Subject: Amendment 3 to the Contract for the Housing and Safety Element Updates EIR Dear Shipra,
This is a request for a cost modification to our existing agreement under Karen Warner Associates, Inc. (KWA) for the Housing and Safety Element Updates EIR (Project).
This request includes additional time and materials for recirculation of the Draft EIR due to public comments received regarding biological resources and wastewater conveyance. The recirculation required the following: preparation of the Introduction, updates to the Project Description based on the final version of the Housing Element, and preparation and revisions to the mitigation measures for the Biological Resources and Utilities/Service Systems sections of the Draft EIR. The time spent on this task included coordination calls with City staff, coordination with KWA for updates to the Project Description, revisions to the analysis and mitigation measures based on review of the agency and public comments, and time and materials for circulation of the Recirculated Draft EIR.
This task also includes the following: time to prepare responses to comments on the Recirculated Draft EIR, updates to the Final EIR for inclusion of the Recirculated Draft EIR, and additional project management time for meetings with City staff.
Upon receipt of all public comments on the Recirculated Draft EIR, Rincon prepared formal responses and submitted an Administrative Final EIR for City review. The responses included the list of commenters, bracketed comment letters, and responses to the comments. A total of 45 letters were received, with three substantive letters (Department of Conservation, Emily Gabel-Luddy, Susan O’Carroll) that required thoughtful and thorough responses, as well as edits to the Errata section of Final EIR. Assembly of the Response to Comments section for all 45 comment letters also required coordination with Rincon’s publishing staff to format the document with the comment letters.
Approximately 80 hours of staff time was needed to prepare and submit the responses on an expedited schedule, which exceeded our original estimate provided in the July 28th version of this request. Upon receipt of City staff’s comments, we worked with staff to revise the response to comments and finalize all sections of the Administrative Final EIR.

Housing and Safety Element Updates EIR
In addition, the original scope did not include Rincon assisting the City with getting the Safety Element through the CAL FIRE review process. CAL FIRE’s review of the Safety Element is a new legislative mandate that came into effect during this most recent Housing Element update cycle, so Rincon’s role was in this task was undetermined at the start of this Project. Per the City’s request, Rincon completed the following tasks associated with finalizing the Safety Element:
▪ Submitted the Safety Element to CAL FIRE for a 1st informal review ▪ Coordinated with the City Planning staff and the Burbank Fire Department to develop customized policies in response to the CAL FIRE review
▪ Coordinated with the City Planning staff to develop additional mapping in response to the CAL FIRE review
▪ Updated the policies and mapping in the Safety Element per City direction ▪ Submitted the Safety Element to CAL FIRE for a 2nd informal review ▪ Updated the policies in the Safety Element per CAL FIRE’s and the City’s direction ▪ Submitted the Safety Element to CAL FIRE for a 3rd informal review ▪ Updated the policies in the Safety Element per CAL FIRE’s and the City’s direction ▪ Submitted the Safety Element to CAL FIRE for a 4th informal review ▪ Updated the policies in the Safety Element per CAL FIRE’s and the City’s direction ▪ Submitted the Safety Element to CAL FIRE for a 5th informal review ▪ Updated the initial Burbank Safety Element Policy Memorandum to be included in the final staff report to City Council. The update included final changes to the Safety Element and the results of CAL FIRE’s 4th informal assessment.
▪ Submitted the final Safety Element for the Board of Forestry’s Final Review ▪ Attended the Board of Forestry’s Resource Protection Committee to answer any questions regarding the Safety Element
▪ Made final edits to the Safety Element per the Board of Forestry’s recommendations ▪ Provided the final Safety Element to CAL FIRE and the City Cost
The total budget amendment request is $30,550. A summary is shown in the table on the following page, which would bring Rincon’s overall budget to $247,933.
The total of 368,593 includes Fehr & Peers’ budget for the transportation analysis.
We appreciate your consideration of this request. If you have questions or need additional information, please do not hesitate to contact us.
Sincerely,
Rincon Consultants, Inc.
