1 STAFF REPORT

DATE: January 25, 2022

TO: Justin Hess, City Manager

FROM: Betsy McClinton, Management Services Director
By: David Lasher, Administrative Analyst II

SUBJECT: Adoption of a Resolution Revising the Specification for the Classification of Assistant Community Development Director-Building Official

RECOMMENDATION
Adopt A RESOLUTION OF THE COUNCIL OF THE CITY OF BURBANK REVISING THE

SPECIFICATION FOR THE CLASSIFICATION OF ASSISTANT COMMUNITY DEVELOPMENT DIRECTOR-BUILDING OFFICIAL (Attachment 1)

BACKGROUND
Due to a recent vacancy, and in preparation for an upcoming recruitment for an Assistant Community Development Director -Building Official, the Community Development Department (CDD) reviewed the job specification and seeks to revise the specification for this classification. The proposed revision is requested to bring the specification in line with the standards and language maintained among equivalent classifications, including those of Building Officials, identified among our survey cities. Additionally, the proposed revision would update the language of the specification to align with current verbiage used throughout the City’s classifications.

DISCUSSION
Currently, the s pecification of the Assistant Community Development Director-Building Official classification includes registration as an engineer (or architec t) as a licensing requirement at time of appointment. Additionally, an International Code Conference (ICC) certification as a Certified Building Official is required within one year of appointment , which is in accordance with current state requirements . However, it is not necessary for the Assistant Community Development Director -Building Official to be a registered engineer (or architect) in order to successfully per form the essential functions of this classification and given a recent review of comparable classifications within our survey cities, staff found that the majority of the classifications do not require registration as a n engineer. Therefore, the CDD seeks to revise the Assistant Community Development

MANAGEMENT

SERVICES

2 Director-Building Official specification, so that the City’s classification is more in line with municipalities the City competes with in the local government job market.

Staff is proposing to no longer include registration as an engineer (or architect) as a requirement, but rather list it on the specification as a desirable qualification. Staff would note that while desirable, as indicated, there is no impact to the CDD if the Assistant Community Development Director -Building Official is not registered as an engineer.

Additionally, maintaining the registration as an engineer influences recruitment efforts, and limits the pool of applicants . Conversely, by revising the language in the existing specification, Burbank would be on a more equal footing when it comes to recruit ment (and retention). Should the specification be revised as requested, in future recruitment s the pool of applicants would be expected to be larger, therefore more competitive, and more advantageous to the City, and the CDD.

Lastly, the proposed revision also includes updating the specification to reflect modern terminology and contemporary phrasing used in the City’s classifications.

The classification of Assistant Community Development Director -Building Official would continue to be an u nrepresented mid-management (“Z” Group) classification, exempt from Civil Service, exempt from the Fair Labor Standards Act (FLSA) under the administrative exemption, and included in the City’s Conflict of Interest Code. The CDD Director concurs with the recommendation.

FISCAL IMPACT
The proposed revision of the Assistant Community Development Director-Building Official specification does not include a change in the classification’s salary. Therefore, there is no fiscal impact associated with the adoption of the resolution revising this specification.

CONCLUSION
The revision to the specification of the classification of Assistant Community Development Director-Building Official will align the specification’s language with the content and criteria found in the classifications of Building Officials and other equivalent classifications identified in the survey cities with whom we compete with for employees, thereby having a positive (and important) impact on the City’s recruitment endeavors. It is therefore vital to meeting the needs and goals of the CDD. Therefore, staff recommends the City Council adopt the resolution attached to this report.
