A RESOLUTION OF THE COUNCIL OF THE CITY OF
BURBANK APPROVING AND ADOPTING CONTRACT
DOCUMENTS, AND SPECIFICATIONS, AND
DETERMINING THE LOWEST RESPONSIVE AND
RESPONSIBLE BIDDER, ACCEPTING THE BID, AND
AUTHORIZING EXECUTION OF A MULTI -YEAR
CONTRACT FOR CITYWIDE LANDSCAPE
MAINTENANCE TO PARKWOOD LANDSCAPE
MAINTENANCE, INC. FOR PRICE AGREEMENT N O.
2227.
THE COUNCIL OF THE CITY OF BURBANK FINDS:
A. Pursuant to notice provided according to law, bids for Price Agreement No. 2227, the Citywide Landscape Maintenance Contract (the “Citywide Maintenance Contract”) have been received, publicly opened, declared, and evaluated.
B. The City Manager reports that the lowest responsive and responsible bid for the improvement was received from Parkwood Landscape Maintenance, Inc., that the bid is as set forth below, and recommends that the bid be accepted.
C. The Specifications for the Citywide Maintenance Contract are on file at the Public Works Department and the City Council Office. The City Council has reviewed and considered the Specifications for the Citywide Maintenance Contract, and approves the Specifications.
THE COUNCIL OF THE CITY OF BURBANK RESOLVES:
1. The Contract Documents consisting of all the documents within Price Agreement No. 2227, including but not limited to the Notice Inviting Bids, Instructions to Bidders, Bidder's Proposal, Bidder's Performance and Payment Bonds, Agreement, Special Provisions, and Specifications for Price Agreement No. 2227, the Citywide Maintenance Contract, all of which Contract Documents are on file in the Public Works Department and City Council Office, are approved and adopted as the “Contract Documents” for Price Agreement No. 2227, with such non-substantive changes as may be approved by the City Attorney. Reference is made to these Contract Documents for further particulars.
2. The lowest responsive and responsible bidder for the Sidewalk Repair Project in accordance with Price Agreement No. 2227 is Parkwood Landscape Maintenance Inc., whose address is 16443 Hart Street, Van Nuys, CA 91406, and whose total price bid of $813,324.00 is set forth in the Bidder's Proposal on file in the Purchasing Division.
This bid is accepted, and the City Manager or his designee is authorized to reject all ATTACHMENT 1
2 other bids once the lowest responsive and responsible bidder has executed and forwarded all the necessary Contract Documents to the City.
3. The City Council has reviewed and considered the Specifications for the Citywide Maintenance Contract, Price Agreement No. 2227, and approves the Specifications. The Public Works Director, or their designee, is authorized to approve any changes to the Specifications.
4. This Citywide Maintenance Contract is categorically exempt from the California Environmental Quality Act (CEQA), pursuant to Section 15301(c) of the State CEQA Guidelines.
5. The total Citywide Maintenance Contract budget for Price Agreement No. 2227 shall be $894,656.40, which includes a 10% contingency in the amount of $81,332.40.
6. The City Manager or his designee is authorized to execute all necessary Contract Documents under Price Agreement No. 2227 and future change orders (if any) up to the amount budgeted for the work under Price Agreement No. 2227, with such non-substantive changes as may be approved by the City Attorney and the City Clerk is authorized to attest.
