility. After much discussion, the Committee would like to recommend that City Council fund this project fully in the amount of $48,000. They have no concerns about the project and did not request any changes to the proposal before bringing it to the Council.

CITY OF BUELLTON
City Council Agenda Staff Report
City Manager Review: SW
Council Agenda Item No.: 8

To: The Honorable Mayor and City Council
From: Scott Wolfe, City Manager
Meeting Date: August 14, 2025
Subject: Initiation of Process for Investigation of Future Use(s) of City Owned Property at 202 Dairyland Road
______________________________________________________________________________

BACKGROUND
At its July 24, 2025, meeting, the City Council approved the permitting and licensing of property located at 202 Dairyland Road for use as a private school. During this discussion, the City Council directed staff to return at a future City Council meeting with an item to discuss future uses for the site following the termination of the license agreement with Hundred Hills School.

There are a variety of approaches that such a process might take in determining appropriate future uses of the site. However, the City is currently in the process of an update to the General Plan, and the update is an opportune time to discuss changes to land uses.

Therefore, the City Council may wish to take advantage of the General Plan Update process to supplement and support the efforts to investigate future uses of the subject property.

Staff would suggest that the process also include separate public outreach efforts, both within the neighborhood of the subject site and Citywide, to help engage interested parties to address this site specifically, rather than relying solely on the General Plan Update process and its more general approach. Further, this process should also look at appropriate intermediate steps to be taken even before a future use is selected to ensure that the site is not identified as a site for potential housing development by the state, given that housing development was not a consideration of the City Council for the property once the determination that the Library and the Children’s Museum would be located there. Such intermediate steps to be considered should include identification of the site as public land on the City’s General Plan Land Use Map, changing the zoning designation to Public/Quais-Public Land (with possible amendments to the designation to tighten up potential uses within the zone), re-configuration or merging of the existing lots to more accurately reflect anticipated long-term use of the site.

Lastly, following a determination of a future use or uses on the site, this process should conclude with the City Council taking actions to reflect those future uses within the General Plan, Zoning, an applicable Parks or Recreation Plan, and/or a Capital Improvement Plan within the City’s Budget. Such steps will solidify the City’s resolve in maintaining this property under City control with an active use that does not support the future development of housing on the site.

Staff finds that City Council oversight of such a process is essential to its success.

Therefore, staff will be recommending an Ad Hoc Committee of the City Council be formed to lead this process. The discussion of creating such an Ad Hoc Committee is the subject of the next agenda item.

RECOMMENDATION
That the City Council direct staff to prepare a preliminary process and conduct a Town Hall style meeting to begin the process.

Council Agenda Item No.: 9

To: The Honorable Mayor and City Council
From: Scott Wolfe, City Manager
Meeting Date: August 14, 2025
Subject: Appointment of Ad Hoc Committee for Investigation of Future Use(s) of City Owned Property at 202 Dairyland Road
______________________________________________________________________________

BACKGROUND
At its July 24, 2025, meeting, the City Council approved the permitting and licensing of property located at 202 Dairyland Road for use as a private school. During this discussion, the City Council directed staff to return at a future City Council meeting with an item to discuss future uses for the site, following the termination of the license agreement for the school, which will occur by June 25, 2030.

In the prior agenda item, the City Council discussed the possible process for this investigation. In the event that the Council agreed to pursue such a process, staff suggests that an Ad Hoc Committee be appointed to oversee and guide this process.

The City Council may appoint two Council Members to this Committee, but staff would recommend that the Council consider the appointment of Mayor Silva and First District Councilmember Hornick, given the location of the property within the First District.

RECOMMENDATION
That the City Council discuss this matter and consider appointment of Mayor Silva and Council Member Hornick (or two other Council Members, as deemed appropriate) as an Ad Hoc Committee for the oversight of a process to investigate and identify future uses of the property located at 202 Dairyland Road.
