A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BURBANK AUTHORIZING THE ACCEPTANCE OF A
GRANT FROM THE UNITED STATES ECONOMIC
DEVELOPMENT ADMINISTRATION FOR THE 202 2
TECHNICAL ASSISTANCE PROGRAM: BURBANK MASS
MARKET BROADBAND FEASIBILITY STUDY, AND
AUTHORIZING THE BURBANK GENERAL MANAGER, AS
DESIGNEE OF THE CITY MANAGER, TO ACCEPT A
GRANT AGREEMENT
THE COUNCIL OF THE CITY OF BURBANK FINDS:
1. The United States Economic Development Administration (EDA), released a Notice of Funding Opportunity (NOFO: EDA-2021ARPAEAA) FY 2021 American Rescue Plan Act Economic Adjustment Assistance;
2. The City of Burbank Department of Water and Power (BWP) has the authority to construct, operate, and maintain a fiber optic network and is responsible for providing reliable, affordable, and sustainable fiber optic services; and
3. To analyze the feasibility of providing broadband services citywide, BWP applied for and was awarded a grant by the EDA in the amount of $85,000 to perform a feasibility study.
THE COUNCIL OF THE CITY OF BURBANK RESOLVES:
1. The General Manager of BWP, as designee of the City Manager, and any of her designees, are authorized to provide the assurances, certifications, and commitment required for accepting the grant, including any amendments or changes to the grant documentation, in each case, subject to the review and approval of each such document by the City Attorney’s Office.
2. The City is capable of providing the matching funding and/or in-kind contributions specified in the grant application funding plan.
3. The City will use reasonable efforts to work with the EDA to meet established deadlines for entering into a grant agreement, and 22-29,353

The General Manager of BWP, as designee of the City Manager, and any of her designees, are authorized to represent the City in carrying out the City’s responsibilities under the grant agreement, including certifying disbursement requests on behalf of the City and compliance with applicable state and federal laws.
