6. PUBLIC HEARING (6A)
Community Facilities Assessment District 39 Taxation 144 6A. PUBLIC HEARING: CONSIDERATION OF ADOPTING A RESOLUTION
AUTHORIZING THE CITY OF BUENA PARK TO JOIN THE CALIFORNIA ST ATEWIDE
COMMUNITIES' DEVELOPMENT AUTHORITY AND PARTICIPATE IN THE
ST ATEWIDE COMMUNITY INFRASTRUCTURE PROGRAM
Presented by Matt Foulkes, Director of Community and Economic Development Recommended Action: That the City Council consider adopting a Resolution authorizing the City of Buena Park to join the Statewide Community Infrastructure Program; authorizing the California Statewide Community Development Authority to accept applications from property owners, conduct special assessment proceedings and levy assessments within the territory of the City of Buena Park; approving form of acquisition agreement for use when applicable; and, authorizing related actions as provided for in the resolution.
Mayor Traut stated that this was the time and place for a public hearing to consider adopting a Resolution authorizing the City of Buena Park to join the Statewide Community Infrastructure Program.
Director of Community and Economic Development Director Foulkes presented a staff report regarding a proposed resolution authorizing the City of Buena Park to join the Statewide Community Infrastructure Program. 5600 Beach Boulevard Developer/Project applicant, Shopoff Realty Investments, has requested thatthe City consider joining the California Statewide Communities Development Authority (CSCDA) in order to avail the Developer to the Statewide Community Infrastructure Program (SCIP), which would allow the developer to finance the Development Impact Fees through the formation of a special assessment district. Development Impact Fees will be funded through CSCDA SCIP bonds, with future homeowner/s paying annual property assessments to repay the bonds.
Furthermore, the proposed Resolution outlines the terms of a joint community facilities agreement between CSCDA and the City for each community facilities district, setting provisions for collection and application of the special tax for use when a community facilities district is formed and approves the form of an acquisition agreement between the City and the participating property owner/developer to provide the procedure for disbursement of bond proceeds to pay for facilities constructed by the property owner/developer. It also authorizes the CSCDA to form assessment districts or community facilities districts within the City as part or future development projects.
Mayor Traut opened the public hearing and inquired if anyone present desired to speak. There being no requests to speak, Mayor Traut closed the public hearing.
The City Council asked about the impact on the City if no action is taken on the matter; authority the state may have over city jurisdiction; association of joining the CSCDA and lowering housing cost for future homebuyers; expected increase in property tax if the City elects to join the CSCDA to avail the SCIP; and, requested staff identify neighboring cities that joined CSCDA in recent years for information that could address questions brought forward by Council Members.
The City Council also discussed their concerns regarding the impact of Mello-Roos on ongoing and future housing developments in the City, as well as its potential impact on residents, particularly in light of the current affordability crisis and economic climate; comparison of recently approved housing developments that did not require Mello-Roos financing; the data to guarantee that initial purchase price would actually be lower since the information provided still lacks details to support the long-term benefits to residents. Furthermore, the City Council directed staff to return at the September 22, 2026 Regular City Council meeting with responses and information to address City Council's concerns, and continue the public hearing to the said date.
Director Foulkes explained that there would be no impact to the City regardless of whether it joins the Statewide Community Infrastructure Program. With regards to control over city jurisdiction, Director Foulkes clarified that the proposal involves formation of a joint powers authority. The assessment district will be responsible for collecting assessments within the project area where the assessment district is formed. With the timing of the proposed participation in the Statewide Community Infrastructure Program, the CSCDA guidelines recommend joining after entitlements are approved and prior to building permits are issued. If the City elects to join the CSCDA, future developments could take advantage of it as well.
Minutes August 11, 2026 Vol. 55 Pg. 257
Scott Di Cesare, Shopoff Realty Investments, indicated that the impact of not joining the program would be on the developer's ability to finance the project. Joining the CSCDA would allow Shopoff Realty Investments, as well as Future developers and homebuilders, to reduce costs for homebuyers by lowering the overall costs associated with putting a project together.
With the Statewide Community Infrastructure Program, Buena Park property tax would increase but not to exceed 1.4% of the property value.
