Dear Burbank City Council,
My name is Linda Rosoff and I am a Burbank citizen. This email is on behalf of myself, Eric Rosoff and Isabella Rosoff, all registered voters in Burbank. We strongly urge each and everyone of you to vote in favor of the URGENCY ORDINANCE OF THE COUNCIL OF THE CITY

OF BURBANK IMPOSING A MORATORIUM ON THE ESTABLISHMENT OF NEW RETAIL USES SELLING FIREARMS OR AMMUNITION at the July 26, 2022 city council meeting. I am out of town otherwise my family would be there to speak in support of the urgency ordinance.

Our zoning code regarding permits for retail selling firearms and ammunition needs to be changed ASAP. I believe this is the first step in making common sense changes that protect our community.

Sincerely,
Linda Rosoff

Dear Burbank City Council:

I oppose any and all new regulations limiting my access to legal firearms including opposing limits on the number of FFLS operating in Burbank and needless local laws that offend my Second Amendment rights. Please do not pass any such ordinances.

I've lived in Burbank for almost 50 years and you all have done a number on our City and it's enough! It is not Constitutional to take away our 2nd Amendment rights as well as the fact that we have the legal right to defend ourselves against thieves that get their firearms illegally! Do not pass this - enough of the destruction of our City and its people! Thank you,
Stacy Magness

CAUTION: This email originated from outside of the organization. Do not click links or open attachments unless you recognize the sender and know the content is safe.

Dear Burbank City Councilmembers,
I have been a resident of Burbank for eleven years, and have three daughters in the Burbank school district. Two of my daughters are at Luther Middle School after finishing Roosevelt Elementary, and one is still at Roosevelt Elementary.

I urge you to immediately take up legislation to make Burbank a shining example of how to address the risks of gun violence and mass shootings. I am not, however, referring to an endless debate about gun control and individuals' right to bear arms. Nor am I writing about the narrow issue of the proximity of Gun World to Roosevelt Elementary.

Now is the time for you to make the courageous decision to eliminate gun stores from the city of Burbank. There is no reason why Burbank needs to be such a central provider of weaponry. This action would not infringe upon any individual's rights. If someone needs to buy a gun, there are certainly plenty of other resources. Burbank does not need to remain as having one of the highest number gun stores per capita that it is today.

The majority of Americans across the country want gun control. That is an issue that I believe needs to be handled at a national level.

You, however, have the ability to enact legislation that is decisive and the right thing to do:
ban gun stores from our city's limits.

I do not want to see our schools turned into high-security prisons. I do not want to see more money going to "good guys with guns" and more armed officers patrolling our schools. I want less guns—period.

Now is the time to act. I urge you to lessen the footprint violent weapons have in our city.

Sincerely,
David (eep) Hauser

Hi Council,
I was pleased there was robust discussion of reducing/ limiting/ outlawing gun stores in Burbank at the last city council meeting. This is a priority issue in keeping our children safe and should be scheduled for further discussion before Aug 9th.

I personally think Burbank needs to create a plan that ultimately outlaws gun stores in our community. With a rise in mass shootings, gun suicide, etc, lives depend on this. We can't ignore this issue or expect shootings won't happen here.

They happen everywhere. It's an epidemic.

Thanks,
Stephanie

Hello Nick,
I'm sorry I missed your call.

For years I served on the Mayor's Youth Task Force and during that time we were able to lay the groundwork for Family Service Agency therapists on every school campus. I also served on the School Board's Safety Committee, where we reviewed
each school's safety plan annually. So I know first hand that the well-being of our children is always a concern to the people who
have been entrusted with their safety.

I have talked with friends and neighbors about the gun store issue. As I count down the days until retirement, I have decided to trust that the
parents with school age children, who have more energy and more at stake than I do, will do the heavy lifting.

I hope the city council will succeed in approving the actions you have listed, although I hope a permanent limit rather than a temporary
moratorium will be placed on gun store permits - regardless of the proximity to schools. 1 am less hopeful about the Congress coming to an agreement...

Thank you for your work on this important issue and more.

Dear Nick,
I appreciate your response; I believe we are on the same page regarding guns.

If there is anything that you feel citizens can do to convince the council to implement the options you have highlighted, let's talk.

I can be reached @ in the evenings or weekends, however, I won't be answering my phone during the January 6 hearings.

Good evening Roe,
Thank you for the message. I sincerely apologize for the delay in getting back to you! By now I'm sure that you've read my comments elsewhere regarding the prevalence of gun stores in our community. As you may know, the City Council unanimously voted in February 2022 to explore the various issues related to the high concentration of gun stores in our community. We have a "gun violence epidemic" in our country and, in my humble opinion, what we really need is a national response. It's counterintuitive to have strict gun control laws in California, but to have relatively relaxed laws in neighboring states like Nevada. Regrettably, I don't foresee Congress acting on this urgent issue any time soon. So, it's up to state and local governments to do more!
I believe that local action could take many forms including, but not necessarily limited * A moratorium on the issuance of new gun store permits * Implementing "buffer zones" that would essentially prohibit gun stores from operating within a certain distance from schools & other areas
* Imposing a "cap" establishing a maximum number of gun stores that can operate within our community
* Requiring locally administered inspections of our gun stores to ensure their compliance with state and federal law
* Establishing an excise tax on gun store sales that could be reinvested into our community
In my view, all of these options (and many more) are "on the table." City staff is busy collecting data and working on a comprehensive report to advise the City Council of 2 potential options for our consideration. My understanding is that this report will come back no later than August 9, 2022.

There is much more information that I can share with you, but it would probably be easiest to continue the conversation over a phone call. Please let me know if you're interested. In the meantime, please know that I hear the community loud and clear. We will do more, and we will take action. Thank you for your patience. Stay safe and be well!

Dear Mayor and City Council Members,
I was stunned last week when I noticed for the first time, the large Gun World store on Magnolia and Screenland.

Today a friend shared with me that there are now 14 gun stores in Burbank. I was shocked!
That is far too many for a city this size.

Will a petition enable the city to limit the number of gun stores? If so, how many signatures do you need?
Please advise.

Thank you,

Hi City Council Members,
I live and work in Burbank and have been concerned about the proliferation of gun stores in our city for about eight years. I asked Burbank residents on Nextdoor this week whether they believe the City Council should try to limit the number of gun stores in the city and it appears that two thirds would like you to do something. Note, I also own a consumer research company so I could run a large scientifically rigorous survey if the City would like to commission one but the Nextdoor survey has 181 completes so it's likely broadly reflective of our resident's views.

Hi,
I am writing on behalf of my fellow Burbank residents/friends/parents to ask for your support on the moratorium on new gun stores. I am aware you will be voting on this at your meeting on July 26 and think it's important to consider all the children and schools in the area.

While I have you, I also ask for your support on the following issues:
-a city excise tax on guns and ammunition
-creating a buffer zone around schools
-setting a limit on the number of stores in the city
Thanks for your time,

Good afternoon Burbank city Council Members,
I'm writing to urge you to vote in favor of the gun store moratorium as the city looks at the number of gun stores within the Burbank city limits. This is a logical first step as the council works on longer term solutions. To me as a mom of two and a Burbank homeowner, reduction of gun stores would make Burbank more pleasant to walk around, and an even better city to call home. I appreciate your work towards keeping gun stores away from our schools and children.

Good afternoon Burbank city Council Members,
I'm a Burbank homeowner and father of 2 daughters in the Burbank schools, so the reduction of gun stores would foster safer schools/parks/playgrounds, make Burbank more pleasant to walk around, and create an even better city to call home. What's your vision for this city? A city that will thrive with community events with a bustling tourism corridor, or a city that is a haven for guns leading to violent crimes. These stores are an eye sore. Your choice. Our children are depending on it. Please Vote in favor of the gun store moratorium as Burbank city limits has an inordinate number of gun stores.

Esteemed Council members -
I have seen that the city is working on limiting the number of Firearms Dealers in the City. While I can understand why someone would want to limit firearms sales, I do not think it is the job of the city to limit the number of resellers. I myself do not understand some people's obsession with gun-ownership, but market forces should be the controlling factor. If the market can financially support the stores, so be it.

Hello council,
I will not be able to attend on Tuesday night for this extremely important meeting. However, I wanted to write to share that | 100% support the staff recommendation of approving an emergency ordinance to halt the issuance of new gun retailer permits.

As the staff notes: "a moratorium is necessary to prevent irreversible issuance of permits, business licenses, and developments that could have a detrimental effect on the health, safety and welfare of the community." | 100% agree with this assessment, as does the community.

Today I spoke with a resident who lives on Screenland, and the entire neighborhood is frightened, upset, and baffled by the appearance of this giant GUN WORLD sign, with some folks literally living feet away from this business.

Please vote YES on this ordinance, and make sure no more gun retailers are added to the city while the council fully considers its long term solutions and options.

Mayor Talamantes, Vice Mayor Anthony, and Members of the City Council, I am a Burbank resident and just wanted to write to express my support for the firearm retailer urgency ordinance that's going to be discussed at Council's upcoming meeting on Tuesday. I strongly believe that the Burbank municipal code should be revised to separate firearm retailers from general retailers, but since it will take time to make that change, this ordinance sounds like a great way to prevent new gun stores from opening up in the meantime.

As a concerned community member and a soon-to-be parent, I urge you all to enact the proposed emergency ordinance.

Burbank is a wonderful city with only a handful of gun stores in all of Los Angeles county, putting restrictions on these not only violate our constitutional rights but also place is a burden for those wishing to purchase ammunition and firearms.

Placing restrictions will only hurt law biting citizens to exercise their Second Amendment right. Allowing these stores to operate in the city of Burbank will not only help the economy but also enable citizens the right to exercise their Second Amendment. Thank you Sent from my iPhone

Burbank City Council,
Please do not restrict our ability to shop at our local neighborhood gun stores. People who shop at these Burbank gun stores here are all sane, sober, moral, prudent people who are all law-abiding citizens. We have a right to own our weapons based on the 2nd Amendment and restricting gun stores in our city violates that right.

Do not listen to these protestors that only want crime to increase, support criminals, and at the same time restrict and eventually remove our right to own guns. There are more customers in these gun stores than there are protestors. Guns make us safer, the facts prove that.

Please do not give in to their demands. They do not want safety. They want everyone unarmed while criminals continue to own guns and cause more crime in our city.

Do what is right and follow the constitution. Remember, shall not be infringed...

Eff.: ORDINANCE NO.

AN URGENCY ORDINANCE OF THE COUNCIL OF THE CITY OF

BURBANK IMPOSING A MORATORIUM ON THE ESTABLISHMENT OF
NEW RETAIL USES SELLING FIREARMS OR AMMUNITION.

City Attorney's Synopsis
This urgency ordinance imposes a temporary moratorium on the establishment of new retail uses selling firearm or ammunitions.

THE CITY COUNCIL OF THE CITY OF BURBANK FINDS, DETERMINES AND DECLARES THAT:

A. Governments at all levels have a substantial interest in protecting the people from those who acquire guns lawfully or illegally and then use them to commit crimes resulting in injury or death of their victims, or who use them in the commission of other crimes such as robbery, sexual assault or homicide, particularly mass shootings such as those that have occurred since 2017 in Chicago, Illinois; Thousand Oaks, California; Pittsburgh, Pennsylvania; Perryman, Maryland; Bakersfield, California; Cincinnati, Ohio; Annapolis, Maryland; Santa Fe, Texas; Nashville, Tennessee; Parkland, Florida; Melcroft, Pennsylvania; Rancho Tehama, California; Sutherland Springs, Texas; Boulder, Colorado; Edgewood, Maryland; Las Vegas, Nevada; El Paso, Texas; Buffalo, New York; Uvalde, Texas, as well as the many other mass shootings over the past several years.

B. Fourteen (14) retail establishments that are licensed to sell firearms and ammunition currently operate in the City of Burbank, while neighboring cities of Glendale, Pasadena and Los Angeles have Ten (10), Three (3), Thirty-Six (36), respectively, making Burbank the City with the most retailers of firearms and ammunition per capita than any of these nearby municipalities at a rate of 1 firearm retail store per every 7,386 residents.

C. Under the City's current zoning regulations retail firearm stores are allowed by-right in all commercial zones that allow general retail uses.

D. Many of the commercial zones where existing and future retail firearm stores are located are adjacent to residential neighborhoods and other uses that include amongst other things, schools, child day care facilities, places of public assembly including places of worship, public parks and libraries.

E. The City is authorized by Article XI, Section 7 of the California Constitution to make and enforce all local, police, and other ordinances and regulations not in conflict with general laws.

F. The City Council finds and declares that it has questions and concerns about the proliferation of this type of land use in the City, adjacent to residential neighborhoods and in proximity to schools, child day care facilities and places of public assembly and seeks to analyze the current regulations and alternative regulations and administrative procedures to ensure the future locations of retail establishments that sell firearms and ATTACHMENT 1-1
ammunitions do not detrimentally impact the health, safety and welfare of residential neighborhoods and other, specific uses.

G. The City Council finds that it is necessary for the City staff to study, develop, and propose for review by the Planning Board and adoption by the City Council regulations within a reasonable time regarding the establishment of a separate land use for the retail sales of firearms and ammunition and additional land use regulations for the use in the City of Burbank.

H. The City Council finds that given the potential deleterious effect an otherwise lawful but unregulated business selling ammunition or firearms can have on other incompatible neighboring uses, passage of this interim urgency ordinance will provide City staff sufficient time to research this issue and present a comprehensive zoning proposal to help ensure that the establishment of a retail sales use engaged in the sale of firearms or ammunition within the City will not be located as to be detrimental to the public health, safety and welfare.

I. The City Council finds that other California cities have adopted zoning ordinances and business regulations that govern the sales of ammunition and firearms, and several municipalities, have adopted moratoria on an urgency basis prohibiting new commercial sales of ammunition or firearms while such ordinances or regulations are studied and considered.

J. In the absence of a moratorium, there is no way to study and consider the appropriate location of retail establishments that sell firearms in the City, and the nature and extent of health and safety regulations that could be imposed on such businesses due to the nature of the products they sell in relation to neighboring uses, thus impairing the City's substantial interests in economically sustainable development, health, public safety, vitality, and image of the City.

K. The City Council has determined that the adoption of this ordinance is categorically exempt from CEQA pursuant to Section 15061 (b)(3).

THE COUNCIL OF THE CITY OF BURBANK DOES ORDAIN AS FOLLOWS:

All the findings set forth above are true and correct and are incorporated herein as if restated in their entirety.

2. The City of Burbank Municipal Code does not include adequate regulations concerning the land use or licensing requirements for the retail sale of firearms and ammunition, but instead considers these uses with other general retail uses.

3. Maintaining the status quo zoning regulations has the potential to result in the further proliferation of new retail uses that sell firearms or ammunition without the proper analysis of any potential impacts to public health, safety, and welfare. By studying and analyzing our local land use regulations for the retail sale of firearms and ammunition during the moratorium, the City will be able to best tailor future regulations to the needs of our community in order to protect public health, safety, and welfare.

ATTACHMENT 1-2

4. The current regulations, have the potential to result in new gun or ammunition retail stores that can displace other neighborhood serving retail and service commercial uses from tenant spaces and therefore create a threat to critical commercial corridors and the City's effort to preserve aesthetically inviting storefronts and pedestrian- friendly retail, restaurants and offices in such spaces, which have historically been the lifeblood of the community and a beacon to visitors where we allow new firearm and ammunition retail sale without regulation or consideration for their location.

5. In Suter v. City of Lafayette, 57 Cal. App. 4th 1109 (1997), the California Court of Appeal held that State law authorizes local governments to impose additional licensing requirements on firearms and ammunition dealers.

6. This moratorium is necessary to prevent irreversible issuance of permits, business licenses, and developments that could have a detrimental effect on the health, safety and welfare of the community. Without it, the potential exists that establishment of new commercial operations engaged in the retail sale of firearms or ammunition within the City without addressing appropriate regulation could result in incompatibility of land uses and adverse impacts on residents, businesses and neighborhoods that present a current and immediate threat to the public health, safety, and welfare.

The City Council finds it is necessary to adopt this Urgency Ordinance pursuant to Government Code 65858 with the interim development controls as follows:

A. MORATORIUM
The City Council does hereby, pursuant to Government Code Section 65858, impose a moratorium for forty-five (45) days prohibiting the establishment of new retail businesses selling firearms or ammunition.

B. DEFINITIONS
For purposes of this urgency ordinance the terms below are defined as follows:
"Firearm" shall mean any pistol, revolver, rifle, shotgun or other device, designed to be used as a weapon, from which a projectile is expelled through a barrel by the force of an explosion or other form of combustion, or any device which is capable of being altered so as to expel a projectile in such manner. "Ammunition" shall mean any projectile designed to be expelled through the barrel of a firearm by the force of an explosion or other form of combustion. "Firearm or Ammunition Sales" shall mean the retail sale of firearms or ammunition by a firearms dealer, whether it is the principal sales item or incidental to the overall sales. This use includes firearms dealers that transfer and lease any firearms or related products.

C. ENVIRONMENTAL ANALYSIS
This urgency ordinance is exempt from review under the California Environmental Quality Act (CEQA), pursuant to Sections 15061(b)(3). The activity is covered by ATTACHMENT 1-3
the commonsense exemption that CEQA applies only to projects, which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.

Therefore, it is the City's determination that this ordinance will not have a significant effect on the environment and is not subject to CEQA.

D. PENDING APPLICATIONS
As to applications for permits for a new retail use selling firearms and or ammunitions stores in the City, which have been accepted as complete, processing and review of such applications may continue, but shall not be finally approved during the pendency of this Ordinance or any extensions thereof.

8. This urgency ordinance shall be introduced, passed and adopted at one and the same meeting and shall become effective immediately upon the adoption thereof, and shall expire and be of no further force and effect after forty-five (45) days from the date of its adoption, unless further extended on or before this forty-fifth (45th) day.

If any section, subsection, sentence, clause, phrase, or word of this Ordinance is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed and adopted this Ordinance, and each and all provisions hereof, irrespective of the fact that one or more provisions may be declared invalid.

ATTACHMENT 1-4

10. The City Clerk shall certify to the passage of this Ordinance and cause this Ordinance to be published, within fourteen days of the adoption hereof, once in a newspaper of general circulation, published and circulated in the City of Burbank, California.

PASSED AND ADOPTED this _day of _ 2022.

Dear City Council Members,
As many members of the Burbank community have come together to bring this glaring issue to the City Council, there are too many gun stores in our town. As the data shows, we have the 2nd highest amount of gun stores per capita, in the entire United States.

Yet Burbank continues to allow gun stores to open and operate in a town that has virtually no hunting and as the country continues to reel from each mass shooting, that is seemingly never ending because of the gun lobby. If having more guns was safer, America would be the safest country in the entire world.

The City of Burbank Municipal Code does not include adequate regulations concerning the land use or licensing requirements for the retail sale of firearms and ammunition, but instead considers these uses with other general retail uses.

Hello,
Please start treating local gun stores with respect and understand how hard it is for them to keep the gun store running. These are the same people who will defend you when cops will not be able to make it in time. These people have families and need to survive using this business. Owning a firearm for our safety is our amendment and we have ever right to own a firearm in the United States of America. It's very disappointing to see local gun stores get harassed like this. Please do better..

Happy Friday to Everyone:

Diese ming get the each stores ation serious taking previously shooting but also the collateral damage to a community when it has been through that traumatic event.

So it's no surprise I'm urging each and every one of you to address the proposed ordinance in the most serious of manners. Gun safety to protect our children, to protect everyone who works in our school districts, to protect everyone in our community should be our first priority. Burbank is often teased or referred to as being just like Andy Griffith's "Mayberry" Seeing lines _around guns/ammo stores during the pandemic lockdown was a wake-up call to me and my tamily that Burbank near that reference. If we do not address this particular pandemic of citizens feeling the need to arm themselves with assault weapons, their only purpose being to hunt human beings not animals, it's not a matter of if it will happen here, it's a matter of when.

In a perfect world, we'd have galleries, fish/tackle, sports stores in place of these retail gun stores. It's not a perfect world so I'd settle ror putting stricter regulations on guns/ammo retail stores, and stricter requlations on when and how they're allowec to open up here in Burbank. 14 1s 13 too many tor our population. I can't imagine the tax revenue is so areat from these stores that we can't afford to reaulate them.

Please consider thiș ordinance carefully, please take it seriously. Please think about the families you represent. Families who choose to live in Burbank because they feel it is a safe place to raise their children.

Please do not limit our gun stores. We have very few here in southern california as is and just because you may not like something realistically in this world you have to learn to coexist with the people who do. On your website it lists that there were 277 homicides by guns in 2020. The number of stabbing homicides was 234, but no one is trying to restrict access to kitchen knives even though the amount of killings is almost the same. Have a heart. your local california resident

Hi,
This is in regards to the upcoming meeting about the gun stores in the Burbank area. I wanted to write in to request you please consider how essential these businesses are and that it is entirely legal for them to be operating. It would be wrong to restrict it in any way. I've had an opportunity to meet many of the owners there for sporting purposes and they are providing a valuable service to the community in a lawful and decent manner. Please recognize their value as solid businesses contributing to Burbank and the surrounding areas. As someone who votes very much Democrat most of my life for most issues it would be remiss to take their presence as negative, in fact quite the opposite for sporting and Thank you,

Members of the City Council,
I read with some interest about the gun store debate in the city of Burbank.

I am far from a person who favors no restrictions on gun ownership but, guns aside, l am dubious of virtually any position that is supported by progressive politicians or groups like Blue Values Burbank. This has little to do with politics.

Any observer of objective reality would find it difficult to square policies like defunding the police or acceptance of rampant homelessness with the concept of "progress". In many cases, as a matter of fact, progressive politics almost dictates an Orwellian emphasis on words and concepts meaning their exact opposite.

And that begs the question, why are gun stores so popular in places like Burbank? A discerning viewpoint might say that a climate which favors the criminal over law enforcement (and almost by definition the law abiding citizen) and which acquiesces to the homeless encampment (to the detriment of an ordered society) is the soil upon which the explosion of gun sales thrives. Remedy that climate and I suspect that many gun stores would have the market share of a VHS repair shop.

I am not a citizen of Burbank so perhaps one could argue that this is not my fight but I think this debate is emblematic of the negative trends which led to the loss of a congressional seat for the first time in California's history. If we learned anything over the last several years, it's that politicians succumbing to mob hysteria is just not a good look. 1 Michael Sheldon

Hello, Burbank City Council
I'm writing in protest about the new restrictive city ordinance that the city wants to put in place for law abiding gun stores in the city of Burbank. This is absolutely unfair and unjust for Gun stores in Burbank. These businesses are not breaking any laws. This shouldn't even be an issue for the city council when there are several other critical issues happening within the city that need to be dealt with that are actually illegal. I.E. (vehicles like BMW's and Mercedes speeding down Glenoaks Blvd that have actually killed innocent people . I don't see BPD being dispatched to firearms stores everyday to deal with any gun related problems . The city is discriminating against Law abiding business's that provide much need tax revenue for the city to pay its bills. This is just more small government over reach on LEGAL firearm dealers and they have no right to do so. I can't remember the last time someone bought a gun in a Burbank gun store and started shooting as soon as they walked out of the store. GUNS STORES ARE NOT THE PROBLEM.

Dear Mayor Talamantes and Cit Council Members,
Thank you very much for your work exploring the urgency ordinance establishing a moratorium on the issuance of new licenses for firearms dealers.

I fully support the staff recommendation that the City Council adopt the ordinance.

I respectfully make 3 additional requests:
* I request that the City Council adopt an ordinance prohibiting the purchase or sale of parts of firearms that lack serial numbers and enabling prosecution, to the full extent of the law, for violators, as soon as possible. https://myburbank.com/burbank-man-arrested-with-large-cache-of-ghost-guns-at-residence/ * I request that the City Council request audit results from the ATF, through Public Disclosure Request, for all firearms dealers/retailers in Burbank. Similarly, I request that the City Council request inspection outcomes for all firearms dealers/retailers in Burbank from the California Department of Justice through the Public Records Act. I support the City Council adopting its own Burbank firearms retailer audit and inspection program as well, regardless of the cost. * I request that the City Council and staff also study ordinances regarding signage and murals for firearms dealers/retailers. For example, is there a sign larger or more prominent for any business on Magnolia Blvd. than the sign for the new location of Gun World?
I respectfully ask the following questions:
* What is required to make the urgency ordinance permanent, and what is the potential timeline? * How do we make sure such an ordinance is enforced? (We have zoning laws about the amount of liquor licenses that can be issued, and yet it wasn't until Whole Foods applied for a liquor license that I learned that Burbank has granted licenses that exceed what is supposed to be allotted throughout the city, sometimes with the help of CUPs.) * How many additional firearms license requests are pending and in progress? How many will be permitted despite the urgency ordinance?
It is disappointing that 6 firearms licenses have been issued in Burbank since 2017. Current Council Members who have served for many years and city staff who have worked here for many years, have long known that firearms retailers are allowed by-right in all commercial zones that allow general retail uses. Yet there doesn't seem to have been any initiative to address the increase in requests for licenses until residents applied more pressure. Firearms retailers certainly knew that the zoning here was as permissive as it gets in LA County. Still, I am hopeful and encouraged by the recent work on this ordinance.

Thank you and kind regards,

What do they want in place of these gun stores? Marijuana dispenseries, liquor stores, another Walmart? Blue value wants change and us to be progressive, but change for the sake of change is usually a bad idea. They wont move to Hollywood or Pacoima where their ultra liberal ideas are appreciated, instead they want to drag Burbank down with them. Before I retired, I was a proud civil servant for Burbank, and I like this motto. Dear Burbank City Council Members
I am a long time resident of Burbank • since 1982), although currently ! reside and work in Japan. I would like to comment on the staff report related to the propose moratorium on firearms retailers. As the report is in large part a statistical analysis, by way of credentials 1 am a research statistician, currently Chief of the Department of Statistics at Radiation Effects Research Foundation, Hiroshima, Japan.

In reviewing the staff report, I think it is a reasonably thorough and balanced analysis of calls for service and other endpoints related to crime in Burbank. I think the analysis presented supports the conclusions of the report's authors. Some key findings and conclusions are the following:
(1) Re CFS (p 7, first paragraph). "However, the number of these incidents at firearms dealers is comparable to other retail locations in the City, such as Hobby Lobby L or 7-Eleven D. Furthermore, the number of retail crime
incidents at firearms dealers was significantly less compared to overall retail crime in Burbank, even adjusting for large retailers that experience or have experienced a high rate of retail crime such as Costco, Target, Walmart, and Fry's Electronics" (2) Re PROXIMITY (p7, last paragraph). "However, these categories of crime may not be unique to areas surrounding firearms dealers as a comparative analysis for the same timeframe indicates that they also constitute top categories of proximity crime at other retail locations in the City. Consequently, the prevalence of these crimes in the vicinity of firearms dealers may reflect citywide trends.
(3) CONCLUSION (p13). "While a review of available data does not indicate that firearms dealers/retailers create an inordinate demand for public safety services ..." Please note that the stated objective of the analysis presented in this staff report was (page 4): "Per City Council's direction ... staff completed an analysis of crime data to determine whether firearms dealers have an inordinate impact on crime rates in the City of Burbank." The conclusion of the report is that there is no evidence that the number of firearms dealers in Burbank adversely impacts crime rates in Burbank.
1 An additional concern raised by staff, which was outside of the scope of the original stated intent, is that an hypothetical proliferation of firearms dealers in Burbank may cause Burbank to become a "go to" for firearms, and also that their store fronts may not be so attractive. I think similar objections could be raised for other legal businesses in Burbank.

For example, I count at least 20 liquor stores in Burbank, and I think a similar number of massage parlors, and these are similarly located in Burbank, and one could object to their cosmetic appearance and concentration in Burbank. There is also a large number of fast- food establishments, and one could object to their presence on the grounds of cosmetics and concentration.

Based on this report, there does not appear to be a rationale to restrict legal firearms dealers in Burbank for reasons of crime reduction. For the reason of business concentration and cosmetics there should not be any urgency in singling out this one legal business for moratorium. If business concentration and cosmetics is a concern in Burbank, a through and deliberate evaluation of all legal businesses in Burbank where such concerns could be regal busines in Burnal for his ben imposeems warranted before a moratorium on any new Sincerely

Re: Proposed Moratorium on The Establishment Of New Retail Uses Selling Firearms Or Ammunition-OPPOSITION
To the Honorable Members of the Burbank City Council,
We write to you on behalf of the hundreds of thousands of members in California, including those members residing in the City of Burbank.

The California Rifle and Pistol Association oppose the adoption of any proposed moratorium on firearm retailers. For the following reasons, we ask the City Council reject adopting a moratorium, and instead consider alternative programs that will better achieve the City's goals of promoting the public health, safety, and welfare of City residents.

I. FIREARM RETAILERS ARE ALREADY ONE OF THE MOST HEAVILY REGULATED

BUSINESSES IN THE NATION
To better aid the City Council in making an informed decision —and to dispel the varying and often ill-informed opinions on the subject—we would like to take this opportunity to explain the numerous and comprehensive steps that must be taken to lawfully open and continue operating a firearm retail business in California.

As a threshold matter, the State of California imposes specific restrictions on the sale and transfer of firearms applicable to both retailers and prospective purchasers in addition to federal requirements.('! Other than specific local licenses and restrictions, a lawful firearm business must possess and maintain all of the following at all times:
• A valid Federal Firearms License ("FFL");
A valid Seller's Permit issued by the State Board of Equalization; • A valid Certificate of Eligibility ("COE") issued by the Department of Justice ("DOJ"); • A listing on the DOJ Centralized List of Firearms Dealers. 12] a. Federal Firearms License Requirement
In order to be eligible for a Federal Firearms License, the applicant must:
• Be at least 21 years of age;
• Not be prohibited from shipping, transporting, receiving, or possessing firearms or ammunition;
Ill The majority of these restrictions can be found in Penal Code sections 26500 through 28490, as well as the applicable regulations from the California Department of Justice regarding these sections. See Cal. Code Regs., tit. 11, 88 4001-5499.
[2) Cal. Penal Code § 26700.
• Not have willfully violated the Federal Gun Control Act or its regulations; • Not have willfully failed to disclose material information or made false statements on the application for a Federal Firearms License;
• Have a premises for conducting business;
• If the applicant is to be a licensed dealer, certify that the secure gun storage or safety devices will be available at any place in which the firearms are sold; and, • Certify that (1) the business is not prohibited by State or local law, (2) within 30 days the business will comply with the requirements of State and local law applicable to conduct the business, (3) the business will not be conducted under the license until the requirements of State and local law applicable to the business have been met, and (4) the applicant has sent or delivered a form to the chief law enforcement officer where the premises is located notifying the officer that the applicant intends to apply for a license (18 U.S.C. § 923(d)(1); 27 C.F.R. § 478.47(b).)
a. Seller's Permit Requirement
Any person engaged in business in California who intends to sell or lease tangible personal property that would ordinarily be subject to sales tax must obtain a Seller's Permit. To apply for this permit, applicants must provide specific personal information, including their social security number, date of birth, Driver's License number, and additional information specific to the business itself. (See California Department of Tax and Fee Administration, Your California Seller's Permit: Your Rights and Responsibilities Under the Sales and Use Tax Law, https://www.cdtfa.ca.gov/formspubs/pub73.pdf (Oct. 2017).

Permit holders are required to report and pay sales and use taxes, keep adequate records, and notify the California Department of Tax and Fee Administration of any change in address, ownership, partners, sale or purchase of a business, or the dissolution of a business. b. Certificate of Eligibility Requirement
In order to obtain the required COE, applicants must have their fingerprints taken by a certified Live Scan operator and submit an application along with a $93 fee ($17 FBl fingerprint processing fee, $54 DOJ fingerprint processing fee, $22 COE application fee) to DOJ. DOJ will then examine its records and any records available in the National Instant Criminal Background Check System in order to determine if the applicant is prohibited by state or federal law from possessing, receiving, owning, or purchasing a firearm. (Cal. Penal Code § 26710(b).) After reviewing all available records, DOJ will only issue a COE to a person if DOJ determines that the applicant is not a person who is prohibited by state or federal law from possessing firearms. (Cal. Penal Code § 26710(c).)
c. Centralized List of Firearms Dealers Requirement
DOJ also maintains a list of all California licensed firearms dealers it refers to as the Centralized List of Firearms Dealers ("CLFD"). In order to be listed on the CLFD, individuals are required to submit an application to DOJ which includes information regarding the business such as the planned hours of operation, as well as the required Federal Firearms License, Certificate of Eligibility, any required local license, and Seller's Permit.

At any time, DOJ is authorized to remove a business from the CLFD for grossly negligent violations of any of the provisions regarding the sale or transfer of firearms listed in Penal Code section 16575, or if the required Federal Firearms License has expired or been revoked for any reason (Cal. Penal Code § 26715(b)(1-2).)
Once removed from the CLFD, DOJ will notify local law enforcement and licensing authorities in the jurisdiction where the business is located. (Cal. Penal code § 26715(b)(3).) IL. ADDITIONAL REQUIREMENTS APPLICABLE TO CALIFORNIA FIREARM DEALERS The rules and restrictions applicable to firearm dealers do not end once all necessary license requirements have been met. California licensed firearm dealers must safely secure their inventory when not open for business, always follow specific rules and restrictions when transferring firearms, maintain adequate records of any firearm transaction, and be subject to routine audits from both the Bureau of Alcohol, Tobacco, Firearms and Explosives ('ATF") and the California Department of Justice, Bureau of Firearms ('BOF") to ensure compliance with all federal, state, and local laws.
a. Firearm Storage
At any time when a California licensed firearms dealer is not open for business, all firearm inventory must be stored in the licensed location and secured using one of the following methods:
• Store the firearm in a secure facility that is part of, or that constitutes, the licensee's business premises;
• Secure the firearm with a hardened steel rod or cable of at least one-eighth inch in diameter through the trigger guard of the firearm which is secured with a hardened steel lock that has a shackle that is protected or shielded from the use of a boltcutter and anchored in a manner that prevents removal of the firearm from the premises; or, Store the firearm in a locked fireproof safe or vault in the licensee's business premises. (Cal.

Penal Code § 26890.)
As used in the above requirements, the term "secure facility" is defined as a building that meets all of the following specifications:
• All perimeter doorways shall meet one of the following:
• A windowless steel security door equipped with both a dead bolt and doorknob lock;
• A windowed metal door that is equipped with both a dead bolt and doorknob lock, and if the window has an opening of five inches or more in any direction, the window shall be covered with steel bars of at least one-half inch diameter or metal grating of at least nine gauge affixed to the exterior or interior of the door; or, • A metal grate that is padlocked and affixed to the licensee's premises independent of the door and doorframe.
• All windows are covered with steel bars;
• HVAC and other service openings are secured with steel bars, metal grating, or an alarm system;
• Any metal grates have spaces no larger than six inches in any direction; • Any metal screens have spaces no larger than three inches in any direction; and, • All steel bars shall be no further than six inches apart. b. Restrictions on the Sale or Transfer of Firearms
In order to lawfully sell or transfer a firearm to an individual, all of the following requirements-at a minimum-must be satisfied:
• The purchaser must provide proof of identity and age; • The purchaser must complete Federal Form 4473;
• The dealer must complete a Dealer's Record of Sales ("DROS"') Form; • The purchaser must pass a background check;
• The firearm must be registered to the person at the time of purchase; • The purchaser must wait 10-days prior to the delivery of the firearm; • The purchaser must receive the required locking device and warnings; • The purchaser must satisfy California's Firearm Safety Certificate ("FS'") requirement; • The purchaser must perform a safe handling demonstration; and • The dealer must deliver the firearm unloaded and securely wrapped or in a locked case.

But these are the only restrictions regarding the sale or transfer of firearms in California which are generally applicable to dealers and prospective purchasers. As one of the most heavily restricted states regarding the ownership and possession of firearms, California generally prohibits the sale or transfer of certain firearms and firearm related equipment, with the mere possession of such items subject to felony convictions. These include:
• Flechette Dart ammunition or bullets containing or carrying an explosive agent 3], • "Assault Weapons" (4]
[31 Cal. Penal Code §§ 30210-30290.

14. Cal. Penal Code §§ 30500-31115. The term "assault weapon" is defined a number of ways under California law, including firearms specifically listed by make and model as an "assault weapon," certain firearms with specific characteristics and features, certain firearms with a fixed magazine capable of holding more than ten rounds, and rifles with an overall length of less than 30 inches. Cal. Penal Code §§ 30510-30515. Possession of any of these firearms by a dealer • .50 BMG Rifles(5);
• Magazines capable of holding more than 10-rounds;
• Machineguns(7]
• Multiburst trigger activators(8)
• Short-barreled rifles and shotguns!?
• Silencers 1°); and,
• Zip guns.!!!]
c. Recordkeeping and Inspection Requirements
California licensed firearm dealers are also subject to numerous recordkeeping requirements for the purposes of ensuring their compliance with all applicable federal, state, and local firearm laws. In connection with these requirements, ATF routinely conducts inspections of FFLs who must produce records (in a permanently bound book kept on premises) to ensure FFLs comply with the Gun Control Act of 1968 prevent the diversion of firearms from lawful commerce to the illegal market, ensure successful tracing of firearms, and to protect the public. BOF also conducts routine audits of California licensed firearms dealers separate from ATF inspections. The purpose of such on-site inspections is to determine compliance with California firearm laws, including firearm transfer requirements, record keeping requirements, and facility requirements. (12)
All California licensed firearm dealers must ensure that the agent conducting the inspection has "reasonable access to all firearms transaction records, the firearms inventory, security features, and all areas within the business premises to which the DOJ representative may need access to conduct the inspection." What's more, upon request by the agent, a California licensed firearms dealer must make available all dealer licenses and permits, locate firearms that are in the 10- day waiting period, clarify or explain any illegible, unclear, or conflicting entries in any records, requires a special permit which is generally only issued for sole the purpose of sales or transfers to law enforcement.

III. A MORATORIUM ON FIREARM RETAILERS WILL NOT PROTECT-AND MAY EVEN BE DETRIMENTAL TO—THE PUBLIC HEALTH, SAFETY OR WELFARE
State law permits local jurisdictions to adopt interim ordinances such as a moratorium prohibiting a use that is in conflict with a general plan, specific plan, or zoning proposal that the city plans to study within a reasonable time. Such ordinances, however, may only be adopted following a four-fifths vote of the City Council, and must contain a finding that there is a current and immediate threat to the public health, safety, or welfare. But a moratorium on firearm retailers for the city will not serve to protect the public health, safety, or welfare of Burbank residents. In fact, it could be said that such a moratorium will actually be detrimental to those interests for a number of reasons.

For one, California law generally requires all firearm sales or transfers to be processed by a California licensed firearms dealer, 1131 As shown above, California licensed dealers are subjected to numerous and comprehensive restrictions relating to the sale or transfer of such firearms. California licensed firearm dealers, who are subjected to routine audits by ATF and DOJ, must ensure that all firearm transactions are processed in accordance with California law.

What's more, California licensed firearm dealers can provide residents with information regarding California's numerous and complex firearm laws. They can serve as a key source of information for residents regarding the skills, knowledge, and attitude necessary for the safe handling, storage, and use of firearms, and provide information on how prospective and current firearm owners can seek out additional training opportunities that exceed California's requirements for the purchase of a firearm. As a result, enacting a moratorium is detrimental to the City's purported goals of public health, safety, and welfare of residents. [13] Cal. Penal Code § 27545.

Subject: Gun Shop Moratorium and Zoning meeting: Resident impact letter CAUTION: This email originated from outside of the organization. Do not click links or open attachments unless you recognize the sender and know the content is safe.

Dear Burbank City Council and other Parties;
I am writing as a 12-year Burbank homeowner. Our property is directly adjacent to Burbank Ammo and Guns. Since this business opened 7 years ago, the quality of life in this neighborhood has decreased dramatically. Our lives have been negatively impacted, and specifically during the pandemic and civil unrest, made nearly intolerable by this business and it's deliveries, customers and staff.

Burbank must NOT PERMIT ANY MORE GUN SHOPS.

We strongly support not only a permanent moratorium on new gun shop licenses but we also must undo the 'Parcel Lot' designations and implement zoning changes, to allow and encourage the existing gun shops to MOVE AWAY from Magnolia Blvd to a part of Burbank where they would have parking and loading areas and could operate without impacting residential neighborhoods.

If then shop license count is simply capped then the existing licenses will become exponentially more valuable and the gun shops already here will grow even larger and negatively impact the community even more. We must acknowledge the reality that Burbank is now known worldwide for our multiple gun ghops, and that having so many of them just steps away from normal family businesses and homes, in an area never designed for so much traffic, is NOT WORKING for anyone.

Here is a list of our concerns.

The gun shop has 1- yes ONE parking spot. This has turned our quiet suburban street into a de facto parking lot for the gun shop. Multiple gun shop emloyees park their cars on the street all day long, taking up all the resident parking for as long as 10-12 hours at times, sometimes storing cars here for weeks at a time. Gun shop customers constantly park on the side street all day and evening long. No exaggeration, on some days the traffic here has rivaled Porto's restaurant, with cars circling the block, honking and yelling at each other and speeding through the alleyways looking for parking.

Illegal U turns in resident's driveways are the norm. I have witnessed 2 fender benders due to people turning around in the middle of the street. I work from home and take particular notice of what happens here on N Griffith Park Drive, I have been waiting for the City to catch up with the reality that the seeming lack of ANY zoning or requirements for these businesses is a disaster for Burbank and needs to be remedied immediately for the sake of our community and our I have personally witnessed these incidents and many more over the last 7 years. • People clearly visible sitting in their vehicles loading weapons while street parked in front of my home, as neighbors kids walk by
• Gun shop customers showing off weapons and purchases to each other in car trunks, carrying open ammunition boxes, cash sales of guns between individuals taking place on the street • Straight piped exhaust cars and motorcycles, large lifted pickups idling in front of resident homes, loud radios, horns blaring
• Constant illegal parking blocking driveways, taking up multiple spaces, parking lifted pickups on the parkway, illegal u turns and accidents
• Trash, lit cigarettes thrown from cars onto lawns and in the gutter, parkway, alleys as customers walk from the Gun shop to their vehicles parked on our street
• Gun shop customers (carrying the store's black bags and ammo boxes) urinating in public in the alley and the street in front of my home
• Alley is posted NO STOPPING yet Semi-trucks unloading illegally in the alley multiple times a day, semis unloading in front of my home, semi trucks idling 6 feet from my kitchen window. I measured. • Customers blocking the alley trying to load boxes of ammunition from the rear of the business • Gun shop employees on sidewalks carrying multiple boxes of ammunition, guns in cases and boxes, on carts.

Residents made to cross the street to pass safely
• Gun shop trash and 'dumpster' container overflowing with trash in the alley (Jason Dolbier of Solid waste has been incredibly helpful in making this stop)
• On trash collection day, gun shop customers moving full city trash cans so they can park, moving cans onto sidewalk and parkway and not returning them, leaving full trash cans uncollected and sitting on sidewalks all day • Large groups of camo and tactical clothing wearing people crowded around the gun shop entrance, blocking Magnolia Blvd
• Gun shop having 'cookouts' for large groups of people on the weekends, yelling • Gun shop has built an added 'room' in their back parking area out of chain link fencing, employees working outside at tables out there.
• Shipping containers with direct street/alley access and no fencing used to store weapons? ammo? Tannerite? Without any seeming fire / security protection
Our home does not have a street facing driveway. Our driveway access is in the alley, directly across from the gun shop rear. We have been drawn into shouting confrontations with the (armed) store owner over blocking our driveway when we try to leave or enter, gun shop employees and customers have verbally harassed me, I have been in fear of my safety from armed, angry people since this business opened. This kind of nonsense is what we moved to Burbank to GET AWAY FROM!
Mr. Frutos and Lt. Pfrommer have been incredibly helpful and responsive, and constantly spend time and attention to personally intervene and help our situation. They can attest to the amount of incidents created by this store and it's owner and the cost of city resources and time expended. Their volume of business is simply too much for their small storefront.

The store rents storage space in neighboring businesses, they apparently store inventory of ammunition and guns in shipping containers 16 feet from my property, without any seeming fire control or inspection or security beyond padlocks. What's in those containers? Are they full of Tannerite or live ammo? Is there going to be an explosion some day? Will first responders and residents be in danger if there is an incident? We deserve answers and protection from the City.

The store's product (guns/ammunition) is basically TONS of metal every week, going through a small, nail salon-sized storefront. The road, sidewalk and alley around them are completely torn up from large trucks delivering pallets of heavy guns/ammo. Pallet jacks are dragged across sidewalks. People constantly walk down the street with open boxes of ammo. delivery trucks making noise and blocking traffic. Residents and children forced to cross busy Magnolia Bld to avoid crowds of people swarming in front of the store.
2 We implore the Council and all parties to:
• immediately implement the 45-day moratorium on new gun shop licenses in the city of Burbank • enact a permanent moratorium on new licenses
• immediately begin a study of how to change the 'parcel lot' zoning and conditional use permit regulations so that these businesses can move to appropriate locations, industrial or commercial zones where the existing gun shop businesses can thrive and be successful, and the community can be spared their significant negative impact. • communicate with residents regarding fire /safety requirements and compliance related to ammo /firearm inventory storage
• implement special City initiated permit parking zones around these businesses to mitigate their impact on residents and keep commercial traffic on Magnolia Blvd and out of our neighborhoods I will close by noting that after YEARS of effort by Lt. Pfrommer, the gun shop owner lately lately been behaving professionally, and for the last couple of weeks they have kept the large trucks on Magnolia where they belong and not in the alley where they are prohibited. However, going by YEARS of past experience, this will only last a short while, their explosion in business is cyclical and all it takes is one news story and people will panic-buy guns again, and the problems will begin all over again.

Gun shops are too volatile and just carry too much baggage to be in a family neighborhood and should never be located adjacent to people's homes.

Thank you for your time-

I am opposed to spending my/our taxpayer money for buy backs.

Firearms are not the problem, the people who use them improperly are and I support all legal enforcement of existing laws.

There is no reason to create more restrictions for buying, selling, owning firearms.

Please vote NO on any of the proposed actions.

Hello there,
I'm writing to you as a mother of a soon to be first grader at BUSD/a homeowner here in Burbank. I want to make it clear l am in favor of the council voting yes on an urgency ordinance that would prohibit the establishment of new retail businesses selling firearms or ammunition while the City Council studies and implements these possible regulatory frameworks.

Please, choose our children over gun violence. We do NOT need more gun stores here. And please be aware of the extreme groups currently trying to stir things up on Nextdoor and twitter, trying to turn this into a second amendment issue. They are not indicative of the voices of parents living here in Burbank, and many of those extremists are also using fake accounts to email/stoke tension.

• Tax-payer funded firearm buybacks that are sure to cause taxes to go up. • Restrictions on access to firearms by limiting the number of legal sales in Burbank. • Additional local rules and regulations that are not supported by the latest Bruen Supreme Court ruling.

Dear Burbank City Council, I am opposed to you interfering with the right for law abiding citizens to shop at local gun stores in your city of Burbank. We as 2nd Amendment supporters have the right to shop in these stores. There are rules that are followed when purchases are being made at these stores to keep things safe. Not only are these stores following the rules they also bring a large amount of tax dollars to your city. You are in an office that you are representing the people and that also means you protect and honor our Amendments and rights. So please remember why you are in office and who you are representing and oppose anything that would make doing business harder on these stores.

With all due respect even though I now question if it's even deserved, what are you people thinking????? It is not okay to ban new gun stores from opening up,
Even worse not renew current license holders for gun stores, not only do the owners make a living from their stores, but also serve the community greater than you city council do.

Stop going after law abiding citizens that own firearms, try enforcing more laws and higher punishment to the criminals that are committing crimes and carrying illegal weapons.

This is really scary for us, you are trying to take away our freedom, our local gun stores keep us safe in our own homes this is complete nonsense stop going after the stores and go after some criminals! Don't do it! It will only get worse if you choose to do such a horrible thing.

I repeat, DO NOT TAKE AWAY OUR LOCAL FIREARM STORES. People are breaking into homes, following people home, everyone should have the right to have a firearm in their own home and have a store to go to in their home city, stop this anti gun nonsense before it's too late and things only get worse! CAUTION: This email originated from outside of the organization. Do not click links or open attachments unless you recognize the sender and know the content is safe.

Hello Jess, Konstantine, Bob, Sharon and Nick - elected members of the Burbank City Council, I am of the understanding that you will receive a report on possible regulatory frameworks for firearm retailers in Burbank at tomorrow's council meeting. And, that City staff will introduce an urgency ordinance that would prohibit the establishment of new retail businesses selling firearms or ammunition while the City Council studies and implements these possible regulatory frameworks.

I urge you to please vote YES on this moratorium. I agree that it is necessary to prevent irreversible issuance of permits, business licenses, and developments that could have a detrimental effect on the health, safety and welfare of our community.

This is especially important given Burbank's current elevated status of most retailers of firearms and ammunition per capita than our nearby municipalities of Glendale, Pasadena and Los Angeles.

I encourage you to vote yes on the moratorium to allow time to do the work that is needed to make a sound determination, and consider what else could we bring into these retail locations to bring life and business to Burbank.

Thank you for the work that you do.

Sincerely,

Good evening Burbank city council,
I oppose any and all new legislation limiting the amount of gun stores or any call or planned restrictions on renewals of existing licenses for legal firearm retailers. To do so would be in opposition of the outcome of NYSRPA V BRUEN in which it was found that all legislation regarding the 2nd amendment rights of the citizens to keep and bear arms can not be arbitrarily restricted unless passing a historical text and tradition standard as outlined. If Burbank city council were to enact any restriction on the rights of legal gun owners their ability to purchase firearms and ammunition it would no doubt be challenged in court and would be struck down due to the lack of merit as outlined in NYSRPA V BRUEN. This course would cost the city and tax payers money in a fruitless effort to infringe on 2nd ammendment rights. It is my hope that the city counsel Votes NO on these proposed regulations.

I thank you for taking the time to hear from this magnolia park resident.

Kind Regards,
Julian Jaramillo

CAUTION: This email originated from outside of the organization. Do not click links or open attachments unless you recognize the sender and know the content is safe.

Dear members of City Council,
I am deeply concerned about the number of gun stores in Burbank.

I'm concerned that the concentration of firearms stores in our small town may be attracting outsiders, participants those who are not law abiding citizens.

I recognize that the 2nd amendment exists. I have no issue with local residents who legally own firearms and properly secure them and have them locked up according to the law.

However, it seems excessive to have 14 stores in a 17 mile radius particularly when there are so many schools in walking distance to each store.

Our schools are not secure and this could attract a school shooting simply by proximity to the many stores that sell guns and ammunition.

I support anything you can do to ensure that our strict CA gun restrictions are followed and to protect our schools. Our high schools have no way to protect students. They cross a street mid day. The teachers have to lock doors from the outside. This is not acceptable.

Personally, I feel the need to share with you that such a high amount of gun stores per capita near my home causes an extreme amount of stress and anxiety because it's a constant reminder of the threat of gun violence.

A dear friend of mine almost lost her life when riding public transportation because a gun accidentally fired from inside someone's backpack.

I am a teacher. Every time there is a school shooting and I have to drive by a gun store I feel frustrated and confused about why so many of these stores are necessary as we live nowhere near access to hunting.

BPD has proven they can protect us properly without the need to individuals to have a plethora of firearms in their homes. It seems we have some citizens anxious to push the boundaries of the law and carry weapons wherever they go since there have been so many arrests of unsecured firearms in cars recently. This threatens the safety of all of us.

Please consider restructuring the zoning of these stores, ensure they been a good distance from schools and limit how many can be in our small town.

Sincerely,
Brittany McNamara

Hi all,
Just wanted to thank you all for considering a moratorium on new gun stores in Burbank at tomorrow's meeting. As a parent, small business owner, and homeowner in Burbank, it nakes me grateful that our city council would support kids' safety over gun retailers' profits.

It shouldn't be this much easier for gun retailers to set up shop in Burbank than it is a few streets away in North Hollywood—we need to stop being a haven for gun retailers and start living up to our reputation for having safe neighborhoods and public schools.

Thanks again,

To Whom It May Concern,
My name is Jessica Keith and I have been a resident of Burbank my entire life. I have been made aware of a proposed new law in Burbank that would ban new gun stores and stop renewing existing licenses for fire arms of law abiding citizens. I am writing this email to express to you how much in opposition I am to this proposed encroachment in my right to keep and bear arms.

Burbank is NOT the city I grew up in. It is becoming increasingly more dangerous for a single person, like myself, to feel safe and secure in the city.

This proposed legislation would only continue to take away our autonomy to feel safe and secure in our lives. As a Burbankian, I am ashamed we are even entertaining this absurd piece of biased legislation.

By even considering this ridiculous bill you are saying you don't respect the United States Constitution, which is the supreme law of the land. The Supreme Court of the United States has ruled in favor of gun owners and the 2nd Amendment every time. You're consideration of this law violates their ruling that the right to keep and bear arms SHALL NOT BE INFRINGED.

Don't cower. Protect our rights as Americans. Uphold the constitution. Defend the 2nd Amendment and DO NOT pass this legislation.

Dear Burbank City Council Members,
It is quite concerning the number of gun stores in this city. There are two within .5 mile of my house and a 3rd store less than 3/4 mile away- but more importantly quite a few are very close to our public schools.

Please pass any ordinances, taxes or laws that will help stop any new gun stores from opening in Burbank. Having so many visible gun stores only further reinforces a gun culture that only seeks to divide. Guns do not help our family feel safer, in fact walking past the stores make my kids feel anxious after so many shootings have come up in the news. If someone feels the need to have a gun to feel safer in their home, there are already plenty of stores open that they could purchase one from.

Thank you for your time and attention.

Dear Councilmembers,
1 am in favor of a moratorium on new firearms dealers in Burbank. I have been disappointed watching the number of gun dealers sprouting up in our community. It is obvious from the fact we have a greater concentration of firearms establishments in our city, there is a flaw in our business license structure which allows for this. Given the high amount of gun violence in our country, we can't continue on the path lead gun supplier to our county.

How are you all? I am writing again in regards to my heavy concerns with gun shops in what I thought was a "family friendly" city. I hope you will each do your part to get the urgency ordinance prohibiting the establishment of new retail businesses selling firearms or ammunition approved AS SOON AS POSSIBLE. This could not happen soon enough as it is unacceptable with the number of gun shops we have without regulation. We should have never had 14 gun shops in Burbank, and Burbank should NEVER be known as the 2nd largest gun retailer per capita in the nation. There is a reason why our neighboring cities have strict regulations against stores opening in their city, why haven't we??? Gun shops should not be near schools, community spaces, and family friendly neighborhoods.

Please make the right choice in finding impactful ways to keep our children, families, and community safe.

To Whom it May Concern:

I have lived in Burbank for 15 years and there is no place I'd rather live. I am constantly promoting the amazing aspects of the city to friends and colleagues around greater Los Angeles, touting Burbank as the ideal place to live.

However, there is one embarrassing thing about living in Burbank - that is the obscene number of firearms stores selling weapons of death in our wholesome city. I think the last straw for me was seeing a big disgusting GUN WORLD open up in beautiful Magnolia Park right across from an institution like Porto's.

I fully support the moratorium on establishing new firearms retailers that is being put up for hearing on 7/26. I hope it is the first in many steps of ridding Burbank of as many firearms stores as possible.

Thank you very much for considering my letter.

BURBANKERS' SECOND AMENDMENT

The City Council is considering a vote to limit the sale of legal firearms in Burbank and offend our Second

The City Council is considering:

number of legal sales in Burbank.

not supported by the latest Bruen Supreme Court

Dear Burbank City Council,
Thank you so much for discussing the gun issue on the agenda this evening. I grew up in Burbank, and just moved back here to raise my children. We happen to live blocks from the new gun superstore that just opened on Hollywood Way and Magnolia, which is shockingly close to our daughter's elementary school (Roosevelt Elementary).

Please consider pausing new gun store licenses until there has been an opportunity to study this issue. We have 14 gun stores in Burbank, and that's plenty for such a small community.

I support no new gun stores, as well as raising taxes on gun and ammunition sales, with funds going towards school mental healthy services.

Please help keep our community safe.

Thank you so much for your time and consideration.

Best,

CAUTION: This email originated from outside of the organization. Do not click links or open attachments unless you recognize the sender and know the content is safe.

Dear City Council Members,
I have been a Burbank resident and home owner for 20 years. The reason I moved to and love Burbank is because it feels like a small town and a safe/quiet place to raise a family. I was very disturbed when I drove down Magnolia Blvd and saw the massive super-store Gun World in my neighborhood in Magnolia Park. Not exactly a neighborhood friendly store. No one in my neighborhood was informed and we are all horrified about it. This makes us feel less safe and it lowers our property values. Then I found out that there are actually 14 gun stores in Burbank. With over 300 mass shootings in the United States so far this year, does Burbank want to be known as the place where it's easy to buy your guns in LA County? Please vote to limit the sale of legal firearms in Burbank. 14 stores for a population 103,411 is just wrong.

Concerned and scared Burbank resident and constituent.

Dear Burbank City Council,
I oppose any and all new regulations limiting my access to legal firearms including opposing limits on the number of FFLs operating in Burbank and needless local laws that offend my Second Amendment rights. Please do not pass any such ordinances.

These retailers are non contributors to gun crime and violence, already operating under the most stringent of regulations in the nation following California requirements for FFL's. Anyone not pushing a political agenda knows this.

My suggestion would be to go to one of these retailers yourself and see the requirements that go into purchasing a firearm.

The Supreme Court has already further strengthened the protections granted to the 2nd amendment in the most recent Bruen decision, the city may just be opening itself up to more litigation following through with such an irrational ordinance. I know you guys don't care because it's taxpayer money and not yours, but it still will tie up city resources.

Additionally I recall Konstantine Anthony citing his offensive behavior (directly to me) as protected under the 1st amendment, this man seems to pick and choose what rights guaranteed in the constitution matter to him based on his weekly agenda. I urge the rest of the council to consider the biases and logical fallacies often employed by the Vice Mayor when making their vote today.

Thank you again, I hope you all make the decision not to further burden those of us who abide by the law, and instead focus resources elsewhere.

Dear Council
I'm a little confused why you would have an item on gun stores before we've heard the report on gun stores? Seems this item is getting ahead of the report? Unless this is one in the same? I didn't realize the report would be framed as an AN UNCODIFIED URGENCY ORDINANCE. I though the report was slated for early August? It's going to be a busy nigh with this on the agenda why was it last? I'd bet 100% of callers will be about this item? Since it's a public hearing I presume there be an oral communication period before the item?

Dear City Council,
One of the reasons Im in Burbank is because I always felt it was a city that upheld the rights of its citizens better that other surrounding cities. This idea of trying to limit the sales of a perfectly legal item for any reason mystifies me. Let the market dictate what the people want, not some special interests groups that don't even reside in Burbank.

Are guns dangerous? Yes of course, when in the hands of people who shouldn't have them.

But so is alcohol. How many people are killed or injured each year by drunk drivers? Are you going to limit and reduce the number of liquor stores in Burbank? I am 100% against any type of discrimination towards firearms stores in Burbank.

Remember it's the individual pulling the trigger that is to blame, not the object.

Please vote no on this.

Dear City Council, and in particular, Vice Mayor Konstantine Anthony The Second Amendment is in the Constitution for a reason, specifically to guarantee that the government will respect the First Amendment.

By considering tax payer funded buybacks, restrictions on the number of legal gun sales, and any additional rules, you are weakening the First Amendment. In effect, you are proposing a solution in search of a problem. It is not law abiding gun owners that present any kind of a threat to civic safety. In fact, they help preserve it! Nothing you propose will do anything to reduce violence. Have you never heard of John Lott's book "More Guns, Less Crime?"
I stand in strong opposition to any of these proposed actions.

As a Burbank resident and teacher at La Canada High School | whole heartedly support every gun safety regulation that can be implemented. As the country gets collectively traumatized and then desensitized to the violence now so pervasive it feels insurmountable, we must take whatever steps possible to begin to turn the tide. We all know that guns are not intended to do anything other than kill, and that these extremist groups are not "well regulated militias." Thank you for the good work you do, and I hope you have measures in place to deal with the disrupters that will surely descend on the meeting tonight to create chaos, stoke fear and try to intimidate and menace. To the Burbank City Council,
Unfortunately, I cannot attend tonight's meeting in person. However, I wanted to let you know my strong opinion that I do not want any more gun shops in the City of Burbank. In fact, I would like to see a reduction.

I was stunned to discover a super-sized Gun World moving into my neighborhood with not so much as a sign out front to alert neighbors of what was moving in. Raising Cain's was months of debate over traffic, and yet a weapons shop, near a grade school, filled with ammunition (and a target for crime. It has been robbed before) opened with practically no notice or neighborhood review? This is, after all, the same gun shop that sold Elliot Rodgers, the Isla Vista mass shooter, at least one of his weapons of murder. What happens if the store is robbed again, or if there is a fire? Will all those rounds of ammunition blast through the neighborhood? Has my property value been downgraded because of proximity to this shop?
I love this city, but I really felt let down by the clandestine way Gun Wold was opened. I joined dozens of my neighbors protesting on opening day, most of whom were also caught unaware.

And then I was shocked to discover that Burbank has 14 gun sellers. The City of Los Angeles has 38... and that's a city of 4 million people! If the City will not permit cannabis shops because they are not in keeping with community satety standards, then I implore you to apply that same standard to these merchants of death and terror. These weapons shops do not reflect the character of Burbank.

I hope that you will not only put a moratorium forward on any new firearms retailers, but will also allow review for any renewals of business licenses.

Thank you,

Dear City Council Members,
We have lived in our home on the 1000 block of N. Screenland Dr. since 1989. We raised 3 kids in Burbank and have been proud "Burbankians" for nearly 40 years. Our kids got great educations at the Burbank schools and enjoyed many of the sports activities offered through Parks and Recs. We love our neighborhood. But nothing has been more upsetting to us than to see Burbank recently become the "gun capital" of So. Cal. To see all the stores and restaurants shut down during the pandemic, yet lines down the block at the Magnolia gun stores was very disturbing. And now, to have a giant Gun World open on our block, kitty corner from Garri Dance, and just a few blocks from Roosevelt Elementary School, is devastating. To unfortunately and repeatedly hear the terrible news of mass shooting in schools and elsewhere and yet more and more guns are being sold in Burbank and just down the block from where we live. We are already seeing people park on our block and carrying guns to their cars and trucks Enough is enough, Burbank has always stood for decency, neighborliness, community. Please don't let us be known as the place for gun stores. Enough is enough.

Please, NO MORE GUN STORES IN BURBANK.
sincerely,
Frank Sinton

Dear Burbank City Council (BCC)
The people of Burbank are outraged and we demand BCC to kill a proposed ordinance placing moratorium on new firearm retailers because this this an egregious violation of 2nd Amendment that would not survive judicial review with a 6-3 Supreme Court (SCOTUS) majority after the landmark Bruen ruling. Like most unconstitutional gun laws, this ordinance has no historical analogue or tradition since California become a state in 1850 but is billed as protecting public safety despite ZERO evidence that such a moratorium will have any impact on crime. Gun rights are infringed because gun stores are where we go to buy, trade, sell, network, service, practice, and get info and training to be responsible citizens because cops are not legally obligated to even defend us. We demand evidence linking location of gun stores to proliferation of crime because many of the most crime-ridden areas have few or no gun stores at all, since criminals don't buy guns legally or from stores. This is really stupid because we can now carry anywhere, and BCC has betrayed its residents by not ordering Burbank police to fight a growing crime wave.

Removing gun stores from the community not only does nothing to prevent crime, it removes a valuable resource for Burbank residents who must bear arms to protect themselves since cops are cowards and only show up when we're dead or shooter ran out of ammo. Gun retailers ensure that firearms are purchased and processed in accordance with California law, provide insight about gun laws, and serve as a key source of information for residents regarding skills, knowledge, and attitude necessary for safe handling, storage, and use of firearms.

Gun stores are part of our culture and is vital to our personal safety as well as public safety since armed citizens deter crime and actually help a defunded, vaxxed, or demoralized police, and we will vote out of office any enemy of the Constitution and gun grabber on BCC.

Dear Mayor Talamantes, Vice Mayor Anthony, and Councilmembers Schultz, Springer and Frutos, I am writing to urge you to vote for the urgency ordinance for the moratorium on new retail businesses selling guns and ammunition. The moratorium is only for 45 days and will give you on the City Council a chance to carefully review and study the report on possibly enacting regulations on gun retailers in Burbank. We already have 14 gun retailers and lead the nation with gun stores per capita.

Firearms retailers open stores in Burbank because other cities won't allow them. 45 days to pause new gun stores in order to examine the report is the least that can be done to help make Burbank a safer place for its citizens.

Subject: Comment (07/26/22): Urgency Ordinance Imposing Moratorium on New Firearms Retailers in Burbank
CAUTION: This email originated from outside of the organization. Do not click links or open attachments unless you recognize the sender and know the content is safe.

We are new residents in the City of Burbank, moving here recently from Washington, DC as retirees to be active grandparents with our daughter's three children and a husband employed at Warner Brothers producing family entertainment.

Our life experience in cities big and small all across America is family and community related.

So we commend the Burbank city council, city attorney, police chief and development director for the staff report and proposed adoption at today's public council meeting of the "URGENCY ORDINANCE" imposing a moratorium on new firearms retailers in the City of Burbank.

It was our son-in-law and daughter who showed us their great concern, the nearby huge empty warehouse building purchased by Gun World in their residential neighborhood for expansion of firearm and ammunition sales.

Indeed, the daily current gun violence events in communities across the country demands our city leaders respond with an urgent due diligence review to take innovative action to improve how Burbank engages on this issue.

Burbank should not be known as the go to city of firearms and ammunition retailers, but as a family community that offers support for safety and health to all who visit or reside here.

Earlier this month, we have valued much of what was locally discussed at a virtual town hall on gun violence prevention (July 07, 2022), sponsored by our California Assemblymember Laura Friedman and panelist Nick Shultz of the Burbank city council, plus Dr. Emily Weisburg, school board member of Burbank Unified.

The revelation by the city staff report citing Burbank having 14 licensed firearms dealers is alarming when you consider this data compared to Glendale, Pasadena and Los Angeles.

All the data assembled in the staff report dramatically informs the urgent need of a regulatory framework in our city now.

The action is needed going forward, but also should be done in collaboration with the other communities around us, including LA County and the State of California.

As family-experienced grandparents residing in Burbank, we applaud adoption of the "URGENCY ORDINANCE" today as an immediate, but first step toward preventing a gun violence incident here.

The staff report and URGENCY ORDINANCE should be announced to the news media, offering a helpline for residents to offer support.
1 The city council should produce a newsletter for wide distribution in the community of Burbank - schools, churches, social organizations, retail stores and social media.

None of us wants to experience a gun violence event as have many families all across America in states and local communities.

Some are now living with regret for not aggressively and decisively taking action to improve community safety to prevent gun violence.

Sincerely,
Gary and Elizabeth Ann Hubbard

Hello, my name is Vache Soghomonian, am a Burbank business owner and i stand against the new proposed ordinance to restrict new firearm retailers in Burbank.

The reason why Burbank has gun stores is because years ago Los Angeles City/Country adopted a similar ordinance, all that did was push retailers east into Burbank or west into Simi Valley. Retailers would have loved to open in other cities, away from competition and other stores
All this ordinance would due is push people into other cities. It is a short sighed fix to a "problem" that doesn't exist.

The study so far shows firearm retailers are .09% CFS in Burbank. That's shows that firearm retailers are not a nuisance and not a problem business. 1/10th of 1% with 34% of that belonging to big five.

This is not an ordinance for safety or betterment of Burbank This is an attack on firearms dealers due to people personal and political view of firearms.

Thank you

Hello, Mr. Mayor -
Thank you for your service to the city of Burbank. I urge you to reconsider putting a moratorium on Burbank gun stores. This is completely ridiculous and unnecessary. The city of Burbank has some of the lowest crime rates of any city around and we law-abiding citizens have the right to choose whether we want to have a gun in our homes. We have personally benefited from several gun stores in Burbank, who conduct their business as the state makes them and we have to go through rigorous background checks, gun safety testing, and a long waiting period. We feel safer knowing we are armed in our home and take gun safety very seriously. I urge any council member who has never owned a gun to start learning more about guns and gun safety and how rigorous the process is that these stores go through to abide by all the laws. Thank you for your time.

Good afternoon Janet,
Thank you for reaching out. I sincerely apologize for the delay in getting back to you! I've received dozens of emails on this important subject, and I am trying to respond as quickly as possible. My understanding is that the gun stores in our community are located on parcels of land that allow them to operate "by right" under the zoning code, which means that the store's approval is subject to a streamlined process (and not subject to discretionary review) so long as it complies with the zoning standards. Presumably, previous City Councils did not foresee any issues with allowing gun stores to operate in these locations. We are now left to revisit these decisions decades after the fact.

With that said, the City Council unanimously voted in February 2022 to explore the various issues related to the high concentration of gun stores in our community. As you know, we have a "gun violence epidemic" in Have stic gend onto laws in pimi, but to at aily ease as inge to ring satire to Nevada. Regrettably, I don't foresee Congress acting on this urgent issue any time soon. So, it's up to state and local governments to do more!
I believe that local action could take many forms including, but not necessarily limited to:
• Implementing "buffer zones" that would essentially prohibit gun stores from operating within a certain distance from schools & other areas
1 • Imposing a "cap" establishing a maximum number of gun stores that can operate within our community
• Establishing an excise tax on gun store sales that could be reinvested into our community With regards to your suggestion of an assault weapons ban, I believe that many of the weapons you are concerned about are already prohibited under California law. For example, Senate Bill 118, which took effect in 2021, broadened the definition of "assault weapons" to include semiautomatic centerfire firearms with certain features. However, I will speak with the City Attorney's Office about conducting further research into whether there are additional loopholes under California law that we could address with local ordinances.

In my view, all of these options are on the table. City staff is busy collecting data and working on a comprehensive report to advise the City Council of potential options for our consideration. Based upon the last estimate I received from city staff, I believe that this report will come back to the City Council by the end of Summer. There is much more information that I can share with you, but it would probably be easiest to continue the conversation over a phone call. Please let me know if you're interested.

In the meantime, please know that I hear the community loud and clear. We will do more and we will take action. Thank you for your patience. Stay safe and be well! Nick

Good afternoon Burbank Council Members. I believe it's time the City of Burbank takes a look at the number of gun stores we have within our city borders. According to some research, Burbank is the second highest city in the entire United States in numbers of gun stores per capita:
https://towardsdatascience.com/why-are-southern-californians-obsessed-with-guns-c80ae281f1e8 "Below, we have the top 25 cities ranked by their number of gun shops per capita. Amongst the top 15 cities, five are located in Southern California. In Burbank and El Cajon, we have one gun shop per 13,000 residents." (data is based on Yelp information)
Given all the mass shootings across the nation, I would like to see Burbank limit the number of gun stores we allow within city limits, in terms of both number of stores and square footage of stores. Additionally, I would like to see the city ban all sales of high capacity weapons, similar to the Federal Assault Weapons Ban that recently expired:
(https://en.wikipedia.org/wiki/Federal Assault Weapons Ban). The Federal Assault Weapons Ban was able to withstand many court challenges and may be a good place to start. 3 I implore you to research the topic of gun violence and how the City of Burbank can most effectively address the issue within our local borders, before our children become the next tragic statistic.

Thank you for your service!

City Council,
I wish to express my opposition of ANY limitation to gun gun registration in Burbank. Our family chose to live here in Burbank because of its autonomy from Los Angeles. Slowly our town has adopted LA's liberal policies and has deteriorated quickly. Not only were we compelled to take our children out of our school system (subpar education, controversial sexual education and indoctrination, high rate of self harming students and suicide) but homelessness, theft, and home invasions are now prolific in our once sleepy town. Our Constitution guarantees the right to defend ourselves from enemies both foreign and domestic. Please consider the unstable political and economic times we are living when considering any limitations to our liberties.

Dear Burbank City Council members,
I'm concerned and opposed the current moratorium on limiting the number of legal firearm retails in Burbank. I know that numerous laws are broken when an individual uses a firearm to commit murder and it is truly a tragedy. We already have so many laws on the books that should prevent this from happening but yet evil free will continues to happen. Mental health and the break down of the family unit seem more at the forefront than the number of legal firearms stores in Burbank. These stores sell firearms legally to persons who are eligible to purchase these guns for self defense or sport based on our Second Amendment Rights given to all law bidding citizens.

I am also a believer that we should support all legal small businesses in Burbank regardless of my beliefs on whether or not its the firearm that loads itself and shots people or people that break the law and commit evil crimes. Please don't punish all the people of Burbank who are law abiding citizens wanting to have the choice of exercising their Second Amendment Rights. I don't believe that we would consider limiting the number of car dealerships because people are texting or drinking and driving and killing innocent people on the streets and freeways as people need to be held accountable and not the "tool" being used.

Thank you for your consideration.

Dear City Council -
I sent each one of you this individually earlier today so 1 wanted to follow up with this specific email address.

Thank you for your service to the city of Burbank. I urge you to reconsider putting a moratorium on Burbank gun stores.

The city of Burbank has some of the lowest crime rates of any city around, not to mention one of the best police departments and we law-abiding citizens have the right to choose whether we want to have a gun in our homes.

However, as good as our police department is, even they can not always get to a crime scene quickly enough so some of us feel that protecting ourselves by arming ourselves is necessary. We also feel that what you need to go after more specifically would be the LA County D.A., Gason, who is not truly enforcing the law and both we citizens and the police are frustrated by the lack of consequences and making our lives more dangerous, therefore feeling more and more secure having our own guns.

As a mother of a teenage daughter who works for a law enforcement supply store here in Burbank, I feel it is one of the safest places she could possibly be working. I have no fear of crime there.

We have personally benefited from several gun stores in Burbank, who conduct their business as the state makes them and we have to go through rigorous background checks, gun safety testing, and a long waiting period. We feel safer knowing we are armed in our home and take gun safety very seriously. It was shocking to discover that our city ranks 2nd in the nation for gun stores per capita. It feels more like a "when" than an "if' when hearing that number.

I have been working and living in Burbank for more than a decade. My kids go to BUSD schools. I strongly support the city pass the urgency ordinance that would prohibit the establishment of new retail businesses selling firearms or ammunition while the City Council studies and implements these possible regulatory frameworks.

All we ask now is to put a temporary hold on new establishment of gun retails. There are 14 gun shops already, and there are many more in LA county. For people whoever need a gun, they have sufficient access to gun stores.

After I realized there are multiple gun stores on Magnolia Blvd, we as a family don't go to that area any more. I am sure we are not the only residents disgusted by the high numbers of gun stores. Establishing more gun stores in the city will hurt other business.

I watched part of the city council meeting. I want to remind everyone again, that, if more guns mean safety, America would be the safest county in the world, but clearly we are not. Some of public comment basically says the tragedy happening in U.S. cannot be stopped, yes it can, U.S. is not the only country to allow citizens to legally have weapons, but no other countries have this level of madness. Sure mental health and other long term issues need to be addressed, but this doesn't mean that short term solution should not be done.

Thank you for your work and consideration of passing this urgency ordinance.

Dear Burbank City Council members and who every is willing too listen, Some of what you're trying to put in motion make sense and other ideas only make sense on the surface level. In your words "Limiting or reducing the number of firearm retailers in the City by suspending the issuance of new licenses and allowing the number of retailers to decline over time through attrition". (C, Sherwood myBurbank.com) Here's the problem, even if the number of gun stores in the area goes away over time you still face the issue of other gun stores within the surrounding area, especially big corporate chain stores such as Big 5. Pushing Big 5 out of the picture will be a bit more difficult than pushing out some small mom and pap. Besides, even if you manage to push out all 14 gun stores, all they're going to do is move to an area where getting a gun license to sell is more attainable.

Now the motion to "Amending the business license process governed by BMC Section 3-4-111 to establish additional requirements for firearms retailers, such as successfully passing an audit by a state or federal agency as a condition of license renewal. Council may further consider implementation of local inspections regarding inventory, storage, site security, and transaction procedures; and" ( C, Sherwood myBurbank.com) I actually see benefit in this, keeping gun stores in check and showing the community that firearm stores are not as evil and heartless as everyone thinks. Holding them accountable for improper documentation or false documents just to make a sale should and has to be punished with a fine or a shutting down of the store whether it is permanent or until all fines have been paid. Is fair though what would not be fair would be holding them accountable for what someone does with the firearm once legally purchased. Whether the purchaser or someone in relations with the purchaser injures themselves or someone else, the gun store should by no means be held liable by any account. You wouldn't sue Dodge for selling an 18 year old who just got into an 8 car accident killing 6 people right after buying a brand new Hellcat would you. No, you would hold the 18 year old fully responsible for the accident. Now in the case guns are stolen, if the guns are properly secured and up to code, specifically the codes you deemed fitting, in that case again gun stores shouldn't be at fault. Now obviously it goes both ways if the guns were stolen because of the lack of effort to put them away properly then the gun should pay whatever "Adopting a Zone Text Amendment to enact buffer zones and prevent the establishment of firearms retailers near sensitive-use locations."( C, Sherwood myBurbank.com) I'm okay with having gun store a 1,000 feet away from a school, do I see a point no but if it makes the public feel better then okay but here's the issue about near sensitive use locations. Within a 5 mile radius there are 14 gun store but also with in a 5 mile radius of those gun stores there are 294 convicted sex offenders according to Megans law website, non of these sex offenders can legally buy or poses a fire arm. If they did attempt to purchase they would be denied by the DOJ and because they are not even allowed to attempt the background check of a gun because of their record the moment they are rejected law enforcement should be at their door. 1 Now while I was looking over your research about school to gun store distance you mentioned a place called speed shooters. You claim it is 500 feet away from Luther middle school here's the problem Speed Shooters International which is the full name of the place is located in 1522 W Industrial Park St, Covina, CA 91722 which is between 30 to 35 miles away from Luther middle school. Not 500 feet like myburbank.com is showing on their map. Even if you type in the address on google 1734 Evergreen St burbank 91505 what will come up is a beautiful Burbank home not a gun store. Aegis trading enterprises according to google is temporarily closed, now I haven't been there myself so I would have to go there to be certain so we can take that one with the same grain of salt saying that it is in operation. The last thing is that on myburbank.com it says the gun retailers within a 5 mile radius and it states that firing line is a retailer, which is false. The definition of retailer is a person or business that sells goods to the public in relatively small quantities for use or consumption rather than for resale. Under this definition firing line is not a retail store. Now firing line does rent for firearms but the firearm can not be taken home, no expectations and there are other rules and safety precautions put in place for the renting of a firearm.

I appreciate the time you took to read my letter. I like to consider myself very middle ground in this topic, I can try to see reasoning from both sides of the coin and in the end I do not want what a few individuals think is needed rather I want what everyone thinks is right.

Hello Council Member Schultz,
In tonight's meeting you asked CDD Project Planner Mr. Thomas about not hearing his response to intoxicated or mentally-in-crisis individuals attempting to purchase a weapon in Burbank. Chief Albanese apparently volunteered that Mr. Thomas had already answered the question. Oldest trick in the book! In fact, Mr. Thomas had gone on to speak about federal law requiring that the purchased weapon be accompanied by a trigger lock or lock box. This doesn't say that the gun has to be locked when leaving the store but only that the purchaser needs to present his own or purchase a locking device of some kind.

That's beside the point! Mr. Thomas never addressed whether the gun store owner was responsible for assessing the state of mind of the purchaser. Chief LaChasse, who I think was the best police chief Burbank has ever had, did this all the time. He would answer a question other than the one asked, and the Council mayors would all say, "Thank you, Chief." The Chief knew he could get away with it, so really, who could blame him for trying. The fault lies with the Burbank voters who elected people who don't listen to what's being presented (probably because their minds are already made up and they ask questions only to appear to be gathering input).

Everything is right there in the video of the meeting.

I expect better of you.

Dear Burbank Council,
I oppose any and all new regulations limiting access to legal firearms including opposing limits on the number of gun stores operating in Burbank.

Please keep in mind that there may be some very loud voices that are for gun store restrictions but there is a voting silent majority watching how you vote.

Thank you,

I am born and raised in Burbank. There is no need for additional restrictions on guns, gun sales, ammo, parts, or anything. The state already has some of the strictest gun laws in place accross the country and it doesn't work. Criminals do not follow the law. There could be a million new laws put into place and the only thing that would change is the law abiding citizen like myself is made an even easier target for those that wish to steal or do harm to another. Adding more laws only helps these people. Let Burbank be free, let criminals know that people in Burbank have the right and the capability to protect themselves. Issue CCW permits to your citizens. Show the people that you care about them.

Thank you,
Kyle R.

Hello!
I'm emailing today to show support for regulating the number of gun stores in this town. I'm a tax- paying home owner with two kids in BUSD schools. I love this city, this school district, and our Burbank police department, and I do not believe hosting so many gun stores is good for any of the above. Please vote to stop approving new gun stores in the city of Burbank!

I'm writing to ask each of you to vote in favor of the temporary moratorium on any new gun hops in Burbank tonight. Whatever your position on gun control and adding limits to gur ales in Burbank, I think we can all agree that with 14 existing places to buy firearms here temporarily halting the opening of any new shops while we look for a way to legally and prudently address the concerns raised by Burbank residents will not curtail anyone's second amendment rights.

I am urging the city council to vote no on this moratorium for gun stores, sales etc in Burbank. Burbank does not have anything going on that would warrant any kind of a yes vote. The proximity of these stores to any neighborhood, business, religious center or school does not and has never been detrimental in Burbank.

Firearm/ammunition sales are one of the move heavily regulated business in the United States. Burbank does not need the city council to do anything in order to protect public health. The Federal regulations already in place do an excellent job. In no way has anything been demonstrated, or provided for review that shows Burbank's health and welfare are at risk by the presence of a gun store(s).

Nothing has been shown that the presence of gun stores in Burbank has created a threat to critical commercial corridors or preserve aesthetically inviting storefronts in pedestrian friendly spaces. In fact most gun stores have very limited exposure to pedestrians. They have very small signage and no widow displays. These stores absolutely do not present a current and or immediate threat to the public health and safety and welfare.

The Federal government has already passed the most significant piece of gun legislation in decades.

This is simply another attempt by a limited few who don't like, have their own fears, and zero knowledge of this subject.

If Burbank wants so to really demonstrate concern for our health and welfare here are some things you can do.

1. Right now unless you already have submit to the LA DA a letter of no confidence in his abilities to safeguard the citizens of Burbank or LA county. Insist the DA enforce our laws and show that law abiding citizens can and should be safe. Demand the end to cashless bail. Our DA is failing us! His policies directly resulted in the death of two El Monte police officers.

2. An ordinance that states guns be property stored and unaccessible to non-owners and children.

3. Do not pass ordinances that can get the city sued.

From the LA Times:
1 -Robberies involving stollen guns are up 57% from 2020 and 60% for 2019. -Car thefts are up 44% in 2020.
-Homicides up 11.8%
-Violent crime up 3.9%
-Per Mayor Garcetti 8,650 illegal firearms were taken off the street. But the DA does not prosecute perpetrators of the crime! They are released to commit more crime. -Aggravated assaults up 17.10%
These numbers continue across the board for crimes. They just go up! Wonder why Burbank has gun stores? Because there is demand for them! People are scared, concerned for their own safety, their children's safety. People feel their governments have abandoned them.

Hence the buying of guns. Gun stores are not the problem! By the way, in San Diego to drug runners were caught with enough fentanyl to kill 100,000 people. They were released with no bail and never showed up for their court date!!!! Please vote NO.

Burbank City Council..

Do not attempt to deprive us of our rights!
Just because Dummycrats can't figure out that it is not the gun that kills, but the individual that is holding the gun! Chicago, for example, has the the highest mortality rate by guns in the nation AND the toughest gun laws.

It isn't gun control we need, it is gun education.

While on the subject of education, is the freshmen suicide rate still at 5 or 6 per high school. Maybe your methods of counseling need improvement.

Guns were NEVER the problem. Parents, training and mental health have always been the problem.

Try to get your liberal minds around that.

Dear Council Members,
I just learned that at your meeting tonight, you will be discussing putting a moratorium on new gun sales. I want to express how deeply passionate I am about gun control and that I am in favor of any and all steps that will limit accessibility to guns and ammo here As a survivor of gun violence nearly 30 years ago, and an advocate for gun reform, my heart hurts more and more to see how little things have changed in all these years, and I value the steps that you are taking to ensure a safe community for us all here in Burbank. It seems that school shootings and violence in very public and crowded places has become more common, and that is something that we should NEVER have to get used to. Each time I kiss my children goodbye and send them off to school, or take them to a fun activity, I shouldn't have to worry about their safety in terms of gun violence. It's very disheartening that Burbank furnishes weapons from so many locations. We are a small community. One gun shop is more than enough in my opinion, let alone, 15 is it?! I see progress and I am grateful to your open minds and ears as we come together to solve this very serious problem.

Thank you for your time,
Dana Sebastian

Dear Burbank City Council members:

I am a lifelong Burbank resident and I support the moratorium on gun shops in the city. I urge you to do everything you can to limit further gun shops from operating in our city. In addition, I support any action that would reduce the number of current gun shops.

I was appalled when Gun World opened their superstore 2 blocks from my home. I have no statistics to share, but I feel that this reduces my property value. I know that if I were looking for a new home, and passed that building with the HUGE Gun World signage, I would think twice about buying a home in the neighborhood.

Burbank is better than this. Please take action.

Sincerely,
Geri Maddern

By the way.....some states have lessoned existing rights for the sake of giving more citizens the right to own guns.

Burbank will have a liability on their hands, if mass shootings find their way to our city.

THERE ARE LAW ABIDING CITIZENS WHO MEET THE STATE REQUIREMENTS FOR GUN OWNERSHIP. WE HAVE THE RIGHT TO DEFEND OURSELVES AGAINST INTRUDERS WHO WANT TO DO HARM TO US LAW ABIDING CITIZENS IN OUR HOMES.

Drop this draconian idea that you will fix a problem by passing ordinances that literally MAKE NO SENSE. Do you see what's happening in our country? There are mass shootings nearly everyday. RESTRICTING GUN RIGHTS FROM THE GOOD GUYS IS LAUGHABLE....

Give me a friggin' break from this nonsense...

Hello Mayor Talamantes, Vice Mayor Anthony, and Members of the City Council, I am a resident of Burbank and I just wanted to let you know that I strongly support the Firearm Retailer Urgency Ordinance that's going to be discussed at Council's upcoming meeting on Tuesday.

The Burbank municipal code needs to be revised to separate firearms retailers from general retailers, and while I know this ordinance wouldn't do that - it would at least prevent new gun stores from opening while that more permanent change to the code is explored and implemented.

Again, I urge you to enact the proposed emergency ordinance.

Dear Burbank City Council,
I oppose any and all new regulations limiting my access to legal firearms including opposing limits on the number of FFLs operating in Burbank and needless local laws that offend my Second Amendment rights.

Please do not pass any such ordinances.

This needs to be repeated as IT'S BEING IGNORED: criminals don't care for your laws. They WILL get their gunstammo regardless. The ONLY people you're harming are legal gun owners, putting them at risk for harm and curtailing their right to choose where to obtain their weapons. Instead, do actual work by setting up a task force or department to train and educate people about guns in lieu of propagating the fear of them for no reason. Stop this attack on gun owners.

The gun store moratorium is a gateway to curtain the 2nd Amendment further. DO NOT DO THIS. Also, stop using manipulative fallacies to reach people: a) Burbank does not have 14 gun stores, as several of them are only tactical gear stores (they don't sell firearms); b) Gun World is NOT a new store; it's been in business for close to 40 years; it just relocated; the fact that the sheeple clamored it was a "new" store shows the level of ignorance there is on gun education; c) please stop propagating dramatic fearmongering and appealing to emotion, that's manipulation.

Any laws curtailing our Second Amendment are null and void.

Thank you.

Marie Regine.
