RESOLUTION NO. ________

A RESOLUTION OF THE COUNCIL OF THE CITY OF

BURBANK AUTHORIZING AND ESTABLISHING A
PREFERENTIAL PARKING DISTRICT ON 100-200 BLOCKS

OF SOUTH REESE PLACE AND SOUTH ORCHARD

DRIVE, SPEED HUMPS O N SOUTH REESE PLACE, AND

TEMPORARY STREET CLOSURE ON SOUTH ORCHARD

DRIVE AS PART OF THE RANCHO PROVIDENCIA

NEIGHBORHOOD PROTECTION PLAN

THE COUNCIL OF THE CITY OF BURBANK FINDS AS FOLLOWS:

A. On February 19, 2013, the City Council adopted the Burbank2035 General Plan. The General Plan Mobility Element included a neighborhood protection goal to “minimize[e] cut-through traffic in residential and commercial neighborhoods to maintain neighborhood quality of life.” Further, the General Plan’s policy in considering installation of neighborhood protection measures is to “pursue comprehensive neighborhood protection programs to avoid diverting unwanted traffic to adjacent streets.”

B. The City has experienced increased cut -through traffic in the residential neighborhood south of Olive Avenue and north of Oak Street on South Orchard Drive and South Reese Place (“Neighborhood”). The traffic and parking impacts to these residential neighborhoods include: (1) increased utilization of residential curb parking by non- residents; (2) increased traffic volumes on Orchard Drive and Reese Place; (3) drive- through vehicle queuing on Olive Avenue and Orchard Drive impacting access to nearby residential and commercial properties; and (4) higher than usual speeds.

C. The City Council may, by resolution, establish regulations that may address these impacts, including designating streets for preferential or permit-based parking after adequate signs have been erected (California Vehicle Code ( CVC) § 22507), using barriers that prohibit entry or exit from certain streets (CVC §§ 21101(g), 21351; Burbank Municipal Code (BMC) § 6-1-401 and following), and using roadway design features such as speed humps.

D. The City Council has considered the record before it, finds that such barriers implement the circulation element of the general plan in accordance with CVC section 21101(g), and desires to establish such preferential parking, speed hump, and traffic barriers to address the existing impacts at the Neighborhood.

E. Under the California Environmental Quality Act (CEQA) and the CEQA Guidelines, the operation, maintenance, or alteration of existing streets that do not result in any expansion of use, and the addition of safety or health protection devices in conjunction with existing facilities such as streets, are exempt from CEQA . (14 CCR §

15301(c), (f).) The City Council exercises its independent judgment and finds , based upon the record before it, that the preferential parking, barrier and roadway design features adopted by this resolution, that limit who may travel and park on the streets, do not expand the capacity or use of the streets, nor do they appreciably increase the amount of overall vehicle travel. Additionally, the imposition of the measures reduces local vehicle traffic and operations within the Neighborhood, and reduces vehicle speeds, both of which add safety features to the existing streets. As such, the activity is exempt from CEQA and no further environmental review is necessary.

THE COUNCIL OF THE CITY OF BURBANK RESOLVES AS FOLLOWS:

1. Establishment of Permit Parking Zones . Permit-only parking zones at the 100 and 200 blocks of South Orchard Drive and Reese Place, as depicted in the attached Exhibit A (“Permit Parking Zones”), are established, and parking restrictions will be limited to those vehicles with City -issued parking permits between the hours of 8:00 AM and 10:00 PM, Monday through Sunday.

The Public Works Director, or their designee, is authorized to approve any changes to the Plans.
