November 2, 2021 Council Presentation
Summary
Staff notified Council of the following :

Property that is being used or is planned to be used pursuant to a written plan adopted by the City is exempt from the Surplus Land Act (SLA).

Council Indicated that:

1. Prefers that future tenants under City leases provide services that benefit the residents of Burbank.

2. Any future tenant’s monthly rent should at a minimum cover the ongoing maintenance costs and possible long-term
improvements of the leased property.

Option #1
• Offer the Property through a Request for Proposal
(RFP) for lease to a non-profit partner that provides a City use
• Property would not be subject to the statutory SLA
process
• Staff would pursue a non-profit partner through an RFP • Selection process and lease negotiations to be
approved by Council
Option #2
• Property is not required for a City-use
• SLA process will apply
• Staff will have to offer the Property for affordable housing, open space and school use first, before entering into
negotiations with a new tenant.
• Good faith negotiations will be conducted for 90 days with any interested party who responds
• If an agreement cannot be reached during those 90-days, the City could then proceed to secure a tenant for an
alternate use of the Property.

Recommendation – Option #1
• Issue an RFP that includes proposed use &
displaying financial ability to pay for a portion
of the renovations, the routine maintenance
costs, and possible long-term improvements
• Staff will come back to Council with a
recommended user and financial options
• Lease the property to a non-profit that
provides City services
