Why Are We Here?
• In September 2021 the Governor signed Senate Bill 9 (SB 9) California Housing Opportunity and More Efficiency (HOME) Act into law – California Government Code Sections 66452.6, 6852.21, and 66411.7
• On April 5, 2022, City Council adopted an interim urgency ordinance establishing interim objective development, design, and subdivision standards regulating SB 9 projects.
• Interim Urgency Ordinance is set to expire on Friday, May 20, 2022. • Cal. Govt. Code Sec. 65858(a) allows the City Council to extend the interim urgency ordinance for an additional 10 months and 15 days by a 4/5
th vote.

• Upper-Story Stepbacks when a Second Story is Permitted – As established in the underlying zone. Second stories shall be stepped back a minimum of 15-feet from the property line.
• Development Standards For The R -1-H Zone - Consistent with the purpose of the R-1-H zone and to ensure that Two Unit Housing Developments do not adversely impact public safety and equine/horse keeping uses located in the R-1-H zone, all the provisions and development standards of the underlying zone must be met (BMC 10-1-605):

Proposed Amendments to Adopted Urgency Ordinance:
o Setbacks for Openings
o Standards for Non-Commercial Stables/Corrals
o Restrictions on Keeping Horses
Next Steps:
• At the meeting of April 5th 2022, City Council asked staff to explore additional standards that could be added to mitigate the impacts of SB 9 projects:
o Additional development standards, specifically standards that can be applied to SB 9 projects in R-1-H zone;
o Deed restricted affordable units;
o Enforcement procedures and/or fines for violating owner-occupancy affidavits.
• Staff is currently analyzing all these items, plus additional standards, and will bring back possible solutions during the Zone TextAmendment (ZTA). • The requested 10 month and 15-day extension will provide the time necessary to further study potential objective standards. If approved, the ZTA process would have to be completed by April 4, 2023.

Conclusion
• Pursuant to Gov. Code Sec. 65858(a), the City Council can extend the adopted interim urgency ordinance for an additional 10 months and 15 days, which would expire on April 4, 2023. • Staff is requesting the extension with amendments to the development standards in the interim urgency ordinance. • The time is extension is warranted in order to further study and create additional objective development regulations sought by the City Council to preserve and protect the City’s single family residential neighborhoods while complying with State law.
