GAS-POWERED LAWN EQUIPMENT BAN
Director of Community and Economic Development Foulkes provided a report regarding the development of a Citywide gas-powered lawn equipment ban. The state legislature approved Assembly Bill No. 1346, which banned the sale of gas-powered lawnmowers and leaf blowers in California effective January 1, 2024. While homeowners and businesses will still be permitted to use gas-powered equipment after that date, a purchase of one will no longer be allowed in California. Director Foulkes also explained how the negative environmental impacts of gas- powered lawn equipment are substantial according the California Air Resources Board (CARB).
Moreover, Buena Park has recently taken several steps to expand its commitment to environmental stewardship and sustainability, including the development of a Climate Action and Adaption Plan, adoption of an Environmental Justice Element in the City's General Plan, creation of a Sustainability Manager position, and implementation of a Climate Action Commission. Director Foulkes discussed other cities' efforts in supporting the AB 1346; AB 1346's impact on the City and its contracted services; sustainability efforts; and, potential ordinance elements. Staff sought City Council direction on recommended measures to prohibit the use of gas-powered leaf blowers and lawnmowers within the City.

AMENDMENTS PERTAINING TO ILLEGAL STREET VENDING
Director of Community and Economic Development Foulkes provided a report regarding a potential amendment to the Buena Park Municipal Code (BPMC) pertaining to illegal street vending. The California Safe Sidewalk Vending Act, Senate Bill 946 (SB 946), took effect in January 2019 and posed a significant shift in the state's approach to street vending, aiming to balance the economic needs of vendors with the interests of local communities and businesses.
In compliance with SB 946, the City adopted Ordinance No. 1653 amending BPMC Chapter 5.64 to create a permitting and regulatory program that preserves public parks, rights-of-way, and other public places for the use and enjoyment of the community at-large. In addition to location restrictions, sidewalk vendors are required to obtain a Sidewalk Vending Permit and a Business License from the City, and any additional licensing requirements from Orange County Health Care Agency (OCHCA). Moreover, Director Foulkes discussed the negative impacts of illegal street vending; Orange County Health Care Agency's requirements on food preparation and operations; regulations implemented by surrounding cities on street vending; City's enforcement efforts; and proposed options for enforcement.
Jose Trinidad Castañeda spoke via Zoom regarding his concerns to the potential Municipal Code amendments pertaining to illegal street vending.

Council Member Brown also spoke in support of amending the Buena Park Municipal Code pertaining to illegal street vending with the effort to educate street vendors through materials available in different languages.
Council Member Traut stated that street vending should be encouraged for it is an asset to the community, and encourage the City Council to consider implementing an outreach plan for street vendors to be educated on public health and safety.
Following the discussion, the City Council directed staff to proceed with the proposed enforcement options such as to amend the BPMC to allow Code Enforcement to impound equipment and food without OCHCA participation; allow for an increased amount of enforcement efforts but would not reduce the City's costs associated with vendor enforcement; allow part-time staff to assist with vendor enforcement; and, expand outreach and education campaign that could accompany enforcement actions.
