SUBJECT: Approval of National Museum of The United States Air Force Community Static Display Loan Program 2022 Loan Agreement, for Continued Display of an F-104D Starfighter Aircraft at George Izay Park
RECOMMENDATION
Approve the National Museum of The United States Air Force (NMUSAF) Community Static Display Loan Program 2022 Loan Agreement (Attachment 1), for continued Display of an F-104D Starfighter Aircraft at George Izay Park.
BACKGROUND
On March 27, 1984, the City of Burbank (City) executed a Conditional Deed of Gift to accept a conditional donation from the U.S. Government of an F-104D Starfighter Aircraft, serial number 57-1334 (Aircraft), now displayed at George Izay Park on Olive Avenue. In December 2002, the U.S. Government contacted the City and requested that the terms and conditions of the City’s possession of the Aircraft be converted from a conditional donation to an indefinite loan. As a result, beginning on January 1, 2003, and continuing each year thereafter, the City has entered into one-year loan agreements with the U.S.
Government, represented by NMUSAF, for the continued possession and display of the Aircraft on an “as is, where is” basis.
DISCUSSION
The terms of the Conditional Deed of Gift and subsequent annual Loan Agreements require the City to annually provide the U.S. Government with photographs depicting the Aircraft display, complete an inventory report ( Attachment 2), provide a point of contac t information sheet (Attachment 3), and proof of insurance to cover any irreparable damage or theft that may occur to the Aircraft.
This year, NMUSAF revised the 2022 Loan Agreement from an annual renewal to a biennial renewal for the next term. Followi ng the biennial loan renewal, the subsequent term will be for five years from 2024 to 2029 and will continue to remain a five-year term,

2 renewing the 4th and 9th year of each decade. The purpose of this revision is to decrease the workload for borrowing organizations.
Additionally, the Loan Agreement has been updated to reflect the governing organizational change from the United States Air Force to the Department of Air Force.
FISCAL IMPACT
There is no fiscal impact associated with executing the 2022 Loan Agreement. However, under the terms of the Loan Agreement, the City is required to maintain the Aircraft in good condition, including maintenance and infrequent painting of the Aircraft. A Capital Improvement Project request was submitted for the Fiscal Year 2022-2023 Budget in the amount of $15,000 to perform an assessment of the overall condition of the Aircraft. If at anytime the City decides to terminate the Loan Agreement, the City is responsible to bear all expenses associated with moving, reclaiming, and/or demilitarizing the Aircraft.
CONCLUSION
Staff recommends that the Council approve the NMUSAF Static Display Loan Program 2022 Loan Agreement, SDA0029, for the continued display of the F-104D Starfighter Aircraft at George Izay Park.
