SUBJECT: Approval of a Fourth Amendment to a Professional Services Agreement with Elizabeth Moule & Stefanos Polyzoides, Architects and Urbanists, for the Downtown Burbank Transit Oriented Development Specific Plan
RECOMMENDATION
Approve the Fourth Amendment to Professional Services Agreement (PSA) with Elizabeth Moule & Stefanos Polyzoides, Architects and Urbanists (Attachment 1) for the Downtown Burbank Transit Oriented Development (TOD) Specific Plan.
BACKGROUND
The City entered into a PSA with Elizabeth Moule & Stefanos Polyzoides, Architects and Urbanists (Moule & Polyzoides or Consultants) on May 5, 2020, to prepare the Downtown Burbank TOD Specific Plan (P roject) and conduct the associated environmental review (Attachment 4). The original cost of service was $1,125,000.
A First and Second Amendment were made to this PSA on September 8, 2020 and April 6, 2021 respectively, to amend the Consultant’s business name and extend the term. A Third Amendment to the PSA was made on November 16, 2021 to increase the Project budget by $22,000, to $1,147,000. A Fourth Amendment is now being requested to extend the term of the PSA to December 31, 2023 and increase the Project budget to account for additional work necessary for completion of the specific plan document and the associated environmental analysis. This Fourth Amendment would increase the Project budget by $226,500 for a total of $1,373,500.

2 DISCUSSION
Staff is requesting that the City Council approve a Fourth Amendment to the PSA with Moule & Polyzoides to extend the term of the PSA to December 31, 2023 and to increase the project budget by $226,500. Based on the work completed to date, it was determined that an increase to the Project budget would be necessary for Moule & Polyzoides to account for additional work that is necessary for completion of the specific plan and associated environmental analysis. The additional funds would be used to complete th e following tasks:
• Additional CEQA work related to Preparation of a third Notice of Preparation (NOP) and conducting of a third scoping meeting to inform the public on the changes being made to the scope of the environmental analysis for the Project; inclusion of additional analysis associated with the Civic Center Project. • Development of a CEQA Checklist that will provide guidance for future development projects on which CEQA streamlining tool will be most effective in order to reduce constraints for future housing projects, under the plan, by streamlining the CEQA process.
• The provisions for three additional in-person community workshops that will allow the Consultant team to moderate the workshops, prepare workshop advertising materials and creation and interpretation of workshop materials (handouts, boards).
The cost increase will also include workshop supplies and refreshments for attendees.
• Additional funds to forecast utility capacity (sewer, and power) necessary for the envisioned build-out.
• Additional funds to undertake additional traffic analysis and modeling.
FISCAL IMPACT
There is no fiscal impact to the General Fund for Downtown Burbank TOD Specific Plan.
Funds are available in the current Fiscal Year 2022-2023 Budget for $226,500 in account number 001.CD31A.62085.0000.23217 (General Fund, Community Development – Planning Division, Other Professional Services, Downtown Burbank TOD Specific Plan).
CONCLUSION
Staff recommends City Council approve the Fourth Amendment to the PSA with Moule & Polyzoides for the Downtown Burbank TOD Specific Plan. Approval of the amendment will ensure long-range planning projects are on track for completion at the end of 2023.
Approving the Fourth Amendment is also consistent with the Burbank2035 General Plan Land Use and Housing Element Goals as well as the Realization Plan Program LU-3 that provides for the update for the City’s existing specific plans as well as a creation of the Golden State Specific Plan.
