MEMORANDUM OF UNDERSTANDING BETWEEN
THE CITY OF BURBANK
AND THE BURBANK UNIFIED SCHOOL DISTRICT
FOR THE COOPERATIVE USE OF
DISTRICT HIGH SCHOOL SWIMMING POOLS AND CITY SWIMMING POOLS
This Memorandum of Understanding ("MOU") is entered into and effective July 1, 2022 (“Effective Date”) by and between the City of Burbank, a municipal corporation and charter city ("City"), and the Burbank Unified School District, a body corporate and politic of the State of California ("District"). This MOU is intended to stand alone and not be affected by or have any effect upon any existing agreement between the parties. Collectively, the City and District shall be referred to in this MOU as the “Parties” or each individually as a “Party.”
RECITALS
A. The City and District are authorized under the authority of California Government Code Section 6500 et seq. to provide any services jointly for which each may be individually responsible. Under such authority, the parties to the MOU may designate any one of the parties as the agency to administer the program and exercise such powers as may be therein specified.
B. California Education Code sections 10900, et seq., empower the District and City to cooperate with each other and enter into agreements for the purposes of organizing, promoting, and conducting programs for community recreation, and acquiring, constructing, improving, maintaining, and operating recreational centers, including but not limited to such facilities as playgrounds, outdoor playing fields or courts, swimming pools and gymnasiums.
C. Education Code section 10910 provides that the governing body of any school district may use or grant the use of any of the buildings or grounds of the school district to any other public authority for the purpose of organizing, promoting and conducting community recreation whenever such use will not interfere with the use of such facilities for any other purpose of the public school system.
D. On November 7, 2008 the City and District entered into an agreement for the joint use of facilities, and it was later amended (the original agreement and subsequent amendments are collectively referred to herein as the "Agreement"). Agreement determined that any future agreement for the joint use of District-owned and -operated or City-owned and - operated swimming pools shall be addressed in a separate agreement.
E. The City owns and operates two swimming pools, located at McCambridge Recreation Center, 1515 N Glenoaks Blvd, Burbank, CA 91504 (“McCambridge Pool” or “MCP”) and 3201 W Verdugo Ave, Burbank, CA 91505 (“Verdugo Pool”). These two pools are collectively referred to herein as the “City Swimming Pools”.
F. District owns, manages, and operates a swimming pool located at Burbank High School (“BHS”), which BHS students use for athletic programs. The BHS pool was recently closed for emergency repairs and will likely remain closed through May 2023.
G. District owns, manages, and operates a swimming pool located at the John Burroughs High School (“JBHS”). Both the BHS pool and JBHS pool are collectively referred to herein as the “High School Swimming Pools”.
H. The Parties desire to enter into this MOU to allow the District to use either MCP or the Verdugo Pool when the District is unable to use the High School Swimming Pools, as well as allow the City to use the JBHS pool, and the BHS pool, upon its reopening, during times when the City is unable to use the City Swimming Pools.
I. It is the intent of the Parties that City allow District to use MCP until the BHS pool reopens, subject to City use and other regulations as set forth below. Further, it is the intent of the Parties that either Party allows the other to use each other’s pools subject to usage priorities as set forth below, when either Party’s pools are out-of-service. After such time, the Parties will explore whether continued joint use of the pools could be beneficial to the community.
J. It is in the public interest that the recreational and educational facilities of public agencies be put to the fullest possible use.
K. This MOU is exempt from the California Environmental Quality Act (“CEQA”) pursuant to Sections 15301 and 15323 of Title 14, Chapter 3, of the California Code of Regulations (“CEQA Guidelines”).
L.
The purpose of this MOU is to memorialize the Parties’ rights to jointly coordinate and use the Parties respective swimming pools and enhance recreational opportunities for the students and all community members.
Now, therefore, the parties hereby agree as follows:
