SUBJECT: Approval of Amendment 1 to the Reimbursement Agreement with Krismar Construction Co. Inc. to Construct Pedestrian Safety Improvements at the Buena Vista St. / Riverside Dr. Intersection as Part of a Transportation Mitigation Measure for the Burba nk Studios Master Plan (Warner Bros.
Second Century Project)
RECOMMENDATION
Approve Amendment 1 to the Reimbursement Agreement with Krismar Construction Co.
Inc. (Attachment 1) to reimburse the Developer of the Burbank Studios Master Plan for additional costs to construct pedestrian safety improvements at the Buena Vista Street / Riverside Drive Intersection as part of a transportation mitigation measure required by the project’s Final Environmental Impact Report.
BACKGROUND AND DISCUSSION
On August 10, 2021, the City Council approved a Reimbursement Agreement with Krismar Construction Co. Inc. to reimburse the Developer of the Warner Bros. Second Century Project for costs to construct additional pedestrian safety improvement s at the intersection of Buena Vista Street and Riverside Drive (Attachment 2) . Krismar was required to construct intersection improvements at this location to satisfy conditions of approval for the construction of the Second Century Project at the Burbank Studios Campus. At the same time, the City requested that the Developer construct additional pedestrian safety improvements at the intersection that were not a part of the original conditions of approval. The City Council approved the agreement, and Kr ismar Construction has constructed the improvements to satisfy both the conditions of approval of the site as well as the additional pedestrian improvements requested by the City.
During construction, the cost of the pedestrian improvements was slightly higher than the cost originally estimated as part of the reimbursement agreement. This higher cost was

2 due to extensive traffic signal infrastructure adjustments, complex traffic control in coordination with the 134 freeway on and off ramps, and some additional unforeseen conditions identified in the field during construction that required the redesign of the pedestrian ramp at the northeast corner of the intersection. This additional cost, combined with other costs to secure performance bonds for the project, was partially offset by cost savings for the striping portion of the project. The total cost increase to construct the pedestrian improvements was $17,001. Staff agrees that the cost increase was necessary to construct the improvements properly and recommends that the City Council approve this increase.
The original Reimbursement Agreement identified a cost for the improvements that did not include a construction contingency. As a result, the City Council must approve an amendment to the Reimbursement Agreement in order for the City to reimburse for these additional costs. Thus, staff recommends that the City Council approve the proposed Amendment 1 to the Reimbursement Agreement to increase the total cost of the improvements by $17,001 for a total cost of $159,837. The original cost of the improvements included in the original Reimbursement Agreement, plus the cost of the proposed increased costs, would be paid by Transportation Development Impact Fees.
FISCAL IMPACT
There is no fiscal impact to the City’s General Fund for approving this proposed Amendment. Sufficient funds are available in project account 127.CD33A.70002.0000.24329 (Public Improvements – Transportation, Street Improvements, Buena Vista/Riverside Pedestrian Safety Improvements).
CONCLUSION
As part of the Second Century project, the project Developer constructed intersection safety improvements to the Buena Vista / Riverside intersection along with additional improvements required by the project’s conditions of approval. City Council approved a Reimbursement Agreement for these additional improvements to be constructed in concert with the condition of approval. The cost for these improvements exceeded the cost estimate, and staff recomme nds Amendment 1 to the Reimbursement Agreement be approved to cover these increased costs.
