Section 17.9 Amendments. This Agreement may be modified or amended only by a written instrument signed by the Parties.

Unless otherwise approved by the Owner, Contractor’s insurance shall be written by insurers authorized to do business in the State of California and with a minimum “Best's” Insurance Guide rating of “A-.” Self-insurance will not be considered to comply with these insurance specifications.

In the event any policy of insurance required under this Agreement does not comply with these requirements or is canceled and not replaced, the Owner has the right but not the duty to obtain the insurance it deems necessary, and any premium paid by the Owner will be promptly reimbursed by the Contractor.

Such insurance shall not limit or qualify the liabilities and obligations of the Contractor assumed under the contract. The Owner shall not by reason of its inclusion under these policies incur liability to the insurance carrier for payment of premium for these policies.

Failure to maintain and provide acceptable evidence of the required insurance for the required period of coverage shall constitute a breach of contract, upon which the Owner may immediately terminate or suspend the agreement.

Contractor shall be responsible for all Subcontractors’ compliance with the insurance requirements.
