SUBJECT: Review of the Fiscal Year 2022-23 Budget Related to the Police Department Deputy Chief Assignment

RECOMMENDATION
Approve the Police Department’s submitted requests for the proposed Fiscal Year 2022- 23 budget.

BACKGROUND
During the April 26 and May 3, 2022, City Council meeting discussion s on the C ity’s proposed Fiscal Year 2022- 23 budget, Council Member Frutos requested a report regarding the budgetary impact related to the assignment of a Deputy Chief within the Police Department.

DISCUSSION
The Police Department ’s authorized sworn command staff consists of one Police Chief and four Police Captain positions. The position of Deputy Chief is a specialty assignment and not a classification or permanent budgeted position. Upon assignment as Deputy Chief, any Police Captain serving in this capacity receives a 12% differential pay of their base salary. The Department’s current command structure does not include an assigned Deputy Chief and there is no vacant Deputy Chief position. All four authorized and budgeted Police Captain positions are filled with Police Captains serving as command respectively for each of the following divisions: Administrative Services, Investigation, Patrol, and Support Services.

POLICE

DEPARTMENT
2 The Department last had a Police Captain serving as Deputy Chief in July 2021; there has not been a n assignment of a Deputy Chief since that time. As part of the City’s budgeting process for salaries and benefits, a point in time review of all positions is conducted. This review evaluates each employee’s current salary, differential pay, and eligible salary increase over the next year to determine the position’s budget for the next Fiscal Year . There was not a Police Captain serving as Deputy Chief (no one was receiving the associated differential pay) when salary evaluations were completed for the Fiscal Year 2022-23 budget. Therefore, differential pay for a Deputy Chief assignment is not included in the Police Department’s proposed Fiscal Year 2022-23 budget.

The salary for the Police Captain position previously assigned as Deputy Chief has been adjusted for Fiscal Year 2022- 23 based on a Police Captain’s salary and eligible salary increase and does not include Deputy Chief differential pay . The salary offset from the prior assignment of a Police Captain as Deputy Chief was realized during Fiscal Year 2021-22; this offset does not carry over to the Fiscal Year 2022-23 budget.

The Department is not budgeted for Deputy Chief differential pay in any of the Department’s four Police Captain positions for next Fiscal Year , therefore there are no salary savings within the proposed budget related to the current non-assignment of a Deputy Chief. I f a Deputy Chief is assigned during Fiscal Year 2022- 23, the 12% differential pay will increase the salary over the budgeted amount for a Police Captain position. This salary increase over the authorized budget for the position would be offset by salaries from vacant positions within the Department.

FISCAL IMPACT
There is no differential pay for a Deputy Chief assignment and no salary offset from the prior Deputy Chief assignment included in the Fiscal Year 2022- 23 budget. The budget for each Police Captain position has been adjusted based on current staffing assignments without inclusion of Deputy Chief differential pay.

CONCLUSION
There is no funding in the Police Department’s proposed Fiscal Year 2022- 23 budget associated with differential pay or salary offset related to the assignment of a Deputy Chief. Staff recommends that Council approve the Department’s submitted requests for the proposed Fiscal Year 2022-23 budget.
