A RESOLUTION OF THE COUNCIL OF THE CITY OF
BURBANK APPROVING AND ADOPTING CONTRACT
DOCUMENTS, PLANS AND SPECIFICATIONS, AND
DETERMINING THE LOWEST RESPONSIVE AND
RESPONSIBLE BIDDER, ACCEPTING THE BID, AND
AUTHORIZING EXECUTION OF A CONTRACT FOR
LANDFILL GAS COLLECTION AND CONTROL SYSTEM
EXPANSION 2021 TO BSE GENERAL ENGINEERING,
INC. FOR BID SCHEDULE NO. 1484.
THE COUNCIL OF THE CITY OF BURBANK FINDS:
A. Pursuant to notice provided according to law, bids for Bid Schedule No. 1484, the Landfill Gas Collection and Control System Expansion 2021 (the “GCCS Contract”) have been received, publicly opened, declared, and evaluated.
B. The City Manager reports that the lowest responsive and responsible bid for the improvement was received from BSE Engineering Services, Inc., that the bid is as set forth below, and recommends that the bid be accepted.
C. The Plans and Specifications for the GCCS Contract are on file at the Public Works Department and the City Council Office. The City Council has reviewed and considered the Plans and Specifications for the GCCS Contract, and approves the Specifications.
THE COUNCIL OF THE CITY OF BURBANK RESOLVES:
1. The Contract Documents consisting of all the documents within Bid Schedule No. 1484, including but not limited to the Notice Inviting Bids, Instructions to Bidders, Bidder's Proposal, Bidder's Performance and Payment Bonds, Agreement, Special Provisions, and Plans and Specifications for Bid Schedule No. 1484, the GCCS Contract, all of which Contract Documents are on file in the Public Works Department and City Council Office, are approved and adopted as the “Contract Documents” for Bid Schedule No. 1484, with such non-substantive changes as may be approved by the City Attorney. Reference is made to these Contract Documents for further particulars.
2. The lowest responsive and responsible bidder for the GCCS Contract in accordance with Bid Schedule No. 1484 is BSE Engineering Services Inc., whose address is 26132 Old Highway 80, Descanso, CA 91916, and whose total price bid of $382,674.79 is set forth in the Bidder's Proposal on file in the Purchasing Division. This bid is accepted, and the City Manager or his designee is authorized to reject all other bids once the lowest responsive and responsible bidder has executed and forwarded all the necessary Contract Documents to the City.

2 3. The City Council has reviewed and considered the Plans and Specifications for the GCCS Contract, Bid Schedule No. 1484, and approves the Specifications. The Public Works Director, or their designee, is authorized to approve any changes to the Specifications.
4. The City Council exercises its independent judgment and finds that the approval of this GCCS Contract is categorically exempt from the California Environmental Quality Act (CEQA), pursuant to the State CEQA Guidelines Sections 15301(b) and (f), because the approval involves the expansion of existing landfill gas control and collection systems of a public landfill, and address es safety and health protection related to gas emissions from the Landfill,
5. The total GCCS Contract budget for Bid Schedule No. 1484 shall be $894,656.40, which includes a 10% contingency in the amount of $81,332.40.
6. The City Manager or his designee is authorized to execute all necessary Contract Documents under Price Agreement No. 2227 and future change orders (if any) up to the amount budgeted for the work under Price Agreement No. 2227, with such non-substantive changes as may be approved by the City Attorney and the City Clerk is authorized to attest.
