1. Public Notice had insufficient information regarding website links to the project plan and staff report, and how to submit

2. staff report which identifies “Friends of the Rancho for Equestrian Safety”. To our knowledge this group does not exist.

3.Project site does not qualify under SB-35. Not “infill” land, and is not designated in the General Plan for housing. I prefer mitigation over litigation. This is why CEQA is important because it identifies the areas of significant impacts and opportunity to mitigate these risks in the plan.

We need housing in Southern California. State law mandates that we approve this. There is no reason to spend more time and money avoiding it.

YIMBY Law already sent a letter by email to the City Council. This is a shortened comment.

The City's prior denial of this Project resulted in two lawsuits against it, one brought by YIMBY . YIMBY brought its lawsuit to remedy the City’s violations of the HAA and SB 35. We are pleased that the City has agreed to reconsider this Project.

We would like to remind the City as we have previously that it is required to approve this project ministerially. We further advise the Council to reconsider Ordinance 22-3,964 and its designation of the Council as the approval body for SB 35 applications.
