TR23009
1. PROBLEM STATEMENT
The City of Burbank is 17 square miles with a population of approximately 110,000. This number includes a high percentage of elderly residents. Located within the City of Burbank is the Burbank Hollywood Airport, Walt Disney Studios, Warner Brothers Studios, Saint Joseph's Medical Center, the Empire Shopping Center, and the largest Ikea in the United States of America. Additionally, the major mixed-use (commercial and residential) Talaria development project was completed in 2018, which consists of a Whole Foods Grocery Store on the ground level with a multi-unit condominium complex built above the store. Based on the success of the Talaria project, several additional mixed-use projects have begun construction in the City of Burbank. These businesses, along with numerous other small businesses, attract a large amount of consumers and tourists that increase the City's daytime population to well over 200,000 people. The aforementioned projects and attractions, in addition to the City's large daytime population, have increased the amount and flow of traffic through the City of Burbank. Increased traffic leads to an increase in traffic- related issues and traffic crashes.
Quantitatively, the City of Burbank continues to have persistent issues with speeding violations, automobile versus pedestrian crashes, hit-and-run crashes, and alcohol-related crashes. Speeding was one of the top three primary crash factors affecting the City of Burbank during 2021 with a total of 132 crashes reported and 131 persons injured as a result of those crashes. In August of 2021, the City experienced a tragic speed-related street racing crash that resulted in the death of three individuals. The City of Burbank had an increase in alcohol-related crashes by 63.7% from 2020 to 2021, and an increase in automobile versus pedestrian crashes by 54.2% from 2020 to 2021. There were seven fatal traffic crashes in 2021, two of which involved citizens over 65-years of age. According to the California Department of Finance, Burbank's population grew by approximately 4.8% (2012-2016) with a marked increase in Burbank's 65 and older residents (2012-2016). This is the portion of the population that we seek to educate and inform on overall traffic and pedestrian safety, which will include educational presentations at adult recreational centers.
The Burbank Police Department receives a large number of speed-related citizen complaints yearly and has seen a significant increase in the number of reported and observed reckless driving violations.
The addition of new LIDAR devices and handheld citation data collection devices have assisted with handling speed complaints, and have solidified testimony and prosecution for reckless driving cases. The handheld citation data collection devices have also provided the tools, through included software, necessary to conduct the appropriate analysis of enforcement activity to identify common violations and problematic areas within the City.
The Burbank Police Department (BPD) currently utilizes the traffic data collection software system Crossroads to compile and analyze traffic-related information and to document traffic crashes. However, BPD currently does not have the ability to automatically transfer crash data directly to the Statewide Integrated Traffic Records System (SWITRS). SWITRS is a database that collects and processes data gathered from crashes scenes, and the California Highway Patrol (CHP) has a vision of 100 percent electronic crash report submission by making their webservice interface to SWITRS available to all law enforcement agencies in California. The goal is to provide timely delivery of crash data to all California law enforcement agencies to assist with reducing traffic crashes and help revent injuries and fatalities. BPD hopes to enhance the current capabilities of the Crossroads electronic delivery method to provide BPD crash data to SWITRS.
2. PERFORMANCE MEASURES

1. By signing and submitting this proposal, the prospective primary tier participant is providing the certification set out below and agrees to comply with the requirements of 2 CFR parts 180 and 1200.
2. The inability of a person to provide the certification required below will not necessarily result in denial of participation in this covered transaction. The prospective primary tier participant shall submit an explanation of why it cannot provide the certification set out below. The certification or explanation will be considered in connection with the department or agency's determination whether to enter into this transaction. However, failure of the prospective primary tier participant to furnish a certification or an explanation shall disqualify such person from participation in this transaction.
3. The certification in this clause is a material representation of fact upon which reliance was placed when the department or agency determined to enter into this transaction. If it is later determined that the prospective primary tier participant knowingly rendered an erroneous certification, in addition to other remedies available to the Federal Government, the department or agency may terminate this transaction for cause or default or may pursue suspension or debarment.
4. The prospective primary tier participant shall provide immediate written notice to the department or agency to which this proposal is submitted if at any time the prospective primary tier participant learns its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

10. Except for transactions authorized under paragraph 6 of these instructions, if a participant in a covered transaction knowingly enters into a lower tier covered transaction with a person who is proposed for debarment under 48 CFR part 9, subpart 9.4, suspended, debarred, ineligible, or voluntarily excluded from participation in this transaction, in addition to other remedies available to the Federal government, the department or agency may terminate the transaction for cause or default.

BUY AMERICA ACT
(applies to all subrecipients as well as States)
The State and each subrecipient will comply with the Buy America requirement (23 U.S.C. 313) when purchasing items using Federal funds. Buy America requires a State, or subrecipient, to purchase with Federal funds only steel, iron and manufactured products produced in the United States, unless the Secretary of Transportation determines that such domestically produced items would be inconsistent with the public interest, that such materials are not reasonably available and of a satisfactory quality, or that inclusion of domestic materials will increase the cost of the overall project contract by more than 25 percent. In order to use Federal funds to purchase foreign produced items, the State must submit a waiver request that provides an adequate basis and justification for approval by the Secretary of Transportation.
PROHIBITION ON USING GRANT FUNDS TO CHECK FOR HELMET USAGE (applies to all subrecipients as well as States)
The State and each subrecipient will not use 23 U.S.C. Chapter 4 grant funds for programs to check helmet usage or to create checkpoints that specifically target motorcyclists.
POLICY ON SEAT BELT USE
In accordance with Executive Order 13043, Increasing Seat Belt Use in the United States, dated April 16, 1997, the Grantee is encouraged to adopt and enforce on-the-job seat belt use policies and programs for its employees when operating company-owned, rented, or personally-owned vehicles. The National Highway Traffic Safety Administration (NHTSA) is responsible for providing leadership and guidance in support of this Presidential initiative. For information and resources on traffic safety programs and policies for employers, please contact the Network of Employers for Traffic Safety (NETS), a public-private partnership dedicated to improving the traffic safety practices of employers and employees. You can download information on seat belt programs, costs of motor vehicle crashes to employers, and other traffic safety initiatives at www.trafficsafety.org. The NHTSA website (www.nhtsa.gov) also provides information on statistics, campaigns, and program evaluations and references.
POLICY ON BANNING TEXT MESSAGING WHILE DRIVING
In accordance with Executive Order 13513, Federal Leadership On Reducing Text Messaging While Driving, and DOT Order 3902.10, Text Messaging While Driving, States are encouraged to adopt and enforce workplace safety policies to decrease crashes caused by distracted driving, including policies to ban text messaging while driving company-owned or rented vehicles, Government-owned, leased or rented vehicles, or privately-owned vehicles when on official Government business or when performing any work on or behalf of the Government. States are also encouraged to conduct workplace safety initiatives in a manner commensurate with the size of the business, such as establishment of new rules and programs or re- evaluation of existing programs to prohibit text messaging while driving, and education, awareness, and other outreach to employees about the safety risks associated with texting while driving.
